I would suggest you read through the guides prior to making any decision as to whether going the K1 or K3/CR-1 route.

As for your questions:

1) If your fiancee is holding a valid mutiple entry tourist visa, she can enter the US during the K1 process, keeping in my that everyone can be refused entry into the country. She should make sure that whenever she travels to the US to bring sufficient documents with her that show that she has strong ties to her home country and thus will return to the same.

2) As for the work permits, some POEs do 'stamp' a temporary work permit in the passport upon entry. However, this is usually only good for one month (anyone, please feel free to correct with regards to this time frame). Once you are married you will file for Adjustment of Status, including the work permit and Advance Parole.

Your case is *touched* when you see a new date in the column that says 'last update'. Touches don't necessarily mean anything. It can be that they just move your file to another box.

We have done quite a bit of research on this issue and talked to our real estate agent about it. As long as your status is not adjusted, you will most probably not be able to have your name either on the deed nor on the mortgage. This may vary from state to state. First of all, welcome to the forum.

In my opionion your fiancee will have to go through the US Embassy in Germany again, just like she did when applying for the tourist visa. Anyone who legally lives in a country other than their home country during the visa process has to go to the US Embassy where they currently reside.

I relocated to Bermuda several months ago (work-related relocation) and I'm going through the US Consulate here as well.

I completely understand your feelings.

Two individuals planning a future together is a challenge in itself and when they come from different countries/backgrounds things don't get easier. I'm sure that we all, at one point or another, when we have those bad days, think about what 'if things don't last'. I'm a firm believer, however, that whoever is going to such greath lengths like we do with the tedious visa process, we have a very special connection with our SOs. Because of the distance, we are forced to communicate better/more with our SOs than couples that can see each other whenever they want to.

In my case I believe that all the stresses of being apart and going through this visa process has made our relationship stronger. We talk a lot and have learned to communicate our deepest feelings, share our good and our bad days, discuss our future without any distractions.

Every relationship needs work, committment, love, understanding and the will to make things work. And you will. If you have bad days, even in the future once you and your SO are together, always remember the good times. How and why you fell in love. All the things you have in common. All the times you laughed together.

I'm a firm believer that everything will work out just fine if each person is willing to do their best. Believe in yourself, your SO and the love you share!!!

I assume with 'shipping things' you mean your fiance's personal belongings. If so, there is no restriction (at least not to my knowledge). I have started shipping clothes over to my fiance and I'm now planning to send other personal belongings over with a professional moving company. The value of the items needs to be declared on the documents and accordingly you/your fiance will have to pay customs. Don't worry about it. Your fiance will be alright shipping things over.

I'm not an expert when it comes to China, but I'm in a similar situation, hoping that my best friend from Egypt will be able to obtain a visa to attend our wedding. She was told that when applying for a tourist visa she should bring the wedding invitation (or document signed by me and my fiance confirming the wedding date), letter from employer, letter from the bank showing sufficient funds for traveling, any other documents as evidence for her ties to Egypt. Obviously, there is no guarantee that the visa is granted, but let's hope for the best.

I didn't mention anything when I went through immigration last month. I just filled out the regular forms. I had a ton of documents with just in case any questions came up. Everything went very smoothly. I would guess that they can see on their systems that you have a visa application pending because the officer went quiet for a little bit, looking at his screen. If the officer asks any questions, just answer them honestly and everything will be ok. Tell me about nerve-wrecking, my heart was beating like crazy since I had planned to pick out my wedding dress and take care of some more wedding preparations during my last trip.

Yes, you can still travel once you receive NOA2. The approval notice is valid for 4 months, so it should not be a big deal if you don't send Packet 3 back immediately.

If you should decide to travel to the US, take lots of documents with you proving your ties to your homecountry. I also took a copy of the petition along.

First of all, I hope that your fiancee is not hiding from her husband, but from her EX-husband, otherwise the K1 is the wrong way to go (as well as K3, CR-1, since both of you need to be free to marry).

The address on the G-325a needs to be a valid mailing address. It doesn't matter that it's your fiancee's friend's address. Since you don't have a timeline, I'm not sure at what stage in the process you are.

Usually you don't have to apply for a new passport when you're changing your address. It might be different in Ukraine, so I'd suggest your fiancee to contact the place where passports are issued.

From personal experience I can only recommend not to hire a lawyer. All they did was fill out forms and assembled our supporting information. The paralegal that was assigned to our case was unorganized and not very pro-active. I'd say she delayed the entire process for about a month.

Anyway, lesson learned and money wasted.

You can do it yourself. All you need to do is set some time aside to ensure everything's in order.

What about those lucky enought to get the ead stamp at port of entry? unsure.gif I know they are not garenteed and not all poes do them but you can work with one of those before you are married until the i 94 runs out can't you?.


Technically, yes. Practically, it's difficult to find an employer who will hire someone with a temporary work permit. So in theory if you enter the U.S. through JFK and are lucky enough to get the EAD stamp (valid until the I-94 expires), you will still have to find an employer, get married and file for AOS, EAD, etc. It's highly unlike that there is no gap between the expiring of the I-94 and receiving the EAD. The bottom line is that a work permit is not included in the K1.

Have a look at the timelines. Rather than choosing a visa based on 'speed', we considered some of the following before making a decision:

- Do we prefer being apart before we're married or once we're married?
- If going the K1-route, is it finacially feasible given that it takes a while to get a work permit?
- Do we want to start with the paperwork immediately or wait until we're married?

We opted for the K1 route. However, I'd suggest that every couple discusses the pros and cons of either visa after having all the facts together.

This sentence alone shows that you're already planning to get married. Entering under the VWP (visit visa) you'd be committing visa fraud under the circumstances described in your post. I would highly recommend that you look into filing for K1/K3/CR, etc.

You're a long way away from filing for US citizenship. Even if you got married during your next "visit", you'd first have to file for Adjustment of Status. Anyone here, please correct me if I'm wrong, but I think that the law currently says that you must have resided in the U.S. for at 5 years before being eligible for citizenship/naturalization.

I wouldn't worry too much about not having received NOA2 yet. I've seen from other March filers that Vermont has slowed down a bit after they moved at lightning speed during the first quarter of the 2008.

As for your concerns with regards to your attorney. I can only talk about our experience (we hired a lawyer and wish we hadn't). The attorney should've most probably included a cover letter. As far as I remember there is also a special of form that the lawyer has to include, citing that both the petitioner and the beneficiary are confirming the legal presentation through law firm XYZ. I am surprised to hear that no letters of intent were included. The worst that can happen is that you're getting an RFE for that. Then all you have to do is send Vermont the requested information.

In my opinion, since you have most probably paid a good amount of money for your attorney, I would consider terminating the legal representation if you receive an RFE. A qualified immigration lawyer should know what to include in a petition.

Don't stress to much at the moment. It's out of your hands. Wait until you hear anything from Vermont.

Like the other posters before said, no need to provide any details about a set wedding date, etc. At the same time it's pretty much impossible to set a wedding date when you're going through the K1 process. The visa can take anywhere from 3 months (that's extremely fast but does happen occasionally) to a couple of year (again, rare, but it does happen).

From personal experience I can only say that we did talk quite a bit about the wedding and everything that comes with it during the K1 process. We finalized everything that could be done without having a date, i.e. picked out invitations, bought the dress and tux, selected the music, etc. Now that we're almost there, I feel that this was a good thing to do, especially since we're planning a bit more of an elaborate wedding and there's just so much to consider. As well, we made a shortlist of wedding venues.

Don't stress too much. It'll all fall into place. It is possible to plan/have either a simple wedding or a more elaborate one during that 90-day window.

If you get married outside of the 90-day window (which is not advisable) she will be out of status. If you have doubts about getting married, I'd suggest the two of you spend some more time together before applying for the K1.

2. Would it be practical or advisable to time the K-1 visa application in conjunction with a tourist visa stay, or apply for another type of visa, to maximize her legal stay in the USA, prior to marriage.

As long as she doesn't she doesn't stay in the U.S. beyond the tourist visa validity and still spends the majority of a year in her home country you will be fine. However, there is always a chance to be turned down at POE if the IO believes that there's a possibility that she will stay in the U.S.

3. As much as practically possible we would like to keep the issue of legal immigration and building a life long marriage separate.

Again, I'd suggest the two of you spend some more time together to see whether you want to spend the rest of your lives together. There are no guarantees in life, but it may make you feel more comfortable if you have more time together before the wedding.

4. Keep the ability for her to travel to and from Chile to maintain her family ties.

She has to spend most of her time (per year) in Chile. On a tourist visa she will be able to travel back and forth (given that it's a multiple entry visa). Once she enters on a K1 visa she cannot leave the U.S. before she receives AP or you'll have to start all over with a spousal visa.

5. So she may better understand our culture she may like to take college classes, volunteer, or work if permitted, prior to our marriage. My income is sufficient for both of us during this process.

The K1 is not a work visa. You will apply for a work permit for a fiancee after the wedding along with AOS and AP. I'm not sure about college classes, but volunteering should be fine.

What are the best practical actions we should consider and/or take at this point and time? We would like a sufficient amount of time to see if our relationship is marriage worthy, and at the same time we like not to feel we are putting the cart before the horse with all the steps that we need to be taken with all the complicated immigration issues.

Please feel free to share any ideas, advise, or experiences to help us in our process.



Hope the answers above helped a bit. This process is quite confusing in the beginning and being away from your SO during that time doesn't make it easier. Take your time to make your decision. Once the visa is received, your fiancee will have 180 days to activate it / enter the U.S.

If you're more comfortable going through this process with the help of an attorney you should do so (my fiance felt the same way and we did hire a lawyer). I know we could've done it without their help. All they do is fill out the forms for you and put all the supporting docs (that you have to compile anyway and provide the lawyer with) in order. We chose a law firm by its reputation and proximity since my fiance found it easier to just run by their offices to drop off docs instead of mailing them. We are in the Atlanta area as well. PM me if you need more information.

Looking back at it, I wish we would've spent the money on something other than attorney fees.

Hi everyone,

My fiance and I are just getting started on the K1 process. I lived in several different countries (for more than 1 year) in the past year, one of them Egypt. Now I have to obtain a Police Certificate from Egypt or rather the Egyptian Embassy. I moved to Bermuda in July due to a new job. Egypt does not have any consular representation here. Therefore, I tried contacting the Egyptian Embassy in Washington D.C., but to no avail. None of their email addresses seem to work. I tried three different ones, and my emails bounced each time.

Can anyone help me with this issue. Is anyone out there who has been going through the same process and can tell me about his/her experience and whether it is possible at all to obtain this certificate under the circumstance mentioned above.

I'm sure other can give you more detailed information, but from reading your post I would suggest that you contact VSC and send them copies of the correspondence from the time you canceled the last petition. Mayb they can still reverse it. If not, I would either send the petition in again along with the said correspondence or contact a lawyer (i know...).

I'm not sure what kind of problems you had with the paperwork when sent in the petition the first time and I'm not sure if you want to disclose it, but this might help others to give you more detailed advice.
