K-1 Fiance(e) Visa Process & ProceduresForm I-129F Question 18
We are currently filling in this form and have a query about question 18.

Describe the circumstances under which you met...

How much information do they want here? Do they just want a brief statement of how we met or do they require us to go into very specific details?

Do they need to know I am a dual national?(USA and UK) - the forms don't mention anything about it. I have been living and working in the UK - all my life but i am moving to the US to be closer to family and thus are applying for the K1 visa for my fiancee - do i need to go into all this detail saying why i have been in the UK?

thank you.

You will be challenged with both lack of US domicile (unless you maintained it) and financial support... The financial can be overcome with a joint/co-sponsor.

hi. what do you mean by maintaining US Domicile? does this mean I should move to the US first? like i say i have lived and worked in the UK but have citizenship through one of my parents. I have a US passport, SSN, and filed US tax returns...

You have never lived in the USA?

no - not for longer than 6 months at a time - never worked or went to school there

K-1 Fiance(e) Visa Process & ProceduresK1 Visa Information / Dual National / Living in UK
Hi I have a few questions regarding the K1 Visa process...

I recently got engaged to my girlfriend of 7 years. I'm a US citizen and dual national and living and working here in the UK. Due to the fact we are both living here together the situation is slightly different than if i was filing for the visa while in the US. Is it possible to file this while im in the UK?

I've read on the USCIS website how I need to provide evidence of how I can financially support my fiancee (Form I-134). As im working over here all my income is foreign earned - does this income count towards this? or do i need to move and establish myself first?

Once we are in the US and married and we apply for her adjustment of status how will this work with my limited employment history within the US? I went to university in the UK and have only ever worked over here.

The petitioner must demonstrate a US domicile and this address should be put on the I-130 petition... on the g-325a just list the needed biographic data as requested...

So your saying to include the US address on everything other than the G-325a?
What about the I-129F - is that the same thing? I am talking about the K1 visa here...

Same for any petition

How easy would it be to change the address? Initially I will be in the UK(but going to use a US address i Missouri) then i will move to Missouri and then to New York.

K-1 Fiance(e) Visa Process & ProceduresI-129F & G-325a Address Question for Dual Citizen
Here is our situation. The US citizen is a dual national(US & UK) and has been living and working in the UK pretty much since birth. We met in the Uk and have been living together for a few years now. The US citizen is going back to the US in early Jan 2009 but we want to get the application in process as soon as possible so we don't have to spend as much time apart.

So here is the problem both the I129F and G325a ask for an address (both our addresses are currently in the UK–the same address). Is this ok?

We thought about putting down the american address down(a relatives - where the us citizen will be living) but the G-325a asks for where you have lived and worked for the past 5 years. Obviously if i put down i have been working in the Uk for the last 5 years they are going to want to see Uk addresses for the past 5 years?

If I do put the UK address down how to I go about changing this when I move in Jan 2009 - will this slow the process down and how easy is it to change the address?

Should we include a note explaining our situation?

Thanks for the help.

Every case is so different it's hard to say. Have you discussed DCF with the London Embassy at all? I'm unsure of the new procedures as everything changed just last year but if you are both residing legally in that Country then there is a possibility of marrying there and applying for Direct Consular Filing. It is a much easier process to contend with as long as you can prove domicile in the U.S.

As I said, i'm not too familiar with the process as it stands now in London but i'm sure if you visit some of the other forums here (particularly DCF and UK Regional) you will get some answers.

good luck.

thanks very much

Yes, you can file when you are outside of the US but you must have domicile in the U.S. to obtain a visa for your fiance. Make sense?

That makes sense thank you.

Our situation is the USC is a UK/US dual national and is living in the Uk at the moment and has been pretty much all his life. We were wanting to file for the K1 now (and use the address of Family in the US) In the new year the USC will be moving back to the US and will be there before interview stage. The USC has US bank accounts and will have a job over there by the time of the interview. But when we file he will be in the UK working here.

Do you think we will have any problems?
