I dont think we quite get what you are asking, you want to be exempt from IMBRA? I want to be exempt from driving too fast but its the law...
I do not think there are "exemptions" ... did you meet through a international marriage broker? if so, you must answer questions pertaining to petitioners background. the IMBRA is to protect foreign beneficiaries from abusive spouses.
Shouldnt be a real problem, unless....

I'd vote for her to return to the province after the interview. There is no guarentee that the USE will release the visa immediately, and Delbros will deliver to the province (just takes a few days longer). Since it will be a few weeks before she comes to America anyway, there really is no point in staying in Manila. Just remember to give yourself enough time in Manila before ya'll leave to attend the CFO seminar and have the visa stamped. Whatever time she can spend with family before she finally departs will be precious for her, so she should take advantage of that.

Would you be able to tell me how I can help my fiancee get an Amended NSO Birth Certificate?

Her original Birth Certificate did not show her mother's name on it (the mother's information was not included). Her original Birth Certificate says, "Mother's Name: NOT OF RECORD." :hehe:

Her original NSO Birth Certificate shows the midwife's name at the bottom of the NSO Birth Certificate as "RHM" and the same person as her mother's name. :(

Because of these errors we had my fiancee's mother travel to the Local Civil Registry where my fiancee was born. With an Affidavit, Baptismal Certificate, and Marriage Contract in support, we were able to get a Supplemental Report showing my fiancee's mother's name, father's name, date, and place of birth--all listed correctly! :D

How may we get the NSO Birth Certificate to be Amended to include all of this information? :help:

We have the following original documents and copies to support our request:

Baptismal Certificate (showing mother's name on it),
Original Birth Certificate (mother "Not of Record"),
Original NSO Birth Certificate (midwife listed as mother),
Supplemental Report (all info is listed correctly),
Local Civil Registry letter (from June 2006) indicating the changes to the Supplemental Report are being sent to the NSO Office to be updated.
Mother's Affidavit, supporting the Supplemental Report,
Copy of my fiancee's Passport,
Copy of my fiancee's Postal ID.

Any help or advice would be greatly appreciated. :help:

Each consulate can ask for different things regardin finiancial support. However if you check the instructions on the I-134 you do not have to provide tax returns unless you are currently self employed.

You do need to provide

1. Letter from employer stating current earnings, whether you are part time, permanent or temporary.
2. Letter from bank showing date bank account opened, total deposits made in last year and current balance.


You can provide other evidence such as stocks, bonds, property etc to up your finiancial status but if you are well above the the poverty level you shouldnt have a problem

Thank you Dwar, but I had already checked the Manila Embassy and it says there that the I-134 should be accompanied by ITR. I'm thinking that its a moot point because the wait times in Manila are very long and will most likely be well beyond the first of the year, So I can wait and use My 2006 ITR

For the past 10 years or so I have been self employed (with the exception of this year) in 2005 Cheaper alternatives to my products and services becoming available practically put me out of business So 2005
was a VERY BAD year financially for me and of course my 2005 Income tax returns reflect this.
Near the end of 2005 I changed careers back to a previous trade and things are going smoothly, I make more than enough to meet the requirements set forth for Support of my fiancee, However If I show the 2005 ITR
the consulate may have a stroke due to laughter...I have not yet sent my 129F package...it is ready but for two documents in transit from Manila, I expect to mail it in a few days...Is there another way to prove income besides the ITR reflecting my current Salary or had I better hope that the I-134 is not needed until after Jan 1 07
at which time I will be able to file at my current pay scale?
Advice anyone?

A fiance visa, bypassing USCIS? I don't think so. I have never heard of this.

The forms are legitimate.

DS-156 = Nonimmigrant visa Application (filled out by the beneficiary)
DS-156-K = A rider, to the DS-156K (also filled out by the beneficiary)

These documents are usually included in "packet 3" from the Embassy or Consulate, after the I-129F application is approved by USCIS.

However, there are many other documents required to get the visa.

Suspicion is high on this end.

I have a friend who went to the Ukraine a few months ago to meet a woman. She agreed to marry him.

She has told him that her agency has told her that she can get a fiancee visa at the US embassy in Kiev, bypassing the system here. Today she emailed him two forms to fill out, DS-156 and DS-156K, "Non-Immigrant Fiancee Visa Application." I checked and found these forms on the US Department of State website.

Has anybody heard of or used these forms? Is what his woman says possible? I am wondering if it is some kind of scam.

Hello,

I wondered if anybody could help. A quick history of my situation: my wife-to-be lives in the US and I'm in the UK, I used the visitor visa/waiver to live with her for about a year (leaving every 90 days and spending a week or so in the UK before returning to the US). Obviously during this period I was unable to work as this is one of the restrictions of the visitor Visa. We applied for the K1 during my visit in March this year and I have been in the UK since the end of April. From May until now I have been doing some self-employed freelance work (web design) with customers from online freelance job-sites.

So, my question is this. How can I prove that I will not "become a public-charge"? I have no significant savings or funds. When I go to the United States I would like to continue working on a freelance/self-employed basis so I have no official "offer of employment". My freelance work has generated about £5,000 pounds in the last four months, but as I have only been doing it a short time I have no tax returns or similar official documents to prove my income. Would copies of my bank account statements showing the incoming payments be enough or will I need to get an affidavit of support?

Your income does not come into the equation, They wont even ask. It is your fiance the US citizen that will have to prove that her income is at minimum 125% of the poverty level for herself, you and any dependants, so she can support you. Your income cannot be figured into the total. Good Luck.

Hi, the delbros will send you two package ...

one plastic contain your passport - this is the one she COULD OPEN because you gonna need your passport at the airport and she should check it if there's any mistake or error in her information at her US visa attached in her passport.

the other package is like a dark yellow or light brown envelope which has cut in the right corner of the envelope that you could see all the documents you and her submitted at the start of the application. this SHOULD NOT BE OPEN, she gonna submit this at her POE - point of entry in US immigration. You could see a paper like note that t"this packet should not be open" then it really is because if she mistakingly open it, she needs to bring it back to US embassy in Manila to repacked it again.
