For G-325A, you can make a continuation sheet similarly to the I-129F. Follow the same guidelines for the I-129F but applied for G-325A.

On the G-325A, enter into the space "See Additional Sheet G-325A - #"
where # is the question number.

Also there is a gentleman on this site with a link to a modified G-325a that allows Acrobat to dynamically reduce font-size and fit the address in a limited space. I did not use it for my filing but I did test the form and it works well. Let me find a link to his form.

i don't have any advice to offer but i wish you luck.

audy rob, is that a new requirement on employment letters in bangkok? when my husband went through there (nearly 3 years ago) it was not required. i would think for a good number of thai's that it would be difficult since there are so many cash type jobs in thailand.

It is not new, it has been there since 2004 that I am aware of. I think it is a much more important issue for Thai ladies to provide letters of employment than it is for men. Due to a lack of education, a weak child/spousal support system, and very little welfare state for children and single mothers, prostitution is quite prevalent in Thailand.

For Thai ladies, even if they are in a cash job, should be able to provide a letter from their HR department or manager/boss stating when they started, or how long they have worked there and what their responsibilities are. It is best to provide a sequence of letters if the amount of time at the last position has been a relatively short time.

Read the web site for the US Embassy in BKK under the K visa interviews. It is a listed item.

At the US Embassy, they will require accounting of her time since she left school. They definitely will require letters from all employers for a history of employment.

If you met in person in Phuket, that will be a red flag.

If you have met online, flown to Bangkok, met her there and then flew to Phuket for a one week holiday, that would be more reasonable.

I think it will be very difficult.

No the instructions are very clear on how to file and what to include. No other options.

Actually the instructions state that you must have met in the two years preceding the filing UNLESS it;

A) Goes against long established social and cultural norms for your society and religion OR

B) The requirement to meet would prove to be an EXTRREME hardship.

I have never heard of anyone getting either of these waivers.

When you do provide tax returns of prior years, tax transcripts are preferred which can be ordered for free from the IRS.

looks like it was a lot faster... delivered to them in 2 days - even with all the snow. they already deposited the check!

That is good that it is much faster. I got my receipt back from the USPS and there was no signature for who received it. Just a stamp number 066 I think. I also got NOA1 hardcopy yesterday Feb 12, 2010 in the mail. Now just sit and wait, hopefully no RFEs

I think it is OK.

I did my I-129F to CSC by Certified return receipt. I sent it on Feb 1, 2010. I just saw on the USPS web site it was delivered to CSC today, Feb 8, 2010. So it took 7 days. I hope Priority is a lot faster than Certified.

Everyone is soooo helpful on this site. Thank you all so much!!!

I am a grad student with a student loan and do not work. I graduate in May 2011. I own my own condo and receive finacial help from my family. My mother has offered to co-sponsor my fiance to move here to the US from the UK. But after looking at the forms, it looks like the only type of co-sponsor form that is available is a "household member" type of form. My mother and I do not share the same residence nor does she claim me as a dependent.

What is the best way for us to get around this?

You are reading household member way too literally. The co-sponsor does not need to actually reside in the same physical home as you do. Your mother will work well as long as she does all the things required on I-134. Many members use a parent, relative or friend not living under the same roof.

At the USCIS web-site, click on forms, then scroll down to the I-129F, you will see the following:

"07/30/07, 11/24/06 editions can be used, no other editions accepted. Please note that USCIS is currently accepting the 07/30/07 version of Form I-129F despite the fact that it has passed its expiration date. The Office of Management and Budget (OMB) is still reviewing our request for an extension of this form. We will post the form with the new expiration date once OMB approves it. In the meantime, continue to use the form provided here."

This makes it very clear that the current form with the Jan 2010 expiration date is still valid. Good luck in your journey to come.

I followed tthe links from the US Embassy in Bangkok since I am doing a K-1 that will require filing the I-134 form. There link connected me to the I-864 form. You must earn 125% of the Poverty guidelines, not just meet the amount in the guidelines.

Assets can include equity in property such as home ownership or owning land outright. It includes savings accounts, CDs, stocks, bonds, mutual funds. Do not include a car or anything where you cannot generally access the money or take out a loan against the asset or sell the assets fairly easily.

I remeber reading a posting over the weekend where there was an estimated 50% of people with convictions were delayed at NVC. It was not a scientific poll and was based on a few respondents. It is hard to say what the effect will be.

I think you might want to select the best translation of Turkish Sounds into an all Roman Alphabet. Then use the box where it asks for Fiance(e)s name if written in other than Roman Characters to write the correct Turkish spelling.

There are other things to consider such as Credit Cards and Travelers Checques if you use them or will use them. It is best to develop an all Roman spelled name and signature which is used for Credit Card signatures and Travelers Cheques. My fiancee is from a country where the native alphabet is not even close to the Roman characters. I am asking her to continually practice an all Roman signature to prepare her for life here in the USA.

This is a little difficult to explain.

You do not need to prove she is single. Some countries do keep a database of marriage and if necessary, you can only show she is single if they keep a database in Colombia. They will not ask for that. You are going to need very strong documentation from the biological father stating that he is giving his permission for the child to emigrate to the USA.
It sounds like the father is NOT ready to do that.
You need to think about what time frame is right for bringing the child to the USA. More than 6 months or less than 6 months.
The K-2 visa for the child is a derivative visa from approval of the K-1. When your fiancees K-1 is approved by the Embassy then the child would automatically have a K-2 visa if you ask for it. You do not have to ask for it yet. You can reapply later. The K-2 derivative visa is valid for 6 months after approval. Your fiancee could come through and try to get settled. Then within six months the child could come on the derivative K-2.
I do not think at this time you can get the derivative K-2 without a solid document from the father which he won't issue until he is comfortable with his son's future domicile.
You need to discuss your options with your fiancee and what sounds like a reasonable and concerned father of the child

You want to keep evidence of a bonafide and ongoing relationship. Besides, if you are like me, I miss my fiancee and want to see her as much as I can. 22 days until my next trip to be with her.

i met my peruvian fiance in april of 2008 in the US when he was working there on a J1 VISA that has a 2 year requirement that he cannot return to the USA until then... but i am confused as to if this means 2 years from the day he entered the USA or years from when he left and returned to Peru.

My ex-wife was a J-1 from Venezuela. But a J-1 was a student visa on a scholarship funded by their home country's government or a private agency not their family. The J-1 used to be impossible to get around (except for a waiver which was impossible) . I have not heard of being allowed to work in the USA on a J-1.

But the point is, that now the DOS (department of state) routinely issues no objection letters which must become part of the I-129F package if the student was/is here in the USA on a J-1. I think you should check to see if there is a waiver for the J-1 and also check on whether he was a student and maybe working when he should not have.

This is something I asked my fiancee to do before we sent the papers to CSC. I told her in the USA we use signatures a lot for checks, credit cards and many types of documents and contracts. I showed her about a signature when we were together. Then I asked her to practice and start developing a signature for her in Roman Characters. It was more difficult since her native alphabet does not use our Roman character set.

I am surprised that in Colombia they do not have a signature. My ex-wife is from Venezuela and she always had a normal signature.

But I plan to give my fiancee a credit card and travelers cheques etc... She will need a signature in the Roman alphabet.

I think the father we need to turn over sole custody to your fiancee and also write a legally binding document granting your fiancee permission to take her daughter out of the country to the USA permanently in order for the Embassy to grant a K-2 Visa.

Next, the K-2 visa if granted is only valid for 6 months, so you would not have the option of getting the derivative K-2 visa and having the daughter follow you as much as a year later.

You would need to go through with just your fiancee's K-1 visa and abandon the idea of the K-2 unless you think the daughter's father will provide the necessary legal paperwork.

If you do not follow thorugh getting the K-2 Visa for your fiancee's daughter together with the K-1, you would need to wait for your fiancee to become a Permanent Resident which would then allow her to file for a different visa for her daughter to come live permanently in the USA once you and your fiancee are adequately settled.

I wanted to write because this is very strange. When I download pictures from my camera to my computer and send them for developing, I do not get the date and time. But when I was in Bangkok with Audy and we stopped to get some pictures made from my camera, I stuck the memory card into a computer there and they printed them at the shop in Bangkok.The proper dates and time were printed out on the photos with the date and time the photos were taken, not a current date and time the shop could have printed on them.

I cannot figure out why there is that difference.

If she is able to obtain a passport and travel outside Cuba alone, no Cuban marriage laws are applicable. For US immigration purposes, she only needs to be of marriageable age where the marriage will take place. Since the marriage in a K1 visa case MUST take place in the USA, and 18 is old enough to marry in and US State, there is no age issue regarding the marriage.

Whether Cuba will grant a passport and allow travel alone is a totally separate issue from marriage or US immigration.

You do not think the US mission in Cuba (I am assuming that is where the adjudication would take place) would honor or respect the country's laws in granting a visa. I understand the US state laws about age are the only ones that matter for the purpose of being eligible to file the petition.
I rather think if I violated laws of marriage in Thailand, the Bangkok Embassy might deny a visa to my fiancee. I think the Embassy has some place in honoring the home country's laws and customs. It seems rather flippant to say the laws of Cuba do not matter.

The legal age of consent in Cuba is sixteen between Cubans, not with foreigners. Eighteen is the legal age of consent for tourists by the way. so i guess it would be around there.

Also, she needs to be eligible to marry in the state of your residence, not really the US federal laws. There are not federal laws regarding the age to marry. But every state has its own laws on the age to marry. She must be of an age for your state. I would think 18 is fine for every state in the US.

Don't panic. I have read that there are some Embassies/Consulates that do not accept co-sponsors for a K-1 Visa. Of course you could try the CR-1/IR-1 route if you were thinking to marry soon. But you will still need to show financial support but the co-sponsor might work.

I just read through the San Salvador instructions for K-1 after NOA2 and there is NO specific mention of I-134 in the INSTRUCTION PACKET. There is a link to the I-134 on the page.

You can try the links to Central and South American Regional forum or you might try an email to the Embassy in San Salvador.

If you can start a job in the US that will meet 125% of the Poverty line for 2 people, then the pay stubs and letter of employment should be sufficient. Assets will help and I think your tax transcript to just show that you were working and filing will also help. Your situation is no different from a recent college graduate.

Did you list ALL of your fiancee's children in Item 13 of the I-129F ? That is all that is needed for the Petitioning stage which you are now at.

My fiance has children that we want to follow to the USA. I have read in some of the instructions that it is necessary to complete an I-130 for each child. The instructions seem to indicate that I, the American citizen, am responsible to fill out the I-130. However, in Section A, Relationship, I as the petitioner need to select who I am filling this petition for. Since my fiance and I are not married at this time and I am not the natural father of the children, the box Husband/Wife, Parent, Brother/Sister, Child does not seem to apply. Does anybody have an answer to this dilema?

You don't fill out the I-130s for the children. The children of your fiancee are entitled to the derivative K-2 visas that are automatically awarded to the children when your fiancee successfully obtains the K-1 visa.

The children need to be listed on the I-129F.

You will need to fill out their own forms at the Embassy interview stage. Each child needs their own Visa application at that time (not now).

You will need a properly executed affidavit from the biological parent (father) of the children allowing your fiancee full custody and right to move the children permanently to the USA. This can be found in the K-1 Visa FAQ in the FAQ sections of VJ.

It's my understanding that the waiver would be required IF he had married the first K-1 lass in the USA, then divorced her.

Since that's not the case, again IMO, the waiver isn't required.

A letter of attestation about the prior K-1, IMO, is needed , when filing the petition, as well as listing the prior K-1 on the I-129F application.

No, it has nothing to do with marrying the K-1 or using the K-1 visa. The issue is the number of I-129F petitions filed and the number of years between filing those two or more petitions.

And as the author pointed out in this very good article, sometimes a K-3 petition, being an I-130 and I-129F counts towards the total number and sometimes it does not count.

This OP asking the question is:
1) Probably more confused now then when he asked the question.
2) In need of a Waiver on the grounds of filing the second I-129F before April 2010
3) Possibly in need of a waiver due to the K-3 petition regardless of when he files the I-129F.

Therefore the original poster (OP) should file for the Waiver. Simply explain the circumstances of the previous two petitions requesting a Waiver.

If the petitioner has filed two or more K-1 visa petitions at any time in the past, or previously had a K-1 visa petition approved within two years prior to the filing of the current petition, the petitioner must request a waiver.

So if you file the I-129F before April 25, 2010 you should give a one paragraph statement of what happened and end it by saying you are requesting the waiver. If all is correct and there are no other problems, the waiver will be routine and you should receive it.

I am assuming you have divorced the lady from the K-3/K-4.

I think you should list all petitions for I-129F and the I-130 for K-3. It might be viewed as this is your third petition, not second. This is because you should have filed an I-129F with the I-130 for the K-3/K-4. I didn't realize the facts about the K-3 until now.
