London always does AP for those born in Pakistan. Your wait seems to be over the extra security checks involved. If you have a common name, it makes it harder to determine clearance. They will not give information on what they are checking, why, or how much longer, even if you call every week. . I don't understand how you will get your passport to London when they are done with the AP if you have returned to Pakistan. Did you have your case transferred to a consulate in Pakistan. Does London know you are no longer in the UK?


Thanks for your quick response.just to clear you that i start my process from pakistan and i left UK last year i had my interview in US EMBASSY ISLAMABAD,yes its a common factor that AP in pakistan can goes upto years and i can see alot of vj members in pakistan they are in AP upto 2 years and 3 months and still going on,regarding my passport cause i had my interview here in pakistan so at the end of interview he CO kept my passport aswel.but my name is not common at all in pakistan you can only find few name that are liberal one of them is me,every time same response from embassy and DOS pending AP.online status on ceac.state.gov site changes every week some time twice a week,my only concern is not long AP but iam much worried about that caution that it might make harder for me to get visa,but on the other side i never been to prison,so i dont know wat will be the outcome...

yes iam muslim born in pakistan stayed in UK only for 5 years on work permit and now iam back in pakistan in may 2012,they ask me to submit w-2 form from the most recent tax year that were missing,so i sent them in 5 working days after the interview,embassy received those documents and confirmed through email.my wife email embassy and call the DOS weekly but there answer is that they dont need anything from us,ur case is in AP we will contact you when AP will over.i only provided them ACPO police certificate at nvc stage they ask me court and prison record i sent them written statement that i never been to court or prison,than they said ok at interview i xplained the CO regarding caution than during the interview he consulted with other officer than he said its ok he only asked one question nuthing else on caution..
i hope this explaination will help you to give me some advice.normally us embassy in pakistan is common for long AP.plz share ur kind thoghts...thanks

So did you send the missing documents? If not, they may be waiting on you. Did you send a memorandum of conviction or court records detailing the incident. A caution is a plea of guilty that is handled without a full court trial. It is an admission of guilt, not just somebody saying you were naughty and don't do it again.

Your extended wait may not be because of the caution. We're you born in a country other than the Uk? Do you have family ties in the middle east or India or Pakistan? Are you Muslim?

thanks for your kind response.i had only one caution in my whole life,apart from that i never been to prison nor fined.i had my interview in the end of sep 2012 during the interview CO asked me about this caution i told him all the story at the end of interview he gave me 221g sheet for missing documents and CO said it may take 3 to 6 months.
just want to ask you that that il be ok or im in trouble coz i never been to prison nor fined please help me regarding this matter.....thanks waiting for ur kind response....

hello all uk vj members i got caution from uk police in 2009 reason is i used to work for a online company based on gumtree offered me to cash there traveler's cheque on percentage i was jobless i never knew that they are fake so when i went to american express in city center give them to the person on the counter he asked me for a wait after few miniutes police arrived they took me police station and kept there for few hours,i told them whole the story and they gave me the caution.now iam worried about that on my ACPO police certificate it says in the column of offense MAKE FALSE REPRESENTATION TO MAKE GAIN FOR SELF OR ANOTHER,,.i m much worried about that as i checked on the google it comes in the category of fraud,i had my interviw in sep 2012 and still in AP please give your opinion that i will be able to get visa or not because it comes in the category of CIMT,but on the other side i only got caution never been to court or convicted,,,your opinions will be greatly appreciated....

Well, I have to speak second hand because I wasn't able to attend the interview. She experienced the whole process of fingerprints, interview, documentation check, and paying the fee. She said the interviewer was extremely nice to her and told her she would definitely get the Visa made for her as soon as she came back to the embassy with the correct birth certificate. The interviewer told her she could drop off the birth certificate in the morning and she could pick up her visa that same afternoon. 

 

Overall, I am please with that result. She has family in Tegucigalpa so it was no big deal for her to wait a few more days.

Hello Everyone,

Me and my Fiance are a victim of procrastination. Our interview is tomorrow and my fiance went to get her forma literal birth certificate today and they told her it would be 8 days before she could get it.....

I need HOPE! haha

 

Can anyone tell me if they have successfully gone through the VISA interview WITHOUT this document???? She has the regular birth certificates, just not the particular one they are asking for.

 

Any hope?

True, the petty offence exception might be of use to the OP.

 

To qualify, they must only have one CIMT, for which the maximum possible sentence was no more than 12 months imprisonment, and you yourself were imprisoned for no longer than six months for the offence.

Not necessarily..

It depends what the maximum possible summary sentence is for the offence. If it is 12 months or less  (and is your only offence) then no waiver will be needed- even if it is an offence involving moral turpitude. Accepting A UK caution requires an admittance of the offence, so a caution is treated the same as a conviction for US immigration purposes.

 

 

I believe the exact offence in this case would be 'fraud by false representation' and the fraud act of 2006 which covers this offence carries a max sentence of 12months upon summary conviction (higher maximums upon indictment are not relevant).

You should be fine and not require a waiver. I certainly didn't for my caution, which was also for a single offence carrying a maximum sentence of 12 months.

False representation is usually considered a crime involving moral turpitude, for which you would need a waiver.

 

You should consult with an experienced immigration attorney.

guys i really need your help ie who are aware of UK law or who been through this situation.
my wife just filed I-130 for me and i have some concern because of my police record.well i had police caution from west midlands police in 2009 reason false representation for trying to cash fake travellers cheques which i been given when i was in europe i never realised that its a fake but when i went to AMEX for cashing they asked for my id i gave them my passport and after 10 minutes police arrived and took me to police station,i explained them every thing but they kept me there few hours and after that released me with a caution.
just to clear that this is the only police caution in my whole life nouthing else is on my police recrod,now my question is that will i be denied my visa beacuse it comes under CRIME INVOLVING MORAL TURPITUDE(CIMT).

please help me with this..thanks in advance vj fellows

We had a courthouse wedding :) I had to schedule a day so we could have a judge marry us which was pretty easy. We basically showed up with his parents from the UK and registered with my drivers license and his passport plus the fee money. My parents were late and so we waited till they finally arrived and finally had the ceremony. I loved it lol the courthouse is also the DMV in my city so the halls were packed with people waiting in lines for car tags and whatnot all cheered us on while we left.

Yes, 50 days waiting on NOA2 was a struggle for us..March 2008 filer..VSC. But I had seen the previous month people getting approved in 2-4 weeks so that was my expectation. A few months later and it was over 100 days. And I remember when Obama was running for his first term in 2008 and many VJ posters were certain he would instantly fix immigration and those 100 day waits would be history. Yeah, they are history all right, but not in the way they expected.

I don't know how you people stand it. I really do feel sorry for you.

 

One thing I learned in life is always expect the unexpected especially change.

Don't feel sorry for us new filers :) It isn't easy to wait I can tell you that honestly, but it tests your love and trust in a person thousands of miles away. Good things come in good time. I just hope I don't run out of things to say to my fiancée when we finally do get married :D

My fiance had his interview today..he said that they asked him how we met and he told them the story all the way up to where we are now, so impressed the woman interviewing him smiled and asked him to write my full name down and after that she told him he was approved :) So only one question. I'm guessing that depending on the person who interviews you and how you present yourself is how they ask their questions.. which is awesome but me and my fiance spent hours going over questions lol..oh well! :D

Well  only had to wonder for a few hours.  They called her at 11 am her time and they asked if she was collecting it or having it delivered.  She told them we paid for delivery, so they tried looking and couldn't find her name, so they then checked the passport number to find that we had paid.  Problem was that she has a hyphenated last name and they were looking it up wrong.  They now have it scheduled for delivery tomorrow (25 Sept)

 

Congrats on his visa arriving today.  

 

I'm so sorry for your delays with her visa. I'll keep my fingers crossed for you guys tomorrow.

 

Thanks so much..Now I need to clean the house like a mad woman before he arrives friday evening

Hmmmm I was feeling rather alright with the timing of things until this.  I'm very happy for you that you should be getting yours tomorrow and hope all goes well, but since my fiance had her interview the day before you and her status change to issued the day before yours, I'm wondering why she hasn't got an email yet.  Hopefully your visa comes tomorrow and our email as well.  

 

Did they ask her at the embassy when she would like her passport back or when she intends to marry? I know they asked my fiance and he told them ideally he wants to leave as soon as possible and told them we want to get married on October 3rd.

PS..he messaged me a couple hours ago and got his passport today :D

To be honest with having gastric I had the option taking B12 every day the rest of my life (under my tongue) or just take a shot once a month..I guess me being lazy I opt for the shot :P of course I give them to myself tho. I had insurance when I had the surgery but they didn't cover the b12 and now that I still have no insurance I pay out of pocket and my B12 for 3 months costs me $12.00 and that's through a walmart pharmacy which isn't bad at all. I just call my surgeon and tell him I need a perspiration for a refill every so many months. But to help you. You can always go to a small doc in a box and tell them about the surgery and ask about b12 they shouldn't have any issues with a perspiration.

 

 

Bingo, the B12 injections. My worry was that if I had the bypass over the band, when I move over to the States in the next few months and would need said B12 injections every month (or 3 months), I wouldn't be able to get them without forking over a lot of money because it may count as a pre-existing condition on Amy's insurance (or my own as the case may be).

 

Either way, hopefully before I leave I'll have had a couple of band fills and I'll be a lot smaller within the next couple of years.

No, I don't reckon it will be (in more ways than one). First off I'll make sure any new Doctor in the US knows I've got it fitted (hence the ID card) and also it's not going to be an issue for flying unless I've had it adjusted within the 48 hours before my flight. Had the band purely because if I had the bypass I'd have had to deal with the injections and all, and something tells me they wouldn't be covered under insurance as a pre-existing. But that's another story.

 

aww bless i can imagin there is a long story. i hope all works out well for you :) i had a card a while ago to take with me if i went out to eat and such but misplaced it. which injections are you refering to? i only have to take b12 once a month for injections, use to not mind them but now that i lost so much weight i can feel the needle going in haha :P

Yeah, this is kind of why I was asking about whether anyone had any clue if they'd ask questions about the gastric band I've had fitted and all of that - might show up on the x-ray or something. But either way I have the ID card for it and all that so when it does come to my turn for the medical and I go through this, it shouldn't be an issue. Could be a first for the VJ UK forums though. tongue.png

 

oh wow great question I had gastric bypass myself but I'm a USC. I don't think its an issue. Just make sure you find a doctor here in the US for checkups.

If you are old enough to not of had your MMR as a child Which I am :( Get it done at your own Doctors as its free but MAKE SURE you go back a month later for the second injection, I never knew about the second injection so it just cost me another £37
