The other reason why we're thinking the fiancee visa is because it would mean I wouldn't have to take any time off any time soon from the new job (always a good thing).

I guess my main concern on the address portion of things is that i will probably be moving within the next few months which would most likely be during the visa process and I'm not sure if it creates more hassle to move while in the middle of it all . Though this does bring up an interesting question about the CR-1. Is it possible to apply from the non-permanent address?

You can still apply using your current address though temporary it might be. There is a form to be sent to USCIS the moment you become aware of the address change and are actually able to accept mail at that address.

That will give you instructions on how to notify USCIS if you change your address. I also believe there are instructions on the I-129F regarding notifying USCIS if you move during the processing of your petition.

pushbrk, while I find your replies normally well-thought out, informed and generally helpful, I do not see how you attempted to answer the OP's question. I found your reply overly pedantic and unhelpful.

It is not clear if the Embassy will allow you to continue and apply for the K-1 visa at this time. Please follow through with your correspondence to the Embassy in Bogota and see if they have her file and are still willing to process her application.

If so, I would suggest you dig in to the web-site, get the forms downloaded and help her start arranging for the interviews, medical, etc...

You know this doesn't have a known answer. It depends on the Consulate and even the adjudicating officer.

I asked on a forum specific to my Consulate if I could black out certain particularly personal parts of our emails and chat logs. One person answered that when that did that, the officer asked her to return with a set of documents unedited. Another person responded that they blacked out certain text and the interviewing officer was fine with that.

You do not know if it is not in the forms, the instructions or the web site for your Consulate.

You should be contacted by the US Embassy or Consulate where the fiance(e) will interview. They will either mail her instructions in the form of Packet 3 or directly email the instructions to you or the fiance(e). I have read posts where the instructions were emailed to the USC, so it can go either way.

If you want to get a jump start on things, go to the web site for the Embassy or Consulate (I guess Montreal or Vancouver) and look for their section on Visas. Go to K-1 fiancee visas and locate instructions for appointments and forms, medical, police certifcate and further instructions. You and your fiance(e) will need to be very busy.

If he receives a steady monthly pension that could be used to work as the co-sponsor. He will need to fill out his own I-134 separate from yours. In addition he will need to supply check stubs or something to show the payments or possibly use bank statements showing a regular auto deposit.

Also assets can ve used as opposed to income or a short-fall in income.

It is remotely possible they are referring to something at NVC but it seems very quick from approval at the service center to any possible investigation ay NVC. It does not seem likely. If you don't hear anything (receive anything) in a week, call the NVC to see if they have your case number or file.

Hi Ann, I hope you are doing well. I would like to see if you can get some more help from your USC fiance.

If the father's name is on the birth certificate you will need to try to locate him and show you could not. On the forms for father's address, write "Unknown" or something similar. "Whereabouts unknown."

But if his name is on your daughter's birth certificate, you will either need to get a legal document permitting you to take your daughter out of Thailand to the USA or show you have tried to locate the father but cannot. SInce you are in Thailand but from the Philippines, I am not certain how the US Embassy in Bangkok will handle the Visa application of your daughter.

Yes this is correct. The processing time as listed by the USCIS is currentlly 5 moths for the I-129F petition whether it is being adjudicated at VSC or CSC.

Do you have youe WAC number or EAC number> Then you could go to the USCIS website at www.uscis.gov, and sign up for an account. Then you could check to see what stage it is at. It might be possible you are approved or they sent you an RFE and you have been overseas unaware of what the status is.

Even though some claim that you can get a copy notarized and have it be considered a Certified Copy, I wouldnt go that route. You can get documents notarized almost anywhere, but you can only get a True Certified Copy of a Divorce Decree in one place.

This doesn't make sense. I highly doubt you could get it notarized as the notarization is an authorized person (notary public) witnessing the signature put on the document. There is usually not a signature being put on, although in my case the court officer did sign it, there wasn't anyone around to witness the signature therefore it cannot be notarized.

You can take it out of the courthouse to get it notarized, but then the notary public will not notarize it as they did not witness the signature.

Reading this site I have come to realize notaries and notarization has to be one of the most misunderstood concepts in the USA.

I read some conflicting notes about what the counsular needs regarding a divorce decree. I am a USC petitioner and my finace CO is Egypt. I have been divorced for 7 years and all I have a copy of the divorce decree. VSC just sent us our NOA2 but I heard the CO in Egypt requests for a "certified copy of divorce decree." What do I have to send my fiancee for her interview? And what do they mean by "certified copy"?

I had to do this as well. Some "copies" of your divorce decree might not have the Official seal of the county plus something that represents the judges signature.

I went in person to the court house for the county I was divorced in. They have the records. The man looked up my records, printed out 4 copies, then he stamped them with a large purple seal of the County, then he signed it as a court officer.

You need to do this. It cannot be an unsigned or unsealed copy of the divorce decree. I got 4 copies of the certified so I could have extras.

I just found and joined this forum. There are a lot of information here. I've read a lot but still have a few questions I hope some of you here can help me with. Thanks very much in advance.

A little background first. I'm a Chinese-American (naturalized citizen), and my fiancee is Chinese. I met her on the internet just over a year ago. Since then I have been back to China twice to be with her. The first time we spent about 2 weeks together, and the second time a little over a month. And we were engaged on my second trip. Now I'm starting the K-1 visa process.

First question, for my fiancee, on the various forms/letters that she needs to sign, how should she sign them? Since her native writings are Chinese characters, should she just sign like she used to or change the signature to English letters (i.e. use Pinyin for her name)?

Second question, since my fiancee and I mostly communicate in Chinese (I'm bilingual, fluent in both Chinese and English), can I translate those materials that support/prove our relationship myself (such as letters she wrote to me, our chat log, etc)? Would that be allowed or valid? If not, what is required for the translation to be official?

Third question, I have my naturalization certificate, do I still need to send in my birth certificate?

Fourth question, I read here something about one page or four pages for form G-325A. What is that about? I downloaded this form, and G-325A is only 2 pages, 1 for filling and 1 is instruction. So I'm a bit confused...

Last but not least. I heard that for Chinese applying K-1, the interview is done at the Guangzhou consulate only. Is that right? Only one place in entire China?? I hope I can get confirmation on this. My fiancee lives in Chengdu and there's already a US consulate there. It'd be so convenient if she could do it there. Also, is it possible for me to accompany my fiancee to the interview, I mean, go into the consulate with her?

1) She should in general sign in Chinese pinyin. There are specific locations on the I-129F and/or G-325A that clearly says, if your native alphabet or writing characters are other than the English Roman characters, sign your name here in your native alphabet.

The answer for this question is on the form. You are not reading the forms. So if it does not say use native writing, she must develop a pinyin signature.

2) The translations of email and chat logs do not come up at this stage. They will come up at the Embassy interview stage in Guanzhou. You should check about the translations on the Guangzhou web-site or there are many people here who have gone through GZ.

This is not correct. All children of the fiancee must be listed in question 13 of the I-129F. Listing the children there does not mean you are requesting the K-2 Visa for them. But you must fill out each question completely and honestly. That question asks for children of the fiancee (beneficiary). It does not ask only for children that will be asking for the derivative visa.

This does not seem to be off to an auspicious beginning. You and your fiancee do not seem to even see eye to eye on this issue.

In any event, you should have listed the child on the I-129F whether the child was following the fiancee or not. You made an error. It is not likely the I-129F will be denied as the USCIS will not know about the child. However you have damaged the likelihood for success at the Embassy by improperly filing the I-129F with all the children of the beneficiary listed.

No one can say what the Embassy will decide when your fiancee comes forward with the truth about her child(ren).

A document of sole custody is often not sufficient at a US Consulate to allow the Consulate to issue a Visa granting permanent departure from Mexico and permanent residency in the US. Often the Consulate will require permission in a very tightly worded form from the Biological Father granting his permission for the child to leave Mexico indefinitely.

I couldn't find a specific time limitation from the Embassies web-site in Accra, Ghana. Within six months should be reasonable. Since you have time before the interview, can you have your fiance(e) contact the Embassy and ask them if it is acceptable.

The other alternative is to simply get a new certificate about 2 weeks before the interview.

This is a really difficult question that might require a lawyer's advice. It really matters when she entered the USA, did you two already know each other, had you already filed the I-129F petition before she arrived, etc...

The reason is there might be an interpretation that she entered on a Tourist VISA with the purpose of marrying and/or immigrating. Some might call this VISA fraud. But this IS NOT legal advice as it is against the policy of VJ to give legal advice. But you need to be really careful.

The best answer might be to fulfill the K-1 Visa application in US Embassy Bangkok but while waiting for the interview, you can easily compile many pages of documents showing a genuine relationship.

You should contact the embassy immediately and ask for an appointment to have the visa reissued. I would also ask them about what documentation they will require to consider the request. You should also have a document signed by you and your fiance reaffirming you intentions to be married. It would also be wise to provide some documentary evidence regarding the circumstances that you required your fiance to return to her country. Only your fiance needs to write How you met. It actually should describe the circumstances of you two having met in person in the last two years. I wrote a list of the documents I had included which were evidence of our meeting.

He does not need your birth certificate nor your police certificate for the I-129F filing. You do not need to translate them yet. You might want to translate them for the Visa interview for the actual K-1 Visa much later. I think Ciudad Juarez probably does not need them translated for the interview but you will want translations of those documents for use in the USA. Maybe you will need them for AOS later.

No, he is not saying get married instead of filing as K-1.

It seems you are free to marry now. There was some mix up but I do not know what it is. If you are free to marry now and your foreign fiance(e) is also free to marry, you can go either way. I-129F petition for a K-1 or the CR-1 way.

DO NOT send USPS Certified or Registered Mail. This slows it down. It took seven days for mine to arrive to the same state. Your options should be USPS Priority Mail Return Receipt Requested or Fed Ex overnight with tracking that is very cool.

So G-325A is using the 6/12/09 version with many previous versions accepted. But not for ten years.

Petition for Alien Fiance(e) I-129F 07/30/07, 11/24/06 editions can be used, no other editions accepted.

I-129F is using the 07/30/07 version and only the one previous version. But it is now about three years that the 11/24/06 form is still valid.


You are only asking about a few months. You will be fine with the current versions, but your signature date should be fairly current as should your passport style photos you submit. If your signature is dated well before submission like two or three months, they might think your passport photos are not recent enough.

Just something to think about.

This is a very good question and has been discussed many times on VisaJourney.

1) I do not see your Embassy listed for your fiance(e) but I have read that London wants to see the USC check intends and fill in some appropriate wording.
2) The last thread that discussed this extensively involved a USC with a Co-sponsor and the responses to #11 did not match. One checked Do not intend and the other checked intend. The consular officer did not deny the visa but did request two NEW I-134 filings from USC and co-sponsor (joint sponsor) with matching answers.
3) Many people have said this question is not applicable for a K-1 visa. So the answer should be N/A K-1 Visa or some such thing. I have seen postings where the Consular officer did not accept that response, but it is a case of consular officer preference, in that posting the person said it is not consistent for all officers in the Embassy.

To be safe, I recommend checking the box for INTEND to: and write something equivalent to saying that the USC intends to provide all necessary support for ... <list everything you can think of> then write "and anything else as needed."

So I think in your case they will accept city and country or city and state which contains Kiev. Kiev might be its own district as is the case with most world capitals.

I am sure Kiev, Ukraine will be satisfactory.

They are not looking for the name of the Region of Just or Civil Jurisdiction building names. I did not put County Courthouse in Detroit, Michigan. I only listed Detroit, Michigan.

Your USC fiance(e) needs to fill out an I-134 for evidence of support. There is no requirement on the alien fiance(e).
If the USC earns 125% of the poverty line for the family size the fiance(e) will be supporting, then no assets or joint sponsor is needed.
Evidence to accompany the I-134 is two or three years IRS tax transcripts, up to six months of pay stubs from their employment, maybe a letter verifying employment is nice. Additionally bank statements can be provided but the pay stubs and I-134 along with tax transcripts are the minimum required.
