Hi All,

I had my K1 interview yesterday the 03/01/2010 and i was approved. Got a green slip saying i must collect my visa next week monday. Happy times for me!

Can i book a one way ticket and when issued with the visa does it tell you how to book the ticket? Looking at booking my ticket today(one way)

Yes, you can book a one-way ticket as long as the airline permits it. Some airlines do not permit one way tickets from their country to the USA because the airline is responsible for your return if you are not admitted at POE. I think Garuda Air is like that.

But you should get the best fare (as the other response said) and come on over.

I wanted him to call USCIS tom so we argued about it.. :(

1) Calm down. Please do not argue. You have a long way to go. Do not argue.

2) The checks are not a problem. The middle name is not a problem.

3) Yes, wait one more week.

The problem is calling USCIS, they may not be able or willing to locate a missing package that could be missing for many reasons.

You did not specify what the OTHER matter was. Was it to the I-129F or G-325A? Which form did you put the incorrect birthday. They need to be consistent but it is hard to say what to do without knowing what the RFE was for and which form you put her birthday incorrectly.

Yea, the previous poster is correct. You are still under 5 months, but only by a week. SO give it another week before calling. Then you will be over 5 months which is the current USCIS wait time (processing time).

No it is not an RFE. The adjudicator is convinced there was no meeting in the two years before filing and outright denied the petition. It is not considered an RFE. It sounds like you are saying they did not indeed meet in the preceding two years.

They need to go meet, document the heck out of their meeting and submit a new application.

No, your fiancee does not need to leave Egypt and return to the USA. Things are on autopilot for some time here. It will go through NVC and then be sent to your Consulate. They will notify you by email or regular mail.

At the time you do need to send in the I-134, you should send with it the pay stubs, preferably 6 months of pay stubs and a letter form your employer unless you are self-employed or receive 1099's instead of regular pay stubs.

It is not likely the embassy will take the video camera. I say that based on many other responses from people who said at the Embassy they tried to pass over a CD or DVD with pictures or wedding videos etc., and the COs never take them. They will only take hardcopy photos.

While I think this should be a red flag within the divorce's mind, I certainly do not believe the Adjudicators give it a moments thought. As long as you are both divorced or able to marry before the Petition was filed you are good to go.

Every day I read numerous posts from many successful petitioners who hold up filing their petitions while they wait for their divorce to go through. It is very common and nothing to worry about.

I have read many postings where a notice never arrived from NVC. You can call NVC in a week to 10 days after NOA2 to make sure they received your file. If all is well, it might have been sent to the Consulate by the time you call.

NVC has streamlined things and moves very quickly.

I have had some discussions with other VJ members about processing times calculated from VJ time lines. The real problem that makes the processing time an estimate is that a very small number of filed petitions and processing dates are recorded here at VJ. The number of petitions reported here versus the number actually filed by all sources is probably in the 1% to 10% range.

Lonener: It would help all at VJ if you could fill in your timline. Look up at the top and click on Immigration Timelines. Then click on Add/Edit Timeline. You need to enter an email address and a password. Then just type in the dates of when you sent your petition and received notices like NOA1. That way the numbers are a little more accurate and helps everyone at VJ.

Once you've updated your timeline, go to that page again and click on the bold Statistics menu called 'processing status: igor's list'. Here you will scroll down and see that of the November VSC filers, only a couple have received their NOA2 and there's 1 RFE. There's only 1 NOA2 for later in November, who just got lucky I guess. Otherwise anyone around October 29th to November 4th should be expecting theirs any day now.

You're not even on the list because you've not filled in your timeline.

At this point in time, that is not unusual for Vermont (VSC). Additionally, you could go through the process and receive your NOA2 without ever having your file touched (although that is rare).

Your question is not quite correctly formed.

NOA2 applies to the I-129F petition, typically approval. In the I-129F the USC petitioner must list ALL children of the foreign beneficiary. There is no statement on the petition as to which children will be joining or following the beneficiary. So USCIS does not know which if any of ALL the listed children will be applying for the derivative K-2 visa.

So the short answer is NO, NOA2 does not list the children because it knows nothing about which if any children have anything to do with the process.

Unfortunately for you VSC seems to be Issuing Approvals or NOA2s in 85 to 105 days. CSC is issuing approvals in 45 to 55 days.

Your time is coming soon. Drop down to that link I gave you and read some of the postings. Check if people with NOA1 dates of Feb 1 have received approvals.

I think you had your I-129F petition denied by USCIS and never got to the Consulate at Ciudad Juarez. So the Consulate will not have a record of a denied Visa Petition.

You are no longer able to try to get in to the USA with a K-1/K-2. That has ended.

I think it is difficult for you to get to the USA with a B-2 visa. You need to show you have many things in Mexico that will require you go back. You have family ties in Mexico, you have an important job for which you must go back to Mexico, you own land and a house and will not leave them.

The Embassy/Consulate will worry you want to immigrate/emigrate to the USA. You will be high risk of not returning. So maybe a B-2 Visa will be difficult.

I could be completely wrong and if so I hope someone comes along and corrects what I am writing.

You might want to start looking through Packet 3 on your US Embassy/Consulate web site to help pass the time.

She did not get approval in March.

She submitted her petition in March. She got receipt that her petition arrived. That is NOA1 in March.

After NOA1, receiving the petition, you wait for NOA2 which is hopefully approval.

Look on the back of your check if you are setup to have web access to your checking account. On the back will be a WAC# for CSC or an EAC# for VSC. Then when you read your case number, go to the USCIS website and register an account and then enter the case number.

NOA1 can be 5 to 15 days. Some will say up to 30. You never know. See if you can get the case number from the back of the check and then see what your case status is.

Yes, I agree, the two prior K-1 visas could be a problem. It is a little strange the way you wrote neither filed charges (I am paraphrasing).

The other thing is if the have places to contact or check out then it is easier for them to check off items on their list like previous employers. Since you are self-employed maybe they need to look elsewhere to find the references they need to cover that.

But the two K-1 wives might be a flag.

This is totally bizarre. I cannot believe it as I have also read that this is N/A for a K-1.

It would seem that you both need to tick "intend" and write appropriate intentions where your mother's is worded slightly different. But if you have a different CO adjudicate the new I-134's, he/she could disagree and have different requirements for this question.

There are two possible places where this question might get more appropriate responses.

1) One would be under US Embassy and COnsulate discussion as that is where I-134's are handled.

2) The Regional discussion area specifically for the Philippines.

Is my previous marriage is a red flag? ... I also filed for divorce in summer 2009. Lived apart from my ex for a long time. NOA1 on 11/23/2009. Divorce decree says I can remarry 12/22/2009. (yes, I sent I-129F before that, anticipating a delay in the petition processing.

This might be the problem. You filed the I-129F petition when you were not elligible to marry in your state of residence. Hopefully that is not the issue and there is some other minor glitch.

But you did violate the rules(laws) for submitting your I-129F. It can be denied or revoked since already approved.

There is another way a job could have gotten her visa denied. If she was entering the USA on a tourist or B-2 visa and was then working while in the USA, that could result in visa cancellation and refual of entry at the port and denial of a visa on the next attempted application.

All of this has recently been reported by one member of VJ as having happened to them.

She entered the USA twice and worked for a legitimate employer both times. On her third attempted entry into the USA under question by the CBEs, she admitted she was working in the USA.
