Yes the NOA1 was dated Feb 27th, after being sent to the lawyer much earlier.

Once your fiancee gets the interview appointment date, then you will be in a better position to decide if you need to delay the interview. She will have to arrive in the USA on or before the expiry date of the visa, which date shall be 6 months after issuance by the consulate in Sydney.

So, add 6 months to the date of the interview and if that isn't late enough for you, call the Sydney consulate and ask them for another interview date that fits better for you. I have heard of this sort of thing done before, so I feel confident that you won't have any problems. I wouldn't delay anything else at this stage. Get the documents returned to the Sydney consulate as soon as you can. It will be easier to delay the interview than to try and explain why you took a long time to return the packet 3 documents.

Whatever else you do, I don't think you should follow misskiya's advice. If your fiancee comes the USA as she suggests, then she will not be able to return to Australia and then return to the USA without an Advanced Parole (AP) document. AP can only be applied for after you get married and file for Adjustment of Status (AOS). Assuming that your AOS submission is submitted shortly after the 'informal wedding' and there are no problems with it, AP takes about 2 months to acquire. This would mean that your fiancee would have to stay in the USA for about 3 months or so after the so-called 'informal wedding'. This doesn't seem like a good course of action for you, given what I can read into your situation.

Just to clarify, I wasn't recommending AP. I was wondering on which side the family problems are. if they were on the US side ( meaniung the ceremony itself was the problem and not the travel) then just postponing the ceremony, not the legal action of marriage could be a possible solution.

But it does seem to be on the Aus side(traveling) so I hope the 6 month visa expiration date will be enough time.

I don't want to get into too much detail because I'm sure it's personal, but I'm assuming the family issues are IN australia so the problem is your fiancee wouldn't be able to travel? If that's my understanding I have noo clue, if it were on the US side, maybe she could come and you could just have an informal wedding at a courthouse and THEN postpone the ceremony. IF it's on the Aus side, I BELIEVE (may be mistaken as it may have been taken down to 4 months, I've heard both) your fiancee has 6 months to travel after recieving the visa. Would that be enough time to sort things out, and just push back the TRAVEL to the US rather than the visa?

I just had to correct a birthday at NVC, the operator said I could fax in my birth certificate now, or I could just point it out at the interview (hahah I wont be going :( ) so if it gets pointed out at the interview, I'm sure there's no problem. IF they even notice.

Wait is your lawyer in the US or in Turkey? Why would they forward it to your attorney rather than to the foreign fiance? Is that standard procedure? Because I'd never heard of it before.

My lawyer is in the US. From what I heard they will either send it to the petitioner or the lawyer in the US, and then send a duplicate copy to the beneficiary. But they never sent it to my fiance in Turkey! This also happened to another couple that I know. It only went to the lawyer! :wacko:


That's ridiculous. I'd get another lawyer to sue your lawyer! no really...people have no understanding of what we go through until they GO THROUGH IT THEMSELVES! I'm so sorry to hear that it happened to you. Pray it doesn't happen to me cause our lawyer would make your lawyer look like a saint. He kept his secretary lol.

A number of people on this board have small, legal marriage ceremonies in the US to statisfy the AOS requirements. Then, they plan the huge, blow out, fairy tale wedding for a later date, when they can better afford and plan for it, and/or after they receive advanced parole/green card.

My husband and I are still saving up for that fairy tale wedding. *sigh*

*back on topic* My fiance and I are planning on a court wedding here in Idaho. Then once he has his AOS (we're hoping sometime in summer of 07 ) We'll fly to Paris and have a "ceremony" on the beaches near his home for his family. I'll get my dream wedding and his family wont be left out of the process, just delayed lol. It seems to be the most popular option to just save the ceremony for AFTER. Maybe to celebrate your first ann or something? That's how we're planning it anyways. Hope it helps.

We were also approved after you and recieved packet three. From Paris. There's no reason you should have been recalled, I'd just keep calling and calling and calling until you find out what is going on. IMBRA is for those with noa1 recieved dates after march 6th from what I understand. Goo dluck and let us know how it goes.

PS- please update your timeline. It's REALLY vital in calculating dates and statistics for the site.

From what I understand (take it for what it's for)

having gone throughhis process, military, and government paperwork. It seems to be a requirement on any US government based paperwork that you sign with your full name. First, middle (if applicable), last.

Again, that's just been my experiance so take it for what it's worth.
