There is some information that suggests Manila Does not accept co-sponsors for a K-1 application.
The requirement as best I understand are, you must make 125% of the poverty level guidelines,
Assets value is divided by 5 (years) so a $10,000.00 income coupled with $100,000.00 in assets would grand total to $30,000.00.

The poverty guidelines can be found here:

do we really have to wait for 150 days before we get our interview schedule or our packet? oh thought it would be in january :(

no, thats not true..it should only take you a month or so

Unfortunately it is true, Manila is typically 3-5 months wait for interview. As to the packet, I think you should receive it in a month or so.

Can you scrape up the $300 in assets eg, personal property as someone else suggested? I think they will be strict about this.

Good luck!

I could be mistaken but I think the value of assets are divided by 5 for a spread of 5 years
so the actual asset value would have to be $1500.00

US Embassy and Consulate Discussion2006 income level

here is a question for you all I was laid off in 2006 for 5 months , so my income for 2006 was low , only 18000 my income for 2007 will be about 30000 should I write a statement explaining why my income for 2006 is so low or not? I won't have my w2s for 2006 before the interview so won't know the exact amount of income . Also I just started my current job the 2nd of Jan will this have any effect ?
Mark

Your timeline says your interview is 12 Feb, You should have your w-2s by 31 Jan.

I should of said that I won't have them by the time I send the information which I am sending the 26th but even if I have them your reply still doesn't answer the question
Mark

And you *have* to send these documents on the 26th? cant wait till the 1st? or any chance you might get your w-2's before the deadline? My reply does not answer the question for probably the same reason no one else has answered it. I'm not a consular officer, I don't know.

US Embassy and Consulate DiscussionK-1 Interview in Manila...APPROVED!!!

Good news from Manila....Churchita's K-1 visa was approved on Thursday, January 11, and she received the visas (K-1 for her and K-2 for her daughter) on Tuesday, January 16...we picked them up at the USE. I was there for her interview and I believe that definitely helped. Now we are in Chicago...just got her on 1/19/07. The interview at USE was challenging, and so was the POE experience at O'Hare in Chicago. But...we made it through everything and now we just have to plan our wedding date and then begin the AOS process.

Churchita's first experience with winter in Chicago was not a good one...she immediately slipped on some ice in front of our house and fell face forward...but she's ok. It just scared her and embarrassed her, too.

Thanks everyone for being so supportive, especially Trey and Roxy, who also were approved the same day as Churchita was.

To everyone who is still in the K-1 process...hang in there and be patient. Your time is coming, even though the waiting drives us crazy sometimes.

TimR

Congratulations!

US Embassy and Consulate Discussion134f manila embassy income requirements

Whether Manila uses 100 or 125% seems to be unconfirmed, but I'd work against making the 125% level for safety's sake. IMHO
Good Luck

Does it really matter if USE takes 100-percent level for I-134? You are gonna have to come up with the 125 for the I-864 in less than 3-months anyway when you adjust status

That is exactly what I meant, but I understand how one might misinterpret my verbage.

US Embassy and Consulate Discussion134f manila embassy income requirements

Poverty levels are established by the USCIS not the individual Embassies. It is 125% unless you ar emilitary, then it is 100%. Ken

Does anyone know if the US embassy in manila uses 100% or 125% of poverty level as an income guideline?
I know technically the 134f uses the pre 1997 i-864 guildelines which are 100% but I heard different embassies use different amounts.

Also, I have 2 children who don't live with me but are partial dependents. Is this counted as one full dependent in figuring the family size?

Thanks!

The poverty guidelines are established by the DHHS Dept of health and human services NOT USCIS. As to whether they go by the 100% or 125% level it is at the discretion of each embassy. The I-134 is not legally binding so the level associated with its qualifications are only relevant to those of us trying to make the grade. Its at AOS when the I-864 comes in to play and that the 125% level will surely be used. Whether Manila uses 100 or 125% seems to be unconfirmed, but I'd work against making the 125% level for safety's sake. IMHO
Good Luck

PS. about the kids...I'd like to know too. Your theory makes sense but since nothing else in this process makes sense...well you get the picture.

The I-134 is also used for other types of visas, that question applies to sponsorship of those.
I put something like " N/A this affadavit is submitted in conjunction with application for K-1 (fiancee) visa."

US Embassy and Consulate Discussionpre-interview notice from the embassy.

hello everyone!

i got hold of someone through call centers 3 times already since our case has been received by the embassy. i asked them if i am going to receive a letter (pre-interview notice) from the embassy but all that i talked to have the same answer. i will not get any notice or letter acknowledging my case. well, i had been reading posts here noticing that ,mostly everyone who have their case forwarded in manila received a pre-interview notice. mine has been received in manila february 20, until now i have not gotten anything from the embassy. is it alright if i dont have the pre-interview notice or do i have to let my fiance call the embassy and ask regarding this matter?

call center guys told me just to wait for my packet 4 which will be send 90-180 days at the most after manila embassy received the case. we are hoping that our case will be included on the may interviews.

btw, congratulations to those who got approved and have their visas on hand! all of us deserve to be happy. GOOD LUCK to everyone.

I expect you will get a pre interview letter, it took us near a month to get it. Good Luck

Hmm that is interesting that some people say co-sponsor is not allowed, while some say you can. Also a surrogate is allowed. So i can use my parents then? Well I just got my new job, and I shall make over 20,000 by her interview. I just hope they view my future potential earnings, and by then I should have about 8-10,000 in the bank. Of course my new problem is that makes seeing my sweety impossible now. Will one trip be enough to prove a bonafide relationship? I heard 2 or more is the norm.

Is it true that Manila no longer accepts co-sponsors for the K1 Visa? I had one of the lawyers I contacted tell me this. I averaged only $14,000 the past 3 years. Anyone know about this? Thanks so much!!!

I am in contact with someone, who has an attorney, and just filed using a co-sponser. I do not see where it should be different with you. PM me. I am an attorney here and will be getting into immigration law and have no problem doing free research for people as I learn about immigration law.

Your current earnings are more important than an average. Do you currently meet guidelines? If not, you can expect you will be denied the visa based on insufficient support. I have not heard of a single successful attempt to use a cosponsor for a K1 in Manila. I have heard of denials followed by a marriage in the Philippines and a new CR1/IR1 petition. They are willing to entertain the use of a cosponsor for the immigrant visa.

I do not know the solution to your problem but, there has in the recent past been posted about someone not using a CO sponsor but rather a surrogate (i think it was the posters mother or father) and having been successful. careful research will pay off. Good Luck

Hi friends,

I just thought I'd check in with an update as well as congratulate all those that have gotten interviews, visas, about to come to USA ro already here, etc, you all know who you are.

Fely and I are moving along at the NVC. I'm currently waiting for her to send me her DS-230 and other documents so that I can forward them on to the NVC and we can finish our case there. I've told her to look for a Fedex office, but she just says she'll go to Iba later this week and find an international shipper. If anyone has any suggestions on how she should go about shipping to me quickly I'd accept any help. Next week she plans to go to Manila to take her CFO seminar. I tried to tell her she really doesn't need to do it yet, but she seems to want to get it out of the way as well as get her passport name changed. After that she has a job turning beds at a resort for a month.

Well that's where we are. Later everyone.

Gary

hello gary, fely might want to try LBC? haven't tried it yet, but a friend of mine did and she said the service is excellent. documents could be delivered 2-3 days and fees are reasonable. it has many branches nationwide, im sure she could find one in zambales. hope this helps. GOD BLESS!

Yes LBC is good and they work with UPS, So a UPS man will likely deliver it here in the states,

Well....I guess I will throw in my two cents where its probably not needed. I have a hard time recommending that someone not be honest in any portion of the interview or medical. I could see not bringing up the fact of an abortion if its not asked about by medical staff, but I just don't agree with the blanket statement that you should never admit to having an abortion if you are asked.

Years later there may be no sign of the abortion, but I read a urine test for hormone HCG also remains positive for almost 4-6 weeks after abortion. So what if the girl has an abortion a month before her medical? Then she lies and says she has never been pregnant and never had an abortion. The urine test shows otherwise and she has now lied and would be denied for sure. What if, because an abortion is illegal in the Philippines, she went to a less than professional location to get the abortion and it left her with some scarring that is detected in a medical exam?

I don't know the right answer here. I am only throwing out another angle to facilitate the discussion. I just think if the question is not asked (which I think it probably is asked)....then its don't ask and don't tell. If it's asked....I would be honest. Why would they send someone to a psych eval if it's just the abortion in itself is a ground for denial. Maybe its not, so they need the psych just to make it legal....like a rubber stamp medical opinion to say the girl is a danger to others cuz she can harm the fetus?

We don't know all the facts of this girl's situation....or any other woman's situation in the future. For that reason I am reluctant to say you should never admit to an abortion. Never is a big word and an absolute.

Just an opinion.....and as such....subject to challenge and being proven wrong.

Scott

I'm no doctor but I expect the hormone levels would remain elevated for some time after a miscarriage as well as an abortion.

As to scarring, I dont think the exam is going to be quite so revealing and it would be very difficult to prove scarring was due to an abortion, DNC's are legal.

She has dealt with the fact that she did what she had to do and moved on. She is scared that they might not give her the visa. Can this keep her from getting her k-1??? We really need to tell her??

Thanks so much for your advise? :help:

I honestly have no clue, however I strongly suspect it is a formality. There could be a statistical correlation between abortions and mental illness for example.

make sure she does not tell the psychiatrist about the talking flowers... :jest:
