Good question. I did not explain that well.

First there are many types of waivers as always. There is an entire forum dedicated to the two main waivers I-601 and I-212.

The good news is you do not need a formal waiver. In the case of two I-129Fs within two years or more than two I-129Fs over any time period, you simply need to submit or augment your additional sheet to question 11. I cannot tell if this is really your second I-129F within two years as you only gave the approximate K-1 date. But if this is your second I-129F in two years time or less, than expand the explanation on the additional sheet. "We had co0me to realize we just were not compatible...so she did not go to the interview...etc..."

BE HONEST!!! DO NOT misrepresent the actual facts.

That is all you need to do. Your waiver is submitted as part of question 11. If there is no real mystery or contrary evidence, it will routinely be granted.

To start with, on the I-129F question 11, you of course need to answer honestly and give as much of the information as you can. Add an additional sheet but you should not give a long explanation.
Say yes, I have filed an I-129F previously for the alien (WRITE NAME). Give the NOA1 date if you know it or approximate NOA1 date if you do not have the sheet.
Give the A3 if you still know it and a short, one sentence explanation that K-1 visa was approved but ex- fiancee did not use this K-1 visa within the six months or whatever happened.

I think since this is your second I-129F petition within two years (Is that correct on my part???) then you will need to file a waiver which you can attach to the I-129F.

It seems if it was 1988 and you are staying the straight and narrow path now, with some good documentation you have a very good chance to make it. If you file I-129F for a K-1 Visa be sure to fill out Part C question 2 completely and honestly. And try to provide some documentation of your life since the convictions.

This definitely sounds like more an issue of what is happening on the Russian side then an actual problem with US Customs. I know Thai customs routinely X-rays the envelopes my Fiancee and I trade and I suspect US Customs might also X-ray some larger packets from Fed-Ed or DHL. But they do not stop any particular papers. I think they are only interested in any real contraband within the envelope/packet.

I think one legal approach might be (I do not want to recommend anything illegal or unethical) if you have a Master's Degree and a unique specialty within the IT field, you could try to locate an Employer in your fiancee's area that would sponsor you for an H-1B. Then I think if you marry her, you have a different avenues to AOS independent of your spouse being a PR.

I am not sure if this would fail any test of intent to immigrate. I would think all H-1b's can be viewed as intending to immigrate.

The only vaccination REQUIRED for my finacee to get through the consular level interview was td. That is the only one she got and had never had any before. We didnt have any problems. (Well until now - we have to get all the rest completed for AOS)!

Not sure if the requirements vary from consulate to consulate. I guess that is one of the problems with the "system", to much inconsistency.

I think this is correct. It varies from Consulate to Consulate. I asked in a thread specific to Thai people what to do. You might wish to go to the Central and South America forum to do the same. Also go to the Embassies web site for Bogota.

In Thailand, nore or very few of the Fiancees had their immunization records. I guess they do not think it is important to keep them. The doctors are very accustomed to this and run a blood test to see which immunizations they have had. Then the doctor gives the correct immunizations on a case by case basis.

If her B-2 application is denied which is very likely, May that hurt her case for K1 when it gets apporved??

You are right. The B-2 isn't likely to be approved. However if it is approved, it will not affect your chances later on in the K-1 visa petition or interview. If it is denied, I think it should not matter. She just needs to say she wanted to spend time with you in the USA but it was denied. No big deal.

While you have met the requirements of having met in person at least once in the past two years, it is very IMPORTANT you keep emails, chat logs, phone records to show you have maintained the relationship with your fiancee. This is what is most important to the CO at the Embassy. If you do have an opportunity to visit each other again, take a lot of pictures in different places, maybe with some relatives also in the photos.

The location should not be San Diego. It should be CSC for California Service Center. You do need to provide a brief statement (one sentence) of the outcome.
Technically, if you file before May 1, then it is inside the two year window and you need a waiver. If you file after May 1, then your second I-129F petition is outside the two year window and you do not require a waiver.
The waiver is not an official form or document to be submitted but might require a more extensive investigation. Thus you might need to document or explain in more detail than has been suggested so far. I am not sure what the actual difference would be.

The waiver is really answering yes to Part A - question 11 on the I-129F. Although if this is your second I-129F in two years or your third or more I-129F petition ever, than yes you need the waiver. If this is your second I-129F petition in MORE than two years, technically the law does not require a waiver. But you still should answer question 11 with the required information.

Yes, you must pay the visa application fee for each applicant. The children requesting the derivative K-2 Visa are also applicants. Be thankful it has not yet been raised to $350.

No one really knows what percentage of total petitions filed with CSC and VSC are then reflected here on VJ. So VJ represents only a very small number of all petitions actually filed. So the average here from VJ is statistically meaningless.

As the other two knowledgable responders have already made it clear, the only Consulate for K-1 visas is Ciudad Juarez. So you cannot petition to move the Consulate/Embassy for adjudication. She will need to go to Ciudad Juarez no matter what. NVC will send her file to CJ no matter what you put on the I-129F.

In this thread the OP posts that his fiancee was denied for not knowing his job title for his work in 1994. I posted a reply that I thought such a question would not carry much weight in a CO's decision. Another member seemed to jump on me for not believing a CO would use such a question to discount the validity of the relationship.

I do not know for sure, but i think if a CO wants to prohibit the Visa issuance, they will find some trivia question to ask. I know my fiancee does not know the name of the high school I attended nor does she know what my job title was in 1994. The Consulate will not know either answer. But I have told my fiancee if they ask her a question she does not know, to say the truth and tell them she does not know.

I was not able to fit my fiancee's address in for Part B, question 2. I was able to fit it in later I guess it was queston 15.

So for question 2 of Part B I wrote See Additional sheet B-2.

I attached the additional shhet with her address only for Part B-question 2. I submitted the form with her address filled in for Part B question 15.

Make sure the sheet is labeled "Additional Sheet I-129F" and label each section you are answering in the additional sheet such as "Part B - 2." On the bottom of EVERY page of your additional sheets, SIGN and DATE the additional sheets.

Actually you should make a copy and keep it for your records.

It is possible your fiancee will need the original NOA2. I know in some countries the fiance(e) needs to show NOA2 or can show NOA2 in place of Packet3 to start the police certificate request or the medical.

Your fiance(e) should have all originals with her/him for the actual Embassy interview including your birth certificate but not your passport. All originals including any copies submitted for I-129F such as airlaine boarding passes, hotel receipts etc...EVERYTHING.

Definitely go with Priority Mail over some other type of USPS service. I used Certified Mail with Return Receipt requested. It turns out Certified Mail slows down the delivery. It took seven days to go 400 miles to the South in the same state.

Return Receipt or signature request is nice for added peace of mind, but online tracking is very good. Only Fed Ex online tracking seems to work in real time. I was very disappointed in the USPS online tracking as it is updated when the Post Office took my money and the package but then it was not updated for another 7 days until it was delivered. That is not my definition of online tracking.

And the USPS wonders why they are losing billions of dollars (besides billing and bill pay on the internet, UPS, Fed-Ex, DHL, email, etc...).

I think room is used more as a figure of speech than literally having had to meet in a room. Meeting anywhere, a restaurant, a park, a trip and never sharing or being in the same room is required.

In addition to BRIEFLY explaining how the USC and the alien fiance(e) got together in the same location at the same time, you should provide evidence to help establish the credibility of your story. You should list the evidence you are including.
Copies of (used) airline boarding passes
Copy of airline letter or email showing mileage credited to your account for flights to/from place xxxx.
Hotel receipts (preferably with both names) but maybe just the one traveling
ATM receipts from the same city or vicinity where you claim to have met
Restaurant receipts

Photos of you two together - anywhere...preferably more than 1. maybe 2 to 4 with different clothes on over different days

Then there was the recent posting where the beneficiary was told to get the I-134's redone so that the answers corresponded to each other. One had "intend to" the other person had N/A.

I think the primary should put "intend to" and list any and all necessary expenses including...blah, blah, blad.

I think the co-sponsor should also tick "intend to" and write intend to contribute whenever necessary to provide for the care and well-being of ...blah, blah, blah as required.

...MENA, SE Asia, India, where age differences in couples are very unusual, and most people are very traditional, it could be a problem.

I am assuming this is a typo or else a grave lack of information. It is extremely common in SE Asia, Thailand, Cambodia, Laos, Vietnam, etc... for a younger woman to select or prefer an older man. The age difference in couples is VERY USUAL. This is because the woman prefers a man that is responsible, able to care for her (yes, money), and is more settled in their ways (means less likely to go out and find other women).

It is extremely common for a Thai lady to prefer a man much older. I am not saying it is right. I am saying it is USUAL.

You can register as an applicant customer at www.uscis.gov and enter your case number. WAC# or EAC#. Then when your case is looked at, the date will change.

You can also sign-up to be notified by email or SMS text messages.

The other reason why we're thinking the fiancee visa is because it would mean I wouldn't have to take any time off any time soon from the new job (always a good thing).

I guess my main concern on the address portion of things is that i will probably be moving within the next few months which would most likely be during the visa process and I'm not sure if it creates more hassle to move while in the middle of it all . Though this does bring up an interesting question about the CR-1. Is it possible to apply from the non-permanent address?

You can still apply using your current address though temporary it might be. There is a form to be sent to USCIS the moment you become aware of the address change and are actually able to accept mail at that address.

In case the link above does not work, go to www.uscis.gov. Click on forms. Scroll down to the first form (I think) and click on AR-11. That will give you instructions on how to notify USCIS if you change your address. I also believe there are instructions on the I-129F regarding notifying USCIS if you move during the processing of your petition.
