My fiance got NOA2 in the mail yesterday!!!!!! USCIS says updated as of October 20th (date on NOA2) but it's still in initial review.... guess we were one of those cases that never changes!
Anyway.... wahooo! NOA2!!

I just got my NOA2 in the mail today! I was so sick of being disappointed by this and the USCIS site so I stopped checking for two weeks and I then I got it in the mail today. The strange thing is I never got an email even though I signed up for it. I signed in and it shows it was last updated October 15th. I'll provide more details when I get home to read it with my own eyes, but for now I just put the NOA2 for today on my timeline. Good luck everyone!

Hey June filers!
I am new to VP and I am so happy I am not the only one out there frustrated with how long it is taking CSC to process K-1 applications.

My NOA1 was June 19th and have not heard a peep regarding my filing (not even a touch). When I filed I thought we could shoot for a December wedding - NOT!
Last month when spoke with a rep at the Embassy in Nassau and he told me their side of process is that once
an approval is uploaded into the system. They get notified electronically and then approx.
6 weeks after when they get the actual file and when they start the processing K-1 on their side - AGHHHHHH!!!!

Given all this we pushed our wedding date out to early 2011.

This is soooooooo damn frustrating!!!!!!

Hey everyone, I'm back.
Just wanted to say thinks for the help. We've decided to have Rania move here and stay in her own place, and have the wedding required here, then go back to Egypt after it's approved and have an Egyptian wedding to make it offical.

Sent the I-129F in tuesday, they recieved it on friday, and inshuallah it'll go through the USCIS quickly. I already know that's a pipe dream for Cairo embassy interview though.;)

Again, thanks for all your information. Your help saved us from making a messy mistake.

We just don't want to be married, then seperate for the time it takes to do the visa, and a k-1 seemed like a good option to do the waiting before the marriage takes place. So our options would be to get married here, and go back there for a big ceremony, or do the k-3 route. How long from the time of the application being sent in, until she would be allowed in the country?

I'm sorry if this question has already been answered... if it has, mea culpa!

Alright, so I want to marry a girl from Egypt, and bring her here under the K-1 visa. The problem is this: When I go to Egypt next year, we will be getting married. If we do get married while I'm in Egypt, but after she has been approved the a K-1 Visa, will it cause problems? MUST we wait and get married in the US, or will the marriage in Egypt be valid and she'd be able to enter the country on the K-1 Visa? Also, after we enter would we be required to have another marriage?

Navyk just said it but that is the key point. The poster above Navyk did not qualify the "Yes" and you did not state your approximate time or guaranteed time to return to the US.

Do not attempt to return after your letter of extension for one year has expired. The GC in your mailbox won't be of much help.

NO. I meant everything related to our taxes, like I said. That was a new thought. The RFE also asks for tax transcripts, which is also going to be lots and lots of pages and I was saying I would also send in ALL because I also thought it was excessive amount, as I thought was the case with the ten pages per month bank statements.

Hi Emma.

There are two types of Tax Transcripts. You can order them online, by telephone or in person. I ordered them on-line and received them in less than a week.

The transcripts can be short (2 pages) a cover letter and a listing of only the most important information. The other will be many pages, up to 10 pages depending on the complexity of the return.

1) Long one
Tax Return Transcript provides most
line items from your original return.

2) Short one
Tax Account Transcript provides
basic info, including marital status,
type of return filed, AGI, taxable income, and later adjustments, if any

The short one works well as it will list the filer's names and filing status and that is all you need. See weblink below.

You should make a copy of the tax transcripts and keep the ones sent to you. Treat those as Originals and follow the rules USCIS states for submitting documents. The rule is unless specifically asking for originals, send a COPY of the documents. In the worst case if you have to build another filing for whatever reason, you will have the Original transcripts to make copies of again.

(I know that the paper versions that arrive by mail appear to be xerox copies also. Just call them your originals and file them away.)

You are not late. You are allowed to send it so that it arrives there before May 9, 2013. You did not waste the month but you should start soon.

No one can tell you if your evidence is enough or not. It really depends on the USCIS Examiner on the day they review your file. If they feel more information is needed you could receive an RFE.

Did you have any trips together?
Use anything to show you are living together. Did you get drivers' licenses or IDs in Colorado. Did you have them from GA?
You don't have any joint credit card?
Life insurance policy.
Doctor bills for each of you from the same doctor. Something that shows your lives are together. You use the same dentist.

"I'm being careful to not ask legal advice here..." Good for you.

According to the I-751 instructions, your situation does not fall under the category "waiver from filing jointly" unless;
a) You have been a battered spouse or subjected to extreme cruelty OR
b) You can prove Exceptional hardship if you were denied ROC and returned to your home country.

However, if the marriage was terminated by divorce or annulment, then you would be free to file an I-751 petition asking that the requirement to file jointly be withdrawn. That would seem to be the best way to go. This is not legal advice nor a suggestion to divorce. Simply interpreting options based on the I-751 instructions.

First of all, what is "notarized" is the signature being written of the person giving the affidavit. So you would take the person (let's say your brother) to the notary public. He already wrote or typed up the affidavit. Then he would sign the affidavit in front of the notary giving his ID to prove it is him and the signature matches his ID.

I see long lists people post of their evidence and almost none of the lists have an affidavit in them. I provided one affidavit.

I do strongly believe the evidence of a solid genuine marriage is the most important thing. That does not even need to include an affidavit as they would assume you can find someone to write that for you.

Joint tax filings, joint bank accounts, joint utility bills, pictures and receipts or tickets from vacations together would be better I think in the eyes of the examiner.

Relax Lucy. I think you will be fine having the single joint account that you both contribute to and use to pay bills. The USCIS should be fine with that. I would expect them to understand the situation, it does not affect the way people would look on a genuine marriage which is what you are really trying to prove.

Yes, but when you join a job you are eligible to sign up for the benefits usually within 30 days. Any life event, marriage, divorce, adoption, having a baby etc... allows you to make changes to benefits without having to wait for the open enrollment.

For the OP, I would definitely change the insurance and save the 250/month. USCIS will not actually go and check the validity of you being a beneficiary of the wife's policy. If they did and sent you an RFE, they would request an explanation. Keep all of the paper work and explain you made the change for 250/mo savings. They certainly will understand that reasoning.

Actually, USCIS has recommendations for putting together your package. The most important thing to note from their recommendation is to STAPLE your check to the cover letter or I-751. I stapled it to the cover letter. All the rest was about 220 pages so I couldn't paper clip it, I just stuck it in a folder which then went in a 10" x 13" envelope and sent it. I think it is all there. I know the check went through.

You won't get an RFE. And I never have heard of them not wanting the Biometrics because you are required to pay the $85 fee per person with the I-751. Wait the two to four weeks. If you have not received an appointment letter, make an Infopass appointment.

Here is an outline of the complete process in California.

"Adding someone to your house deed requires the filing of a legal form known as a quitclaim deed. The quitclaim deed is a new deed that legally overrides the deed currently in effect. By filing the quitclaim deed, you can add someone to the title of your deed, in effect transferring a share of ownership over the property with the added individual."

In California the legal documents have different application. It seems a quitclaim deed is all that is required and the quitclaim deed needs to be filed after being notarized.

Wow, what a mess that post of mine started. In California we just call the whole process as it varies from state to state, filing a Quit Claim Deed.

I am not saying they will deny because of that but I am thinking it could be a red flag for an RFE especially with only the two years of tax transcripts. Since I eFiled last night I will wait one or two months and get the 2012 tax transcript to have in case of an RFE for that. I have seen postings about this.

That is good to hear. I am also wondering about that because I did submit a very full and complete package I have not added my wife to the title. I just never got around to it. I understand I can file some kind of "quit deed" to add her or I can refinance with her name.

The other thing I am worried about is I only had tax transcripts for 2010 (the year we married) and 2011. My 2012 taxes still aren't finished so I can't get a tax transcript. I am planning to order a tax transcript after I file them to have on hand in case of an RFE.

There have been other threads discussing this. Someone was saying that CSC is transferring its caseload to TSC for I-751's. But I didn't see that in the link on the USCIS homepage. CSC is transferring two other form types for processing from CSC to TSC to reduce the CSC caseload.

So far, I think the only thing about the other postings stating that the I-751's are being transferred to TSC is speculation. I cannot find it in writing.

I did notice that the CSC processing times about two weeks ago listed the I-751 at July 8, 2012 but also note that it is not now listed. TSC says 6 months but when I filed my I-751 about 18 days ago TSC was not an option for mailing, only VSC and CSC.

The question is only for children that will be requesting removal of conditions if they meet the qualifications of having entered or followed the foreign spouse in within a certain time frame and/or filed AOS within a certain time frame of the foreign spouse's AOS application.

The instructions that come with the I-751 are very explicit about the conditions and time frames. Please read the instructions.

I had trouble following your story. Just make sure he is not out of the country too much or that is cause for him to lose his GC. I think he cannot have more than any consecutive six months out of the US. A GC is not a visa for living overseas and travelling to the US as wanted. It is a permanent residence card for the person intended to permanently reside in the US.

I think it is better that you stay home and care for your spouse but I would try to document that somehow, maybe affidavits from friends, neighbors, relatives. There is no requirement you work as long as there is sufficient income for you to get by, your working is not an issue.

 

You already brought up the one thing that I was afraid you hadn't done and that is taxes. Make sure you have been filing taxes married (preferably jointly). If you can show your part-time or free lance income on the taxes you are covered there. It is better not to mention your freelance work if you have not been listing your freelance income on the taxes. But you should list it and no one here should encourage you to avoid filing taxes on your joint income.

There is a link on the homepage about transferring workload from CSC to TSC but the I-751 was not mentioned. They say only the I-821D and the i_765 are affected.

You have two options which are 1) remained married long enough to complete the ROC, or 2) she files the joint filing waiver and will have to wait for the final divorce decree before the ROC is finalized.  If she wants option 1 then the name will need to be what is already on the 2 year GC.  Option 2 she can use her maiden name as the divorce will be final when they approve her ROC.  Option 1 also as the waiting for the ROC to be approved before filing for divorce.  Option 2 is cleaner for you.

 

 

Actually, this probably isn't the best answer especially in keeping in line with the spirit of Visa Journey. You must never recommend  following a path that will mislead the government. Nor must you ever mis-represent material facts nor suggest anyone else do so. Option 1 is not an option as you are deliberately misleading in the process and should not even be suggested here.
