If it makes you feel any better, mine was received 4:40 am in the morning of the 27th, and I haven't received anything either.

 

I've been following the timeline of another person here, and in talking with her,  her first email notification was not until about 4 days later.  But it's random at best.  We shouldn't get the first email until they set up the NOA1 and the petition has been started (they apparently won't email just to say Hey we got it!)

I would recommend doing what I am doing (besides being paranoid, don't worry I'm being that way too :))

Call your bank every day and when they cash the check, you know you're in the clear.  The others have told me first it goes to the lockbox, then it gets sent to the service center.   At the service center, then they cash your check, and ONLY then do they send you your first email once the petition has been accepted to begin.



 

Frustrating, sure, you're not alone, but hopefully that will help you!

I think I figured out what this is. (correct me if I'm wrong)

 

Last week I called USCIS because there was a typo on their form.  They typed her last name without the hyphen and I very politely mind you, informed them that all of the forms I sent in had the hyphen, and that I would like their topographical error changed pleased since I'd need it later for NAO2.  They said they'd fix it immediately and put in a ticket for it and told me I should hear back in no later than 15 days.

 

Maybe this was their text confirming they checked the file again?  ah well, at least it's progress :)

Since she'll send her old passport off later to get that fixed, she'd be getting a new passport.

 

The new passport wouldn't have all her entry and exit stamps.

 

We scanned the front page of her passport to show the old ID.  Color scanned all the entry and exit stamps and saved them too.

 

Having those as printouts for evidence should be enough right?

In our case, she wants the hyphen, as she's very proud of that name (since her sister's don't have the hyphen), so since that's what she wants on the green card (we've agreed to not take part of my name after marriage), then she's going to work to ammend her passport last name.

 

We're also going to file the I-129 by next week as well.  Gathering all the evidence.  

 

But again, thank you both so much.  I look forward to all the upcoming help, and sticking around once my entire process is done to help others too.

She could get a new passport in the name on her birth certificate, then no confusion for the immigration forms or having to try to explain to a CO why the names do not match on her documents.
 

 

She wants the hyphen on her green card when that day comes

 

Do I have to now wait on the I-129F until she fixes her passport or since they don't require a scan of the UK passport I can still file and she fix it on her own time before the interview?

Sounds like a mistake on the birth certificate. Can they get it amended, or is there some actual reason she has a different hyphenated last name than everyone else? I wonder how you can get a passport in a name that does not match your birth certificate. I thought that was the document used to get a passport.

 

I would use the one on the passport that she has used all her life, and list the hyphenated one under 'other names used'.

 

Well her mom says its Mary-Lee
Her dad says its just Lee

 

So they don't even agree.  I doubt they'd change the birth certificate.

 

So is the consensus to just use the passport as the actual name?

 

Unless she wants to change her passport to the actual last name

I would think that.  But I would also think the birth certificate would trump the passport.  Wouldn't it?


If it makes any more sense, apparently they didn't want her younger sisters to know she had a different last name then them.  So all this time they told her she had two middle names when in reality on the birth certificate she didn't.

 

And the hyphen isn't even part of the mom's maiden name.  I checked.  Lee is the dad's last name though.

Quick question

 

Please note, for the example below, this is not my fiancee's actual name, but you'll get the point.

 

Working on the I-129F, and I have a question.  My fiance is 24 years old.  For the first 24 years of her life, she always thought her last name was just Lee.  When she got her first passport that her dad did for her, the last name on the passport was Lee.  When he renewed it, her last name was Lee.

 

Her parents are divorced, and when she was working on gathering her birth certificate from her mom, her mom told her that her actual last name was Mary-Lee.  Confused, she explained she's the only of the three daughters with the last name of Mary-Lee, as her younger sisters just have Lee.  Sure enough, the BC has Mary-Lee with a hyphen.

 

All this time, she thought her name was Stephanie Anne Mary Lee with two middle names.  Both Anne and Mary are listed as middle names on the passport.  But on the birth certificate, it says Stephanie Anne Mary-Lee with Mary-Lee being the full last name.

 

So here's the questions I have.

 

On the I-129F, I believe I should put everything to match the birth certificate.  I feel that is the official document to match, not the passport, so I'll put as her last name Mary-Lee with the hyphen.  I will put that in Part 2 question 2a.  2b. and 2c.

First name:  Stephanie
Middle name:  Anne
Last name:  Mary-Lee

 

Should I put the name in her passport under part 2 question 10a. 10b. and 10c (other names) or leave it blank?
Blank?  or
First name:  Stephanie
Middle name:  Anne Mary
Last name:   Lee



 

Since she will have to bring the passport, and the birth certificate to the interview when that day comes, does she need to try to fix her passport asap to be prepared (since we do have time since I havn't even sent the I-129F yet), or can she just explain the passport has an error if they ask?

Anyway - fair enough.  I think you're being over-cautious.  You've had a 7 year relationship, no doubt tons of good evidence, she's interviewing in the UK (one of the easiest embassies - have a read of the interview reviews to get a feel for how straight-forward it is)... you're probably textbook.  wink.png

 

If you want help - do a new post with what you're putting in your I-129f package before you mail it out, and folks on here should help point out anything that may be missing.

 

 

 

Oh I plan on doing both.  I guess I just have that inner fear because in my head, as I was for sure thinking the B-2 visa would have been a for sure thing.  But after reading online later, they've been more strict on that if you mention a boyfriend/girlfriend/fiancee because they fear you're coming over to stay illegally and tend to automatically decline.

 

And of course had I known the VWP would no longer be an option if a B-2 was denied...I'd have not done that either.  

 

At least I'm not as paranoid as my girlfriend...she's afraid the same lady who denied her B-2 is going to be there when she does her K-1 interview :)

That's true.  It's an option.

 

I figure right now...I have 11 days of vacation.  If the K-1 gets denied, it will take probably a year anyway to set up an England wedding since we'd have waited on the K-1, so I'd have accrued another 21 days so I'd have 31.  If I only need 28 I should be ok.

 

I still think I will hold off and wait until I at least get the NAO2 before I plan a travel.

About waiting to visit... It's going to be a long wait for the K1 to come through (maybe 6 - 12 months), so don't discount your need to visit.  As *another* "back-up" plan, remember, she can still come to the US and marry you while visiting on the VWP.  Or you could get married in another country.  That's totally allowed. She can also come visit you in the mean time while the petition is pending - that's also no problem.

 

Wish this was true, but sadly it is not in our case.

 

We tried to have her come over for a B-2 visa to spend 6 months together.  They denied it due to "not enough strong ties to her home country.

 

By doing that...she no longer can ever visit on the VWP.

At this time, my girlfriend and I are planning on filing the I-129F by the end of next week.

 

We plan on her coming to America and marrying here with the K-1 visa.  But because my dad raised me as an engineer, I always try to come up with a back up plan.

 

If the K-1 is denied, the next plan would be for me to fly to the United Kingdom and marry her there, and then bring her back later on with a K-3 visa.  The only issue with this plan on my side is after receiving my petition to marry is I'd have to first visit England, be in the country for 7 full days, apply for the certificate/petition to marry, wait about 15 days, and then marry.  All of this was confirmed by them.  Much research I've done ha ha.

 

So all and all I'm looking about 26 days total.  So let's say four weeks vacation.  I only get three weeks vacation a year, and my job has agreed that if needed, they'd work with me to be gone the 4 weeks in a row, as long as I started saving my vacation now that way I didn't come across as begging for more.  Sure no problem.  I love my job, it's a great job in engineering, so obviously I don't want to do anything there to be negative either.

 

But I also want to be able to use my vacation time to see my girlfriend in England as well once I know for sure the hard part of the K-1 process is complete.  So here's where my question comes in at.

 

If my goal is to not visit my girlfriend until we believe we've moved on to the smooth sailing part, would the correct plan be as follows

 

Use no vacation until the K-1 visa petition is approved (receiving NA02 and no RFE).  At that point...everything else is smooth sailing right and nothing should deny it if we follow all instructions?  So if we receive NA02, I should not worry any more about hoarding vacation to try and marry her in England and use my vacation to visit her while we wait for the interview?

I'm sorry if it's a paranoid question, but a second opinion would mean a lot.

I am glad you are ready to get this process moving. My fiancee is in Brazil and I know how hard it is to have them so far away. I have just one question regarding all your paperwork. You said you had letters from your parents? Did you have letters from her parents as well? Both my parents have passed away but hers are still with us. Would letters from her parents suffice? Also, are the letters neccessary or is this just added information for the verification of the ongoing relationship?

Letters are not required.  I just added them as extra information.  I scanned through several pages of the RFE forum, and many times, when they request an RFE, they request notarized letters from individuals confirming the relationship (other than the petitioner and beneficiary).  Being the Boy Scout that I am, consider it me just being over-prepared, and sending them anyway in the beginning.

After many hours of scrutinizing forms, gathering evidence, and trying to be as perfect and concise as possible, I believe I am FINALLY ready to send off my I-129F petition to marry my fiancee from the United Kingdom.

 

But before I send it early this week, I thought I might confer with the experts (that would be you all) to see if what I have is enough, or if I should work to find some more.  

 

This is everything I have so far, I followed the K1 guide and many many forum posts as best as possible.

 

(P.S. I copy and pasted a bit from M&Mz and then edited to match my stuff, so this is just to thank them and credit them)

QUESTION:  Can I send in a front and back photocopy of my certified copy (I only have 1 personal copy) or should I send in my certified copy and just go get another certified copy for myself.

     A. Passport pages showing stamps of arrival and departure, scan of airline ticket , and airline fare payment emails/receipt for petitioner (2 flights from past 2 years)

Thanks everyone for the info. Yes, I agree there is something not right here and I am checking. I worked in Ukraine for a year and lived with her for 3.5 months. Age difference = 9 years. I have almost daily skype evidence from day 1 in Ukraine, photos in Odessa, Kiev, Nikolaev. I have airfare returning on her birthday, etc, etc...She has never been denied a visa, no criminal history. She speaks little to no English, but I do speak Russian. She is asleep right now, but I will definitely be doing some fact checking. According to her, she was just given her passport back without papers.

 

 

Again, no expert here, but I did research a lot on reasons why it could be denied (Boy Scout Motto, always be prepared).  What stands out to me could be the little to no English.

Summary

 

My fiancee has two last names.  Example.  Sarah Anne Emily-Smith.  The last name has a hyphen.  For her entire life, she believed though, that she had two middle names.  So she went by Sarah Smith.  Passport had Sarah Smith.  Etc.

Upon working on visa paperwork, she went to look at her birth certificate,  It was there she realized her last name was Emily-Smith with the Hyphen and only one middle name.  After researching the history of why her last name is Emily-Smith, but her younger sisters are just Smith, she decided to keep it out of respect for her mom.  (parents are divorced)

Following so far?  Ok good.  Caring on! 

 

Earlier when I was working on the I-129F, I asked the board which name should we use.  The name on the passport without the hyphen and two middle names, or the name on the BC.  They all recommended the passport name.  However, since the fiancee wanted the hyphen name on the records, she decided to renew her passport to get that changed.

So again, we're keeping the Hyphen last name.  All paperwork we filled out (the G form and the I-129F form) list the hyphen name as her actual last name, but just to be on the safe side (because again, she thought her name was Sarah Smith for 25 years) we put "other names used" as Sarah smith.

 

So we filled out all the paperwork, sent it off, and thought I was done.  Until...the light bulb went on.

 

All the stuff she signed (again, she's been signing her name for 25 years now) she signed all the documents as Sarah Smith.  And not Sarah Emily-Smith

 

Would that raise a red flag?  I figure worse case scenario I get an RFE, but I'm thinking since we put it as other names used, my parents talk about her as other name used in letters confirming the relationship, and flight documents before she realized her last name had a hyphen have Sarah Smith, we should be ok.

 

Thoughts?  Am I over worrying like a paranoia person?

 

Should she have signed the name as her actual name was, or signing as Other names used would be fine?

I had a similar issue with my fiancee in that her last name was hyphened in real life and on the birth certificate, but on the passport they only had the last half of her last name (family name) and put the hyphen part as a second middle name.

 

When we filled out all the K-1 forms, we listed the true last name.  We scanned all the pages of her passport, and the pages of her incorrect last name, in case needed as evidence, and then sent off to have her passport renewed.

 

The advice I gathered from fellow VJers is that the name on the passport will overrule the name on the birth certificate, so I was recommended to get the passport of her's fixed, so we did

Ah well, no regrets, we're working on the K1 anyway and already sent off the I-129F

 

But it might not hurt to apply for an Esta after 6 months to see if she'd be approved.  She could always tell the POE officer it's to help plan the wedding, and if I have a copy on hand by then, maybe she could even show them an NOA2 so they know she'd go back home.  Might help POE clearance...

The B2 denial was because they didn't feel she have strong enough ties to her home country.

 

I guess my fear is that because they ask you if you've ever had a visa denied, they are going to ask you that, and it would be an automatic refusal at POE, regardless if ESTA is accepted or not.

I looked at that site as well.  VWP is still no longer eligible if a B2 is denied.  See Q and A and link.  Also I figured the lawyer wouldn't lie to me either.

 

I'm not trying to prove you wrong, I just don't want to give anyone false hope (as for a second there, I almost had some hoping I had been wrong and she could visit...)

How would my eligibility for a travel authorization via ESTA be affected if I was previously denied a visa, previously denied an immigration benefit, or previously committed an immigration-related violation?

 

If you were previously denied a visa, or previously refused entry to the United States, or previously removed from the U.S., your ESTA application will most likely be denied, and if you are allowed to board your carrier, you may be subject to additional processing upon arrival at U.S. ports of entry, and may be denied admission to the U.S. Applicants who are uncertain of whether they qualify for travel under the Visa Waiver Program (VWP) are encouraged to apply for ESTA authorization early, to allow time to apply for a visa, if needed.

Many people make the mistake of thinking that if they were denied a visa when they were a citizen of one country, then become a citizen of another country, they can travel to the U.S. under the visa waiver program using their new passport. That is wrong. The eligibility question about having been denied a visa does not ask whether or not the denial was made after you became a citizen of another country. It asks, "Have you ever been denied a visa?" - period. If you answer "No" then we determine that you have been denied a visa in the past, we consider that to be fraud, and you will be barred from entry for a number of years. It is better to admit the truth, and then apply for a visa, than go through the experience of being deported for fraud.

In some cases, you may not be sure how to answer this question because you were "allowed to withdraw" your application for entry, or a U.S. Consulate declined to issue you a visa because you did not have enough paperwork for them to make a decision on whether or not to grant you a visa. If this is your situation, we advise you to contact a U.S. Consulate and discuss what happened and ask them to tell you whether or not the withdrawal or declining to issue a visa constitutes an actual denial of entry or visa.

Everything online says once you've been denied a visa, you are no longer eligible to use the VWP.  Even had it confirmed with an immigration lawyer...

 

 

I was previously denied a visa to the US. Can I apply for a Travel Authorization and enter on the Visa Waiver Program? faq_a.gif No. If you have ever been denied a visa you cannot travel under the Visa Waiver Program.

UK not usually a problem, most odd for London to see people who have only met once.

 

Presumably not eligible for the VWP?

 

If you are referring to me, yes, no longer she's eligible for the VWP due to now having the B2 denied.

 

In my case, I had to let the cat out of the bag on filling out the I-129F (since she has to send me the G form and the fiancee letter of intent), but I do at least plan on surprising her with the ring after I receive the NOA2 (I'm guessing Feb 2014)

I am confused, could you write down an accurate timeline, as presumably the above is incorrect.

 

If this is what was said to the Consulate probably did not help matters.

 

 

Which you actually just brought up a good point I was curious about.  When they ask you that question, are you supposed to answer when you first met, or when you last met?

When I filled out the I-129F, I listed an attachment that explained when we first met online, in person, but then followed it with a history of all the trips we've made and when we've seen each other recently.  So all of that was provided.

 

But when they interview you, are you supposed to answer when did you first meet, or when did you last see each other?

 

Granted, in my case, whenever that day comes next year I actually plan on attending the interview, but is a valid question.

 

Also, to make sure I'm not hijacking this thread, I offer my condolences on your visa denial.  My fiancee was denied a B2 before, and the heartache was quite painful.  I had planned on proposing during the 6 month visit with the B2...and the government sadly took opportunity that away from me...so we filed for K1 instead 3 months later and I kind of had to let "the cat out of the bag" in regards to my proposal plans...

In my case, my girlfriend from the UK was always visiting me for up to 3 months on the visa waiver program.  In the 7 years together we never stayed over 85 days to give us padding in case airline issues.

I thought we could try a 6 month B-2 tourist visa, with my plan during that time to propose, and applied for it in July.

 

Much to my disappointment, it was denied due to lack of roots in her home country to prove she'd go back.  Trying to stay positive, we at least had the visa waiver program to look forward too...until I realized that once a visa has been denied, you are never eligible for the VWP again.

 

So now she can't visit me in America until we either try again for a B-2 or the K-1.  

 

Question though.  If we are in the process of applying for the K-1 visa, would that be enough proof she'd go home to the Us customs officer in order to get approval for the B-2 visa?

 

Would it be worth the gamble of another 180 dollars for the B-2 visa attempt, or do you all personally believe it would be a waste of effort and money and to just deal with the 9 months of her not being able to visit america and me only able to travel to see her till the K-1 is complete.

 

Thoughts?

Fiancee had her medical on April 16th.  Case updated on April 24th.  Received letter today that interview is May 12th.

 

If anyone else is interviewing May 12th, feel free to let me know.  I'm sure my nervous fiancee wouldn't mind a friendly chat while waiting
