Correct but in most cases the only email update is the approval notification. Consider you filed into a black hole and expect no information for about 100 days or so. Be happy if it is sooner but not alarmed if it's longer.

California Service Center has been averaging 50 to 55 days on approvals based on the VJ statistics and the approvals read in the February and March Filers progress forums. You should on average do much better than 100 days. I did it in 46 days. My friends in February K-1 CSC 2010 were all in the 50 day range. One or two petitions are still waiting.

If you go down one level in the Forums, below K-1 Fiancee Visa Process and Procedures is K-1 Fiancee Visa Progress Reports. Usually someone starts a thread shortly after the beginning of each month for people that have filed "I-129F" at CSC for the month of April, or May 2010. Same thing for "I-129F" at VSC (Vermont which you are not). Check down at that level of the forums for the right filing time for you and participate in the group. Get to know the other members and read postings and wait together. It did help pass the time.

thanks for your input, did your husband send a bank statement that shows the account opening date or was it just a regular monthly statement depicting the available balance, because according to the instructions the letter/statement must show the date the account was opened along with the money deposited in the past year. I am wondering how do I go about obtaining that or like the one of poster mentioned if you're above 125% then the bank statement wouldn't be required and you can do away with offer letter, tax transcripts and pay stubs.

If your income is at or above the 125% of the poverty line, you need pay stubs, letter of employment and Tax Transcripts or Tax Returns with Schedules and W-2s, 1099s. You do not need the bank letter or list of deposits and statements of your deposits. They are not relevant.

(As a side NOTE, many people ask about the Bank Letter because they are unable to provide it. The Banks will not go back and add up your deposits of the past year anhd provide you a letter. Additionally, some will not provide any letter because you can use bank statements. So this question comes up often.)

If your income is below the 125% poverty line for your family (household) size, you will need to make up for it in one of two ways. You can make up for less than 125% of the poverty guideline by showing financial assets. Financial assets can be real estate (house), stocks, bonds and mutual funds, cash assets in a bank account, a second car if you demonstrate you still have one working car left, etc...

Another way to make up the income if you are below the 125% poverty line is to enlist the aid of a joint sponsor. I know for a fact the Argentinian Embassy accepts joint sponsors because it is written in their Packet 3 instructions.

If you can answer one question without giving too many details, this can be made simpler. Can you say you earn 125% or more of the poverty line for your household size? Can you say you earn below the 125% level of the poverty line for your household size?

Then it is easier to direct you to exactly what forms to provide. OK?

MORE is better.

I am surprised a member is recommending to submit less documentation rather than more documentation. But that member went through Australia, not Argentina. For Australia and New Zealand there will be far less scrutiny then your Consulate/Embassy. Why provide less documentation and risk a 221(g) or request for more documentation at the Interview stage when it is so easy to provide an abundance of proof of your I-134 Affidavit.

I am also providing three years of full tax transcripts because I do not want to risk a 221g when they decide they want to see more.

There are many interesting discussions going on now as to the applicability of the I-864 instructions relative to the I-134 Affidavit. Unfortunately there are no answers in this thread because there are no statements in the I-134 instructions and statements in the I-864 instructions are changed or ignored by members such as calculating household size and how to apply assets to income levels.

It's an interesting theory. If it were true, then it hasn't panned out that way. Many consulates still accept joint sponsors with the I-134. It's true that the I-134 doesn't specifically allow for joint sponsorship, but it also doesn't specifically forbid it. In fact, the I-134 is almost completely devoid of specifics of any kind. It's vague and ambiguous about what sort of income evidence is needed. It doesn't specify what the minimum income requirements are, or how it will be determined if the sponsor meets those requirements. It lacks the concept of "household size", and differs dramatically from the I-864 in how dependents are declared. This leaves the determination almost entirely up to the discretion of the consulate, which is actually what the law specifies for a non-immigrant visa.

If it were the goal of the Department of State to phase out joint sponsors for K visas, they could do that with a policy memorandum. The law gives them that discretion.

Audy_Rob, thanks for chiming in. How many years worth of tax transcripts is the norm with consulate or does it vary?

It will vary with the Consulate but THREE years is the very maximum anyone would ever ask for. You can request Tax Transcripts which are FREE from the IRS by calling 1-800-829-1040 and go through the automated phone system listening for the options related to tax history or records until you actually get the Tax Transcript menu.

DO NOT get the Tax Account Transcripts. Get the Full Tax Transcript which is Option 2 of the Telephone menu for Tax Transcripts.

What supporting evidence should be sent along with form I-134 for K1 purpose?. I have seen people mentioned attaching past year tax returns, pay stubs, to name a few, I just went over the instructions and there is no mention of any of those items there, instead they are asking for your bank statements indicating the opening date, current balance and deposit made in the last year. A leter from your employer showing your start date, your title and salary would suffice too, I wonder if it's either or between those two or both.

Would an offer letter along with pay stubs be sufficient proof of employment for USCIS?.

2) If you can show a steady income of 125% of the poverty line or more for your family size, you, your fiance(e) and any other dependents, then you should provide:

c) Tax Transcripts or Tax returns with W-2s, 1099s and all schedules attached

3) If your income is below the 125% poverty line then you might want to show substantial assets
a) Bank accounts - statements for 6 months to 1 year
b) Brokerage accounts, bonds etc...
c) Real estate appraisal, deeds, mortgage amounts.

Thanks. I was afraid of that. Now that our timeline has been thrown off as we were planning the marriage party back in Thailand sometime shortly after we recieved the "parole" to leave the US during the AOS stage, would it better to now do both the ceremony and party there at that same time and proceed through the K-3 route or just bide the time and stay with the K-1 plan?

The K-3 process was obsoleted in February 2010 (I believe it was February). You need to look at the CR-1 process and filing I-130.

I know you can request a Consulate/Embassy for your interview if you live outside the country of your nationality, there is a place on the I-129F form that asks what Embassy/Consulate you want to interview. I do not know if there is something special about Egyptians that would prevent them from interviewing at Riyadh, Saudi Arabia. It is allowed and many people interview at Embassies or COnsulates outside their native country.

Also to the recently divorced person, yes you must wait because you must be eligible to marry at the time you SUBMIT the I-129F, not eligible to marry at some later time in the process. So please wait.

This is a very good point. I personally believe that photos of you two together with some of her relatives goes a long way to showing a genuine relationship. At least I have read this many times for the Embassy where my fiancee will interview.

They are very likely to ask her if you have met her family. Or ask if her family knows, do they approve, what better than to show happy family photos. :thumbs:

I do not agree with the above two Posts. There will be a Form which the Armenian Fiancee will need to fill out before going to the US Embassy/Consulate where she needs to interview.

The Form is DS-156 which is the US Nonimmigrant Visa Application. Question 37 asks if the Applicant (The Fiancee) has any of the following in the USA, Mother/Father, Brother/Sister, Son/Daughter... It does not restrict the age to 21 or less. If you answer Yes, you must also give their status which is US Citizen, US LPR, studying, visiting, etc...

I do not know what to say about this issue. I only want to point out that a problem MIGHT arise later at the Interview stage.

Mine says Rev. 05/23/06. When you noted the date of yours I wondered how in the world I got an older version. Because I know I downloaded the forms from here and they all link to the USCIS page or at least list the rev date as the one you listed. What looks like happened was I used the form linked to as an 'example' via the K-1 Guide page and just replaced the example info with my own. Guess I didn't notice the dates were off. :\

Try to relax, submit an Additional Sheet I-129F Part C-2 and give your answer a short explanation that you did not see it because of the Revision Number. This will lead to some "fairly short" delay in your processing.

I see the three options you describe and immediately below those three options are a check box Yes and a check box No.

My form is Rev. 7/30/07 and Expires 1/31/2010. There is a newer Revision now at USCIS but it is also the same. You do not see two check boxes below the three Bulleted items of question 2.

I just got an RFE in the mail and I'm a little upset about it. The section that tells you about your criminal history and "check all that apply. Part C, Question 2 of the I-129F. Since I have no criminal history there, I didn't check anything. And there were no text boxes or anything so I just left it as is. I just got sent an RFE for that. I called Customer Service and they said I should have attached a separate piece of paper explaining that I had no criminal convictions and as such that section didn't apply to me. So ridiculous....am I the only one who's had this problem?

Question 3 requires you to check all that apply, not Question 2. Question 2 requires you to check Yes or No. Very simple matter. If you check No for Question 2, skip Question 3. But you cannot leave Question 2 unchecked. It is a legitimate RFE for an important question.

Yes, your income is good at about $18,212. You sound like a very well grounded young lady. I do not wish to worry you, and Canada has good Consulates in that it is not a high fraud country and they will not give the beneficiary a hard time.

Have you filed a tax return or more than one before. While you have a good job and are earning, I am not sure about the ability to show past records. You do not need to have a large bank balance.

I think you will need AT LEAST:
Letter of Employment
Pay Stubs, 6 months would be good in this case (since you are young, sorry)
Tax Returns with W-2s "OR" Tax Transcripts (1 - 3 years)
Maybe copies of one year of Bank Statements (not necessary if you earn 125% of the poverty line but in your case again I would recommend this).

I want to add a couple of things. First I do agree with Alcheringa that you have done a very good job, you seem very well-organized and thorugh.

Ok,
1) Yes, you will need the Affidavit of the Court showing Guardian's consent unless the legal age of marriage in your state is 17 or lower. The requirement for the USCIS is to make sure you both are eligible to marry so what you need to demonstrate is you are either of age to marry in your state or have consent of parent or guardian.

2) Are you aware after the I-129F petition is approved, that your fiance will need to interview at one of the US Consulates in Canada. For that interview, you will be required to provide an Affidavit of Support (known as the I-134) to show you can provide for your fiance (future husband) and keep him from becoming a Public Charge (relying on Welfare, TANF, Food Stamps, other public assistance). If it is just you and your fiance you will need to show an income of about $18,212.

There is a possibility of finding a responsible person (known as a joint sponsor) to help you with this issue.

I was reading through the forums on what to do after you receive your NOA-2 and preparing for the next phases of the process. My employer requested I write the necessary letter and he would sign it for this part:

You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives.

My question is this:

Who do I make the letters out to? The Embassy in London? NVC? USCIS doesn't have the petition anymore...so what has everyone else done in the past in regards to this? It doesn't say on the guide and I couldn't find anything through search on the forums here. I certainly would not want to take some lame letter to the director of HR and ask him to sign it. :wacko:

In the VJ Example forms for the Letter of Intent, they suggest changing the Recipient for the second Letter of Intent from Department of Homeland Security, USCIS to:

Department of State
US Embassy of Place (so London, England for you)

Question 1 of the DS-156 which is the Application for Visa is what is Passport Number. The next few questions are all about her passport such as Date of Issuance, Date of Expiry, Place of Issuance, etc...

With the petition, you submit a photocopy of a certified copy. Then take the actual certified copies to the interview for possible inspection. It won't hurt to sign and date supplemental pages for the G325a but I'm 100% certain it is not required.

I am 100% certain you need to sign and date each additional sheet to the I-129F which is regarding the OP's question as I stated immediately above. She also stated she will use an additional sheet for question 18 which again convinces me we are discussing the I-129F and not G-325A. Here is the instruction from the I-129F:

I am 100% certain that the OP is referring to Question 9 of the I-129F petition which has as Question 9, two lines for prior spouses which is exactly what her question is concerning. While the G-325A has two lines for former spouses, they are not numbered as with Question 9 of the I-129F.

I read where they require certified ones. You need to provide them with a copy of an ORIGINAL certified which has the signature of the judge or court officer or county clerk, and then some type of stamp or seal. I do not know how much choice you have for foreign divorce decrees.

I remember reading somewhere, I am not sure if it is in the I-129F instructions, that all sheets should be signed and dated. I used two additional sheets to catalog or list all the evidence I submitted for Question 18. I signed and dated both (ALL) additional sheets so please remember to do that.

Also be sure you go to the www.uscis.gov web site to make sure you get the newest I-129F form. They have a new version out that expires in 2012. I noticed this when I was posting an answer to a question from a member that had used an (unfortunately) out of date I-129F from VJ's forms.

VJ is a terrific web site and of great help to me and many others. But please check with the actual USCIS web site for the correct LATEST versions of the I-129F and G-325A. I resolved a question this past week with a lady that had erroneously picked up an old version of the I-129F petition from the VJ site. Bobby was going to notify Captain Ewok to update the form but in any event, I really suggest using the forms from the USCIS web site at www.uscis.gov.

Then you can come back to VJ and click on Example Forms to find a list of forms that are filled out to help answer many questions.

Because i just passed my Citizenship Interview and now waiting for my oat-taking ceremony date. So right after that oath-taking I can have my naturalization certificate? How soon can I file after I got naturalize?

You must be a US Citizen, born or naturalized to apply for the K-1 petition. You will need to check the box on the I-129F stating you are a US Citizen through Naturalization. You will also enter the Certificate number for your Naturalization certificate.

If you demonstrate you are a US Citizen by sending the copy of your naturalization certificate, you do not need to submit a copy of your old passport. That would not have done any good to show you are a US Citizen and able to apply for the K-1.

So you must wait.

He has clearly already filed two I-129F petitions but it is not clear at which stage the first process stopped. One K3 plus 1 K1 is two I-129F petitions, so a waiver request would be required. Otherwise, I concur with the above. There will be extra scrutiny of the relationship at any visa interview.

According to the I-129F instructions, it seems the USCIS desired to omit the I-129F that is filed in conjunction with the K-3 Visa I-130 petition. The wording directly from the I-129F instructions mimics Jim's writing which only refers to the petition for a K-1 visa, not any reference to the petition for a K-3 visa.

The instructions state:

2. Filing Limitations on K Nonimmigrant Petitioners.

If you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver.


This will be the OP's second K-1 visa petition. Nowhere in these instructions regarding filing limitations does the K-3 visa petition appear.

I think everyone is in agreement that the fiance(e) applicant will be in for more intensive screening perhaps then the Consulate's norm would be.

I hope you are planning to bring your girlfriend/fiancee here to the US for the purpose of marriage and not any other purpose.

The time frame depends on the Service Center you file with (CSC or VSC) although I think they are VSC is speeding up, I am not sure if CSC is slowing down or not. Many people say petitions and interviews slow down in the summer.

Another factor in the time line is how quickly an interview appointment is granted by the US Embassy/Consulate following your sublission of checklist, packet 3, or whatever they call it where you will interview. Some Embassies/Consulates grant an appointment in 2 to 6 weeks, others (like Ghana) seem to be an automatic fixed SIX months. I know two people that have completed the I-129F petition and K-1 visa interview in LESS than 4 months. Most will be 6 to 7 months. Then she must come to the USA and marry with you.

Then you file for AOS, EAD (Employment Authorization) and AP (Advance Parole or permission to leave and re-enter the USA.) This can vary but is about 2 to 3 months.

In any event, DO NOT marry your fiancee unless you finally decide to go the CR-1 route, note the K-3 has been obsoleted.

I think Bobby was referring to a later date at the Turkish Embassy due to Obama's visit.

The six months waiting time might be part of the process to determine if this is a valid or real relationship, kind of like adding a test before the interview.

Make sure to keep copies of correspondence such as email or chat logs. Also keep your phone bills if you do call her. Try very hard to make additional visits and keep all the documents and evidence of those visits. I am not saying it but it seems to be widely posted that some of the Embassies in that part of the world are very difficult to work with and see a lot of visa fraud. Kenya, Nigeria, etc...

As the previous poster mentioned, the fiancee can fly into the Port of Entry but is not guaranteed admission into the US for being a risk to overstay the visa.

Also, as your fiance(e) makes more trips, say two to three, the CBE officers are likely to say OK, that is it, you are starting to abuse the privilege, don't come back for 6 months or 1 year.

I do not have first hand knowledge of this. This was in a few postings mostly from West Europeans of their experiences.

Yes, you are absolutely correct although technically, there is no document that says who actually lives in the house. But I believe there is a Deed or Title (which is why I said Title Search but that isn't correct) which will list the Legal owners of the property and residence. Half seriously half joking these documents have absolutely nothing to do with who is living in the house such as if the House is "rented out."

In any event, no worries, USCIS will not look, they have no way of knowing.

Thanks. Of course I will make those changes. What happens if I don't sell the house by the time she has interview? Please, note my 1040 that USCIS requires for affidavit of support for the past 3 years still has my ex name and current address on it.

You submit 1040s or Tax Transcripts, which is a highly recommended suggestion for proof, you might need to do a little extra documentation to separate the earnings shown on the 1040 versus your earnings alone. This is of course making an assumption that maybe your ex-wife was also working and her earnings are also reflected on the 1040.

When you do get to the I-134 submission to the Embassy for the interview, you will have the opportunity to list your annual income only without including any additional that your ex-wife contributed.

The only thing that was returned to us at the interview was the original birth certificate. They even kept my W2s.

I think they are talking about the large brown/yellow envelope the Alien Beneficiary should carrty to the US POE when entering for the first time.

Every post I have seen is that all the documents are supposed to be in that large envelope. The Embassy/Consulate will return most document originals that you brought at the time of the interview that they might have requested to see such as Birth Certificate, Divorce Decree, etc.

I-134 is NOT sent with I-129F petition. It should be sent to fiance(e) for Embassy interview.

Your fiance(e) could give you a copy of the I-129F petition for your interview preparation although I do not think it is used. You should have the ORIGINALs of any document copies from the I-129F petition such as a Birth Certificate or Divorce Decree.

This is a difficult question to answer. There is no known correct answer because there is no instructionn on how the Partially Supported Children are counted. Additionally, no where on the I-134 form do you make a tally or counting of the number of members in the household. Basically only the CO (Consular Officer) at the Embassy/Consulate will look over your form, see that you have children partially supported by child support, and will add up what he believes the family count should be for a K-1 applicant.

Technically the member of active duty at 100% only applies to spouse and children if you read the I-864P poverty form carefully. It does not say for the alien fiance(e) of a USC on active military duty.

To be safe, you can "probably" use 100% of the USC plus fiancee plus number of partially dependent children and that will be safe if the USC is on active military duty.

If you do not reach that level of income, you might try to get a joint sponsor who does earn the 125% level for the joint sponsor, his/her dependents and the fiancee.

Yes, please be honest and document all. It will not hurt to have been denied. They already know 99% of the applicants are denied.

It will hurt you if you do NOT document it. So please be sure to list everything.
