Hi,

I just got my EB-2 based Green Card approved (perm process took 1 year, I-140/485 together took 6 months).
I am interested in moving to another state to work for the same employer with a different team but a similar job description.
Given that my GC is just 3 months old, would moving now be a problem during the naturalization process 5 years from now? I hear they might question candidates who have changed their job soon after getting their GC.

That shouldn't be a problem just make sure you file an AR-11 and keep a copy for yourself. When it's time to apply for citizenship on the N-400 application it will need the exact dates you moved.

Hello guys im a newbie here but lurking on the site for a while now. So today i finally decided to register and ask for advices and your guys input about my problem. Here goes, so ive had my interview on January 15. Im still waiting on my oath letter. Ive been calling the uscis customer rep plenty of times to ask them about the status of my oath taking scheduling but all of them said the same thing, they keep telling me to wait until april 15 which is 90 days after the interview before they can find out information about the hold up on receiving the oath letter. But they said by law I have to give them 120 days for processing for the oath scheduling. That’s where the problem is going to be for me, because im leaving out of the country on may 21 and im going to be in Philippines over the summer for 2months vacation and to marry my fiance. So today I went to my local office where I had my interview with the appt. I set through the infopass last week to find out for myself whats holding them up. I talked to the Representative and she told me the reason behind the hold up is because of the presidential hearing last November, I guess i'm not sure what it is exactly but im guessing it’s the presdintial election? Anyways she told me some of the people that had their interview on December where still waiting to get in and she said their having ceremonies every week to catch up. She told me march were all full for the ceremonies and that the chances of me getting in to any of the April ceremonies were slim. Oh my, Im so worried. There are so many concerns running through my mind, I don’t want to leave the country without becoming a citizen. If I have to reschedule there is probably another delay and probably have to wait for a long time again when I get back from philippines. Im worried if its going to get delayed again and I have to wait before I can file a petition for my wife, once I get married in june, when i get back in August. I’ve been thinking a lot in the past hours and I was wondering what if I get my oath schedule around may, which should be the worse case scenario, because on may 15 that should reach the 120 days time frame, which is the time we give our local uscis office to schedule us to get in to an oath ceremony. But anyway lets just say I get my oath scheduling around may before the 21st, can I still travel outside the us going to Philippines using my Philippine passport and certificate of naturalization only? And i thought since im going to be in philippines for 2 months maybe i can just get my passport at the us embassy or consilate in Cebu City, philippines. Can i do that? ugh

Im in need badly with you guys input on this matter, as I know a lot of you have had the same experience im having. Thank you so much for the help!


If you take your oath in May and become a citizen you need to use a US Passport when leaving and entering the USA. You can do 1 day expedited passport..so that may help if you are worried about processing time. Good luck!

I am just curious if I am missing anything with that idea.....In case I don't receive my US Passport on time, could I not just travel with the passport from my country of birth to my country of birth, one way flight...? (The passport mailed to my US address, could by friends than mailed to me abroad and I could enter the US with it later)..... Because before when I travelled with Passport and Greencard, leaving the US, they never wanted to see the Greencard, just the passport anyway. Yes? No? Thanks


It is up to you. You can chance it, but to be on the safe side I would make sure I would have a US passport in hand before leaving the country to avoid any potential problems later on.

1. My husband is the american citizen, it say's that one of the requirement to be included is photocopy of passport, but my husband passport is already expired...do we need to have it renew first? or is it just fine not to renew it since it only need the page wit his pic?
2. Is the tax return file online can b submitted?

You can still send in a photocopy of the passport it should be okay as for the tax return files call the IRS and get copies of your tax return transcripts anything submitted online they will have a record of it.

US Citizenship General Discussionn-600 or passport?

I am still really new and trying to get all my information together so any help is appreciated! Here is a brief background on me...

1978 Born in Philippines. Father was in US (Father is filipino but was serving in US Navy. He was not a US citizen at the time and was in the US. Mother is filipino citizen)
1979 Moved to IL with mother. Came with lawful permanent resident card.
1980 Father was naturalized
1984 Mother was naturalized

My apartment was broken into and I can not find my ss card or my green card. I am filing i-90 but am thinking of filing n-600 as well since my fiance and I are planning on going overseas so I want to get my passport. I believe I need to file my i-90 to get a replacement ss card, is that correct? Or should I try to just get my passport to submit to the ss office?

I am really unsure about whether I am on the right track.

I have a question for you wouldn't you already be a citizen because your parents naturalized when you were under the age of 21? In order to apply for the n-600 you need the certificate numbers of your parents naturalization certificate. Just wondering why you would still have a green card after all these years. Get the 1-90 first since you will need your A# when filing out the n-600 application. (You can then get your replacement SSN Card) You can get your passport once you get your n-600 approved.

Question;

One of the items I have to bring according to the Interview Letter is Selective Service Registration Confirmation. I went on the page and selected Search record, typed my name, social security and birthday and my Selective Service Number came up with the date that I registered. So I printed that. Is this enough to provide proof or do i need something really official by mail from Selective Service. The website seems to be displaying everything I need.

Why is all this stuff required when USCIS is supposed to have a lot of information on each person. I swear half the things they ask for they either already have or i sent it with my N-400.

Yes the print out should be enough proof for selective service. As for having all the stuff it's better to be prepared vs not having everything with you and getting a RFE. Good luck with your interview! Posted Image

I have a bad timing situation: I have my Oath ceremony on Mars 20th and my son turns 18 on the 24th. Theoretically if I file the N-600 right away it should be fine (since I will become a US citizen before his 18th birthday) but what date really counts? The filing date (date signed on the N-600), or the date of the NOA, or date the N-600 is received at the USCIS, or just the date of me becoming citizen? The N-600 specifies that it should be filled before the 18th birthday but in my case it is really a matter of a day or two. Did anyone have the same issue? any idea?

The fact that you are naturalized before your son turns 18 will make him a citizen. The date on your naturalization certificate (which is the date of your oath) is what you will go by.

US Citizenship General DiscussionTraffic ticket not on driving record

I'm applying based on 5-year rule and I'm preparing a list of documents to take with me to the interview, God Willing. I obtained my driving record, however there is only 1 ticket! I know i had another ticket february of last year but for some reason it's not there.

Basically, if the ticket isn't in my driver's record, do I need to bring it up at all? I don't want to cause any confusion as to why it's not on my record. Anyone had a similar experience?

and for taxes, there are years when i was a student and didn't make enough money to file for taxes. Do I have to bring proof that i wasn't required to file for such years?

My husband had a couple of tickets about 9 years ago and from what I've read some IO ask for the record and proof that the fines have been paid. So what we did was go to the county court house (in the counties the tickets were issued) and obtained his records saying he was cleared of all outstanding fines. That may help you in case they bring it up. At least have proof that all fines for your tickets were paid.

So I have overdue taxes and it says to bring signed payment agreement form and also show that Im in good standing with IRS

I do have a copy of signed agreement that Im on repayment program when I started it, however IRS says they dont have a letter per say that says you are in good standing. All they have is transcripts that show payments have been made on time and she said I can use copies of my payment stubs to show that Im making payments and that Im in good standing that way.

What do you all think, would that be enough?

You should be fine with the agreement form as well as the payment stubs. The thing that they want to make sure is that you truly are paying your taxes and are not in default. (That's what makes you in good standing in their eyes.)

My husband marked no as well. During his interview they brought up his past traffic tickets (so pretty much they knew he had them without him disclosing it.) When they asked him about it, he was honest and also gave his DMV record and documents that all fines were paid. So when it comes time for your interview be honest and show your records of everything being paid and cleared.

I would look into filing a N-600 (Certificate of Citizenship) not a N-400 (Application for Citizenship). You would need your parents naturalization certificate numbers as well. You are pretty much already a citizen if you satisfy all the requirements on the n-600. Just make sure you verify the dates of when they became citizens as long as you were under 21 you should be included.

Hi to all , am new here so forgive my nervousnous . So i moved here with my family back in 1977 from England, i was 13 at the time and will be 50 this year (nov) i have had a green card all this time and am ready to move forward for citizenship - i served in the army when i turned 18 for 3 years left under other than honarable but while i was in the army my parents and siblings did get their citizenship .. when i came out of the army i just went on with life .. now my wife wants me to pursue my citizenship which i have filled out all the paperwork and have it ready to go. My british passport was lost long ago while i wa sin the army and i never re applied as i have never been out of the states since being here my question as i see a lot stating they will ask for the old passport..will that be an issue as i havent had one in 30 years . anyway any help will be greatly apprecieated

Were you under the age of 21 when your parents became us citizens? Reason I ask is because you may already have a claim to us citizenship.

I entered the US with a Tourist Visa and overstayed until 2010 when i finnally received a Green Card through Marriage.

during my illegal time, i renewed my driver's license twice, and the last time in 2005, i accidentally registered to vote.

Now, im getting ready to apply to my citizenship, and i read a story on Change.org about a woman that did the same, and she is now in deportation status.

I registered to vote, however, i never voted. Im woundering if i should reconsider this and not apply to become a citizen and just stay here with a Green Card.

If anyone know anything to this topic, let me know.

What you should do is call your county's voter registrar office and have them remove your name from the voters list telling them you had registered by mistake. Maybe they can send you a letter stating you are off the list now. Second consult an immigration lawyer. This is a BIG mistake that can definitely delay if not deny your application because the USCIS will see this as a false claim to citizenship. They just have to dig more into your background and maybe verify everything is cleared before making a decision. All you have to do know is wait. Hopefully you hear back from them in a timely matter. They quoted you 30-90 days so that timeframe for waiting should be expected.

Now my question is:
- By not signing the selective service unintentionally, am I disqualified for applying USC ?
- If not, what evidence should I present them ?
Some people are telling me that I should not do it now, rather wait a couple more years, after I turn 32 now because by that time, the INS will not bother to ask me about selective service anymore.

Here is some info from the USCIS website that may help. As for others telling you to wait until you are 32..the USCIS officer will be bringing it up to you in your interview regardless because it is a question in your N-400 form and you have to be truthful in your answer. Trust me on this. During my husband's interview they brought up stuff that happened 9 years ago.

Eligibility for Naturalization


Section 316(a) of the Immigration and Nationality Act (INA) requires a naturalization applicant to prove that he or she is, and has been for the requisite period, a person of good moral character, attached to the principles of the Constitution of the United States, and well disposed toward the good order and happiness of the United States. Section 337(a)(5)(A) of the INA also requires applicants to declare under oath his or her willingness to bear arms on behalf of the United States when required by law. Therefore, it is INS policy that refusal to or knowing and willful failure to register for Selective Service during the period for which an applicant is required to prove his compliance with § 316(a)(3) supports a finding that the applicant is not eligible for naturalization, because he has failed to establish his willingness to bear arms when required and his disposition to the good order and happiness of the United States.


Effect of Failure to Register for Selective Service


Failure to register for Selective Service is not a permanent bar to naturalization. In general, INS will find an applicant ineligible for naturalization on account of failure to register for Selective Service if a male applicant refuses to or knowingly and willfully failed to register during the period for which the applicant is required to establish his disposition to the good order and happiness of the United States. This period coincides with the more familiar good moral character period. Whether it is proper for the INS to determine that an applicant refused to or knowingly and willfully failed to register for Selective Service will depend on the applicant's age at the time of filing the naturalization application and up until the time of administration of the oath of allegiance.

I have a general idea of when I went back to Canada, but not all the exact dates; how should I answer the question?

I know I went back for Christmas, but I'm not sure it if was from December 23rd or 24th to January 2nd or 3rd in 2011... and then a few really short trips (2 or 3 days) I know I took, but it was in "July 2010" or "Fall 2011"... I don't want to lie, I'm just not 100% sure of the dates.

Trips outside of Canada, I have more accuracy in my records. :blush:

Was your passport stamped? The dates should be there of when you returned. Just be honest during your interview as to approximately how long you stayed in Canada. The main concern is that the USCIS wants to make sure you didn't abandon your GC by being outside the US for more than 6 months at a time.

I stupidly did not copy my I-751 application, so I don't remember the dates I put down for our start date at current residence and end date of the previous one. Now I'm getting ready for citizenship application and I want the dates to match up.
The landlady at our current address had given us a grace period of 2 weeks that we could move in prior to start date on lease in Nov 2011. So I don't know if I used the start date in the contract or the actual start date factoring in the two weeks prior! And I neglected to copy the information. I'm such an idiot. I'm SCREWED!!!

Go with the start date you actually moved in. If there us any questions at your interview you can explain that. It shouldn't be a big deal if your off by a couple of months. You'll be ok. After being in US on various visas and eventually a green card I'm finally applying for naturalization and am terrified of screwing up the process or getting so frustrated I give up completely. Any practical advice on what to do/not to do or just stay sane during the process will be much appreciated.

Be honest in your application. Keep track of all your travel dates you'll need this for your application. Also make a copy of your n-400 application so you can review it before your interview. I realized I had made an error with a travel date and was able to amend it at my interview. Once you get you first NOA sign up for USCIS text/email notifications, it updates you as soon as your status changes. Do an early biometrics if you can. Just wanted some feedback or thoughts on this as I get anxious easily even if its a job interview or other stuff so this just keeps adding to it and I've had some nightmares.

So I'm a US. Resident (green card) holder for last 21 years and my parents have it as well and my grandparents are US Citizens. I decided to file N-400 in lieu of renewing a green card for another 10 years. Never been convicted, arrested, detained or anything like that. Do owe IRS money but got the agreement and proof of good standing. I'm thinking that my interview should be a breeze since I've been here so long, arrived as a green card holder when I was 10 years old, and not on student visa, or marriage or illegaly entered.

Anyway this website helped me some and put me on axniety with other things. Last night I had a nightmare that during my interview the IO pulled out a Library Card application and said YOU MARKED US CITIZEN - DEPORTED and they took me straight from the office to the plane..LOL..i know silly.

Well as far as I can remember on every government document I placed US Resident and my A# number. Never registered to vote, never really dealt with any immigration officers other than renewing green card in 2002 and then when I entered with my parents in 1992. Had a Jury Duty notice, but sent in copy of green card saying I'm ineligible, all my I9s for work show that I'm a resident with A#...even bank has me as US resident.

But i can't help to think that I might have mistakenly put US Citizen on something...I know the difference, but maybe during rushing to get paperwork done and now I'm thinking, Gosh what did I put on my selective service registration, elementary school paperwork back in early 90s when my English was poor, etc..etc..

My question is;

How deep to they look? What if someone did make a mistake, but it was not to gain anything or defraud anyone as it either would not make a difference between US Citizen or US Resident in case of I9 if nothing it to be gained by it...just curious and wondering. I know it's the worst that someone can do and lie and I know that I've been diligent with paperwork...but Im I obsessive about thinking in regards to what I put on my blockbuster application in 95 or are they looking for bigger fish such as past illegal aliens that lied to Border Patrol Agents about Citizenship or Illegal Aliens that should not be working but found work anyway and listed US Citizenship.

Please help me complete Part 8, Section G:

My information is as follows: I'm a female. I've been married once, which is to my current spous, a male.
My spouse, the USC, was married before.

1. Section G asks, 'HOW MANY TIMES HAS YOUR CURRENT SPOUSE BEEN MARRIED? What do I put here? 1 for the previous marriage? or 2 counting the previous marriage AND OUR marriage?

2. Section G 2 asks, If your spouse has ever been married before, give the following information about your spouse's prior marriage.
My question is, what goes here?? MY Spouse's information? Like his name etc? or Does his PREVIOUS WIFE'S information go here?

In section G you put down any previous marriages as well as your current one. Section G2 you put all his previous wife's info and how many times he was married etc..
