Just spoke with the friendly people at NVC, my petition arrived there today and it will also be sent on to the consulate today! So, basically it was 4 days from USCIS-NVC. The person on the line was very polite and helpful, as most people who work for our government should be.

Wow, finally got a rude VSC person. She basically admitted there was no way they could tell me where or when my approved recalled petition would be sent to NVC and told me to stop calling so much. Funny, the NVC actually recommended calling the USCIS in the email I received from the NVC. She actually was ignorant of the fact that the recalled cases will have the same NVC case number also. I was glad to be of service to her. I'm praying for the USCIS to get out of the picture at this point, it is utterly disgusting.

Your comment about a VSC recall/reprocessing deadline by the end of August is interesting, coz last night I called the Manila Visa Call Center to ask if reaffirmed Petitions would be given immediate visa interview date preferences, and Tina said if they receive her Petition back before the end of August, then my fiancee could be scheduled by October 5th coz her approved Petition arrived in Manila on April 5th which is 6 months from October 5th. Anybody make sense out of this time frame requirement? Thanks, Rick


rlt also called the consulate in Rio and they said that once the reapproved petitions get there, they should reschedule the interview for any date they have available to make it as quick as possible.

They can´t reschedule the interview until the case is back to the Consulate, but once they get it, they will be giving us new dates.

I think that procedure should be the same for all of us who had returned packet3 by the time they canceled the process.
It won´t be too long, people.
We just need to keep an eye on this vcs-nvc-consulate bridge.
It´s taking longer than usual, isn´t it?


rlt, this is the response I got from the NVC when I emailed them asking about where my petition was. I emailed them one day after (08/08/06) I received approval. I'm calling the USCIS and NVC tommorow after I make some margaritas. (I'm on a mini-vacation now before school starts again)

Dear Sir or Madam,

Your inquiry indicates the petition has been forwarded to the National Visa Center (NVC) for further processing. The NVC has not yet received this petition back from CIS (Citizenship and Immigration Services). The NVC will send further instructions upon receipt of the petition. Please contact CIS to verify the status of this petition.

Weird? yes, and many other things. I think all of our petitions will be approved eventually but the USCIS has so many problems with compatible systems and inefficiency right now. Aussie was right on the mark, the paper based system can really cause a big mess and slowdown.

Sleepless, I'm pulling for you more than anyone at this point. There's no logic behind any of it so far. One of the first recalled and approved VJer cases was from CSC. And now we see an interview being scheduled for Mike, which is very good news.

As for the 8 day theory, it looked good at first but now it appears not to hold water. I was losing it, really, I still am. I know these cases will go through eventually, it's such a b352h dealing with it but it is worth it.

I have a good feeling about August, I think the recall situation will be amended and interviews will start being scheduled. May your case be approved soon!

I hope this will give you all some hope. Our case was reapproved, and they scheduled my fiancee for her interview on Agust 14th. I am not sure why we got our interview date so quickly, I am just happy that we got it. I really hope that this will give us all hope and I hope that I hear the same news from many of you.

I sorry I haven't posted this earlier, just been too busy getting my fiancee prepared for the big day.

hi all and congrats to anyone who has movemnet on their case!

question, for those of you who have been approved, do you know where your case is? sent to the consulate yet?

mew - it's been 9 days since your approval. any idea where it is? (my noa2 to nvc notice took only 8 days)
rene has been 2 weeks longer and is still at CSC (i assume from their last post i read)
everyone else (all 2!) might be to soon to expect it to be sent.

my concern here is since it appears CIS is sending direct to consulate for the reapproved recalls, are they going to wait for all the recalls from each country to be approved and then send out in one batch? at this point i would not be surprised if this is the case.

mew, can we add a column to the chart with "rec'd at consulate"?

Talked to USCIS, she said I will get a new expiration date, mine expires on 08/06. She said my case is still with the adjudicator most likely and will probably come within a week. The supervisor said all reaffirmed petitions will be sent directly to the consulate. Who knows?

For the recalled, we do have cases "reaffirmed" from both CSC and VSC. And all of them so far as we know still have not been sent to the consulate. We still have no clear verfiable info on where they go after they are "reaffirmed". I don't think it has anything to do with spreading resources at this point, I think it is just pure confusion among all the entities involved about how to handle the recalled cases even now. The "memo" posted yesterday offered no new info on recalled cases. The leadership on explaining the process has been atrocious and non existent on the USCIS part. We are left to do the work for ourselves by analyzing bits of information that may or may not be significant. In my lifetime, I have never witnessed such incompetence and lack of transparency in our governement.

Let's hope VSC and reaffirmed cases will have some good news this week.

Immigration liaison for my congressperson today contacted me, rexplained exactly what I told her myself, and gave a canned We have no idea when it will be complete, and told me not to contact until the end of September.

There is only one pattern that is possibly emerging, when the "approvals" happen, they seem to happen in batches. As our recalled cases eventually get "reapproved or reaffirmed" or whatever the USCIS call it we still have a question of what comes next.

So far, there has been conflicting info being given out by the NVC, USCIS and our congresspeople where the petiton goes next. Is it the NVC or straight to the consulate? I plan on contacting my consulate and congresspeople immediately with proof of reapproval in order to have a backup plan. This makes me nervous because if all parties involved don't know there could be more potential for errors. I did read an earlier thread where an approved petition (with IMBRA RFE approved) was actually sent back again to the USCIS.

I don't know what to say at this point other than I am disgusted also but I will never give up on being with my love and I hope that all of us feel the same.

Well, I would contact them (DOS) as soon as possible. Maybe the DOS will send it to the consulate being that it has already has been through NVC. They may just have a system in place by which DOS is responsible for petition mailings to the consulate. I'm so happy for you! July and August will be months of action for all of us.

So, the notice says...

"On July 25, 2006, we mailed a notice reaffirming the approval of this case, and returned the case to the Department of State for visa processing. If you have any additional questions, please contact the Department of State.

What do you guys think it means? DoS will handle the mailing or NVC?


The original approval notice states that the case will be sent to the NVC which is part of the Department of State. I guess you will be one of the first ones to find out. Does it mention NVC anywhere on your new notice? Does it give a contact number for the Dept. of State? In any case, your case is moving.

I just got off the phone with USCIS center - I was trying to get information on the status of all the recalled petitions, and asked if USCIS has announced internally any new policy or procedure on how they are going to finish processing these cases. The first operator was nice, sympathetic even, but she did not have anything new to tell me. I asked for her supervisor, who was also pleasant, but said that, no, they had not received any internal briefings or updates on how to respond to my questions. They were both familiar with the fact that many K-1 petitions were hanging in limbo, but did not know how to respond to the question of why so many petitions are being approved that were submitted after March 6 and subsequently put on hold.
The supervisor said the standard time for processing an RFE is 60 days. They had not received instructions to say anything different for recalled K-1 petitions.

Today there was a flurry of NOA2 approvals out of CSC, but none of these were recalled cases as far as I can tell, and there seems to be no systematic pattern by NOA1 or RFE dates. So if USCIS has had internal discussions on what to do about the recalled cases, they are not sharing with anyone. I am so depressed.


I also called USCIS yesterday and my state representative today and I asked if there is any new procedure for the recalls. Both said as far as they knew it was just a matter of time to have the petition sent on to the consulates and they did not know of any new policy involved. My representative said the NOA1 is basically pointless until this IMBRA backlog is done, so if anyone's case is already being processed with the RFE presently they will receive notice soon. I also looked at the lag times of 3 CSC approvals today and I think they were 19, 18 an 13 days from the time the RFE started processing to approval.

I have been very moody and miserable due to all of this lately and I feel frustrated also but I will continue to mine for info from different sources on the recalled situation. If the patterns hold true, the recalls may start seeing action soon. Personally, I don't expect mine to come through until early August. I was very happy to see Cigarovich tracked down his lost petition, hopefully the others will follow soon. May all of us have great news soon.

There's no problem in either case, they have all of our RFE's that were sent and they are actually processing yours as we write. Williston is just where the FEDEX location is, that's all.
Too bad we have no data yet to predict how long the RFE approval will take but I will guess less than 30 days. Looks like you get to be one of the first NOA2 recall VSC guinea pigs! Hopefully, this week or next.

I also used FEDEX and have Williston, VT which I believe is the correct location. On the site it said the address was a "revised address". The package was also signed by the same person that signed for my expedite request, G. Merrihew. It just a matter of waiting for the RFE email notification.
