I don't believe I see any problem or issue here. There was no crime committed or reported. You were not denied entry into the USA. You were denied entry into South Korea. So you do not report that anywhere. The US is only interested in US Visas you applied for, US Visas were granted, US Visas denied, US Visas revoked and US Entries both allowed and denied.

You have nothing to report, nothing to list. You will be fine.

Actually, yes, the Consulate or Embassy might handle it differently. She will not be denied a Visa just because she is pregnant. But I would expect all American Embassies to have instructed the Consular Officers to make sure the Petitioner is aware of the pregnancy and still supports the Fiancee.

The petitioner is allowed to withdraw support for the Alien beneficiaries Visa application. So the Embassy might handle it differently, but I do not know how. I just wanted you to know of two cases I have read here.

She will not be denied if you still agree to support her. A notarized affidavit should be sufficient. Perhaps if your petition has reached the Embassy, you can send an email requesting how they want to handle the situation.

As mentioned the pregnancy will be reported from the medical. I believe it is tested for in case it is not obvious and not revealed.

In one case posted here the Embassy officer did not care that the USC was the father, he asked the questions:
1) Are you aware your fiancee is pregnant?

The poster replied yes it is my baby. Officer did not care.

2) Officer asks do you still support this woman's petition?

The USC replied yes. So she was approved.

What is important is that the USC send a letter informing the Embassy if he will not be present at the interview that he is aware of the pregnancy and still supports the fiancee.


This is difficult in Bangkok and other Embassies where the USC is forbidden from entering for the interview. If you cannot attend the interview or the Embassy does not permit you entrance, then make sure you have an affidavit prepared in advanced stating you are aware she is pregnant and still will support her application, notarized and have your fiancee present it at the interview.

Hi,

Just a couple of quick questions:

(1) As I read through the archives here there is a lot of talk about 'high fraud consulates' but I've not really seen any kind of list of which embassies fit this definition. Is there some kind of objective measure or is it pretty much just a subjective criteria. In either event, I'm wondering whether or not people consider Bogota, Colombia to be a high fraud consulate?

(2) A few weeks ago I received in the mail from my fiancee, signed / dated copies of her G-325A and letter of intent. The forms are dated April 3rd, but unfortunately, I still haven't got everything together to send the I-129F packet off. Does it matter if the signatures are stale by a few weeks?

The signatures can be off by a few weeks with no issue. The only reason USCIS might think there is an issue is because the passport style photos should be taken within thirty days of the submission of the I-129F. She did send you recent passport style photos didn't she??? Anyway, if the signatures are dated six weeks before the submission, then the photos are probably not within specification either.

Hi,

I have a small number of documents (none of them strictly required or critical to the process) which are written in Spanish which I'd like to include along with my K1 Petition packet. They consist of a three or four emails written to me by my fiancee which serve as general evidence of an ongoing relationship as well as a pair of boarding passes and a letter from the Chilean government documenting her travel to Colombia all of which go towards documenting us having met within the last two years.

I know that I need to have all of this stuff translated, but is there some requirement with respect to who does the translating? I'm more than capable of doing it myself, but am I allowed? If not me, can I just have a bilingual friend do it? Or do I need to find a translator with some specific certification.

Since the petition goes to USCIS, I would suggest reading and using their guidelines. When you go to this link look down about at the half-way point.

Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

You do not really need emails for the petition packet for the purposes of an ongoing relationship. You do for the Emabssy Visa interview. You definitely need boarding passes and anything else that goes toward proving you have met.

Anyone that is competent in BOTH languages can do the translation. No special certification is required. Yes, you can do it. But you must state on the translated documents that you are fluent or competent in both languages quite easily capable of performing the translation. Yes, a friend can do it. Anyone that is competent. DO not forget to add the declaration of ability to translate to all translated pages.

She told me that the police records in Russia falls within the region not the city. You can have many cities within a region. So I guess the rule is whichever they are consolidate at the lowest level.

You should check the information in Packet 3 for the Consulate you will be interviewing at. They give the requirements for the Police Record as they do vary with the consulate. Bangkok wants the certificate for every country you resided in for 12 months or more.
Normally the home country is just treated as one police certificate but you should check the web pager for your Embassy.
Some countries do not provide the police certificate if you live outside like South Korea. So all other Embassies consider that one unobtainable.

I have only been there to see her in person once a few months ago. I would love to go again before her interview but I don't have enough time off to go now and again to bring her home with me. I would prefer to go and accompany her home on the plane. Do you think only having one visit in person will likely cause a problem even if we have several hours of chat logs every day since we met?


One visit only is not a reason for denial. However I think it raises the bar on documentation necessary to show an ongoing committed relationship. Emails, chat logs, phone bills etc... will be required.

Hi everyone. We're almost ready to start "our journey" and my fiance has a couple of doubts about question 11 of I-129 F ("Have you ever filed for this or any other alien fiance(é) or husband/wife before?").
a) An I-130 (petition for spouse) was filed for his former wife in the past, so does he have to state "Yes" even though it was another kind of visa?
b) About ex-wife's Alien registration number, where can he find it? (I mean, in which document)

1) Didn't the I-130 K-3 filing also require an I-129F submission. I think it does. That is why on question 11 they ask for husband/wife as well as alien fiance(e). So I think it is yes.
2) The A# can be found on the NOA2 from his first petition.

Also another point is, that the US asks about her work and where she worked, but that does not mean she was working in Norway. Unless she was present for 6 months or 12 months continually in Norway, that does not come up either.

Embassies ask for police certificates from places where you have lived for 6 months or 12 months (depending on the Embassy).

I have traveled to Japan, China, Taiwan maybe up to 100 trips with business visas back when Japan required them. It does not mean I have ever "worked" in Japan as in relocated and lived and worked there.

As someone suggested, at least in the state of California in the USA, there is a way to get divorced if the other person does not agree or will not make themself available. That is, they leave the country.

We can make an attempt to contact them and if they do not respond in some time frame, I believe six months, then you can continue without them. I actually saw a divorce granted in abstentia.

Make sure whatever you send includes dates. May boarding passes don't have dates on them. Send in itineraries and receipts showing the flight dates along with the boarding passes if they don't show the dates.

I had the same problem. My boarding passes did not have the dates on them. SO I included the flight itinerary that was emailed to me when I purchased the tickets and also an email showing the mileage added to my account which listed the flights and dates.

I think on the back of many boarding passes are advertisements that the airline sells. I know I have seen advertisements on the back of JAL boarding passes and I believe EVA boarding passes.

1) Requirements are
a) You both are eligible to marry, divorced, annulled or single.
b) You two have met in the two years before he files the I-129F petition. You should have strong evidence of your meeting.

2) Your 18 year old daughter should be able to go as she can get the derivative K-2 visa to go with you and the other daughter. He will need to pay the Visa application fee for you and each daughter, so three applicant fees. Currently it is $131. But it is to go to US $350 anytime now, but nobody knows when or how they will do the fee increase.

3) Processing time is difficult, it varies (changes) with every person or applicant and I do not know much about the Embassy and process in the Philippines. Right now it is 2 to 5 months for I-129F. I did it in 46 days. Then the Embassy needs forms, medical, then a passing interview in person. That could be 2 to 4 months. So I would GUESS 4 to 8 or 9 months. Really, it can vary with each person.

Somewhat difficult to answer your question. His 20 years in the US will have no effect one way yor the other. But there could be circumstances not described, which would make it hard for anyone to tell you this is routine case and will be fine. Normally a divorce should have no effect on the Visa approval, of course there can be circumstances before the divorce that might raise a red flag with a Consular Official.

I' m curious. :blink: While checking out the plane tickets I realized the return / roundtrip ones are way cheaper than the one - way ones. As I wanna save money on it ( and on some one can save up to 500 euros :blink: ) I was wondering if this can cause any problems at POE. People entering USA on a K1 visa shouldn' t have a roundtrip ticket anyway so do the officers there even ask or are we all supposed to say something ? Or it doesn' t really matter what kind of a plane ticket one has ? :blink:

Many people do this. It is a little bit of a problem with the airline so you should not do it often using the same airline. The POE inspectors don't care. As a matter of fact, it is good to have.

It says: Send an original letter affirming your desire to marry your fiance and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).


Is it saying just submit the same letter with a more recent date? This is what the original letter contained:

It should be addressed to the Department of State, then the US Embassy or Consulate you will be interviewing at. See the Example in the section at the top of VJ called Example Forms. Also, since you are the USC you should state you continue to support the beneficiaries petition.

I guess I'm still thinking about this...I mean, between writing a succinct and straightforward account that's backed up by ample evidence and writing a very flowery account of our falling-in-love process, am I wrong in thinking the first is best? The correspondence I include indicates how difficult it is for us to be apart, how excited we were when I got to come visit, etc. Does anyone else think this would be a problem?

One way to do this is to write in Box 18 what you first stated, short and to the point as well as writing "See Additional Sheet I-129F, Part II - 18.
Then on the additional sheet, without any flowery language or story telling document or catalog in one sentence per documents the proof you are submitting. This is what I did, I basically turned Question 18 using an Additional Sheet into a list of my proof.
1) See attached sheet of boarding passes...
2) See 2 sheets attached of photos ...
3) See hotel receipt attached for...
4) See hotel receipt attached for time in ...
5) See copies of Visa Stamps showing entry into Thailand...
etc...

Along with the answer fitting in the box you need to provide substantial evidence of having met in the two years prior to filing the form. So besides the answer, you should provide documents and photographs showing you have actually met. I know it seems a little crazy if you have been living together or dating for a while but it is a serious requirement.

Oddly enough you can get the answer by going to the USCIS web site, www.uscis.gov, and click on FORMS at the top left. Then scroll down to the I-129F. It will list the current Fee of $455.00 or else you can click on the forms instructions which also state the Fee of $455.00.

The next step is the Visa Application Fee which is paid by the alien beneficiary at the US Consulate or an agent for the Consulate. That is currently $131.00 per visa applicant but the amount is going to be raised to $350.00 per Visa applicant. But no one seems to know when that increase will be enacted.

Yes, South Korea is the same situation. You cannot obtain police records from South Korea. The Embassy considers those records unobtainable. You can go to the Department of State web-site and search for Reciprocity. Then set the country to South Korea. Scroll down to Police Certificate or records. You can only obtain those records if you are currently living in South Korea.

The US Embassies consider South Korea Police Records Unobtainable. (Means you can't get them. So they do not expect you to provide them. OK ???)

No Police Certificates for Mexico and South Korea.

Everyone needs the police certificate, whether you have a criminal record or not. It is required for every place you have lived more than 6 months (12 months for some Embassies) since you were 16 years old.

The police certificate is appected by the Consulate or Embassy for one year. So you can get it now if you think your interview is in about 5 months.

A comment on something you wrote in your first posting. I noticed your fiance filed in CSC or the California Service Center. Based ON JV member statistics, about 75% of the I-129F filers at CSC have been getting NOA2 in about 50 days. So that process is not 5 to 6 months. Some members have been longer though.

No, everything he listed is new. You might want to go to the US Embassy or Consulate web site for where you will interview. Look at Fiance Visas or K visa packages. They will probably have Package 3 on line. Start reading the forms and checklists so you know what to start preparing.

Also, keep all records of your trips and communication with your fiance. Phone records, emails, chat logs, airline tickets, border crossings in a Passport. Photos of you two together when visiting or even better is of you two with the parents of each.

Normally, she needs to have all documents before she sends in the checklist requesting the interview. Many people sort of cheat on this requirement and send in the checklist while not having all documents like the I-134 from USC or police certificate.

The amount of time to schedule the interview or time from Embassy receiving Packet 3 to Actual interview date is up to your Embassy or COnsulate. Mine has said it will be two to six weeks. Some are four months.

Some things she needs to send to the Embassy to request the interview appointment. Normally DS-230 Part I original. Maybe others, but should send copies of all forms and papers like DS-156, DS-156K, DS-157, birth certificate, I-134, divorce decrees.

Please read the instructions YOUE Embassy wants. Follow the instructions your Embassy wants. Every Embassy asks for something different to be returned. Read your Packet 3 instructions.

Yes, actually I have heard of it because there is another VJ Member who is going through something very similar.

You are going to need the services of a competent lawyer. That is what the other member ended up having to do. You might be able to get a judge's order compelling the USC father to sign. A family attorney would be able to advise you best about that option. The other option is to consult an immigration attorney to see if in the attorney's opinion the US Embassy will consider the unusual circumstances sufficient to grant the passport to your fiancee's daughter.

I cannot believe how bad some "adult" parents can be in these kinds of situations.

K-1 Fiance(e) Visa Process & Proceduresk-1 interveiw???

Hey all my fiance is going be goin to frankfurt germany for her interview. we have not recived the packet from the embassy but it is on its way. what i need to know is what are the original documents from me she will need to take to the interview??? I know she needs her medical, police records also what are the forms she will have to fill out and i also heard the I-134 doesnt need to be notirized but apparently there is on counsl that still requires it what should i do about that thanks all


If you download the I-134 and its instructions, the form itself clearly states you do not get it notarized any longer as it is an affidavit which you swear to the veracity under penalty of perjury when you sign it.

Originals needed from you are I-134 with original signature, Letter of intent to marry and continued support of her petition. Also she will need originals of your birth certificate or naturalization certificate and a divorce decree if that pertains to you.

Find someone you know, usually a relative but it does not need to be a relation and if they have sufficient income, ask them if they are willing to sponsor your beneficiary.

But you should know that many Embassies will accept a joint sponsor for the K-1 visa and some will not. The Embassies do not have to accept the joint sponsor for the affidavit of support. If they wish, they can throw out the joint sponsor's affidavit and require the USC to meet the income or assets requirements. This just happened to a VJ member posting here over the past two days. It would benefit you to go to the Consulate and Embassy forum and post on the Colombian thread for people's experiences with Bogota and if Bogota usually accepts a joint sponsor or not.

No, I do not think you need to worry. The RFE will add some delay to your processing. I have read that after you respond with the information, they will put you back in the place in line for processing. You were delayed while they sent the RFE and while you sent the RFE.

I think your petition is being adjudicated nor or will very soon. Just be patient and wait a little more time. This is not a reason to worry nor do you need to involve a Congressman.
