Do either of you have wills with the other as beneficiary? That might help. You could probably even produce one fairly quickly with a software package and get it recorded at your courthouse in a matter of days.

I agree with the poster who said the residence situation is of primary importance, and we have personal friends (IRL) who were RFE'd for the same thing.

I'm thinking we'll be RFE'd this fall, too, because I have not put my house into my husband's name yet and am completely torn about doing so, even though he is a wonderful sweet husband and I love him beyond words. I lost my first house in my first divorce. Once burned, twice shy, as they say - and I'm even thinking about writing something to that effect with our application to remove conditions!

I wish the OP luck, and I'm sure things will work out fine... your original list sounds like plenty!

The reason I noticed is because I'm struggling with that one myself. I owned my house 9 years before I even met my husband, and I have not added his name to the deed. sad.gif Call it post-divorce traumatic stress disorder...

We are getting ready to file for Removing Conditions (late, I know... due to a death in the family). I went in to USCIS "case status online" today, having not been on for a LONG time, and saw that our AP documents for my husband and son, originally issued in March 2006, show a "last update date" of 6-21-08.

We never used the AP docs, but we did eventually go back to Nepal for a visit in June 2007, well after the greencards were issued.

How odd is that?

Has this happened to anyone else?

Is there any significance to it?

It was a little creepy, actually, seeing that someone has been messing with our files when there is no application currently pending. ph34r.gif

Any light on this would be appreciated.

Yes, we are filing at the last moment (don't ask... it's been a rough past few months, not for the marriage but because of other things), and I'd like to put the package in the mail this afternoon.

Is there any down side to filing by UPS or Fedex as our USPO is closed? I see the VT service center address contains both a street address and a PO box.

If I could just piggy-back on this thread with a related question...

We just mailed our I-751 package yesterday and will be away the week of Thanksgiving, and probably for a longer period next June to visit Nepal again. I am getting started on my worrying early and have two questions:

Is there any given time in the next year that they are more likely to send an RFE than any other? IOW, is it more common just after they receive the package, or when they're getting ready to process it (like months from now), or anytime in between, with no discernable pattern?

How much time is usually given to respond to an RFE?

Fingers crossed that we don't get one!!

To remove conditions on her own, she will need documentation that the marriage was in good faith and genuine. See the guide to removing conditions for a list of possible evidence that will help her. She should take as much of that with her if/when she leaves for another living arrangement.

A child, imho, is the best evidence that a marriage was legitimate, so the birth certificate, pictures of them as a family, mail addressed to them as a family are particularly valuable.

I agree... it sounds like this loser is just trying to avoid fulfilling his obligations to support his child, and possibly her as well. I wish her luck.

Try Catholic Charities for pro bono immigration help. They were very helpful to someone I know who was in a pickle.

We got our son's NOA-1 (if that's what it is) today before my husband's. I think someone forgot to put the official paper/letterhead/whatever in the printer before they printed this thing off! unsure.gif

It is just a plain white sheet of paper with all the correct info and a paragraph about how he is included as a dependent on his dad's request to remove conditions. Near the top, it says "VERIFICATION OF INCLUSION OF A DEPENDENT IN FILING OF FORM I-751 OR I-752"

But the fact that it is just a plain white piece of paper is freaking me out! Is this what others have gotten for K2 dependents?? And has anybody used it to re-enter the US after a trip abroad??

We just had our check cashed at VSC. I mailed the package 11-3, it was received at VSC on 11-5, and the check was cashed yesterday, 11-12. That's with a holiday in there... I'm guessing VSC did not work 11-11 (Veteran's Day). Also yesterday we received our son's notice of inclusion on our joint petition.

Should be any day for your check....

Hi, yes the letter you recieved is normal, i got the same for my son, after recieving mine. You will get the proper one later, his extension letter and then his biometrics, be calm, its just part of the process



Ah good! Thank you for your response! It provides a level of comfort to know that this is how it has gone for others. I am glad to hear that he will get an extension letter of his own later, as we would like to travel to Nepal next June, and I doubt we'll have their 10 year greencards by then, and I just can't imagine handing this letter to CPB as proof he is a PR... it looks like anyone with a computer could've generated it.

We all went yesterday 12/9 to my husband's appointment, and the Service Center was fine with allowing our son to get his biometrics done at the same time. So now we don't need to make the trip again next week... YAY!

Annabelle, I agree with payxibka that you would be better served by entering your request in the AOS forum. There are a lot of folks who have arrived as you and your son have, using K1 and K2 visas, and have adjusted status or are going through the process now. I would also recommend reading the guides (see tab at the top of the page) and especially the USCIS instructions posted with the I-485 application itself on the uscis website. Then if you have specific questions, the AOS forum would be a good source for clarification.

We just received letters for biometrics appointments for my husband(K1) and our son (K2). Unfortunately, for the first time in our visa journey, their appointments are for different days. sad.gif As it is a 1.5 hour trip one-way (as long as the traffic isn't bad), I'm thinking we should maybe try to get them done at the same time.

Would it be worth it to take our son with us to my husband's appt on the off chance they'll process him too? It would mean pulling him out of school, and if they didn't process him and we had to return for his appt, he'd miss two days instead of one.

And what about that scary writing on the appt letter:

IF YOU FAIL TO APPEAR AS SCHEDULED, YOUR APPLICATION WILL BE CONSIDERED ABANDONED.

What if they processed him with my husband and then freaked when he didn't appear for his scheduled appt?

Yeesh. Has anyone had this same issue, and if so, how did you handle it?

You didn't say if you were going to Nepal, but either way, travel can be unpredictable, and that goes double in Nepal! I've had too many flight delays and schedule changes in my trips back and forth, including a delay of several days in 2005 after the "coup". And the current govt is not really that stable, imho.

Hope for the best, prepare for the worst, eh?

Just thought I'd update this thread...

On Friday May 8, we recieved letters from our local USCIS office (Washington DC/Fairfax, VA) saying that the 10 greencards had been approved and we would get them in the next 60 days. Since we are going back to Nepal in about 30 days, I have been hoping they would arrive before our trip. Well, they arrived last night! Yay! jest.gif

It is curious, imho, that the approval letter came from our local office, but the cards themselves clearly came from VSC in St. Albans, VT. I wonder if that is true for everyone who goes through VSC? And what role does the local office play in the Removal of Conditions?

So we are happily and busily preparing for our trip back to Nepal. And Dolma-bahini, we are looking forward to meeting you too! biggrin.gif

VJ meetup in Kathmandu at the end of June! Be there or be somewhere else!

We are getting ready to return to Nepal for a 2 week visit, and have NOA-1's for my husband and son, in addition to their expired greencards. As the time approaches, I have read everything I could find about I-551's and would feel much more secure (perhaps falsely so) if we had something more than just a letter. I think I'd rather lose my passport than those letters! Yeesh.

I am just wondering if anyone has had any luck, in the same situation, with making an Infopass appt in Fairfax and requesting an I-551 stamp in their passport? We are traveling in mid-June, so now would be the time to do it, but I don't want to make the effort if others have been consistently unsuccessful, and it seems like USCIS, on the whole, is very inconsistent from one local office to the next (and maybe even within a given local office) about granting I-551 stamps.

Any feedback?

For us, checking case status online during the ROC process was pretty much a waste of time (although I'd still do it again, if only to hope for a head's up of an RFE or any other problem).

My husband and son have their 10 year greencards in hand as of a couple of days ago, and case status still shows only the action of sending the NOA... no touches or approvals posted since last December. whistling.gif

Wow.

I came home from work today to find two letters in the mail. Knowing it was WAY too early for approvals, my heart sunk, thinking they were RFE's instead. Wrong! My husband and stepson are approved for their 10 year greencards! The letters are dated 5/5/09. It looks like the approval came from our local Washington DC (Fairfax) USCIS office. The approval letters came exactly 6 months from the date of our NOA-1's. Lightening fast compared to what the timetables say.

Now if those cards would get here in the next 4 weeks, I wouldn't have to worry about traveling with the expired cards and NOA-1's. Pretty please???

Would someone kindly put our approval dates up on the list? Or should we wait until cards are in hand?

APHIS (part of USDA) is charged with regulating the import of food. I didn't see anything on their website regarding dried fish, but there is a phone number.

I hope everyone will take from this that it doesn't really matter how forthright, honest and careful one is at the petition stage or at the Consulate... at the POE you have to behave, dress, speak like someone who is a fiance(e) by American standards. It's not fair (and I don't see why it would be that difficult to create some kind of notation on a visa if a couple has had a religious ceremony that was disclosed at the petition or interview stage), but for now, this is how it is.

Maybe there should be some sort of permanent warning on VJ about this (or maybe it's there and I never saw it). It has come up over and over again. The issue caused me a fair amount of angst last year because we did something similar. That NOLO book does say it's no problem to have a religious ceremony, which is clearly untrue. Maybe there could be a pinned thread about some of the very avoidable pitfalls that have occurred, especially if it has happened to more than one VJ member...

Oh, and there is a USCIS petition denial/appeal in their archives about a couple that had a ceremony but no paperwork who were denied a K3 based on no documentation (ie, license or certificate) and then denied a K1 based on the ceremony they had had, or something like that. I may be able to locate it if anyone's interested, or maybe someone has a link handy. Anyhow, the ruling was that, if the couple's "marriage" was not legal for the purposes of a K3, then their K1 petition can not then be denied on that basis.

Best wishes to Goldenheart in getting this straightened out. If I were in your shoes, I would be contacting both of my Senators at this point.

Gosh I hope Goldenheart is still reading. My heart goes out to her and her sweety. But in order to move forward, the more resources and information they have, the better. VJ is one valuable source of info.

It was reading VJ that saved us from a fate just like that. We had a religious, undocumented, not-legal-in-his-country-or-the-US "celebration", and when I stumbled upon something at VJ about this topic while researching K-1 visas, after I had a cow, I was able to thoroughly research how to handle it. And my fiance did fine when he was asked by the CO at the interview if we had had any kind of ceremony :o (he told the truth, but he also fully understood the significance of what he was being asked). And we had a very smooth POE experience, thank goodness.

Let all of this be a lesson to those starting down this path...

BUT, that said, I am wondering if Goldenheart saw this, from a link posted recently on the thread she started herself (I am asking this on this thread since it seems like Goldenheart is/was more active on this thread):

I didn't read the whole thread, but I have two comments:

1. Check with your local health department and/or free clinic. They will most likely have services for you.

2. Regarding your breathing/asthma/bronchitis... check out something called a neti pot:

It is designed to flush your nasal passages. It looks weird, but it works. I have had chronic sinusitis and resultant bronchitis for several years now and this has literally changed my life! I can finally breathe! I have not had to take any meds since starting to use this method several weeks ago.

I recommend it highly, especially if you want to avoid taking lots of meds. This method just uses salt and baking soda, and you can flush as much as you want. I started with 2 times a day, but now once a day seems adequate. TMI, but you wouldn't believe the junk that came out the first few times!!! ohmy.gif

Several thoughts...

1) You don't actually love him... you love who/what you thought he was, which is like loving a unicorn or a dragon, or some other make-believe creature. The truth is that he is just a common scammer... someone from his own real life pretty much confirmed it.

2) Feeding anger and resentment towards him will only hurt you. I concur with the forgive and forget crowd.

3) Consider your money went to pay your tuition at the School of Hard Knocks. I think most people have to pay at some point. I know I did.
