USCIS direct to Embassy?

I was once told somewhere that all, and I mean all, corespondance with embassies and the US go through the DOS/NVC without exception.

I think this is correct also but at this point anything is possible. :lol:

Please keep us posted you two, there has been a lot of speculation on this subject and it appears one of you will be one of the first to find out. My senator's office said it would go direct to the consulate, but it is just speculation.

Case Numbers, CIS Receipt Numbers & IMBRA

If your petition was recalled, your case number (the one NVC assigns you) remains the same. Your approved petition will be sent to NVC first then to the consulate.

I have a feeling it won't be too restrictive. The law could definitely use some more restrictive language, but at the same time the law as it is written now can also lead to a loose interpretation with possibly a negative effect towards people that met online. The interesting part will be in the details regarding when the law actually went into effect and whether or not you met before the "cutoff date" matters. I have heard many conflicting opinions on this. The problem is, the people that will be making decisions on our cases do not know how to interpret this new law so it is likely there will be many initial errors on their behalf which will negativley impact the guinea pigs.

We will never truly know until the first guinea pigs are subjected to the USCIS interpretation of IMBRA. Hopefully, the interpretation will not be ultra restrictive and all of the agencies involved will apply the law in a fair and sensible manner.

OMG! You can forget all of that! They still don't have our paperwork, but they've assigned us an interview!!! Yay! Just like they'd originally promised, and much sooner than expected - October 4th - I can't believe how soon that is!!!

They want us to bring in copies (and originals) of everything we've sent in for them and the originals of both approval letters (pre- and post-IMBRA) and my fiancé has to come in with me to swear an oath (for the IMBRA stuff we're assuming), but we get our interview! I'm soooooo excited and relieved right now! Thanks Montreal!

No, not at this time. That's why sites like VJ are so helpful in the process of educating oneself. Hopefully, after this initial road block thrown in, the process will be smoother, but I highly doubt it. As for the volume of people applying for K1 applications with USCIS, IMBRA will most likely have no affect at all on this mainly due to the lack of PR and understanding about the law anyway. Not to mention the huge amounts of other types of cases USCIS deals with everyday.

Question for you all....

I sent a letter to both of my Senators regarding this whole situation May25th. On Friday I got a letter from Senator #1 who contacted USCIS. The OMB pulled my application and told the senator my application was submitted on the 19th of May(actually it was the 2nd of May). The letter then went on to state about the new form that is coming and the pending RFE's etc. Then on Friday I got a call from Senator #2 asking if there was anything they could do to help.
Here is my question. In contacting them I did not ask for help with my application specifically. I just asked if they could get some answers for me. I did not include my case number but yet USCIS looked at my case and gave Senator #1 my (wrong) petition date. I'm hoping I haven't sh*t canned myself in contacting the senators. Is this possible? I'm concerned about "additional security checks or name hits" or whatever it is called.
Next, I am to call Senator#2 back on Monday with any additional concerns. If I have screwed myself
should I go for the full Monty and have Senator#2 contact USCIS/OMB. I'm inclined to have #2 not make any inquires on my behave at this time until I need them later.
What do you guys think?

Go for it! This is encouraging, I'm sending one of my senators a letter tommorow and contacting one of my representatives. I'm also sending an expeditie request tommorow. All I know is we are not getting any answers from the agencies that are supposed to serve us as American citizens.

Nope, I just found out they aren't. My friend who works at the lawfirm I am using as representation just came over for breakfast and told me that even though they were able to get them to start sending out RFE's sooner than 30 more days, the RFE's they are sending out are the ones they have on hand, and are most recent first which can take a month to get through. Then they will start sending us RFE's and will be processed in the order the RFE's arrive. So it's as if the NOA2 no longer matters. Once it goes back to the embasy, it will be put in the que in the order it was recieved in the very back of the line. So another 2-5 months wait once it arrives at the embasys before we get our interview dates.. So it's almost as if we haven't even applied yet. I expressed my outrage, and he explained that this is the kind of game they try to play. You ask them to do something and they do it half assed IF they even agree to it. So the next thing they are going to do is try to setup some meetings with some key folks (I have no idea who they are) at the DHS and work with them on implementing a true FIFO system to prevent this from happening again when they add other new hairbrained laws.

I may possibly send in an expedite request this week. I'm still studying the actual process. Let's keep in touch with this. It does appear that that original memo that was released about the recall was worded in such a way as to not blame the USCIS for the error, although we all know it was. Keep digging yeah~!

I also just sent an email to my rep and I will call them tommorow.

Yes, they don't have a clue. I guess I got lucky and talked to someone who knew what they were doing. I had to call multiple times to find out they actually have my petition. It is possibly the worst customer service experience I have ever had besides the MVA!

I also emailed my consulate and the NVC and asked them about it. Once I knew it was not in their hands and had emails stating the consulate or NVC did not have it, I kept calling the USCIS and let them know it had to be there and it was found.

I will do the same if I have to call 100 times (and I will call that many times). Any tips??

Do the emails first, that way you know the NVC and consulate do not have it. Once you know this just let the USCIS know this and insist they check for your petition. I'm lucky I'm on vacation now and I had time to do it. The emails can be sent at any time, just make sure you include your receipt number and specifically ask where your petition is and/or where it was sent. Both emails are similar depending on your case.

Consulate example for petitions with NOA2:

To whom it may concern:

case id#
receipt#

My name is xxxxxx and my fiancee's name is xxxxxx. I received a notice from the xxxxxx consulate on xxxx informing us that our case was ready to be further processed. On xxxxx someone at the consulate called my fiancee and said our case was being sent back to the USCIS. I realize all K1 cases after March 6th have been sent back at this point due to IMBRA. I fall into the category of the applicant that will receive an "immediate" RFE. My questions are specific to the consulate:

Why was I not informed by letter, email or phone by anyone at the consulate that my case was being sent back?

Will my case still be expedited at the consulate due to my petition already being approved on xxxx, 2006?

I look forward to a clear and concise response.

good news everyone!!

I just received an email saying that the RFE is on the way to me...yeah!!! Our case was put into the system on Apr 24. So maybe VSC is sending out the RFEs to everyone regardless the NOA1 receipt date.

It appears that way so far.
