Wow! That was a lot of reading - with a few sharp debates in the middle.

I apologize if I'm jumping in on anothers topic, but perhaps my situation could be an example for what you all are trying to explain. Or perhaps you might have some news to tell me about my situation.

I'm living/working in Ho Chi Minh City, Vietnam and have applied for a K-1 Visa. If/when the visa is granted we INTEND to move back to St. Louis and begin a new life. I still maintain a domicile (my parents home; my last residence before moving to Vietnam in 5/2005) in the United States (i.e. receive mail, do financial transactions through this address, vote, etc.).

I consider my living/working in Vietnam as temporary. Is the K-1 Visa the appropriate visa for our situation based on all of the information you all have shared and debated above?

Apologies in advance to Mr. Tig for jumping in on the tail end of your post! I just thought it was easier this way since everyone is gathered and shared on this post already.

I agree, travel agents are the way to go for international travel - unless of course you find an ubeatable deal on the internet (just read all the fine print). I live/work in Vietnam and use a travel agent to book my travel on Cathay Pacific.

I know in the case of Vietnam, a R/T ticket purchased in Vietnam is usually cheaper than a R/T originating in the United States.

If it makes you feel any better, I just read two other places, I'm sorry I already closed the pages and no history, to put N/A if applying for the K-1 visa. They said, like ziggy, that listing specific contributions was for temporary visas (i.e. student or tourist).

I'm going with the exact wording on the VisaJourney I-134 example form.

A fellow Vietnam member. I plan to put N/A in the section for Question 11. Follow the example form for this question and/or the post from zyggy. I think it fits appropriately. What the co-sponsor is really saying to the government, is that he/she is commited to ensuring the beneficiary will not become a public charge to the United States. My father is my co-sponsor and doesn't intend to give us any specific type of contribution. We'll make it on our own. It is just that my Vietnam salary at present puts us just above the poverty line for a household of two. So I'm preparing with a co-sponsor for a safety net.

Take this all in stride. Go with your gut feeling. Perhaps you justify it like this: your mom isn't intending on any specific contribution, but rather will certify that she will not let the situation lead into your fiancee becoming a public charge. Think of your mom as the guarantee on the car loan. You intend to make the payments for the car, but your mom co-signs to give the lender a little more assurance and/or someone to go after if you don't make the payments.

I'm going through the same process and consulate with you. Just food for thought!

I don't know if there is one exact way of completing this answer on the I-129F. I've read of many different petitioners having approached it many different ways and having success.

Our answer to question 18 wasn't anything long in length. It was a simple paragraph of 4 to 5 sentences stating the facts that I met my fiancee while I was working in Ho Chi Minh City. I wrote "See Attached Sheet" on the lines of the I-129F form and then attached a separate sheet, indicated the question being answered, and put my statement there. We had no trouble or RFE through the Nebraska Service Center.

I'm the USC and currently living/working in Ho Chi Minh City, Vietnam. I met my fiancee this way. I returned to the US for the Christmas holiday last year (Dec 2005), and that is when I sent the I-129F petition in. I didn't have any problem getting through USCIS, and so far it hasn't seemed to red flag anything at the US Consulate in HCMC. I'm sure I will just have to prove I still maintain a domicile (which I do) in the United States.

Here is an answer to a FAQ of that nature from the US Consulate website in HCMC. You might check your own embassy/consulate website to double check.

"Can I file a petition for any kind of visa for my fiancée/wife when I am here in Vietnam?

The fiancé(e) petition cannot be filed with oversea offices. The only petition that you may be able to file while you are in the country is spousal petition for her (Petition for Alien Relative, Form I-130). This petition can be filed with local CIS offices (Citizenship & Immigration Services). To be eligible to file an I-130 application with our DHS office in Ho Chi Minh City, you must establish that Vietnam is your place of residence, and that you have continuously resided in the country for a period of not less than one year with no more than thirty days accumulated absence during any calendar year.
"

Can anyone with experience requesting the bank letter through Bank of America elaborate on their experience? Did you obtain it at a local branch, over the phone or via bank mail on the internet? Were there any fees associated with the request?

I live/work in Vietnam for a private Vietnamese company (i.e. we don't have a USA office). In my situation I still have a domicile address in the United States (i.e. receive mail, vote absentee, etc). I put down the US domicile address on my I-129F form. I've read on the boards here that it is possible my fiancee might have to show proof of my domicile during the interview. In addition to that, they might raise a brow to my employment situation upon return to the USA with my fiancee (i.e. where will you work if your company doesn't have a USA office?). So far so good on our case though. We just received packet 3.

I haven't seen anything specific regarding domicile necessity regarding the K-1 visa. You might be safe and contact the consulate/embassy that your fiance(e) will interview at to clarify this further. Perhaps they will want some type of employment evidence showing you will be transferred back to a position in the United States.

Definition of domicile according to the Department of State website
: "place where a person has his or her principal residence. The person must intend to keep that residence for the foreseeable future. The sponsor of an immigrant must have domicile in the United States before the visa can be issued. This generally means that the sponsor must be living in the United States. In certain circumstances, however one can be considered to have a domicile while living temporarily living overseas."
