K-1 Fiance(e) Visa Case Filing and Progress ReportsSooo nervous!!

My fiance has his interview in London tomorrow morning. I'm dying of nervousness. We have waited forever to get this interview and it decides our whole future. We've been engaged 4 years now, since we are 21, visited multiple times to each others countries, etc but I can't help but be scared. Can anyone tell me the percentage of fiance visas that are approved from the UK?

*since we were 21

Going by your timeline, you guys have had a loooong wait!!

Congrats and all the best! Finally over smile.png

We did have a long wait. Bad luck mostly, paperwork got lost which delayed us and then my fiance's house caught on fire so he had to miss his June interview date.

Sorry you're in AP! I've seen your recent post though and it looked like you were approved and just waiting for your passport to get back to you. Were you told you were approved at the interview?

IR-1 / CR-1 Spouse Visa Process & ProceduresAnyone ever used a co sponsor?
Hey Everyone!!
Hoping I can get some advice. My fiance and I both met when we were students in London in 08. And long story short we plan on getting married this Christmas. We both just graduated, and although I'm a nanny I don't make enough to sponsor, but my parents are willing to co sponsor. My father just received a pay raise about 2 months ago, and now he makes enough to qualify under the 125% rule. The problem is, on the tax form we would send with the Affadavit of Support might not show that he makes over the require 37,000 (I have a younger brother and sister, this makes my father's dependents as five, and then six with my fiance). Basically, what should we do? I know we have to send the tax paper but can we send further proof that he makes more? Such as pay stubs or a letter from his employer? Thanks a bunch!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresJoint Sponsor and Sponsorship questions...
We're in the exact same boat! We even have British husbands (well, soon to be husband for me). I'm not sure about the other stuff but I know for you to be the primary sponsor for your husband you have to make close to 19,000 dollars a year. I myself am a nanny, so my dad is being the co sponsor for us. Being young and not having much work/work experience kind of puts us in a tougher place than older petitioners. Good luck!

Guess I spoke to soon about not hearing from the post office. I just checked and found this:

You may arrange redelivery by visiting <a href="https://www.usps.com.../redelivery</a> or calling 800-ASK-USPS, or may pick up the item at the Post Office indicated on the notice. K-1 Fiance(e) Visa Process & ProceduresHow did you mail your petition?
Hey everyone! Firstly, this is a great and really helpful resource. Thank god for VisaJourney.
Anyway, so I mailed my K1 petition on Monday, April 30th. I filled out a postal money order but didn't put an address for the US Department of Homeland Security. Just made it out to them and put my name and address under the "From" section. So I stuck that in my envelope and the had my package sent priority mail certified to the PO box address. Anyone else ever done that? What kind of experience did you have with mailing? I'm hoping it wont be a problem to get it signed for since I sent it to a PO box. It didn't even occur to me at the time. I know that priority/certified mail can't be tracked, but when I checked online it hadn't said anything other than it being sorted at my local post office. It said it should arrive May 2nd (today) and that's it. It doesn't say if it's arrived or anything. Talk about confusing. Can anyone help clear that up for me? Also, was it ok for me to leave the address section blank on the money order? Thanks guys! :)

Also, I noticed that the zip code says "75222" when on my certified mail receipt it says it was meant to be delivered to zip code 75266. What's up with that? Any comments are much appreciated.

K-1 Fiance(e) Visa Process & ProceduresSo is this my NOA1?
I got this email at 1:30 am. Weird time right? Is this my NOA1?
Dear Applicant/Petitioner:

Your USCIS application/petition has been received and routed to the Vermont Service Center for processing. K-1 Fiance(e) Visa Process & ProceduresQuestions on a few dates
Ok well I received my hard copy of my NOA1 on Friday I think. The paper has two different dates and I'm wondering which one is my NOA1 date. The notice date says May 07, but the received date says May 03. Also, regarding whether an application has been "touched"- when I go on the USCIS website, onto my account and under "portfolio" there is a section that gives the receipt number, email alert options etc. Then there is a section that says "last updated". Under "last updated" it says 05/09. Is this a touched date? Thanks everyone!

K-1 Fiance(e) Visa Process & ProceduresSponsor for AOS

Are you talking about Affidavit of support for the visa interview or AOS for adjustment of status. They require two different forms and are two different things.

I'd like information on both actually. Kind of confused about the whole thing. Are past three years taxes mandatory? I thought I saw on some paper somewhere that it was optional.

I am very lucky to have a father who is willing and able to be the co sponsor for my fiance's visa. I myself am a nanny and don't make enough to qualify as my fiance's sponsor. I was wondering, when we get around to submitting financial stuff for the AOS, do I submit my tax returns as well, or just my dad's? Thanks!

K-1 Fiance(e) Visa Process & ProceduresCould really use some help!
Hey everyone!
Just a couple of quick questions. My father is being our co sponsor for our K1 and although he makes enough hourly to qualify to be sponsor, he also gets paid double his hourly for over time. The thing is, over time is not a set amount of time. In regards to the employment letter, what should be listed as a salary? How could overtime even be included when it varies week to week? Also, how many tax receipts are required? Anyone have an official link to this stuff?
Thanks!

K-1 Fiance(e) Visa Process & ProceduresA question about dependents.
Hi everyone!
My parents are going to be co sponsoring my petition for my fiances visa. My sister is 22 years old and is not claimed on my parents tax returns. She kind of floats in and out of the house and has for years, though she has used our address for mail, etc. She is talking about moving out, so I was wondering how this effects the poverty line for our petition. I'm pretty sure they make enough even if she was included in the poverty line, but if they don't, does not having her on the taxes make a difference?
Thanks everyone.

K-1 Fiance(e) Visa Process & ProceduresDoes anyone know...
Does anyone know if it is ok for me to just send a w2 to my fiance for his visa interview (along with the I 134 of course) I didn't file taxes this year because I didn't make enough. My dad is cosigning for us so of course we are going to send his tax return transcripts and a few pay stubs. I also can get a letter from the couple I work for (I am a nanny) stating that I work for them for how much I work a week. Is there anything else I'm missing?
Thanks guys!

Ok so I'm expecting to get my NOA2 pretty soon. What supporting documents do I need after that? My dad is our co sponsor so do I need to send both of our tax returns/w2s? I didn't file taxes last year because I made less than 3000 dollars so is it ok if I just send a w2? Any other documents I should send?
Thanks everyone.

K-1 Fiance(e) Visa Process & ProceduresIs this ok?
I'm not going to file taxes because I made less than the $9,750 threshold for a single person required to file. Would I be alright attaching a letter stating how much I did make (4000)instead of attaching taxes? My father is joint sponsor so we are covered in the financial department. Thanks!

US Embassy and Consulate DiscussionPacket 3 Preparation
Hello

I am expecting to be processed soon and would like to start preparing. I am wondering if, once we have a case reference number from NVC, whether we can download the Packet 3 documentation from the (Bangkok) embassy, prepare all requirements including police report and medical, and submit them to the embassy? Can this be done before my fiancee actually receives the Packet 3 by regular mail from the embassy so as to get in the queue for an interview faster?

Thank you.

1. since the question doesn't apply to your fiancee, use NONE.

2. if you meet the poverty guideline then you don't need to provide anymore info.

3. Check No and write down " I will support "name of fiance(e) as my spouse"

4. sorry, can't help you with this question..

US Embassy and Consulate DiscussionI-134 Questions
I have several questions:

(1) On the I-134, item (3), how do I answer questions like the name of my fiancee's spouse (obviously she has no spouse), do I leave it blank or say "none"? (and similarly for the question regarding children names (there are none)?;

(2) On the I-134, item (7), if my salary is more than adequate to qualify, do I need to divulge additional finacial net worth information such as savings account balances, stocks and bond investments, etc?;

(3) On the I-134, item (11), how do I answer the question regarding whether I "intend to make specific contributions to the support of the person" in terms of the "exact nature and duration of the contributions"?;

(4) Does my fiancee really have to hear from the embassy directly first before she can submit the packet 3 checklist and required documents and get an interview date/time or does one get a State Department case number from the NVC upon forwarding to the embassy that would allow her to submit preemptively?

Thank you for your help, I really don't want to make a mistake on the I-134

US Embassy and Consulate DiscussionK1 Vaccinations Thailand
Can anyone ell me what the policy in Thailand is regarding vaccinations? My fiancee went to Bumrungrad Hospital today for her physical and the physician said 2 vaccinations were required at the embassy (rubella/mumps and pertussis). She had her first round today and the physician claims she has to return for 2 additional shots for one vaccine and 1 additional shot for the other. Is this necessary before she goes to the US where she can get them for free under my medical coverage? I paid 1,618 baht for the two vaccines today.

Thanks.

K-1 Fiance(e) Visa Case Filing and Progress ReportsUnderstanding IGOR'S list
Hi

Can someone please help me interpret IGOR's List? I see that the majority of the last 20 K-1 approvals from VSC have been for NOA1s received in the early to mid October range. Yet when I look at the main list of K-1 applicants, there are many applicants with NOA1s dating as far back as April. There are approximately 130-140 applicants with pre-October NOA1s. Any responses would be appreciated.

Best,

Congratulations!!!

I am in a similar situation as you (were!). I cannot track my case, the website does not recognize me, and I received my NOA1 roughly 4 months ago. Without recognition of my case number, I am unable to register my case as well. So I was wondering if USCIS will use my email address on the I-129F to inform me of approval? It is the only place I know that my email appears (without registration). Thanks for your help and again, congratulations.

Hi All

I have noticed that VSC is slowing down again after two strong weeks. Does anyone have any insight into what controls the dynamics?

Also, I noticed that 70% of the last 20 NOA2s were from NOA1 dates in November and December (one in very late October). Yet the queue of applicants with earlier NOA1s is still quite large. WHat is the interpretation of this?

Many thanks,

What is your problem dude?

This: "as a professor at a major state university, I am a public figure" Maybe in Binghamton, but it is no cause for an attitude outside academia. We all have put up with unnecessary and sometimes rude interrogations in overseas travel, and the imprecision with which USCIS does its work.

I am sure overseas travel is a frustration to most Americans, ever since the terrorist events in the last 2-3 years caused a further tightening of security. No doubt Nobel Prize winners experience the same treatment as the OP, even if he is a professor from one of New York's state universities. And everyone is tired, worn out, after flying from southeast Asia. Minneapolis/St Paul does not necessarily have the most courteous CBP staff, but their security track record is good. Get over it.

The various Senators can get quick answers, and if there is some extraordinary snafu affecting a person's case, perhaps they can see to it that the problem is corrected. Otherwise, they simply report back what they are told. There is a private online system with USCIS that enables a Senator to make a query and get an answer fairly quickly. There is no longer any need for an immigration staffer to use the phone unless there is some special circumstance that requires corrective action on the part of USCIS.

Finally, it is indeed disappointing to many of us that the USCIS online update system has been malfunctioning for so long. I took it as a well-intended effort by some prior USCIS agency head to improve customer relations. It ought to be shut down as it's not working. No doubt it was contracted out originally and still under some outsourcing contract. First-come first-serve is still the rule they follow, but petitions involving certain overseas countries bear watching due to incidences of fraud. They take a bit longer to check out.

I wonder what Professor OP teaches? I'm sure it is not current affairs.

K-1 Fiance(e) Visa Case Filing and Progress ReportsResponse from Senator's Immigration Director
Thank you all for your replies. First I would like to say that I disagree respectfully with the opinions that my case did not warrant involving my Senator. I would say this in counterpoint: (1) the USCIS explicitly states on their website that once we have a receipt number that we can check the status of our case online: I have never been able to do this (I even spoke with USCIS and they asked me if I would like to file a corrective action email to have my case entered online, the woman said it would take up to 30 days, that was over 60 days ago); (2) The USCIS explicitly states that they process applications in the order in which they receive them. With cases with NOA1s from December and January currently being processed, this claim clearly is not truthful (and this assumes that my case has not yet been given any attention). The USCIS and Department of State operate with near total insulation from us. The only probes we have are our congressional representatives. Someone has to hold these agencies accountable to the people they serve. There is much talk in the current new administration about more government accountability and I see no reason why that should not extend to our situations. I also recall the testimony on this website from the former USCIS adjudicator who worked at the NSC. He said congressional inquiries generally yielded prompt action. Once again, I am only trying to help myself, and I have a strong conviction reflected by what I said above. With regard to what my Senator's Deputy Immigration Director said, I quote:

"After numerous calls to get through to someone with hands-on authority over your case at the Vermont USCIS, I have learned that it is currently with an adjudicating officer. It has been there since February 26, 2009. This means it will be resolved within the next couple of weeks."

To me, her words have a measure of certainty to them, and that was why I was asking for feedback on whether she could really be so certain.

Regarding the interaction with the CPB at Minn/St Paul. I have no idea what would have provoked their interest in me, I think I was selected randomly for questioning as I came off the jetway. I don't think I am above suspicion but as a professor at a major state university, I am a public figure and would have a hard time running under the radar. It was kind of aggressive questioning and I was tired. There was no shouting but I wasn't in good humor and my responses became terse in reaction to the agent's tone. Then the incident with my luggage spilling out at the inspection table and my politely asking the inspector for his name and supervisor. If that put me over the CPB threshold and got me flagged at USCIS, I have no idea.

K-1 Fiance(e) Visa Case Filing and Progress ReportsResponse from Senator's Immigration Director
Hi

I have a couple of question and would really appreciate some feedback.

I got my NOA1 November 10. I recently emailed my Senator and asked for intervention because I have been waiting for 4.5 months now and I still get an error message when I enter my case number on the Status Check at the USCIS website. The Senator's immigration director made several inquiries and kept digging until she found out that my case has been with an adjudicator at VSC since February 26. She said that this means that I would get a decision within a couple of weeks. Does anyone have any sense about this statement, I of course want to believe her.

Also, I have been reading some threads about CBP and how they have impacted some petitions adversely when individuals were denied entry. I am not sure if this is relevant, but I had an unfriendly encounter with the customs people last summer when returning from visiting my fiancee in Thailand (I had not yet submitted the petition). I was walking off the jetway in Minn/St Paul to connect to NY after 20 hours of plane travel when an officer immediately called me over and asked to see my ticket and passport. A bunch of questions followed about my relationship and it was civil but not a friendly encounter. At some point in the questioning I revealed that I would be submitting a fiance visa petition. I was sent to the line where bags were opened and checked. This officer was also a real jerk and I almost came unglued when he threw all my stuff back into one of my bags and I didn't notice that he didn't zip it so when I lifted it off the table all the stuff spilled out on the floor. He just ignored what happened. I went up to him and asked him for his name. He was a real smart #### and I asked if I could speak with his supervisor. I talked to his supervisor who just smirked at me. I was exhausted but really upset, basically I encountered 3/3 jerks inside 30 minutes after arriving back in my own country, having just spent 2 months in Thailand with nothing but respectful pleasant interactions with people. So now I am really wondering if this incident or some untruthful rendering of it was passed on to USCIS and may now be prolonging my approval. Does anyone have an opinion?

Thanks in advance for your comments.

I received my NOA1 on Nov 10, 2008. I tried repeatedly to use the USCIS site to check the status of my case. I kept getting the following validation error message:

"Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance please call the National Customer Service Center at 1.800.375.5283."

I tried many times to get a human being on the customer service phone line and finally did last week (January 29, 2008). My call was escalated to the next level and a woman explained that they were behind in entering cases online. I said it has almost been 3 months! She asked whether I would like her to send an internal email for a request to enter my case. I said of course. She said it might take a month to get a response to the email. What is going on with the VSC? Does this imply that my case is going to take an inordinately long time to get processed?

Thanks. unsure.gif

K-1 Fiance(e) Visa Process & ProceduresUSCIS Status Check Is Not Recognizing MY NOA1 Receipt Number
Hi

I submitted a K1 visa petition to USCIS/VSC and received a NOA1 receipt dated November 10, 2008. When I go online to check the status, the USCIS website gives me the message:

"Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance please call the National Customer Service Center at 1.800.375.5283."

When I call the above number and enter my case number, the recording tells me that my number cannot be found.

I am very frustrated, particularly since I cannot seem to get a person on the phone with USCIS although they say real people are available to speak.

Thanks for any help,
Tim
