Hey there guys we just got word that our petition was approved last Friday!
We are very excited about it.
But Angelo (USC) found out today that he owes some back taxes.
Now he is setting up a payment plan to take care of this and he is setting it up tomorrow.
He is well above the criteria needed for his income.
I am just wondering if this will have an affect on us?

Yep my thoughts exactly...they have not told me why they were denied, just that they were. I've asked and haven't gotten a straight answer...always "you know how corrupt things are" or "probably because I didn't bribe anyone...you know money talks". I just can't get with that. :blink:

As for our evidence, here's what I have:

**emails between us (including an email he sent to my son officially asking him for my hand in marriage.)
**a couple of written letters
**pictures from my trip to Gambia to visit with him
**copy of my boarding pass & passport
**phone bills (land line and pingo.com)
**IM copies
**a picture of the engagement ring he made for me
**the receipt for the engagement ring my aunt purchased as a gift for him to give to me (she wanted to make him look good as well as help because she knew he could not afford stones in the one he made for me. Yes this means I have two engagement rings. LOL)
**A "upon visa approval" contract for the facility where we are planning to have our ceremony and reception
**A few pages of the well wishes we received on our engagement from my family and friends
**A letter from the Reverend who will be officiating the ceremony (includes a statement that we are currently undergoing pre marital counseling which will continue with a couple sessions face to face when he arrives)

Is this enough? Since I haven't mailed it yet, if I've forgotten something it's not too late to put it in.


It sounds like you have really get evidence to show an ongoing relationship between the two of you and that you have met within the past two years, which is very important.
From the looks of it as long as you have both filled out the forms correctly it sounds good to me.

I'm trying to figure out question 20 of the I-129F, "Your fiancé(e) will apply for a visa abroad at the American embassy or consulate at:"

Originally I put Toronto based on consulate districts but I saw something that said only Montreal and Vancouver process K1s. I can't seem to find anything official. Can someone let me know which is correct or point me to some information?

Its been 2 months since We have filed for my K1 and not heard anything from the consulate yet.
My question is....can i apply for a tourist visa in the mean while and visit my Fiance ? Will that complicate the K1 process ?


Umm two months since you filed your petition? I am sorry I just don't know what part of the process you are on. Please fill in your timeline that helps a bunch :)
You won't hear anything from the consulate you aren't at this part of the process yet if you have just filed the petition. You are dealing with the USCIS.
If your cheque was cashed that you had sent in with the petition then you should have a case number. You then would be able to go onto the USCIS website and put in your case # and find out where your case is at.

Of course only a US Citizen can get a US passport, which is why i thought it was weird that the Cambodia website redirects Passport applications to the US passport application, doesn't make sense so i thought I'd ask the question. They sent mine to my fiance too because they email it and my fiance put HIS email address on the paperwork. Happened to several people I know. He simply forwarded the email to me to complete as I was the one who was supposed to be doing it (though I speak English so I know with people who don't, their USC tended to do it for them)

Yeah for some reason the embassy in Cambodia will send packet 3 to the sponsor instead of the beneficiary... Crazy, i know. But i'm doing about 90% of the work for her and then I'll send it to her for signatures etc, then she will mail it to the embassy. BTW I have no idea how we've got this far in the process without her having a passport lol... I'll tell her to get to work on the passport. Thanks guys, I appreciate the input!

Ok so let me see if I got this straight. You are the US citizen and you have the packet 3 instructions? Your fiance is filling out the forms for packet 3 right? That is how it should be done and the fiance sends packet three info to their consulate to get the interview date. I am not sure what it is they need to send for the Cambodian consulate before they are scheduled an interview but in my case I ( the beneficiary) have to send a copy of the DS-230 PART 1 form in and my checklist marking off all the things I have that are required for my interview.
One of these things is a valid passport.
Your fiance needs a passport for the interview so they can put the visa in the passport. She may also need photocopies of the biographical data page of her valid passport. I know I need one for my medical.
So tell your fiance to go and get a passport. I don't know how long of a wait it is to get one in Cambodia but your fiance should get on it!

Does anyone know how far the embassy goes back in determining financial support. I now make $42,000 per year and I started this job Feb, 1st. Last year though I only made $9000. She has her interview in a month. What do you guys think?


Get your pay stubs from work as many as you can to show your increase in pay. A letter from HR from your work stating how much you make per year, how long you have worked there, your position. A letter from your bank stating how much you have in your account. Your last years tax returns will show your 9000 income so you have to prove that you make more than that now with the previous proof stated above. If you can't do that then a co sponsor is necessary. :)

In the instructions, it says to make a front and back copy of my birth certificate... there's not really anything on the back of my birth certificate.. just VR-111 rrrrrrrrrrrrrrrreally tiny in the very bottom lefthand corner.. should there be something more significant on the back of my birth certificate? Should I write some kind of note that it is the back of my birth certificate? From first glance, it looks like I just included a blanke page... Posted Image


The instructions do say that don't they. I remember I was confused about that as well as I have nothing on the back of my original birth certificate. I did not include a photocopied page of the back of my birth certificate and I had zero problems. If there isn't anything on the back don't bother it will just confuse the USCIS and you don't want to do that lol :thumbs:

Proof of meeting within the past two years can include copies of your passport pages with the entry stamps in them for either you or your fiancee. Also boarding passes and itineraries are a great evidence as well. Photos with the dates they were taken on them are also good as well. The more evidence you can give the better. It doesn't hurt to front load your petition.

My Fiancée received her Packet 3 late April and we sent back DS-230 & OF-169 May 14th still waiting for interview date. In Packet 3 are instruction to pay a visa fee of $131.00 USA. I just noticed on the Guangzhou Embassy site the K visa fees are being increased to $350.00USA after June 4th http://guangzhou.use...rg.cn/fees.html

Based on these instructions will we need to pay the difference of the fee we already paid given our petition was filed before June 4, 2010?

It has nothing to do with the petition and the fee you paid for that. This is a totally separate fee. You will need to pay the $350 USD to the embassy which ever way they instruct you to in packet 3

Well sadly my Interview Letter is sealed in with my medical results apparently! i never received my letter back and when i called the medical place they told me it was in the envelope :bonk: why i have no idea!!!
ill bring enough money to cover whatever but still .. would be nice of montreal to either call or send something to people! ah well!


Oh that is odd but then again from what I have Montreal and Vancouver do things very differently. I am sure they wouldn't have done that if it wasn't the norm. Maybe go on the Canadian forum and ask the Montreal folks!
I know I man like you said most people have found out from this site although on every consulate web page it does have the fee increase posted on it somewhere. Well my fiancé sent in the package yesterday morning 06/21/2010 i am soo exited and can't wait to get both NOA 1 and 2
but i have a questio and i have read over the guides tips etc.. and my fiance told me that i would have to go to the police station here in my town and get a report stating where i have lived for the past 5 years etc.. to basically prove that i have a clean record... but i cannot seem to find that demand anywher ein any forms...
could someone maybe clue me in... do i ( beneficiary) need to fill out anything after that 1st package is sent ?

Ok what you will need to get after you receive the NOA2 is called a CPIC. It is a criminal records check done for you the beneficiary. The CPIC check is a Canada wide screening. Its not just for the past 5 years. Also you will need a criminal records check if you have lived in any other country for I believe over six months. So if you haven't lived in another country besides Canada all of your life then you don't have to worry about that.
After you have sent the I-129F it is quite a wait. So you can start gathering a few things to be prepared for the NOA2 but you will probably have quite a bit of a wait so don't stress to much. You do not have to fill out any other forms until you reach the consulate stage!

My fiance's interview is on 6/30/10 in Vancouver and he was sorting all the papers and realized he lost the interview letter. arrrrrrrgh! Does he NEED that paper? What can we do to get a new one?? :wacko:

Also, I am hoping to come up to Vancouver and stay with him in a hotel for the interview and take him down with me to Washington (fingers crossed we get approved). I was wondering since most people get their visas in 48 hours of approval, I should just book the hotel for 2 nights or the whole weekend because the Thursday after his interview is Canada Day, does that mean he won't get his visa til Monday?

They ask for your appointment letter. You could contact the consulate by email telling them that your fiance has misplaced the interview letter and see what they say to do. Maybe they will mail you a new one.

Most of the visas are ready to go after 48 hours there yes this is true. But since Canada is the holiday no one will be working that day so you may have to book a day or two more. Ask the CO after the interview when he can come pick up his visa but to be safe stay a few more days since it is possible he won't get it until Monday.

so as u say its not a problem then when they have my old passport number on the i-129f form but then once i receive the package 3 i put my new passport number on the forms i have to fill out for that?
of course i will ask next week (when i go pick up my new passport) if they can return me my old one as well cause of visa issues....i know u can keep ur old id card as well once u get a new one...all they do is punch holes in it or so n maybe its the same with the passport...

Yea the weird thing was that I dont even think I was concerned about it LOL. I just did it. All the want to know that your passport is valid. The USCIS can look up this info on your passport if they wish but you won't be dealing with them after this you will be dealing with the embassy in Germany. So just write down all the correct info on your new passport and give it to them at the embassy!
Yea when I had my old passport returned to me they punched holes in it to show it was void I am sure it is the same thing in Germany :)

I was in the middle of the k1 process ( actually exactly where you are at right now) when I applied for a new passport.
My passport had expired and I just applied for a new one. I had no problems at all. Like you said your passport needs to be valid. I asked for my old one to be returned to me since you have to surrender it when you apply for a new one. I do not know if you can do that where you are at but if you can then for sure do that :). It won't be a big deal if you cannot. All they care about is that your passport is valid for 6 months. You will be fine renewing it :thumbs:

Hi I don't have much advice to offer I just wanted to tell you I am sorry for your situation. But you have the lawyer on the case and hopefully they can help you in the allotted time the CSC has given you to respond back to the impending denial.
I can see why they might have done this. Regardless of how long your relationships were with the previous family members it would seem obviously suspicious to them. It is a unique situation and perhaps someone on VJ with a similar experience will find this post and be able to assist you better. But until then read over the letter they sent you carefully and inform your lawyer and see what their advice is and keep pushing.
