Now I'm super confused. We are CR-1, but I had lots of contact with NVC because there were some crazy things happening with our case. After it was approved, they told me it had been sent to the embassy and they wouldn't be able to answer any other questions... is that not right? Shrewd, I thought you had called to get your interview time before you got the letter? Agh! Just when I think I understand it all! haha.

Does anyone have advice for calling the embassy- the website says not to call... so what number have people used and how do you get the info? I'm just thinking ahead and hoping we'll be scheduled in February for March.

Well, I finally talked to someone at NVC and she was quite rude to me. I explained the situation and all she would say was "well, it can take 90 days to get to us. If you want to know why, call USCIS to see why it takes so long to get here." I couldn't believe how rude she was.

So, I called USCIS and they keep apologizing and telling me that there is nothing they can tell me. I feel so frustrated. Neither one of these offices wants to take responsibility for this case.

Wait- I'm not sure what I need to tell them to fix. I recieved the incorrect NOA1... but the correct NOA2. My case, when I look at it on USCIS website and when I call on the phone has been approved. I don't understand what needs to be fixed.

You said your case was approved 8/29....your signature indicates NOA2 on 9/6. Whichever date is correct...it should not take that long for your case to be received at NVC.
What you need to correct is...they have somehow misplaced or completely lost your package. You should at a minimum have an NVC case number by now.
Review the link in my signature...it shows what happens to the "average" approved I-130 petition at NVC.
If it was a week or so...I'd say don't worry...but I'd rather tell you to start complaining now, rather than wait 12 weeks to get angry.

Thanks everyone. Yeah, Jgay- long story short, the NOA1 that I have had this whole time was for someone else's case (I didn't put two and two together when I noticed that my NOA2 had a different case number). But the guy at USCIS was quick to tell me that my case is approved and RFE is associated with someone else's case (which I received the NOA1 for), makes sense, right?! haha.

I may try calling tomorrow about when it gets sent onto NVC.

I called the NVC line and it just kept telling me that they have no record of our case. So I finally waited patiently... twice because the first time it hung up on me! When the operator answered, she was quite rude to me. Apparently the system isn't working tonight and she told me I should be able to check my case online... well I don't know how to do that. So I logged back into the fee website and this is what it says:

Sign In Failed
Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please click on the Contact the NVC hyperlink if you believe that you have received this message in error.


Has anyone else ever gotten this message? What does it mean??

K-3 Spouse Visa Process & ProceduresA bit confused- can someone help?
I filed an I-130 and once I received my NOA1, I filed the I-129 with the waived fee.

So, as you can see I've received two touches on the I-129 and none on the I-130. But, my biggest concern is what it says on the online status check page:

I129F PETITION FOR FIANCE(E)
I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN


Obviously, this is my husband and not my fiance- is this something I should correct or is this the norm? I don't want to call USCIS if they aren't going to be able to answer me, so I thought I'd ask here first!

I don't know that this is clearly a case of human selfishness I think it is more indicative of how the human spirit handles the complete unknown.

In the US we have been taught to trust our government- many of us will say we don't trust them, however I believe most of us don't ever think the goverment is out to cause us grave harm. We go to work each day and do our jobs, and we expect the same from them. So the people whose files were sent to CSC because that is where it was directed to originally (I am one of those people) have searched and looked at processing times and checked case statuses every day- looking for something to make this process tangible. Something to give us an understanding of how and when we will see our loves again.

I don't dare want to take away anyone's opportunity to be together with their husbands/wives- I wish that for all of us. But, I think, what the original CSC filers are seeing/feeling is this: I finally felt I was begininng to understand my place in this line toward approval. I had some concept of when I could expect an NOA2 if all went well, but now all I see is another line, coming from the side, right in front of me with no end in sight. This takes all that I thought I know and makes everything unknown.

I don't blame those being moved from VSC... in fact I am glad to see that the government is working to correct your injustices. But what I fear is that in correcting what has been done to you, they will displace another entire goupr of people. And yes, that part of this makes me angry.

I would highly recommend that you not report the work. Working "under that table" as you put it, for more than 20 hours per week while on an F-1 visa means that your wife was out of status. If she was working under the table, then she likely had no tax forms and was paid in cash strictly so that the government could not track her status.

However, if she was working less than 20 hours a week, on campus (or with a company contracted by the campus, such as catering), this is work that is permitted by her visa status. That type of work I would report. The rest I would not as it is technically illegal.

Even is the government does go into her bank account, if she was paid in cash there isn't much they can do to track it.

Hi All:

This is a tricky one- and if anyone has any thoughts on it, please let me know!

My husband and I are considering him coming here ASAP to go to school- which would be an F-1 visa. Typically, one of the stipulations in applying for an F-1 is proving that you will return to your home country after you finish your schooling. Now, obviously they will be able to see that he is applying as an immigrant at the same time- so will this keep him from being eligible for an F-1.


OR

If he does get the F-1 and comes to school in the states, is it abandonment of our immigrant visa application?
