The denial for a Tourist or B-2 visa will have absolutely no impact on the approval of your petition or success at the Embassy/Consulate assuming the denial was not for something not disclosed here such as some crimes of moral turpitude, etc...

In general it is very difficult if not impossible to get a Tourist Visa to the USA. I am not sure your fiance should even attempt it again. But do not let it stop you from filing the I-129F petition for a K-1 visa. Be completely honest and disclose all visas received and visas denied on the DS-156 when the time comes for the Embassy or Consulate paper preparation and Interview.

A student visa should have the same reasoning again if the denial was for some of the usual reasons like a concern that there would be an overstay or perhaps sufficent funding and support was not demonstrated. Ten years ago was a long time and circumstances have changed. It should not be an issue again if the denial was not for a serious proble undisclosed here.

Document correctly and fully all attempted and denied visas.

Ning also posted recently Bangkok does not accept a joint sponsor, but in two cases both were students with job plans after graduation, in those cases Bangkok accepted a joint sponsor. She had a very good post. I can find it if necessary.

But the I-134 will be a problem since I don't think they normally will accept a job offer letter as proof of employment.

Also, we've both been in Thailand for around 3 years. Do we need police clearance information from Thailand? Do I need police clearance from the US as well? Or is the only police clearance involved here for her in the Philippines?

OK, Keith, you are the USC and will not interview nor even be allowed into the Embassy while your fiancee interviews. From here on out, it is almost all about your fiancee.

1) Your fiancee will require a police certificate from the Philippines if she lived there for more than 12 months after reaching the age of 16.

2) Only your fiancee will require a police certificate from Thailand. Go to the Royal Police office in Bangkok near Siam Square. There are directions and a map on the web site for the police certificate. One thing that does not seem mentioned in the instructions for getting a police certificate in Bangkok is she will need a copy of your passport name page with picture. They ask for this when she says she is requesting the police certificate for a US Visa.

3) The biggest thing you need to do Keith is start preparing your I-134 Affidavit of Support. Please go to the USCIS web site at www.uscis.gov and click on Forms in the upper left. Then scroll down to the I-134 section, and down load and print a copy of the I-134 instructions and I-134 form.

4) With no children I will skip a lot of unneccessary information.

5) Are you guys planning to move to the USA after your fiancee gets the K-1 visa? She has 6 months to enter the USA on the K-1 visa. Then after entering, you need to marry and adjust her status (AOS) within 90 days. If you did not know this or are not planning on coming to the USA so soon, maybe abandoning the I-129F petition and waiting is a good idea. Then you could do the DCF route later. It depends on your plans to move to the USA.

If you both live in Thailand, why don't you get married and go the DCF route? Probably much quicker.

Yes, that was an option but they already have the I-129F approved. All they need to do now is fill out Packet 3 and wait 4 to 6 weeks for an interview so I thought since they are done with the I-129F, don't bring up the DCF.

What do you think rsn? They are maybe 8 weeks away.

Good thing you said that. In general, yes, the Thailand Packet 3 is what you want. Your fiancee will be interviewing in Bangkok so you should use their Packet 3.

1) You will want to jump on getting the Police Certificate from the Philippines so get that started. For information on how to get the Philippine Police Certificate you can search the Reciprocity Table at the Department of State web site.

2) Not to be nosy or asking personal questions, but for reasons of preparing the proper papers, does your fiancee have a child that will also be coming to the USA?

3) Make sure the birth places match up between birth certificates and her passport. Be careful and consisten in her birth place on all documents.

2) In general, questions after the I-129F approval are about the Embassy/Consulate and a lot of I-134 questions. These should be posted in a different forum called US Embassy and Consulate Discussion because that is what you will now prepare for.

4) After you confirm your package has arrived at NVC you will get a BNK#. Wait until NVC informs you your package has been shipped to Bangkok. I'm not a 100% clear but I think your I-129F petition was returned in its entirety for having many things missing.

1) The letter of intent can be personalized if you wish. They will approve a standardized format so long as the signatures are original.

2) You do not need to send proof of being in love, or having an ongoing relationship. That happens at the Embassy Interview stage after I-129F approval. There are some members like TXTbone that will tell you if you have a difficult Embassy to deal with then add proof of an ongoing relationship to the I-129F petition. This is called "front-loading."

3) It sounds like you might have omitted the crucial step of proving you have met in the two years prior to your I-129F submission. This is one of the two main requirements. Send them used airline boarding passes, copies of visa stamps in a passport, pictures of you together, maybe hotel receipts showing you tweo stayed together or one of you was in the same town where the other lives, etc... You must prove to their satisfaction you have met in person.

4) Other requirements are one of you must be a US Citizen or US National.

It is very likely that this will be OK, the only way to be absolutely certain, is to have someone with very similar circumstances have passed through the London Embassy for a K-1, I think that is what you filed.

If you have a contract stating June 2011 and have been receiving pay stubs or checks (make copies of checks if no pay stubs), you should try to provide as much documentation as possible.

If you have a letter stating the job is a contract until June 2011, you should be fine as you will need to have the Alien Fiance(e) arrive in the USA, you will need to marry and adjust status within 90 days. When you file to Adjust Status, you will need to file a new Affidavit of Support, the I-864, which is much more specific in its instructions and requirements. So you should be thinking ahead to the time frame of marriage and filing the I-864.

She does not need to do anything in Manila. She needs to show her Passport with Visa to the Airline Ticket agent and she will be given her boarding passes. I was going to add that I also have seen postings where the Embassy in London does want you to answer YES, "I intend..."

I do not think you should list a specific amount or duration. This is marraige, you are in it for the long haul.

You should write on the lines after checking the "I intend..." "to provide housing, food, etc...<you can write in more specifics> for beneficiary <enter name>."

This cannot be refused by the Embassy. I believe if you check "I do not intend..." then they will issue a 221g and ask the beneficiary to send the I-134 back to the Petitioner for correction.

If your Embassy requests three years of tax forms or tax transctips, then you should write a letter stating why you were exempt from filing a tax return for 2007. Just sign and date the letter. (No notarization needed as you are signing an affidavit already.)

One member that had his fiancee interview at the Bangkok Embassy was issued a 221g with a request to return with Evidence of an Ongoing Relationship in which the emails and chat logs did not have personal or other information marked out (obscured). Most everything you read is a suggestion or advice, very little is legally binding facts. If the COs at the Embassy want they will request Evidence in which the information is not obscured. Other COs at the same Embassy have permitted obscured information.

When I submitted my Proof of having met within the two years prior to submitting the I-129F petition, there were some credit card receipts from a Resort where my fiancee and I had stayed. I obscured the Credit Card Account number because in Thailand, they still haven't learned the trick in the USA about only pringing the last 4 digits on the Receipt.

This is what I would consider to be personal information which would be prudent to obscure.

Document any and all meetings with your fiance(e) if your paths cross during this trip. Lots of photographs, airline tickets, hotel receipts, restaurant receipts or trips together.

You don't even need to notarize the bank statement nor bank letter as your signature would not appear on either document. You cannot have a document notarized that you do not sign.

Things that would be date sensitive might be evidence of income such as recent pay stubs to be submitted with the I-134 if you are using income to meet the 125% of poverty line. As you are travelling are you employed or currently unemployed??? This will have a bearing on the I-134 Affidavit of Support.

Hi, I only want to give you advice on what I know. First, the letter will probably not catch up to your file with the USCIS.

Secondly, this type of letter really does not hold any weight (or maybe not much weight) in the eyes of the Consular Officer. It does little to change the stack of Primary Evidence or LACK of Primary Evidence that you have a genuine and ongoing relationship. Nor do such third party letters address any intent of immigration fraud or prove there is no intent of immigration fraud. These are the fundamental issues the Consular Officers or Adjudicators review in their mind and in the documentation.

Of course answers to questions during the interview can also be very important.

Do not worry about the letter, instead, make sure your package of primary evidence of a genuine relationship is a solid packet. Make sure it will be delivered to the Embassy. Try to add to this Evidence of an ongoing Relationship if you send in Packet 3.

A final note, I do not know your Embassy. I do not know if they allow the USC to attend the interview with the beneficiary. I know at my fiancee's Embassy, I am not allowed to go in.

Even if you are not allowed to go in, it is a BIG help at the interview if the Consular Officer knows you came for the interview. Your fiance(e) could show your passport with the Visa Entry stamp. Also you will be there to support your fiance(e) and make it a little easier for them.

I will not be allowed at my fiancee's interview, but I will be across the street waiting for her and supporting her in any way I can.

My fiance and I have gotten our K-1 all the way to the consulate and are just getting everything ready for the initial interview. However, since he was here in the U.S. two times without inspection (illegally) we are expecting a denial. Consequently we are attempting to prepare the waiver I-601 (waiver on grounds on inadmissibility) to take with him when he goes to the first interview in Ciudad Juarez, Mexico. In Juarez they have an expedited waiver program. Our problem comes from the lack of time. We are attempting to gather all of the information and put things together but wanted to know if anyone has any experience with Ciudad Juarez and could tell us if they are really picky about their expiration dates on applications or not.
Also, does anyone know if there is a way to extend the application time or renew an application?

I am not certain which application time you are concerned with our which aplication you want to renew.

If you are referring to the four month Expiration date that was sent on your NOA 2 form, it is four months from the date of approval of your I-129F, then that date is routinely extended by four months. This information is posted clearly on the DoS web site. It is an automatic extension.

In your case, and in any other perhaps, it is aa good idea to send an email if possible, or letter, requesting the (Automatic) extension of the NOA2 expiration date.

If you are referring to an other expiration date, I apologize, it is not clear from your posting and I have misunderstood.

If the baby is born overseas (and I include Canada when I say overseas), the child of the USC fiance (male) and the Alien beneficiary, they must file for CRBA or claim US Citizenship. The COnsulates are usually quite strict about this. This means the child does not need to rely on getting the derivative K-2 visa. So it does matter and they do want to know and they will resolve it via DNA tests.

There are even more complex and unfortunately unpleasant postings in VJ delaying fiancee reunions with her USC fiance becaus of a child she had with a different USC who will not sign the papers for the child overseas to claim her US Citizenship and receive her US Passport. The Embassy will not issue a K-2 visa to the child, they insist she claim her US Citizenship.

Oddly enough, I know a couple of people posted if the back of the Birth Certificate is blank do not copy that and send it in. They were approved so it is OK. I do not wish to be contrary or start an argument. But I look at everything very literally. You might have a different Service Center, you very likely will have a different adjudicator at USCIS.

I believe to follow the directions and give them EVERYTHING they ask for and usually give them MORE than they ask for. You cannot get an RFE for providing a blank page of the BACK of your birth certificate. You can get an RFE for NOT providing a copy of the blank page on the back of the birth certificate. I submitted a copy of front and back of my passport including the BLANK back page and was also approved. I did not receive an RFE for sending in a copy of a blank back page.

The birth certificate itself (what you call the original) should be a certified version meaning a raised stamp or seal on the paper. Call that the original. Then make a copy from your copier and send the copy of the Certified Birth certificate. DO not use the short form Birth Certificate (must have parents' names, etc...). Yes cut the pictures yourself.

Your fiance will need this Original version and another copy for the interview in Caracas or wherever. They probably will not ask for the Original BC but they can.

My divorce wasn't final yet when we sent in the application (it is now). But they say they have no record of having received the application at all so that wouldn't even be an issue. We explained the situation very clearly on our cover letter as to why we were applying now rather than wait and we told them when it would be finalized and that I would have the papers to bring to the interview and/or to forward to them within a month of sending out the application. We knew it would take longer than that for them to process the application so we weren't too worried about it.

Now my question is "is it possible it got lost in the mail or are they just pulling our chains?" Why say they haven't received it if they are holding on to it because of a different issue? They should have some kind of a record of it, shouldn't they? Should we re-file or just wait?

A couple of things.

1) They will not be holding onto it. They will have sent an NOA1, they will know your file is there. It is more likely it is really misplaced.

2) If the baby's father is your US Citizen fiance, you will need to file CRBA and will not need a visa for the baby. If the baby is the child of your Canadian Ex-husband, then the baby would need the derivative K-2 Visa.

I have photos with Sobia's sisters and mother. I guess I will go ahead and put a few of those in there. Im doing my pictures by attaching them in word and putting captions underneath each one. Where would I include these pictures in my packet? In the "proof of being in pakistan in the last two years" or the "Proof of an ongoing bona-fide relationship?" And if for both, do i include copies in each section? Sure appreciate it.

In proof of an ongoing relationship. You need to make that section of your application as solid as you can.

Forgot to mention I also have boarding passes showing from dubai to peshawar(entry) and peshawar to dubai (exit). You think its neccecary to show all the boarding passes for the route i took to Pakistan? I figured if anything the entry and exit boarding passes would be fine

It is the correct thing to do by going over the top as you say. I definitely believe in always providing more than is asked for. I think the boarding passes you have will be fine especially with entry exit stamps in your passport.

A letter from your parents will not hurt.

Can you make another trip before the Embassy Interview? Can you meet her parents in person or is this forbidden or simply not possible?

I am sorry, it is just Pakistan is a difficult country and I think you will need a lot of evidence of an ongoing relationship as well as parental approval.

I do think I could have worded my first answer a little better but as I mentioned after considering it some more, I still think in that case pictures with the parents are worth MANY thousands of words. It was one of the first things I did after my fiancee accepted my proposal. I made sure I went to her mother house to discuss it and take pictures.

Continuing to think about this, even for Pakistan, Morocco, or wherever, I think the COs would prefer photographs of the two fiances and the family members over a letter. Letters cannot be easily verified by I suppose there is no harm in providing one. If one fiance(e) has met the family members of the other fiance(e), I think photographs will go a lot further towards showing an approved relationship with the COs considering the evidence.

I just don't think a letter from the family has the same impact but that is my opinion of what will appeal to the COs.

I would revise this to suggest that including letters from your family would probably be a good idea. Audy_Rob was probably not aware that having the consent of the family is culturally important in Pakistan, as it is in most Islamic countries.

You are correct Jim. I apologize to the OP. I did not realize that in Pakistan there are additional cultural traditions whereby family consent is extremely important. I can see where family consent might be very important. I know in my fiancee's country of Thailand, showing the I have met the family is very important. I have been advised to provide photos of myself with my fiancee and her family members, mother, sister and brother will lend extra credibility to the relationship.

Front-loading might be advisable for your Embassy/Consulate.

Letters by friends and family attesting to an ongoing relationship carry little or no weight in the eyes of the CO or adjudicator. They prefer evidence and documentation. Email, chat logs, photographs of you two together, Cell phone bills between the two numbers, SMS Text messages, Visa stamps in passports, Used boarding passes or rail tickets, especially of the two of you seated next to each other going on a trip, money transfers, presents bought each other, flower deliveries. This carries far more weight then family or friends writing letters.

So we will mail in Packet 3 around the end of June to time her interview at the Embassy. We probably could have done the whole process in 4 to 4-1/2 months if we wanted. CSC was much faster than VSC. Now, I do not know.

The G-325A instructions do not cover the answer to this question. I did read a posting from another member where he swearas with 100% certainty it is not necessary, but he is also wrong a large amount of the time.

The safe thing is to sign and date it but since it is the G-325A, go without the signature.

Technically the instructions for the G-325A are inherited from the foorm that requires it which is the I-129F. The I-129F does require each additional sheet to be signed and dated.

Tell you what, send it without additional signatures and I will accept the responsibility, OK. B-)

My friends fiance in the Philippines has a child from a previous marriage whom we would like to bring along.

I have read and understand the procedure to do the fiance visa. No big deal. Friends of ours have done it.

I know kids do come with their moms, but I don't understand what starts the process. One person told me it was kind of automatic, that if you fill out the I129F mentioning a child, that paperwork for the child would be sent to him. But we don't want to risk screwing up.

They have permission from the dad, notarized and all that.

He can't really afford a lawyer.

How does it work?

Well not automatic, but it is fairly simple.

Yes, just put the child's name on the I-129F as required. The child does not need to have a G-325A submitted with the I-129F petition.

After the I-129F approval, when filling out the application forms for the Embassy/Consulate, at that time you will list the child's name on the form and as a person Travelling with the fiance(e).

Normally the child is entitled to a K-2 derivative Visa if the fiance(e) parent qualifies for the K-1 visa.

They will need to pay the Visa application fee for each applicant, one for fiance(e) and one for child. I believe the child also needs their own paper work except for the DS-156K form and will require a medical exam.

EDITED to ADD:

The Embassy/Consulate might want a form from the other parent giving up the rights and custody to be worded fairly definitively such as turning over full custody to the fiance(e) parent and allowing the child to move permanently to the USA.

Then have that signed and notarized or the form they have might already be worded strongly enough.

I believe blank or a dash is the best option. I used blank for my fiancee's middle name and that worked fine with USCIS.

DoS assumes NONE and NA (but not N/A) can both be legitimate names and if appearing on the new DS-156 which is processed electronically, will be removed. You can see evidence of this on the 3rd page of the DS-156 output after you have submitted it and received the final copy with bar code.

In general the Bangkok Embassy does not accept Joint sponsors unlike most other Embassies/Consulates. There was a posting about this issue a week or two ago from a student that had his fiancee going through Bangkok. There was an excellent response written by a Thai fiancee now in the US and married about how she was aware of two cases where the US Embassy allowed a joint sponsor. In both cases the USC was a student finishing up University level studies.

There is a Thai thread called Sawasdee 3 here at VJ under K-1 Fiance(e) Visa Process & Procedures but I do not think you will get many responses. I do not know anyone in there using a joint sponsor so I do not know how much previous experience you will get.

Try asking your fiancee to join www.usvisa4thai.com and post a question asking about experiences with joint sponsors at Bangkok.

I think you need to increase your income.

Aww! Posted Image I didn't go anywhere as far as Thailand. Just down to the beach for a few days without TV and the net. It was nice. Then I read Thai Rath and had a fit.

Don't worry about the other opinions. I was asking because I didn't see you posting through this horrible mess and I was kind of wondering if everything was alright.

I posted a three pound package known as Packet 3 to Audy on Monday for Thursday delivery to her in Nakhon Pathom by Fed Ex. Well they are up already on Thursday. I was so happy she was going to get Packet 3 today. Well I tracked the package left Guangzhou, China, their Asian sorting center about 6 hours ago. I was expecting to see a landing or arrival in Samut Prakan, the airport any moment. Instead I am greeted with the information that FedEx has Suspended ALL pick-ups and deliveries to/from ALL parts of Thailand until further notice and No, I thought for sure they would drive to Nakhon Pathom whereas they might not drive in to Bangkok.

It is really crazy now that they are burning buildings in Mukdahan and other outter provinces. I have been to Mukdahan, why would anybody want to burn down city government buildings there?
