Hopefully you've found others going through Nepal with the hints above.

I wouldn't worry too much about only having met once, but be sure your fiance has plenty of evidence of your relationship to take to his interview in Kathmandu, when the time comes. Photos, emails, hand-written letters, phone bills, etc... are all good evidence of an ongoing relationship. And in Kathmandu, the interview usually comes pretty quickly... he should be ready for it to take place soon after he turns in his Packet 3 (which the Consulate will send to him after they receive your approved petition from USCIS). You do not have to be at his interview, but I believe you are allowed to be if you can make it work.

Have you been to Nepal? I have found it extremely valuable in our marriage (and in raising my Nepali stepson) to have visited Nepal and be a little familiar with the language, culture, typical daily life that my husband and son were coming from. You may want to consider a visit for that reason alone, and if the interview works into it, so much the better.

If someone found the passport, I would imagine they would turn it in to the local police. Is there anything in/on the passport that would lead the finder or the police to you so they could return it (ie, your US address and/or phone #)? If not, you may want to consider contacting your local police and reporting it missing so they will know how to reach you if it is turned in to them.

Ditto for your country's US embassy, which is another place I would imagine someone might turn it in.

It is NOT possible to petition for a fiance one has never met in person - it will be rejected and the fee will not be returned.

(This will occur in virtually every case - the only exception would be if you had not met for religious reasons - and forget about developing 'sudden religious reasons' because they know which circumstances this applies to.)

Go to www.uscis.gov, click on the "Laws and Regulations" link at the top. Then click on the "administrative decisions" link on the left.

I'll save you some time... I've read several years worth of these case decisions and found ONE instance of a person who had some kind of life-threatening, chronic, extremely well-documented (from what I gathered) illness that prevented him from flying. I think his fiancee had documentation of having been denied a tourist visa, too. Other than that, dozens of cases where the USCIS denial was upheld.

Still haven't heard why the USC doesn't want to leave the US to meet her future husband...

I can imagine a petition getting approved without photos together, especially if the non-USC is from a VWP country, but I would be very surprised to see a visa issued without photos together. And I would be super-surprised to see a visa issued by a high-fraud Consulate without photos.

We submitted 3 photos withour petition. When my husband hand-delivered packet 3 back to the Consulate in Kathmandu, he was specifically told "When you come back for your interview, bring more photos!".

I like this thread, too, for focusing some attention on good outcomes. We went through K1/AOS several years ago, but hopefully it is still possible to have a speedy journey like we did.

I filed our K1 petition in June of 2006 and by October 2006, they (my now husband and stepson) were here! We found both DOS experiences (at the US Consulate in Kathmandu) and USCIS experiences here to be professional, helpful, and appropriate overall.

I remember ages ago reading case decisions of people who had appealed USCIS K1 petition denials. Quite a few of them were based on the grounds the OP inquired about (a religious and/or cultural prohibition on meeting), and I don't remember any of the couples being sucessful on appeal on those grounds. The only one I remember as successful was an instance where the USC was unable to travel due to some awful medical condition. These would've been cases from about 2000-20004.

If you are interested in reviewing some of these appeals, you can find them on the USCIS website on the link below. In case the link doesn't work, they are easy to find: just below the heading, click on "Laws", then on the left hand menu, click on Administrative Decisions, then scroll down to category D6 - Fiance visa petitions, then pick a year.

FWIW, I think Pushbrk is right on this one, And tell them to FOLLOW DIRECTIONS and BE HONEST!

I would at least check with the closest US Consulate (or look on their website) about DCF. If you are living there in Brazil, that may be an option for you. You could also ask on the country-specific forum here on Visajourney for feedback from other VJ members who have gone that route in Brazil.

We tried DCF a million years ago in Kathmandu, Nepal and were told at the Consulate that we couldn't because I (the USC) hadn't lived there long enough, but it didn't hurt to ask. I had the impression at the time that different Consulates had different rules under which one could file for DCF. And I don't remember anything at any time about a USCIS field office being an issue. DCF is done through a Consulate (hence the name, Direct Consular Filing), and all the Consulates AFAIK are all run by a completely different agency, the Dept. of State. You wouldn't deal with USCIS until your spouse was here in the US. I'm sure if I'm wrong, someone will be along soon to correct me!

I have heard a few stories over the years about people who were coming in on K-1 visas and either wore a wedding band or referred to their partner as "my husband/wife" when being questioned by CBP and got themselves into hot water at the POE. Don't do either of those things (or, as someone has already said, act like a terrorist or try to smuggle drugs in... lol) and you should be fine!

I am suprised there are not more people advising the OP to contact his USC fiancee and urge her to contact her Senator/US Rep immediately (they all have immigration liaisons) and ask them to contact the DOS and request to keep the package at the Lagos consulate for further review.

Is that no longer the best first approach, given that the denial is only 3 days old as of today?

So the only proof you have of meeting is that you, while in the PI, bought a plane ticket for your fiancee during the same time period you were there?

How did you pay for your own initial plane ticket over there?

I agree he should mention it somewhere - the cover letter is just as good a place as any - along with a very brief explanation of what happened so it is clear that the submission was rejected for improper fee rather than the petition being rejected (like Penguin said).  Much better to get that out in the open rather than having it pop up on someone's computer at USCIS and he has not disclosed anything about it. 

 

 

Hopefully you already realize that the topic of this thread is inaccurate.  The topic indicates that there was a visa denial in the past, which is a big deal.  A petition package getting sent back for the wrong fee is not a big deal.  He submits his petition first, then the visa application will be yours (although you may work on both together).

There are Consulates with very tough reputations - Lagos, HMC, Casablanca - to name a few, and certain countries have very specific patterns of fraud that the individual Consulate will be on the look-out for, but I think any country whose per capita income is significantly lower than the US (or was... unsure.gif ) could be considered as having a higher potential for fraud than countries with a per capita income comparable to the US's (roughly similar or even higher).

Got a call this morning from an IO regarding the confusion about the oath ceremony... they have scheduled my alien husband :lol: for his oath ceremony on Jan 20. I changed the list below but am adding this comment because several things impressed me about how this was handled:

1. They admitted that someone at USCIS had made a mistake (by telling us to come back for the oath later the same day of the interview)
2. They apologized at the time, in a message on our voicemail a day or two later, and again today.
3. They called to tell us when/where the new date was, even though they will be sending the info in the mail.
4. The IO who left the voicemail message also left a phone number!! :o
5. The IO who left the voicemail message (also the same one who called back today) volunteered that he has been through this whole ordeal with his wife, and was therefore empathetic. He was.

All in all this snafu with the oath ceremony has been really refreshing! :P

My husband had his interview yesterday and he passed! :dance: :dance: :dance: m


The IO in Fairfax was very nice and went through his application verifying basic info, then asked him all those questions about breaking the law and being a communist and blah blah blah. I had been up in the air about what to put on the app about serving in the military if asked. My husband said he would, and that's what we put on his app, but when she asked the question, I chimed in, "he's willing to serve, but I'm not willing to let him!". She got a chuckle out of that. She then asked him to read a sentence in English "Where is the White House?" and write the answer "The White House is in Washington, DC". Then she gave him his little civics quiz:

What is an amendment?
What is the capital of your state?
To what are we showing allegiance when we say the Pledge of Allegiance?
Which countries did the US fight against in WWII?

and I forget the other two...

Then she congratulated him and said he passed! And then she said he could take his oath that very afternoon! Could've knocked me over with a feather. But it turned out he couldn't because apparently the county we live in is out of their jurisdiction for oath-taking. I have no idea how that could be, but we have to go to Charlottesville, VA for the oath. Who knew? Has anyone ever heard of this before???

Anyhow, as we were leaving, she complimented me on how thorough and well-organized our applications were, which was very nice. And she mentioned that she really enjoyed a paper she saw (it was actually in the ROC app... interesting that she had that there, too, I guess) where I had had our son write 30X on a piece of paper "I will not kick the soccer ball towards the house"... LOL because he broke one of the window several years ago. I told her it was proof that I was parenting... hehehe

All in all a good experience! Thanks for all the help and support, you all!!

I have read varying information about the Check Case Status tools on the USCIS website as they relate to the N-400. One post I read said that they don't work for the N-400. I just wanted to let people know that our case is in there and can be reached with either tool. One tool lets you just enter the case # on the USCIS home page on the left. The other, you open an account (ours shows all of our submissions from the beginning) and add the N-400 to your "portfolio".

I feel much better with the case in the portfolio and the "email notification" feature turned "on". In case any snail mail notifications go astray, we will hopefully still know when the appointment is via email notification.

Sorry if this is old hat for some/all of you, but maybe it will help somebody...

My husband (the alien) and I (the USC) have been discussing this. He is a life-long Buddhist, although he doesn't really have any proof of this. Most of his ethnic group in his birth country of Nepal are Buddhist. This question gets complicated for him. If he were a USC by birth, he would likely claim CO status during a draft. He would be more than willing to serve in a non-combat support position like a medical unit. He's over 40 now, so I think (hope) the chance of him even being eligible would be slim to none, but who knows?

What happens if you answer "no"? What kind of proof would be adequate to show that one is Buddhist and has a religious objection to taking up arms in defense of the US?

Any (kind and helpful) guidance is appreciated. And I thought of piggy-backing on the related topic thread but decided against it because we are still in the application phase.

Well, I don't want to dissuade you from your path to Canada... heck, I'm seriously considering it myself (even though my husband is from Nepal tongue.gif because we have such a whackjob for a prez and my hopes are fading for the next election)

BUT ANYWAY...

I'm shocked that your husband came on a K-1 FOUR years ago and still does not have a greencard! I'll try to put this mildly and suggest that you contact your favorite congress-person's immigration liaison immediately and ask for help. Or all three (2 Senators & 1 Rep). I'd make a brief timeline of what's happened so far and march right into their offices if you can. That is just outrageous. And I'd do it whether or not I was planning to move to Canada! You have submitted your apps, paid your fees, and deserve an answer... not this ridiculous, protracted run-around!

I hope you do it and let us know what happens...

Sorry I didn't read the whole thread, but I'll chime in anyway...

A word of advice, if you want a thread to stay "in Canada", then don't title it "CONFESSION TIME", because then it will be very well read and might make it on to the "Today's Active Topics" (see upper right corner of screen) where people like me who are nosy and/or bored at work might drop in...

But ANYHOW... it really is no big deal to do AOS on your own. Just pay attention and do your best to follow your case status online. And don't worry about pestering people here... it has been my experience that they are very kind to neurotic worriers who ask a million questions (at least they were to me tongue.gif )

So good luck and here's wishing you a smooth AOS...

Hmmm.... this may seem like a tiny, irrelevant point, but in your original post, you say you were traveling "back" to Canada. Almost makes it sound like you were just visiting PA and now you are going home. I could be wrong, and way too detail-oriented, but if I were Canadian border patrol, that language would send up a red flag to me.

Just sayin'

I think those who are suggesting routinely carrying "proof of ties to your home country" with you as you travel have it right.

I'd be perfectly comfortable going into an I-751 interview and saying my husband is an idiot.

Actually, we just met a couple who recently went through AOS at our local office (wife-USC, hubby-Irish). The hubby, in his utterly charming Irish accent, specifically advised us that the AO doesn't want to see you acting as though you're in love.... he said they are more likely to believe the marriage is valid if you don't get along perfectly... ;)

So if you are fortunate enough to actually be in a relationship where there is a lot of respect and affection, you might have to stage a tiff for USCIS's benefit. I'm planning ours now....

....that is IF we ever get to our AOS interview. :bonk:

We can't file until next August, but in planning ahead...

I think we will submit all the joint stuff we have (an average amount), and only do the affidavits if we get an RFE. I feel like we want to give them all the evidence we have, but yet, if you get an RFE for more evidence and you've already given them everything you have, I guess affidavits might be the only other thing you can offer... blink.gif

We know a couple who got an RFE and felt that it was because non-USC wife was not added to husband's deed on residence. Has anyone heard of this before?

We traveled back to Nepal in June and I was the tiniest bit anxious re-entering the US with the 2-year greencards. I needn't have worried... everything went very smoothly. The CPB officer even said "Welcome home!".

A while back, the USPS changed our zip code. We haven't moved. And we live in a rural area where the mail will get to us, whichever zip code it has on it.

Another wrinkle: in some computer systems, when you enter the new zip code, it automatically enters the name of the neighboring town (which has had this zip code - new to us - for a long time). So our mail comes addressed in any one of the following combinations:

us
xxxx rd
Town A, old zip code

us
xxxx rd
Town A, new zip code <---- this one is correct

us
xxxx d
Town B, new zip code


Are we taking any risk in reporting the changed zip code to USCIS, or should we just leave well enough alone?

Either way, I expect it will get to us, unless the address change somehow messes us up (eg, they change it to an incorrect street number or state!). And all of our mail will, I'm sure, continue to be all SNAFU'd as it is now.

Also, I don't want them to think we've moved, because we haven't.

Reading these stories about denials due to missed RFE's has me wondering... unsure.gif

Do either of you have wills with the other as beneficiary? That might help. You could probably even produce one fairly quickly with a software package and get it recorded at your courthouse in a matter of days.

I agree with the poster who said the residence situation is of primary importance, and we have personal friends (IRL) who were RFE'd for the same thing.

I'm thinking we'll be RFE'd this fall, too, because I have not put my house into my husband's name yet and am completely torn about doing so, even though he is a wonderful sweet husband and I love him beyond words. I lost my first house in my first divorce. Once burned, twice shy, as they say - and I'm even thinking about writing something to that effect with our application to remove conditions!

I wish the OP luck, and I'm sure things will work out fine... your original list sounds like plenty!
