Hey all,

I have sort of a weird question here that I'd like to toss out there. I am completing my 2012 tax returns, and since I was a student 1/2 the year they look low. I am self-employed now, so I expect them to look heavily to my previous year's tax return. As it stands I am just below the cusp of 125% on my 2012 1040. Here's where it gets tricky...

In my time between graduation and full time work I was paid $1500 in cash to build a shed. I have no proof of this transaction since it was done in cash, and the guy obviously wasn't going to send me a 1099 if he wanted to pay me in cash. This is a substantial enough payment that I want to report it, and would also like to do so for the purposes of pushing my 1040 into the 125% requirement. However I am nervous that $1500 of undocumented income which just so happens to qualify me on the i-134 would look suspicious to a CO. Is there anyway they could question your tax return in this way? Do they have that discretion or am I losing my mind trying to guess their actions? The best that I can do to document this $1500 is show the cash deposit I made to the bank, but it was mixed in with other checks I deposited at the same time so it doesn't even show up as $1500.

If you've got experience with taxes or the I-134 please help!

COs generally do not ask for explanantions. The interview process is usually less than 2-3 minutes.

Fill out the I-134. Where it asks for income, state your total combined CURRENT GROSS INCOME from all sources (or whatever sources you want considered) and attach documentation of that. It matters not if you have 2 or 3 or 10 jobs.

Neither you nor your employer must state hours worked or days worked. Simply that you are employed as________________ and earn $XXXX per year. In fact you do not even need a letter from them, attaching recent check stubs will verify the income. You state your current annual income. The big job you just completed counts. If you did the I-134 TODAY add all the income to date for 2013, divide by two and multiply by 12...VOILA! Current annual income from self employment. Add that to the income from your job (whatever it is) and VOILA! Total current annual income. Attach copies of recent bank statements, hopefully you deposited the money...right? Though they do not need to match exactly, the bank deposits will serve to verify your statements.

This is not a court of law, you do not need evidence beyond a reasonable doubt. Just some verification of what you say.


Thanks, I know that this is generally how it works. That was exactly my plan up until two days ago when I was given a job offer- the question was really how can I most effectively point to the fact that my income will be increasing by a large margin since the purely freelance income of Jan/Feb flirts with the 125% line.

I have deposited all the $ and photocopied the checks for my own record.

Hi guys,

As I stated in my earlier posts I am currently working as a freelancer after getting downsized in December. I have taken peoples advice here and tried to make the self employment look as solid as possible, but now things have changed again. After completing a big job for one of my clients the other day the company offered me a job for 3 days a week and will let me keep my self employment going on the side, until June when I will work for them full time. This boss is fully aware of my visa situation, and that I will be going to attend the interview on March 12- so we have agreed to start 3 days a week at the end of March.

What I want to know now is how I can incorporate this into my i-134 case in the best way? I know that the contract is "future employment" while they are more interested in current earnings. Currently I am projecting 22k, but working 3 full days a week will put me at 27k plus the extra 10k or so that I could realistically count on from my other clients. The long term picture, written into the work agreement, is that come June I will be back up to a 45k full time position that I lost in December. Since I wont have regular employee paystubs for the interview, and only the job letter, what can I do to best demonstrate that my situation is improving? Do you think this changes how I should fill out the I-134, or must I stick strictly to the current rate of earnings? (even though things will be much better immediately following the interview)

Any advice on how to best tell this story is really appreciated- I am just hoping for a logical CO that sees it as it is, a recent graduate doing what he could in a transition period. However I am made very nervous by the fact that the i-864 abjudicating instructions include a clause that give the CO discretion to disregard employment when very recent...

Hello everyone after sending my package on April 12, it was delivered on April the 15.

I still haven't receive a NOA, does anybody knows where to check the status of a USPS money order?

I'm not sure about USPS money order but usually after they received the packet they cashed the check i n 5 days. They send the NOA the next day. I'm wondering why it take a week for the mail though. Should be 3 days only. And as soon as you receive your NOA you can check it online when you will get your Bio appt. I got my NOA 04/21 and they sent the Bio appt. the same day. Still waiting on the mail.

A couple things.. MichealOleasea and Edp333 it would help if you added your field office, and Madelyne, welcome to the April filers! Where did you file? Btw are you really from Bethlehem, PA? I am from PA too :)

Hi Everyone,

My GC will expire on April 02, 2011 and I'm starting to gather evidences for my ROC but I have some few questions that I wanted to know before sending it.

1. I'll be filing on Jan 02, 2011 but the Form I-751 available on the website expires on Dec. 2010.
Can I still use this form as I'll be sending my application at the 30th of Dec.?

2. Should my husband and I sign on the Form I-751 dated on Jan. 02 or is it okay to sign it the date we sent it?

3. Do I need to send a copy of my passport?

4. When I send a copy of our debit cards, do we need to send the back copy as well?

Our recent reminder went to our old address,too. I had read this before several times, so was expecting that would happen. The person who bought my house called us since it was delivered and not forwarded. We had also filed the proper AR-11 and I-865 well over a year ago. It does make you wonder why the ROC reminders don't tie in to a central immigrant address database.

It's funny that I mailed my application on 12/29/2010 and two days ago I received a reminder for my I-751 application from USCIS from my old address (which they forwarded on my new address) with a "Change of Address Card" form in it. I filed AR-11 Alien’s Change of Address online and mailed my husband change of address right after we moved on 2009. I received I-797C, Notice of Action a week after I mailed it. I'm just wondering why they don't update it. It's good thing I sent copies of AR-11 and I-797C on my application.

On June 10, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283."

Congratulations! Today, June 13, I also got the same e-mail from them! Card/Document Production :whistle: Looks like they are now moving at VSC. I hope they will process all applications 6 months as it stated when you check the case status.

Bummer. My biometrics appointment was also cancelled due to the weather. ASC never opened up and there was a sign on the door last night saying that if it hadn't opened by 8 am, they would be closed all day due to inclement weather. Called the 800 number in the morning and found out they were closed. They said that they'd send me a new notice but I'll just try and get it done on Monday by walking in.



Geez... I'm glad I had my biometrics done yesterday even though it was a long trip. I was so worried I couldn't make it because my husband who supposed to drive me in the ASC office got stuck in LA. I got lucky a good friend helped me out. It was very quick and the people were all friendly and helpful. I wish they should just consider applicants to go the next day when they open to have the Biometrics done rather than waiting for the new notice. Good decision to just try on Monday by walking in though ;)

I took it to the post office today, it's 4LBS actually! I copied all of our mortgage paperwork, 2 years of income tax, copies of utility bills, lots of envelopes/letters/cards addressed to both of us.... The more the better I think, rather than not enough and getting an RFE!


I kinda have thick files too so I put it in like a filing envelope with tabs in each page and sent it to USPS medium flat rate envelope.

I am hoping to send off our packet this week. Just assemblying everything and we should be good to go. I was wondering if everyone just does a cover sheet or is an outline explaining the various documents and pictures required as well? I didn't see anything about this in the assembly instructions. Not sure if pictures need to be dated, and a front page outline of all the evidence is required?


I did sent a cover sheet. I think it's proper to have it so they know what are the documents you sent (kinda like organized too). I also sent pictures printed in three copy papers and dated it as well. There's no harm on sending it if you have pictures of your husband and his family. Although it's not a primary evidence, it is also a a proof of you and your husband living together.

You should call the NVC when they forwarded your case at the USE then call the USE if they received it too. Once the USE received your case it won't take long to verify it then call them and ask for your PE and Appointment for Interview. Ask them to email you the Confirmation Letter because you need to show this during your PE at St. Lukes.

The girl I talked with at the USE Call Center said that they won't send packet for K-1 but can be downloaded at their website. I didn't know about their new procedure and good it's nice I called them. Also I was curious about the Delbros if all K-1 Applicants need to pay the Document Verification Fee a month after the interview but they said I should call the USE first before paying or I will refund the fee I deposited. So I called the USE again and the girl said that it depends on the Consul and if my documents need to be verified and it's okay to pay during the day of the interview and it won't cause any delay for the visa.

I'm one of those who are scheduled for April 22, 2008 Interview at USEM. I thought I should wait for my packet but it's good thing I called them and they informed me that I already have a schedule for Interview wow.gif The girl was so friendly and she emailed me my Confirmation number and Apoointment Letter so I can show it to the St. Lukes. She said I should have my PE one week before my interview. Now, I'm getting nervous.
