K-1 Fiance(e) Visa Process & ProceduresRequest for expedite # 2 still denied?????
I have never heard of an expedite for a wedding. It's not USCIS's concern whether or not you have made plans for a wedding, and I am surprised your lawyer has had expedites approved for that. People aren't getting expedites for living in abject poverty, in war zones, or under dangerous environmental conditions. Compared to that, a wedding just doesn't seem like a priority.

Out of curiosity, why can't your fiance sell his business and then just wait out the visa? Won't he have to sell it anyway?

[snip]

I am seeing a disturbing pattern of visa refusals, Stokes interviews, AAP and other abuses directed largely at non-white or non-European beneficiaries. Is anyone else seeing this?

This isn't anything new--at least not the "non-white/non-European" part. When you look at the consulates reported to be considered high fraud, they are overwhelmingly in non-white, non-European countries. Beneficiaries from these countries almost always undergo more scrutiny at the consulate than in places like Great Britain, France, the Netherlands, etc.

K-1 Fiance(e) Visa Process & ProceduresCan't find co-sponsor, Need your help
Sometimes I think we are so desperate to get our loved ones to us that we underestimate what we are asking co-sponsors to do. If things don't work out between the couple for some reason, the co-sponsor could be on the hook to pay back all means-tested benefits. This doesn't necessarily end in ten years. If the beneficiary chooses to never work and never gets citizenship, that's it--the government can come after the co-sponsor for funds if they chose to do so. I can honestly say I would not sign for anyone, and I can't think of anyone I would ask either.

On a related note, check out the "Effects of Major Changes" forum--you'll see an awful lot of posts from people who are freaking out because their marriage didn't work out and now the Affadavit of Supports are terrifying commitments. This is not to say the OP's relationship isn't going to work out--just that it does happen more than we would like to think.

To the OP, I really do wish you well--I hope you can find someone willing to help you out!

K-1 Fiance(e) Visa Process & ProceduresExpatriating after the fact?

if you didnt become a US citizen and just kept on renewing your greencard when you needed to (if that is actually possible) could you move back to the UK without having to go through the immigration process??

We've done a bit of research on this, and from what we've read you can maintain your UK citizenship while acquiring your U.S. citizenship, so you (the dual citizen) won't have to go through the immigration process at all. Your American spouse will, however, as well as any kids you have that do not yet have UK citizenship.

K-1 Fiance(e) Visa Process & ProceduresDifference of Age

This is all good advice. The original poster should have his guard up because there are many women out there that are not genuine and have an ulterior motive but over the six month process, you should see those signs.

As far as a younger filipina marrying PARTIALLY for money (security), well you will find more of that in America than you will in the Philippines. Seriously... just try to be a guy in America and telling a woman you work as a mechanic and trying to get a date. LOL. you won't see a first date. These are the first questions she will find out from you before you go on a date. What do you do for a living ? American women want to know if you have earning potential and can support a family. This is no different anywhere else in the world. The most important facts you can find out about the woman is "who they are" and "how they were raised".

If there is any woman on this forum that married and supports their husband, I would like to hear from them. If there is, could you say they married only for good sex??? Everybody wants something out of a relationship but sometimes people care mostly about love and family. Let's not judge all but it is the case of buyer beware.

I married and support my husband. He's in college to become a nurse, and I'm supporting our family (now of four--we've had two children since he moved here).

K-1 Fiance(e) Visa Process & ProceduresLong term unemployed and affidavit of support
The challenge you face is convincing the consulate that your intended will not become a public charge. If you have new employment, a combination of your assets and your income will quite possibly be enough. Make sure your employer writes a letter stating your salary, the permanence of your position, etc. Congrats on the new job, and good luck!

LOL calling your fiance/fiancee 'hubby/wifey' is fine. I call him like that on fb and you know what? I just got approved at the interview.

As we see here on VJ pretty regularly, what's "fine" in some countries is a major problem in others. Just because you were approved while using the improper terms on FB doesn't mean others from higher-fraud countries will have the same success.

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List
I think I've read too much and am now just confusing myself... But I figured it would be worthwhile to check before sending!

My fiance and I are sending in our packet this week, and are including several forms of evidence:

Passport stamps (7 trips to the UK for me, 1 trip to the U.S. for him)
Boarding passes/itineraries
ATM receipts with corresponding bank statements
Apartment deposit/contract in Birmingham
Photos with corresponding ticket stubs (London Eye, Cleveland Indians game, Rock and Roll Hall of Fame)

I'm seriously hoping that this is enough evidence, but here is my question--do I need to send in the originals, or can I send copies of everything? My concern is that I will send in the originals and then the package will be lost (since I'm sending it from the UK).

Any suggestions/recommendations would be greatly appreciated!

K-1 Fiance(e) Visa Process & ProceduresScared about flight!!
I have just booked a ticket to fly out to the States for 2 weeks as a supprise for my fiance's birthday.

However, we are in the process of the K1 visa.

I have never overstayed on the VWP, and it will be 11 months since my last entry when I arrive, so I am definately covered by the VWP.

Will there be a problem with me getting through checks because of my impending visa?

At the time I won't have a job, and live with my parents, so it's hard to provide proof of intent to return other than our obvious efforts to do things 'by the book' by applying for the K-1 visa.

Our visa is at a standstill at the moment while we wait on a copy of my fiance's birth certificate. There was a problem with obtaining it but we expect to have it sent off to NSC within the next 2 weeks. The flight is booked for 21st March; from Birmingham UK to Newark and then on to Oregon (though I've allowed a good 7 hours between flights in case of complications!). I do have a return ticket.

I'm just worrying now about being turned away!!!

K-1 Fiance(e) Visa Process & ProceduresTo mention the internet or not to mention?
Your answer seems about right. I've heard the less detail you give, the less chance of it looking suss. I wrote something like 'met online in 2002, met in person in 2005' and that's it.

There's nothing wrong with meeting online, if they dig deeper with us they'll find we met playing an online video game, I'd rather admit to a chatroom relationship than tell strangers we played Everquest together!!!!

Don't worry about it. He's from the UK, it's not like many people here are desperate enough to marry just to get over there ;).

K-1 Fiance(e) Visa Process & ProceduresRFE received :(
We had an RFE because we sent a short form birth certificate for my fiance (I told him 20 times it was the wrong kind but he swore it has been used for everything he's ever done, military, schools, passport etcetc). We got another one after a lot of messing around, and then they didn't get our first RFE, my fiance called them and we sent it again, 3 days after they got it we got NOA2.

It seems that generally you get approved quickly after they get your RFE.

K-1 Fiance(e) Visa Process & Procedurestravel to the US
I don't think they even know your K1 status when you are at the POE for a visit, btw. I went a few weeks ago through Newark. Very friendly guy. Asked my purpose of travel (vacation) stamped, photo, prints, 'have a good vacation Lottie'.

If they say 'what is your reason for travel' just say 'vacation' (true). The less details you give the less they have to pick on. In my opinion so long as you tell the truth and embelish as little as possible there shouldn't be a problem (unless you've spent too much time in the US in the past 12 months).

K-1 Fiance(e) Visa Process & Proceduresthis makes no sence
Treat them as if they're six year olds. When my fiance phoned up to ask if they had our RFE the woman he spoke to say they 'maybe had' and that he should send it again 'just in case'. He was worried we would miss the deadline on the RFE because we had been waiting so long to hear if they had got it, she waved the deadline away as meaningless. Loads of people have RFE's for things they've already sent. All you can do is resend the passport photocopy, send the evidence of meeting again and perhaps include a couple more things.

If it helps, I only sent a copy of the page in my passport with US stamps on, 2 photos of us together and some boarding pass stubs as evidence we met. I did send some envelopes from letters postmarked over the past couple of years with both of our addresses on (I sent ones with return address on front and postmarks clear) and a screenshot of my email inbox (with emails pretty much every day from my fiance for the past 4 years!), but I don't think this evidence of an ongoing relationship is needed until your interview.

I remember that thread too. The gentleman was awfully rude but they had messed him about so bloody much!!!

Thanks for decoding my plea for a listening ear! For me, I have a difficult time with the lack of equality in our government services. I am sure if I got a response to my case less than the quoted time frame, there would be no need for me to vent my frustrations. Understand, people that filed after me (ie: July 08) are now getting their NOA2s. I feel as if someone cut in front of me without asking! I'm a practical person that likes practical solutions. star_smile.gif Instead of cleaning the spider webs, you have to collect and rid yourself of the spiders!

If it makes you feel any better, no July filers have been approved at CSC--just a handful of early June. There are still a number of outstanding May applications as well. So hopefully you'll be approved any day now--wishing you luck!!!

That doesn't make sense... Why would a government agency be affected by a party event? The Democratic Convention has nothing to do with USCIS--it's run and controlled by the Democratic Party, not the U.S. government. Labor Day is a real "stopper" event, but I can't imagine them taking time off for a party event in DENVER. Hopefully this is another example of misinformation!!!

We're actually going on vacation to Disney World September 13th, so I'm actually more excited about that, and hardly thinking about the NOA2.

It will come soon enough! I feel like the last couple of months have already gone by really fast.

Stay positive everyone!

Ooh that sounds fun! Are you going to go to all the parks? Are you staying at "the World" or off-site? I haven't been to Disney for years, and have been wanting to head back recently!

I've decided to heed your advice and be patient and positive about the whole thing. You're right--the past couple of months HAVE gone quickly, and I should keep that in mind. I'm also trying to remind myself that the earliest Spurs could possibly be here is December/January due to work obligations, so stressing about CSC approval right now does me no good at all.

So thanks, SapphireDreams--and I hope you have an excellent vacation!!!!!

I hate how moody and emotionally unstable I'm becoming during this process. Some days it feels like this is never, ever, ever going to be done and we are never going to be together. I am miserable being apart from Spurs, and I just want this to be over. Occasionally I think I should stop coming to VJ and checking out Igor's list, since seeing the lack of approvals really gets me down. I find myself wanting to send snappy emails to people who have posted about being approved but not updated their VJ timelines (thus keeping us down one spot on Igor's List--one spot!), even though I know that it makes no difference to when we'll actually be approved. Other times, I just figure misery loves company and, when I see approvals, I see the light at the end of the tunnel.

I just wish CSC would start approving May filers already--then at least we'd be next!!!

I'm lucky enough to have developed a love affair with the good guys in Claret and Blue (all hail MON) after the owner of my American football team bought the club, but my fiance unfortunately grew up in North London and thus is a died-in-the-wool Spurs fan. Our friends keep laughing at our "mixed marriage," particularly as we each keep trying to sneak our team colors into the wedding plans. Hey guys, we technically belong here since our NOA 1 date is June 30th yes.gif

One thing we are kinda frustrated about is trying to plan a date for the wedding. Since the whole process could take as little as 5 or as long as 8 months, how can you plan? Does anyone else have this problem? I mean of course we could wait til like the interview to start planning but its hard to plan a wedding in a short amout of time especially with making reservations, etc. And isn't it true that the visa is only good for 4 months from when the USCIS approves it? We want to get married ASAP but we don't want to set a date and then the visa not be ready by then. sad.gif

We're facing the same frustrations... I'm a teacher and thus can't take time off during the school year, and tickets for my fiance's family to fly over from June-August are exorbitantly expensive so we don't want to ask them to do that. As such, we're keeping our fingers crossed that this will all be sorted in time for a March 21 wedding, with the recognition that that date might not work out. If it doesn't, we're going to have to wait until late fall/winter for an "official" wedding celebration. Either way, we're planning to be married in a legal ceremony as soon as the visa comes through.

It's amazing how quickly my emotions change with this process; one day, I'll look on Visa Journey and feel like we're in really good shape, but then the next I'll be convinced that we'll never be able to live in the same place for longer than a few months. The latter days are becoming more common as I get closer to being apart again--I have to fly home in a couple of weeks (we've spent the summer together in England, but the new term starts in mid-August), so we're facing separation again after the luxury of 3.5 months together. It's going to be really, really hard.

Hi all,

I finally mailed in my I-129F application and the assorted materials... On one hand, it feels great to have this off my plate--it's going via some crazy expensive UK courier so it is guaranteed to be there by Monday (and will be signed for, thanks to advice I've read here on VJ!), so at least the process is underway. At the same time, a small part of me is convinced that something is going to go horribly awry and we'll be stuck in USCIS hell for years upon years. Ack.

Thus, I thought the best thing to do is start a thread for other June filers--I like reading through the other months, and it seems like people find good support/advice on here during the process.

Anyway, good luck to all of you!!!
