I agree with Misa. Get married in Germany and go the K3 route OR you can wait until he is back in the States and he can send in the petition for the I129F from there. Either way, you will have to wait in order to get your visa. However, you cannot enter the US, get married and stay, that is illegal just as getting married, not applying for a K3 and then entering the US to adjust status. Don't rely on the people from the mis-information line, they usually know less about visa and immigration as we do here (actually I think that some people here are VERY helpful due to the experience they've made).

It is a non-immigrant visa because you have to file for AOS after the wedding. Without the AOS you would have to leave the country after the wedding. It really is confusing but it wouldn't be fun if it was all clear, right? :)

You should go ahead and call USCIS to let them know that you don't want to persue the K1 Visa application. You will have to apply for K3 instead. K1 is ONLY a fiancee visa and you two are now married.

As from what I know and from what several timelines show here, the K1 really is the quickest option, especially when your Service Center is Vermont. I was approved within only 14 days (also Vermont) and had my visa within 3 months. However, I would say that it might take anywhere from 3 months to 6 months to get approved. The K3 Visa usually takes longer than that AND you would have to separate after the wedding again.

No, it is not illegal to come to the US with the intend to marry. IF that was the case, all those couples getting married in Las Vegas would be illegal. The illegal part is to stay in the US after that and NOT going back to your home country to apply for K3. You are completely eligible for a K3. The only thing is that it would delay you two being together for a while but since you said that she has some exams etc. to do anyway...you should be fine and just go ahead, plan your wedding, apply for K3 and have a happy life togehter. If you have a rather easy case (e.g. not been married before, no children etc.) you won't need an attorney. Even if you have been married before and do have children, you can still do it without an attorney. A lot of questions repeat themselves and once you are in it...it's not hard at all.

I can only help you with this part of your question. Once the K1 Visa is approved, your fiance has six months to leave Japan and once he enters the US the 90 days begin to count down. So all together you will have about nine months from receiving the visa to getting married (if you want to get married so late).

We also did the 'see attached sheet' and my husband wrote on another sheet the circumstances under which we met, that we talk on the phone on a regular basis, write emails and have visited each other and met each other's families. It was maybe 5 or 6 sentences. Remember that the people at USCIS do that every day, they probably don't want to read an entire novel, one sheet is definetely enough. Good luck.

You don't need a police report from the US. USCIS is going to run a background check on you anyway, so they cover the police report with that. Now if you lived in Austria, England, Norway or wherever for more than six months, then you'd need a report but not if you lived in the US.

He doesn't have Federal income tax return form.... is it enough without it?



did he file his taxes for the past 3 years? if he did then he can contact IRS for copies because when it come to the Affidavite of support, he will need to show them.

you wait for NVC to contact you about the Afidavite of support. you will have to pay the fee first then send in affidavite of support.
after that is apporved then they will ask for the visa fee, pay that then you sennd in the application for the visa. once they have those and approve both forms, you will wait for the visa interview appointment at the embassy of where your spouse lives or closest to it.

you can call NVC for more information.

when i started my I-130 i did send some pictures of when i was in egypt with my husband before and after we were married and explained each one.

i know later in the process they will ask for request of more eveidence and that is when you hit them hard with the pics like i did...lol

you know if at anytime you have questions you can call USCIS and the call center is very helpful in what you need to do

hello there...here is some food for thought to give you an idea about I-130 route. I-`30 gives them a greencard and ssn as well. whether it is cr 1 or ir 1.
129f pettition yes can get them here faster but you have to petition for greencard and ssn..more money spent.

i have been in the process of getting my husband here since october 29 2010 when i first did his papers. check my timeline.

as far as my understanding you cannot change interview date to an earlier day because embassy is booked up. you can delay your interview appoitment but why you do that...lol

prior to her interview date you will recieve an email stating all document she will need to take. i know my husband took all that and more just in case they needed something.

yes she will need extra money depending if she needs to pay for courier service to deliver her passport and visa to her.

chek the embassy webite of her country where her interview will happen. they sometimes have a guideline you can follow.

Hello All,

I am new here and this is my 1st post, please I need your help.

I am a USC, my husband is a Nigerian, but resides in Malaysia, so we are going through the Kuala Lumpur Consulate.

I am now at the NVC stage. I called NVC several times and finally got a positive response on the 30th April 2012, I was told NVC has received my Case from the California Service Center CSC, But they do not have a Case number for me yet. It hasn't been keyed into their system.

How long does it take to get a Case number?

How long will it take me to get the fee bills ans submit my documents?

Mailed I-130 Package - 10th Nov. 2011
USCIS Received Package and my Priority Date is - 14th Nov. 2011
Notice Date: 16th Nov. 2011
NOA2 - 14th April 2012 (exactly 5months)
NVC received case - April 30th 2012

it takes a few weeks sometime before you get your case mumber from NVC but once you do you will recieve the first fee bill, pay it then you send in Affidavite of support. omce they approve that you will get the bill for visa fee. pay that then you send in visa application and all they ask for.
it didnt take us long with NVC as it did with USCIS. USCIS it took us exactly 8 months from priority date.

it took us about 4 mmonths to get his interview at the embassy in cairo.
