No problem, My wife passed the naturalization test Oct. 22nd 2009 and the immigration offical told her to, just stay and take the oath that afternoon, then go home and have your name changed to anything you want. That is what we did! Her first name remained the same, her last name ws changed to my family name and she changed her middle name to her Filipino family name. Her nanay and tatay was happy about that! Total cost 18$, time was about one hour at the county court house. Then she got her American passport with her American/Filipina name. God is good! Oh yes, out two boy,s middle name is her Filipina family name. Filipino family is grateful.

Neither of those documents are required by the Catholic Church for marriage. They want Baptism and Confirmation. Not MC and ROMA.

FYI-The Consular reports are sent to the DFA quarterly. From the DFA, they are sent to the CRG. Then to the NSO. A process that takes at least six months ;)

We married in Alabama June, 22 2004 and remarried in Bislig, surigao del sur in Dec. 28, 2006. Had no such problems. My wife took to the philippines our copy of our marriage in U. S. A. AND a copy of the report of marriage to a foreigner abroad that we filed with the Philippne Embassy in Washington D. C. I think that is what you have yet to do. That document can be uploaded and filed via mail with the Philippine Embassy in Washington, D. C. or with the closest Philippine countsulors office to you residence. It takes about two weeks ans is relative inexpensive. The embassy then registers you legal marriage in the Philippines for you. K-1 Fiance(e) Visa Process & ProceduresShould we file a K-1 or marry and file a K-3?

Here's our situation:

He's the USC, I'm the foreigner (Canada). He's in Texas for the next 5 years.

We aren't sure which route to go, because we have sketchy Primary Evidence and are worried that we won't have enough proof of relationship. If we get an RFE, we'll be pooched because we don't have any more than what we can send with the I-129F.

When we met (here, then in KY and then up here) he drove up to Canada, and I took a bus down to see him. No airplane tickets, boarding passes, or passport stamps, because neither of us have passports (we used Birth Certs and Photo ID to cross the border).

Which means we have precious little PE: a few ATM receipts from when he was here, and a receipt or two from when he got gas up here.

We have a ton of Secondary Evidence: lots of photos from two different occasions, credit card bills showing transactions taking place in his hometown and his credit card use in my hometown, affidavit notarized saying we were together in person in X place at Y date, phone bills spanning months showing calls to one another.

But I understand that with little PE, we will probably get a RFE and we will be stuck because we don't have any extra evidence to send along.


Our other option is to wait until Christmas when his family flies him up to KY, then have him come accross the border, and get married. Then we don't need to worry about 'proof' because we'll have the Marriage Certificate, and it would be 'reliable'.

But everything I've read on here suggests that the K-3 takes even longer than the K-1 to go through.

So here is my question: Do we file a K-1 because it's faster, or a K-3 because it's more reliable?


I'm also unclear as to how long the timeline is (yes, I've looked at the Processing Times) from when you file the 1-129F and when you can see and marry your fiance. Can anyone give me a ballpark?

When I filed a I-129 petition for a K1 visa all I had for proof was three photos of us together, a copy of my passport visa and hotel printout of paid bills. We are now married and Rose has her permanent green card. We were as worried as you. Be honest and all will work out. I only wish that we had married in the Philippines because the clock starts to run on your ability to receive a PGC from the date of your marriage. That is the only advantage of a K3 as compared to a K1.

Firstly, sorry to hear your news HA. Must be a shock.

I wish everyone would remember there's 2 sides to every story though. This poor guy's been hung, drawn and quartered by a few on here for dropping this bombshell on HA. Maybe his timing was off, maybe he handled it wrong, but I'm sure he had his reasons and we've only heard HA's side.

HA - I presume yesterday you loved and cared for him and he was your husband. Today you want to kill him and he's a loser. If you didn't feel love and care for him, maybe it was you who was faking, as well as him? Anger is one part of a grieving process and I hope it's just one stage you will go through.

He didn't forecfully MAKE you go to or even stay England, so I don't see how you can throw that in his face. As I said in posts before, if you were that unhappy, why didn't you leave?

I'm not trying to be negative, it just gets to me when people can call others every name under the sun when they don't even know the circumstances. I know the words are said in support for HA, but please guys, name calling??

Frankly, the circumstances don't really matter as SHE is the one coming to us for support. Perhaps if he were on this forum and we'd gotten to know HIM, we might be a little less forthright about our direct support for HA. But no... we've come to know Homesick American through her posts on this forum. Why on EARTH would you want to throw little jabs like "He didn't forecfully MAKE you go to or even stay England, so I don't see how you can throw that in his face" when she is in such obvious distress and faced with a tremendous challenge in the coming days. Sheesh. Is it SO hard to give someone support without all these little nitpicky questions second-guessing what they might have done or didn't do wrong in their relationship?
HA... take the support you find here and find whatever solace in them that you can. How do you go about getting your Police Certificate? Do you just go to the local station and request it? My fiance leaves here (Alabama) to go back to Ireland (Belfast) on Tuesday and he's going to go ahead and get the ball rolling to get his. I'd hate for them to give him the wrong form! We didn't even KNOW about a Police Certificate until a couple of days ago when someone mentioned it to us, so any advice about how to get one would be appreciated!
Also, he has only had one "run-in" with the law and that was last year. He was arrested for a mail-fraude type of offense (an Ebay deal gone bad), but they only questioned him and then charges were dropped. He was home within two hours and the police said it wouldn't be on his criminal record. If it IS on his Police Certificate tho, is this something we should be concerned about since he WAS actually arrested although charges were dropped????

I'm surprised to hear that everyone has had such a positive experience with Atlanta Immigration. The several times my fiance has been over (he flies in from Gatwick, usually on Delta), Immigration has been HARSH. The last time he came, I'd been waiting for him to come out for about 3 hours in baggage claim after his flight had arrived. My cell phone rang and it was an Immigration officer who started asking me LOADS of questions. I was soooo nervous when I answered... I was caught quite off guard because I'd never heard of them CALLING before. I stumbled over my answers and thought for sure they'd deny him entry. But they let him through, thank goodness! But it was so stressful each time, that we decided to not risk a visit here until the visa is approved.
I live in Birmingham, Alabama, by the way. I visit Atlanta quite often... I bought my car there, a Mini Cooper, and have to drive all the way to Atlanta to have it serviced. Maybe we should plan a get-together with Brit/American couples in the vicinity when we all finally get our fiance/es here! :)

Sorry, can't resist the temptation to add a little Welsh representation. Although I grew up in England Cardiff is my home now and i'm sure i will miss it when i move to the US - we have a word here called hiraeth - it kind of means 'longing' in English and something all Welsh expats experience apparantly! I have also lived in Sussex, Somerset, Leicester, Leeds and Newcastle, but met my fiance here in Cardiff.

I've always though it must be especially frustrating for all you guys from N.Ireland in particular to have to travel to London twice for medical and interview. How long does it take you to get there?


It is indeed a pain in the #######, in that it's two extra plane tickets. :( The time thing isn't that bad as it's not a long flight obviously, but the expenses add up soooo quickly. This whole process is ridiculously expensive as it is. I don't know WHY they can't have something set up in Belfast so that all this travel back and forth to London isn't necessary. Arrrrghhhh!!!!

MBE= Mysterious Brown Envelope. NOT TO BE OPENED. If you open it, you have to send it back to have it officially "resealed". There have been suggestions for the consulate to stamp a big red "DO NOT OPEN" on the front of the envelope, but apparently, they print only a tiny little warning on it that is often missed by the over-exuberant receiver. :P

Even people who KNOW about the MBE have found themselves sitting there, glassy eyed, staring blankly into the contents of the envelope they knew better than to open, but did anyway. Makes one wonder if there isn't some sort of wee device planted inside that lulls the receiver into a hazy stupor, subliminally telling them to "open... open the envelope...." in a last-ditch effort to stretch out the k-1 visa process as much as humanly possible. :lol:

Yes, the form we linked to is the correct form. Stephen double checked with the local Police Station and they assured us it was the correct one. If you followed the instructions they gave, then you're good I'm sure.
And no, our application process is not moving fast at all. sad.gif We're coming up on day 117 since our NOA1 and we haven't had any inclination at all that our application has even been assigned yet. So very frustrating. But hopefully things will pick up and start moving again soon. Best of luck to you! I'll check in and stalk your timeline to see how things are going!

I'm hoping someone can advise us. My fiance, who is in Northern Ireland, is in a bit of a panic. He thinks he ordered his police certificate from the wrong place. He downloaded the one from VJ for the UK and sent it in. He got it back this morning and looked at it and said something to the effect of he had no criminal record in London or surrounding areas, but for other areas, he'd have to fill out a regional form. This was apparently a national form he'd filled out. So this isn't the right one is it? He needs to get a regional from Northern Ireland, isn't that right?

Our case was mailed to the Embassy at the beginning of this week. My fiance and I have already downloaded and filled out all the Packet 3 forms (thanks to some VERY helpful VJ'ers!). My question is, now that we have our LND number, can we go ahead and send Packet 3 to the Consulate? Or do we have to wait until verification that they've received our case at the Consulate? And can I find that out by calling the State Dept?

Wow! It's been great reading these stories! Hopefully this will be an ongoing thread...

Stephen and I met at an online poker site (before the bastards in Congress made it illegal). They had a little section on there where members could post a picture and tell a little about themselves. They also had a "guestbook" where visitors to your page could post a comment. Stephen posted a ridiculous comment and I posted back in his guestbook. We started playing some games together (he kicked my ####### regularly) and after several months of growing closer via yahoo messenger and phone calls, we decided to meet up in person for a poker adventure in Tunica, Mississippi. It was a SPECTACULAR trip and what made it so great was... we barely found time to play much poker at all. laughing.gif
Now, two years later, he's here in Alabama from Northern Ireland and we're enjoying our life together very, very much. heart.gif
