Wow MeggyMo, Angelo's rep. is far more supportive than mine! Besides your Congressman (1) we also each have two Senators too that we can contact. Given my dwindling reserve of patience (hey, I never had much to start with!), I may give one of them a call in a week or so too. That especially if Joy comes back with something more revealing than the, 'it isn't done because it isn't done' that I got.

SCUBA isn't so scary. If you can breathe without mechanical assistance you can do it. That was Diana's first time and she did great. Two dives and down to 35' (uh, 11 meters). If you ever think about lessons I would recommend an intensive dive Club Med. They have great instructors. Never been hassled by a shark but I have petted Moray Eels. That's a kick!

JEEZE that is wayyyy too far down for me. See as soon as I see ocean I instantly think of JAWS. My all time favorite movie but it has terrified me since the first time I seen it when I was 7.

Yes, definitely curious to see what Angelo's Congressman finds out. Believe me, I'll be in touch with the USCIS again long before the 90 days are up. Even if I learn something new from others, I'll call the USCIS promptly on the 5 months date!

He just spoke to Joy ( the lady who handles dealing with the USCIS) and she is getting a hold of the CSC for us today. She said we would hear something back in the next couple of days and that it would be a generic response. But she said she wasn't going to stop after she received the response so I am happy she is up for a challenge!
Oh of course yes. When the five month date hits I will be sure to also call.
Hopefully we both don't have to wait that long!!

Interestingly, my Congressman got a reply back from the USCIS (actually it's really the Dept. of Homeland Security, isn't it?) in less than 1 business day. The news, as quoted below was disappointing in a way that only members of this site would understand:

The processing of the above case has been delayed. A check of our
records establishes that the above case is not yet ready for a decision,
as the required investigation into your constituent's background remains
open. Until the background investigation is completed, we cannot move
forward on your case. These background checks are required to be
completed on all applicants who apply for the immigration benefit your
constituent are seeking. We will make every effort to make a decision
on this case as soon as the background checks are complete. If your
constituent does not receive a decision or other notice of action from
us within 90 days of this email, please feel free to contact us again.
Thank you and have a nice day.


I love the last line! As you can imagine a 90 day delay for no stated reason other than they haven't finished is very unsatisfying. I did ask the congressional aide for more information but at this point she has washed her hands until the 90 days are up. I am holding out hope that, on rereading 7 times, they are only saying they haven't finished yet and not that there is a problem. Since we are all technically still within the 5 months for the I-129f approval that the USCIS website quotes maybe the liaison contact was just politely saying, 'don't bug us at least until the 5 months are up.' Dunno.

Anybody else ever seen this kind of response before? And if so, how did it ultimately resolve? Any suggestions as to a different VJ forum where the text of the USCIS response might have been dealt with?

As to contacting all your resepective congressional offices, I think, why not! If you do get a reply I would be interested to know if it is identical to mine which would indicate a canned response. And maybe if a number of Congressman/Senators start asking the USCIS why the December filers have slowed and, BTW, aren't the cases supposed to be handled in the order received, then maybe we will all see some progress!

That response sounds like it has been emailed to many different people. It has no information and just leaves it still up in the air. Which like you said does nothing to help.
On the up side your theory on still being within the 5month time frame and just receiving the standard response does sound very reasonable.
I was sort of under the impression that once you got your congressman involved you would get a more detailed answer but apparently I was mistaken
Well at least they gave you a date when you can contact them again..granted it is 90 days. Lets hope you hear the good news way before then!

I also contacted my District 4 California congressman and faxed him written permission to have his federal program caseworker inquire into my visa petition. The USCIS caseworker manual instructs processing to be done in the order that they are recieved, obviously something is out of order.
The congressmans office said they can get some kind of reply back in 6 working days!?

Fire all your guns at once...


And with that being said I am going to ask Angelo to get a hold of his congressman.
I am unsure about how much our lawyer can do for us at this point.

:)As promised, I contacted my US Congressman's office here in the 2nd District of Oregon and asked what they could do re. my I-129f filing and at least find out what the status is (and possibly, why have the December filings apparently stalled). The woman I spoke with was friendly and said that she would send an inquiry to the USCIS with my case (receipt) number on it but not to get my hopes up as the USCIS often takes 30 DAYS(!) to respond even to a congressional enquiry. I’ll let you know how it goes but hopefully we’ll all have received our NOA 2 before then!

A couple things she did mention that I would be interesting to pass along:

1. She thought cases were handled in the order they were received. Uh, clearly not! I also mentioned that (at least in the sample set of VisaJourney) more January filers have received their NOA 2 than December filers.

2. She cautioned me and my fiancée to be over-prepared for the interview in the embassy. That’s probably old news for you pros but she said the calls the Congressman most often gets for visa help are after a failed interview. She said that once you fail it is harder to get approved. Expect detailed questions of the sort, What are the names of your fiancé’s children? What is his work? His birthday? And the like.

(My favorite story somewhere here in VJ is of the man who accompanied his fiancée to the interview wearing a sweater she had knitted for him. The interviewer asked the fiancée if she had in fact knitted the sweater and she said yes. She was approved on the spot with no further questions! I told that story to my fiancée and she said years ago she made a scarf but it didn’t turn out too well. I guess we’ll have to use photos and documents for our proof of relationship! :)

Yea I was under the impression it was first come first serve for petitions but yes as we have found out definitely not.

Greetings Frustrated Fellow December Filers! I too, have become very annoyed by the apparent stall in new December NOA 2s. If anything, my number on Igor's list went from 109 down to 110! MeggyMo, I look forward to reading what your attorney has to say. For my part, I spent an hour on the phone with the USCIS people at the 800-375-5283 number yesterday. What a wonderful, polite, and caring bunch of people they are... and total useless when it comes to giving information about your application! So, today I called my US Congressman's office here in Oregon and apparently they actually have a person who helps with this sort of thing. We're playing phone tag right now but if I learn anything useful I'll let you all know.

I called the number 1 800 375-5283 and it's a lot of recordings that don't say anything that I don't already know. It seems until the 5 month processing time window has passed there is no oppotunity to do anything but wait. Well that's 2 more months.
As it is every day is like a week waiting for something to happen! :wacko:

I hear there is a number written on your NOA1 that you can call and inquire about your case.
I personally don't have mine since we retained a lawyer and she has all of our stuff.
I was thinking about asking her to give me the number but it is the petitioner that has to phone. Even so if I were to get Angelo to call I don't know if they would give much information.
But this waiting is driving me nuts especially when I see January and even February filers receiving their NOA2

Hi!
From what I've gathered you do not get an email or text for case updates or "touches". As I have had a few touches without notification. Its only when something major happens like they request an RFE or its approved that you get an email.
So when you login to USCIS the first page that comes up for me is "My Portfolio". If not there should be a column on the left side in which you can select "My Portfolio". This should then list your case with case number, petition and last updated date.

When you login to the USCIS case status website (have you created an account with them?) you see the "Last Updated" date. This is your last "touched" date, that your file was viewed/seen on. However multiple people on VJ have said that they have been approved with few to no touches, so its debatable how predictive it is...

We only had to wait a little over 3 months for our NOA2. So it wasn't bad. I think everyone got theirs pretty swiftly in my time frame. It can go slower because of the holidays and such but really I don't think there was much of a difference. Just have to be patient and know you will get news on your case eventually!

It happens pretty regularly, actually. US regards everyone who presents themselves at the border as an intending immigrant, especially if they have apparent 'ties' to the US, such as a spouse or a fiancee. What you need to do is reassure them that you are not an intending immigrant at this time but only a visitor. You do that by providing evidence of strong ties to Canada - a letter from your employer verifying your employment and stating when you are expected back at work, a lease or mortgage (make a lease with your mother if you are still living there), ongoing most recent bills related to living expense (ie utilities, hydro, insurance, ISP, etc.), a return ticket if you are flying or taking land transportation, a specified period of time you expect to be in the US (not "about 3 months", but "returning on March 15", etc.) and if you have started the K-1 visa process, bring along a copy of the whole file containing the I-129f petition and attachments, the NOA1 and when you get them further NOAs, information from the Consulate, etc.

When you get the fiancee visa, having been turned back at the border because you were suspected of being an immigrant becomes irrelevant - you now are an immigrant and have the appropriate visa and documentation to allow you to enter. Just make sure you never lie to immigration or border officials in writing or spoken word - that can come back to haunt you big time.

To answer your question, I've never been denied but I do know of several people that have been denied and went back the next day with no issue. It was most likely a recommendation. I wouldn't be worried about it at all.

So far I am really pleased that I joined onto this website all of my questions have been answered in great detail. I first just want to thank you guys for that.

Alright so my newest and most likely last concern is this...
My fiance is the US citizen and I am from Canada. I am the beneficiary now I don't have the best credit report. I had one very large phone bill not paid through a cell company. I fell on some difficult times and was not able to pay it. Creditors have not been involved yet or anything. I now finally have a steady job and will pay off the debt.
Will this have any affect on me getting a visa? I tried searching this question online but nothing has ever come up.
So yes not the best credit rating will it affect me as the beneficiary?

I didn't realize that you had already submitted your I-129F. I'm assuming that you didn't leave employment gaps for the previous 5 years. If that's the case you should be fine. I've heard of Embassies that have called current employers but I've never heard of a case where the Consulate contacted previous employers.

I think you'll be fine as it is your USC's income and stability that is scrutinized with the I-134 affadavit of support.

I would not prepare another G325A for the interview. Differences in answers on teh biological data sheet can be misconstrued as material misrepresentations during the interview stage. Relax, you're ok. Just stop job hopping... lol

As the beneficiary, this will not cause as much of a problem as it would if you were the petitioner. At the I-129F stage, it is the petitioner who mostly comes under scrutiny. As the beneficiary, your data will be inspected at the NVC and the interview stage.

Obviously, you won't be able to fit all of your past 5 year employment on the G-325A, so in your case, prepare a "G-325A Supplement Sheet". Attach this to your G-325A and list (to the best of your ability, your jobs for the past 5 years". Even though you have had many differing jobs, try not to leave employment gaps of any major type.

You should be fine.

Ohh yet another issue has come to mind in this long journey.
I have just finally settled down living in one spot and working two jobs.
Now before September of last year I had been moving around a lot and had many different jobs.
A lot of those jobs I didn't work more than a week there since I was unable to stay at one place for a definate length of time.
I just remembered a couple of those jobs that I barely worked at and I did not put them down as places worked in the past five years. My petition is now being reviewed and has been since late December.
I am just wondering if this will cause I a problem!

As the days go on we are finding that this was not worth the money. Visa journey is a fantastic website.
Everyone is super helpful and the guides are fantastic. Way more helpful than lawyer in my opinion.
Especially since you say there aren't any special circumstances in your case.

No need to make corrections regarding employment change at this step of the game. I WOULD prepare a new G-325A form to bring with you to the interview and be sure that your letter of employment shows your additional hours and increase in wage (especially if you are close on the income -vs- 125% of poverty level.

Hey all,
Quick question, I am waiting for my petition to be approved and up until two days ago I was working two jobs. I got an offer from my second job willing to give me more hours so I dropped the first one. So on my 129f forms I have both of these jobs listed as current occupations. Now I went on the USCIS website and saw info to contact them for an address change while this process was going on but nothing about a job change.
Is there some way to inform them about leaving one of my jobs or is there no need to.

An approved petition is not an approved visa. The financial support evaluation and any issues with the back taxes will happen at the consulate. It will happen again when you apply for adjustment of status.

I didn't say it was an approved visa.
I know it was our petition that was approved.
It isn't much in back taxes anyways just over a 1000.
