Also agree to just have Teaw hang on to the papers you sent. If they grill her again, she should turn in the papers. If it is a visa in her passport, she does not want to turn in those papers.

Yes, it is possible but please make sure you have it right and do not need to reschedule again. The Embassy will accomodate you for a very valid reason one time, maybe two times (Embassy specific) but do not push it. It is pushed out (further in time, not sooner).

You do not need to pay the $350.00 again.

As a side note to all Thai people. One post office in the province where Audy lives has said the new rate is 11,550 Thai baht. An absolute bargain for bringing over a lovely, warm, caring Thai lady. Anybody know one they could introduce me to??? :rofl:

I am very concerned about Bangkok now.

2) Should my Fiancee submit form DS-156 or DS-160 with Packet 3? The Packet 3 instructions list form DS-156 but the web site says to use the newer form DS-160. However, for some reason I can't remember, I am under the impression that the DS-160 form is for non-immigrant Visas so I can still use the DS-156 form.

The DS-160 is for non-immigrant Visas excluding the K-1/K-2 visas. You want to submit the DS-156 filled out online with the automatically generated bar code.

I tried to drag Audy into Victoria Secret's in Siam Paragon. But she would not do it unless I dragged her kicking and screaming. I am not sure if Siam Paragon is still standing.

I have already given Audy a credit card for emergencies. When she gets to the US, I will have to teach her how NOT to use it.

Thank you for the words of encouragement. We are both excited. After June 4th the fee will be $350 for the K1. I wish you luck and I hope that they get done with your case. When was the last time you contacted the Embassy to 'remind' them?

@Richard - Congratulations.

I am surprised that you were able to get a June 22 interview date. That seems sooner than I was expecting after all the closures at the Embassy. I think it is difficult to say how long out an interview appointment will be from sending in Packet 3 because of the red shirt disruption and even two days off around Memorial Day.

It is very decent of them to allow Ying to get her fingerprints done and save the money on the application fee. I know we will need to pay the $350 but at this point, that is not one of my major concerns.

Hey gang! Has anyone ever had to file an extension for approval of the I-129F? The NOA2 that we are working with expires in Jul. We mailed in packet 3 just before total mayhem errupted on the embassy's front door. We were banking on a Jun or early Jul interview but now that they're backed up from being closed I'm getting concerned. Right now we are just waiting to hear when the interview will be but I'm not counting on things happening very fast now.

Does anyone know if there will be automatic extensions due to the embassy closure and if not is sending an extension request a big deal?

Any advice would be appreciated.

Hi Herk, this is a common question from members interviewing at all Embassies/Consulates around the world.

The COs at the DOS (Department of State) can and will ROUTINELY extend the NOA2 expiration date. This is not a waiver you need to apply for. It had become such an issue the DOS posted a one line statement on their web site saying this will be done and has been there for a long time, nothing to do with the current situation in Thailand.

While the extension is automatic, I think it is a good idea to send an email to the IV Unit and let them know you are requesting an extension and desire to keep the petition alive.

Wait a week or two for things to calm down after they re-open. Then send an email to both email addresses with the Subject line:

and in that email simply say in light of the recent events in Thailand, and some delay in collecting all your paperwork, you are requesting an extension of your NOA2 expiration date of <enter your current expiration date>.

Yea, my fiancee is always on time too. THAI time which is ALWAYS 30 minutes to 2 hours LATE!!! It makes me angry but I can't change her - nor would I want to. It is easier to tell her she needs to be ready 30 minutes earlier than I really need her ready or for meeting somewhere.

I've never heard of such an age difference... I don't like to discriminate relationships because of age, but it's still weird to me. I can't help it. Just the thought that the person you are with is as old as your parents or even grandparents, is just too hard for me to overcome. :blink:

But if you can make it work, then that's all that matters...

When there is such a large age difference, 40, 50 or 60 years, does the younger partner know there is a very real possibility that you will only have 1 to 10 years of marriage with your partner? What if the younger partner is the woman and wants children very much as is often the case. Yes, I understand the man can still give her a child or two, but does it matter that the man knows he is creating a child that in all likelihood will either never remember his father or have a childhood in which the father dies at some difficult age?

This is one of our concerns too. I am older then my fiancee and he and his family spoke about it..I also spoke with my famliy about it. We are fine with it and age should have nothing to do with love.I am 20 years old then him. Will they really frown on our age difference? Can they really deny a petition because of age? Because of the country (sorry), but the COs (Consular Officers) will be looking for Visa fraud. This is nothing intentional on your part. But because of the relatively large age difference and the USC woman being older than the alien fiance (man) they will look very closely.

I cannot say they will deny you. I can suggest you prepare. They will not deny you for age difference, they will deny him (the beneficiary) for what they will think is Visa fraud. Using a potential marriage to enter the USA.

This is not what I think at all. This might be what the COs at the Embassy are thinking.

I think it's a stretch to advise that it will be ok. The more prudent answer is, as Bobby + Umit pointed out, it depends on the CO and the consulate.

Definitely agree with "Bobby + Umit" and "TracyTN." You never really know all the circumstances and the cultural norms and the CO and Embassies positions. I think I know which posting Bobby+Umit is referring to in which the woman was older than the man.

I also remember another posting from Romania where the woman was nine years older than the man and they were denied.

Again, this does not mean anything one way or the other for you. It depends more on your evidence of a genuine relationship, the Embassy and the CO for the interview.

No one can tell you if it will prevent you from eventually obtaining the Visa or not. It depends on the circumstances, the examiners, etc...

You will need to disclose this information anytime the form asks if you have committed a crime but not arrested for the crime (unless it was only a traffic violation).

Always be honest and disclose all information on the proper forms otherwise you can be denied and banned forever.

Well you weren't very specific. What is the document being submitted for? (The I-129F petition?) What language is it in?

All documents not in English must be translated. On the other hand if it is submitted to the US Embassy in the country of which the document is in the same language you would not need a translation.

Anyone including the petitioner or foreign beneficiary can translate the document as long as they follow the USCIS rules for translations. The translator must state they are fluent in the language of English and the Foreign language. Look on the USCIS werb site for their rules for translations.

Yes, that is a good idea, to track the number of the caller if it was Identified.

I asked if someone else knew about the filing and some details because I think that someone is playing a joke on him. Maybe not so funny a joke. USCIS leaves a trail of everything (usually) and would send a letter. They would not call. It does not seem reasonable.

Maybe he was trying to make a joke with you. Do not worry.

I would think maybe it is because of the I-129F application but I cannot believe they would call anyone to ask them are they "legally in the USA." They would send a letter to request some evidence (using an RFE) or in a more serious matter they would send officers to his home address (I know of these situations occurring unrelated to the I-129F).

I find it hard to believe it was a genuine call. Has he told some of his friends about his filing and some of the details?

You are misreading the next line. The certificate number relates to a Naturalization certificate, not a birth certificate, which will have an A# (I think it is the A#). Since your citizenship is through parents, not Naturalization, you will not have a certificate number.

As long as assets you own before marriage are well documented, one of the purposes of a pre-nup is that documentation, you should be fine on your primary concern. Note that there have been trial judges who have interpreted the I-864 as a ten year commitment in spousal support whereas absent an I-864 10 years of spousal support would never be ordered in the case of a short marriage (2-5 years of marriage). So your risk is communal property acquired after marriage and perhaps extended spousal/child support.

I listed my fiancés 9 yr. old son on our K1 application.
What documentation does my fiancé need from his ex-wife to bring their child to the US to live with him? She currently has full custody. Is a letter stating she (the mother) grants permission for the father to have full custody and to take the child to the United State to live with him enough documentation? Of course he would have her notarize the letter. Will this type of letter be enough for the embassy to approve his son to come with him to the US? Also, does the K1 application need to be mentioned on the letter? Thanks!

Does the scholarship mean you were here in the USA on a J-1 Visa? If so, does that J-1 Visa have a 2 year HRR (Home Residency Requirement)? A scholarship from the US Government or Home Government is the normal reason for issuing the 2 year HRR with a J-1.

If so are you still inside that 2 year period, when did you leave the USA? If you are still in that 2 year window, did you apply to the DOS (Department of State) for the Waiver of the 2 year HRR?

Probably should not fax it since they want to see an ORIGINAL signature on it. It is best to sign it in blue pen.

About the appointment, that is Embassy/Consulate specific. Some Embassies mail you the appointment. Other Embassies allow you to call tyo arrange the appointment. Check the web site for your Embassy or post the question in the Regional Forum for Africa.

Oh, now you have the fiance(e)'s country posted. I see you are Western European. That changes things in terms of how high is the barrier for proving you have a bona fide relationship.

I did not mean to not submit the I-129F because the pictures do not have a background. I just made the comment you have no other pictures, you cannot do anything else. Go for it and submit it. You do not have to wait for his visit. However this time around make sure to keep all the documentation also and take a few decent pictures with recognizable landmarks.

You require the I-134 Affidavit of Support to be filed for your fiance(e)'s interview. That form has instructions but the instructions do not say the income level required, if you can use assets, how those assets should be converted to an income flow and they certainly say nothing about a joint sponsor.

You should try to find members that have gone through the German Embassy/Consulate you will use and see if there is an accepted standard for the I-134. Otherwise there really is no instructions you can rely on in advance.

Well, since this is my first time preparing the paperwork, I am feeling a bit overwhelmed and would be eternally grateful for any advice or help!

I've read the gov site, googled, and read as many threads as I could from this forum, but I may have missed a few things and I'm just too darn slow sometimes -

1. Should I leave spaces on applications blank (when not writing "none"), or is filling every blank space with "N/A" ok? Do they find that annoying?

2. I make only 16k a year and have very little in my savings (due to the trip I made to see the fiance.) Will they deny our request because of that? He intends on getting a job as soon as he can, and my parents are giving us about 3k (dollars) while his parents are giving him 10k (euros). But that's not until after things are approved, so I won't be able to prove we have access to that.

3. Proof of an ongoing relationship - we never e-mail, chat on the phone, and barely chat on MSN - we use skype video to talk (it's free). I'm not really sure how to go about proving our ongoing relationship. Our MSN convos consist of "Are you awake? Get on skype." And that's it.

4. Pictures of us - are mostly up close, because we took the pictures ourselves. Will this look bad, without much of a background to look at?

Any help is greatly appreciated! Thank you in advance.

Some spaces are OK if you have indicate a section answer is None already such as Previous Spouses's name, you could put NONE, then leave blank any spaces asking for date and place of marriage, date of divorce, etc... You do not need to get carried away and cover every blank spot with N/A or NONE. Use common sense.

You have until the Embassy/Consulate stage to either increase your cash flow, income, or find out if your Embassy/Consulate will accept a joint sponsor and find a joint sponsor. The 16K will not be sufficient income and the cash amounts you mention won't cover up the shortfall. His potential to find work will not be considered. Even if he had a job offer in writing it could be refused.

Technically you don't need proof of ongoing relationship although you did not mention your country Embassy/Consulate. Some you might Front-load as some people insiste you must. Start collecting and logging all communications. Start diversifying communications. I have read people have logs or records from skyp communications. Find out if you can figure it out.

If you have no other pictures what are you gonna do?
