I wasn't guessing when I stated 3x. In fact, I based my information off of what is stated in the USCIS Adjudicator's Field Manual. In the AFM, it states that if the sponsor is an immediate relative of the applicant, 3x is all that is necessary. There is some confusion surrounding this as there are some vague terms surrounding mention of K applicants in the AFM, but it seems relatively clear to me although I understand why some assert that 5x is required.

This isn't the first time someone has brought this fact to your attention.

Actually 3x for I-864 for immediate relatives. The assumption is that the rules are the same for I-134. I don't see why they wouldn't be.
I realize another person posted on the issue but I ignored since the posted information is incorrect. I am responding to a K-1 Applicant.

I will give link and then cite Section 29 from page 9 of the I-864 instructions which are very clear.

http://www.uscis.gov.../form/i-864.pdf
In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current poverty guidelines for your household size. However,if you are a U.S. citizen and you are sponsoring your spouseor minor child, the total value of your assets must only beequal to at least three times the difference.

[\quote]

It is clearly stated that assets must be five times the income shortfall except for spouse or minor child. It is three times for spouse or minor child. So basically it is correct to say 5 times for I-134 because NOT sposue. And it is three times for the I-864 because by that time, the fiance(e) has become a spouse.

Just because someone posted omething to me does not mean I must adhere to it when it is clearly contradicted in the instructions for I-864 and those instructions are typically used for assets of I-134 and many other aspects of I-134.

You would list the retirement accounts as an asset as that is money you can access in an emergency. Just copy your last statement closest to when you send in any paperwork, black out any acct. numbers. I don't think you need to have close to 100K to show your financial stability. I am sure there are many people that make much less and their visas are approved. They just want to make sure she won't come here and be on welfare right away.

@Eric, There are no instructions or facts about the I-134 and using assets. If you read the instructions for the I-864 form which is used by most people (the instructions, not the form itself) then it says you need 3 times the threshold in assets for spouse or child, 5 times the assets otherwise.

So for a fiancee it would seem you need 5 times the assets to qualify.

For two people the 125% poverty threshold is $18,212. Five times 18,212 is about $91,000. There is always debate whether it is 5 times or 3 times. People prefer to guess three times because it is less.

I think to be certain you need to use five times.

Good luck

...Any suggestions would be greatly appreciated...

When the USC lives and works in Thailand, it is very difficult to get the K-1 because of the I-134 situation. The K-1 visa is for taking your fiancee from the foreign country to the USA for the purpose of marriage. That means you need a job already with current income in the US or substantial assets (about US $91,000) in the bank or in stocks, bonds, etc...

Your offer letter is of no value. They have no value towards proving you can support your fiancee.

Whoever suggested you get a joint spoonsor was misguided because Bangkok almost never accepts a joint sponsor.

The DCF route that rsn mentioned is appropriate if you are married. You could think about marrying in Thailand and then filing for DCF. Then at a later time you could consider the job offer in the US and moving with your wife to the USA.

Hi Tom and Teaw. I wish I could meet up with you guys in BKK. The only night we will both have free is the 12th and the next morning is Audy's Visa Interview. So she said no on going out to meet. I know the 13th you are having dinner in Pathumthani and the 14th we are off to Hua Hin (not Phuket) assuming Audy passes and we don't have to scramble to get together any more papers for the Embassy.

Audy is driving me nuts about the I-134. Apparently she cannot read the I-134 form I sent her along with the cover letter and evidence. I understand it would be difficult when English is not your first language. Apparently she has read a lot of denials from the Embassy. That isn't my concern, I earn many times above what is needed but she doesn't understand that.

I am worried about an I-129F I filed for and was approved in 2004. The interview was scheduled but the relationship fell apart before the interview. It fell apart because it was too close after my divorce and other reasons (the lady ran off and I couldn't find her. LOL). I am more worried about that.

I think evidence of relationship is very solid. We have all kinds of different documents that aren't usually mentioned.

Good luck to Tom and Teaw and all the September interviews. There is ArizonaMike, gbagbo and I do not know if Kookkai is going through with her interview. Good luck Kookkai no matter what you decide and to your fiance also.

Sawasdee Guys,
I've been checking the on line schedule from US Embassy BKK

http://bangkok.usemb...pointments.html

This link was last updated Aug 9 and the list ends in 3 days and does not have any Sept dates yet. Is there a list posted for Sept K-1 visa appointments yet?
Thanks,
P

Many of us here have been informed of our September interviews. Depending on when you mailed in Packet 3, you might or might not be scheduled in September. I received notice of the interview date 7 weeks after mailing in Packet 3.

How long ago did you mail in Packet 3?

... pretty good steak place in BKK if your there...

Don't a lot of Thai people dislike Red Meat, steaks and any kind of beef. Is it cultural. Is it the smell they do not like. My fiancee eats, pork, chicken, fish and seafood but will not eat any red meat.

Is that restaurant you mentioned mostly for farang?

When I go to Thailand, I ask Audy to eat at one farang restaurant one night. Then we eat Thai all other nights. Last time I almost made a mistake at the Farang restaurant and ordered some beef dish for her. Fortunately she stopped me in time.

This is very strange. The Embassy must send out all the interview appointments in large batches.

We got an email from the Embassy, our interview date is September 13, 2010. A Monday. I need to go negotiate (argue) with my boss because I want to take two weeks off. One week before the interview and one week for (hopefully) celebrating after the interview.

@gbagbo: That is great news. I am happy to hear that. I thought Five and Audy would have interview on the same day. I was off one day.

Make sure your Evidence of bona fide Relationship is in order.

Good luck to all.

Hey everyone, can someone tell me, as all Thais have nicknames, Do we put our fiance's Thai nickname under "Other Names Used" on the I-1239F? Or is this like only "Other Legal Names" or something? Thanks! Should I mention her nickname anywhere? It's filled in our chat convos, photo comments, etc. etc.

Also, a random question, but I don't have flight boarding passes, only receipts. Can they print out old boarding passes at my local airport? Thanks!

1) No, do not list her nickname. They only mean if she went through the legal name change that Thai people tend to do once or twice in their life.

2) No, I do not see how they can print out an old used boarding pass. It would sort of be like manufacturing evidence. Your visa stamp should help prove you got to the country and entered on a day corresponding to the airline itinerary or receipyts.

Good luck.

... she had no idea what a police certificate is. I realize that many people have to wait to get their packets in Thailand with a letter from the embassy before even being able to claim them. Basically, one thing we want to know is: What is it??? Where do we go to get one? ...

Read all of the document at the link I pasted in. This is Packet 3 for use after I-129F approval and start preparing for the K-1 Visa interview.

See the following link from the US Embassy in Bangkok:

hi, I am a new member of this website. I am Om. Now i am waiting for PK4 and interview date.
I would like to know how long did your guy wait for another step after you sent your PK3?
I just sent it on last Wednesday(Aug 11th, 2010)

Hi Om. Welcome or Sawasdee krab. My fiancee Aod sent Packet 3 June 29. We have not heard from the Embassy yet. They have not scheduled the interview.

I sent an email to the Embassy to make sure they received Packet 3.

They received Packet 3 July 1. They said 8 - 10 weeks to Schedule the interview. Maybe 2 - 4 weeks later is interview day.

Do you know about www.usvisa4thai.com. Good web site for Thai ladies.

Good luck.

When I talked to Teaw about getting Thai TV for her when she comes in Sept, she said let's wait because she thought she could learn English better watching regular TV here. I kind of have to agree with her
and I thought that was nice of her to think that way. But I also don't want her bored to death so we'll decide after she has a chance to settle in.

This is definitely the way I feel about it. I want her to learn English first. She can call home as much as she wants and we will set up Skype for her to talk to her mother but the last thing I want is for het to sit around watching Thai TV all day.

There used to be a forum at Delphi Forums called Thai-Falang Board or Forum, something like that. They had good discussions about six years ago about bringing the fiance(e) to the US.

One popular topic was how to install the spray host onto the toilets. Audy has already asked me to install the spray thing onto the toilets in the house. One guy at the Thai-Falang forum listed all the materials needed, the steps to do it and showed photographs of his installation. It looked very good. (I will still be paying soemone else to do it but Audy doesn't need to know that.)

To continue along the lines of ryan's rant and rave, I just noticed the last day in August that had a scheduled interview is August 26. So what happened to August 27, 30 and 31. That week has nothing to do with Labor Day or the Queen's Birthday.

I am thinking (hoping) those days were not even filled with interviews by the time they got around to August 2, the day they had to post the scheduled interviews.

EDITED to add: Besides we had slipped all the way down to page 5 or 6 of the forum so I had to bump us back up to the beginning. I guess everyone took the weekend off.

Hi Ryan, I will talk to my fiancee either Friday morning if her computer is working or Friday late afternoon when I call her every morning her time. I realized after the post that the 2nd and 4th are Thursday and Saturday.

Normally we do numbers in Thai when we talk, like she still says she sent "Packet som" because som = 3. So maybe she messed up her numbers in English. I will also ask her to find out when the Packet 3s were sent.

She says she read a June 25 or 26 send date of Packet 3 resulted in an interview of August 27.

That is because I was so fed up with all the papers required to put together and the red shirt crisis and a melt down at work as we were taping out the chip, so that area is a point in time I prefer not to think about.

I was just bored and looking at the interview list for August. Had a ####### moment. BNK2010630001 is listed there 4 times for the same date and same hour.....??? BNK20100611006 is listed 3 times for the same day and same hour....??? I could go on with this, there's a few others like that on every page.

Just looked at previous month schedules and same thing. Anyone knows why they do that?

Hey Jordi, that is kind of strange. I had not noticed that before.

My fiancee told me today that she read on usvisa4thai that one girl received a phone call from the Embassy for a September 2 interview date and another lady received a call for September 4th interview. I am getting "noi jai mak mak."

When we were coming back I went to all the major shipping carriers (DHL, UPS, FedEx) to gt prices on shipping to the US, DHL was the cheapest, but the box weight limits were low. So I had decided we would just pay for the extra bags on the flight. I bought a few large duffel bags at MBK for about 900 baht (with wheels), and loaded them up. We ended up with 5 bags, 4 of them were about 26 KG, and 1 was 23KG, which was within limits on Eva, so we ended up not having to pay. If I remember correctly the extra bag fee was between 30 - 75USD depending on the weight, we were lucky and everything fit within our limit. You figure at 13000 baht even upgrading your tickets to get extra weight on the bags would be well worth it, plus then she will have all of her items when she arrives.

One thing to keep in mind is if you need to switch to a domestic carrier when you arrive in the states the charges go through the roof, their weight limits are lower than international. We flew into LA and then drove to Vegas for that reason. For two of us with baggage one way from LAX to Vegas was over 500.00, compared to 77 for a 1 way car rental + gas.

This is great. I also happen to fly EVA mostly (their food is the absolute worst) and I stop in San Francisco. No domestic destination to continue. Thanks very much.

Hi all, anybody hear any word on interview scheduling dates thus far? How quickly are they being scheduled? Somebody previously posted that its taking 8-10 weeks just to schedule an interview! Ridiculous. The embassy was only closed for 10 days, makes no sense why they would be that backed up (except for the fact that its the typical US government at work).

Anyway, just wanted to know if anybody has received any news on how long scheduling interviews are taking. Any info is appreciated!

Hi Ryan,

The current news is not good. Another member named Jordi that uses the name gbagbo and I are very close in time frame.

My fiancee sent Packet 3 June 29. The Embassy said they received it July 1. Jordi's fiancee sent their Packet 3 about a day or 2 later than us.

The Embassy just posted the schedule for August and neither of us are on it so we are hoping for September.

I sent an email to the Embassy July 20 asking about scheduling and wanted to confirm they received Packet 3. They confirmed receipt of Packet 3. They said they are quite a bit behind and it is currently taking 8-10 weeks to SCHEDULE the interview.

I do not know once they schedule the interview, how much time the interview is after it is scheduled. I will copy and paste the email below so you can read for yourself. Jordi and I are PMing each other about the schedules. Feel free to PM me anytime.

The Immigrant Visa Unit received the returned Packet 3 materials from the applicant through the Embassy's mail room on July 1, 2010. The interview appointment has not been scheduled for the applicant at the moment. Due to the large volume of applicants, now it takes about 8-10 weeks after having received the returned Packet 3 for the IV Unit to schedule an interview appointment. We will be in touch with the applicant by mail once the interview appointment is set.

Shipping Boxes from Thailand to the US ???

Even though we do not have an interview date yet, Audy checked with the Thai post office for shipping rates. The Thai post office informed her 13,000 baht for a box that weighs 30 kgs.

She thinks she will have four boxes in addition to two to three suitcases she wants to bring to the US. Of course I can get three suitcases for free if I bring her to the US which I am certain I will need to do. I think that price is too steep and not very likely to get the boxes to the US.

Have others here shipped boxes from Thailand to the US and if so what were the experiences?

Thanks

A friend of mine that has been to Thailand a zillion times and has a new Thai GF over there told me about a phone service he uses to call her. I checked it out online and it's pretty darn cheap so I am passing it on so you
guys can check it out and see if it works for you. No, I don't get anything for posting this but I might use it when Teaw gets here and she wants to call her family. It's www.rebtel.com. It's like .0008 cents a minute to Thailand. So check it out. Be interested to know if anyone else here uses it. My friend said he has no trouble with the quality of the calls.

I looked at the rebtel. I can't believe it is 0.008 per minute. Can you ask your friend if the wireless provider for the mobile phone charges some type of connection fee? There has to be some other fees somewhere.

Thanks

Audy_Rob, I think the best idea of what is really happening will come from the girls on visa4thai. That seems to be the kept pretty up to date on what is happening at the embassy. Teaw followed a lot of stuff in there and it was a good barometer of where we thought we were in the AP process. Although I really think the letter I sent and the congressman's letter got them moving a little faster.

Yea, I agree. Audy is good about keeping up with usvisa4thai. She seems to enjoy reading the gossip. It is OK for me because I am really busy at work now. I hope that by the time the interview is scheduled I will be able to get some time off and go see her before the interview to help arrange all the documents and evidence.

Just received my NOA2 today!!! Wow, cannot describe how happy I am. Thanks all of you for being so patient and giving information on the process thus far. I really don't know how I could have made it through without all your time and info.

Question for you all who have recently scheduled interviews, how long have you been experiencing for interview wait time at the Bangkok embassy?

Thanks much!

The problems are 1) it is summer time when applications go up (so I have read) and 2) because the Embassy was shut down from May 14-24 the Embassy says it is very far behind in scheduling interviews.

The email they sent me said it will be 8-10 weeks after receiving Packet 3 before they can schedule the interview. Then I do not know how far out that interview will be. The Embassy did not say.

My fiancee told me tonight (Thursday morning her time) that she read the exact same Embassy response from a Thai lady posting to usvisa4thai.

I am not sure I believe the 8-10 weeks. It is somewhat like being in AP for interview scheduling.

@gbagbo Thought I would let you know I emailed the Embassy Tuesday morning July 20 in Thailand time. I gave them our information and the date they received Packet 3. They confirmed they received Packet 3 July 1. They said they are very backed up on scheduling and have not scheduled her interview yet. They said it is taking 8-10 weeks from receipt of Packet 3 to schedule the interviews. Then they will mail her the interview date.

I do not really think it will be 8-10 weeks just to get the interview date scheduled based on what Audy told me she has been reading on usvisa4thai. I thought it would be 4-6 weeks to schedule and the interview would be schedule about 2 weeks out.

The embassy tried to call Teaw twice today, Friday, while she was working. She has told them before when her break times are but I guess they didn't think of that. So we don't know what they were calling for...but hope it was to tell her to come pick up her visa. Now we have to wait until Monday!! Bad timing for them as I had to fly out to Calif as my dad is in the hosp. and my mom wanted me here. But at least if she gets the visa that will be one good thing next week. Keeping my fingers crossed..

Oh, the caseworker has not emailed me so they apparently have not replied to the Congressman yet either.

OK Tom, I hope this is it. I think they have exhausted all avenues of delay and you have outlasted them. I hope your father gets well soon so maybe he can share in some good news.

Tom,

I think it is good news that the Embassy tried to call her today. We are still wishing you good luck. Ying and I got married yesterday. We will have the wedding with my family next year and a ceremony in Thailand. I just found out that I have to go to the desert for a year (Kuwait or Iraq) so we are a little bummed but she is taking it good. She will stay with my Mom while I am gone.

Congratulations on your marriage. Of course shipping out for a year isn't the best way to start a marriage. Well, at least Ying can spend some quality time with your mother and learn how to shop American style. Good luck.

Laddawan is off to her interview right now...Ill post back once I hear back from her! Wishing the best for her

Matt

K-1 interview on a Friday. Is that because of the closure due to the red shirts. I thought K-1s were only Monday and Wednesday mornings?

Anyway, I hope all went well.

Hello folks! The interview went well yesterday and my fiancée (Bud) was told to pick her visa up on Mon. I am super stoked!!! Anyway, the interview took about 10 minutes and they seemed to ask pretty basic questions:

1. Name of fiancée?
2. Where did you meet?
3. What does he do?
4. Has your fiancée ever been married or engaged?
5. Questions about her son
...

Hey, great news and great report. I am glad to hear it. Hope you two have good luck with the next steps in your lives together. Congratulations.

Audy_Rob .....Teaw brought back some letters from her father, aunt and neighbor. The neighbor is the only one that speaks some English. Kari (The Bears) translated them for me and they are such sweet, nice, wonderful letters
that will go with the letter about the divorce that the congressman's caseworker will send next week. That should show them that I have not given up and am anxious to get this thing done!!! I am lucky that she has such a great
family that has so many nice things to say about me and Teaw.

That is good to hear Tom. I hope the COngressman's office will get the Embassy to issue a decision rather than sitting and waiting. Good luck as always.

I know. But part of what the caseworker will email them is a letter explaining the chronology of how the marriage happened and how quickly it fell apart and why. So hopefully that will satisfy their curiosity and get them moving.

@TomandTeaw I am also thinking they are giving you a test right now. They want to see if you are willing to wait out the Inquisition or if you will give up. After Teaw's second interrogation when she thought she was just taking in her passport, there really isn't anymore information to consider. They mentioned her cousin in the USA, they grilled Teaw some more. That's it, they finished their AP investigation.

I think it is just a game of wait and see.

@Richardying Your trip through was very fast. I remember when you had just filed the I-129F. Congratulations and good luck. I am going to Thailand for my fiancee's interview and then she needs to wait in Thailand after that so I will return again to bring her back. I do not think she could find her way through the airports alone.

...My luck they will call Teaw and tell her to come pick up the visa the same day as the email goes out to them but before they get it.

@Tom, yeah but that is a good problem to have. I think this is just the right thing to do.

I think a swift kick in the @$$ will get things moving along. Good luck.

@Those waiting for an interview date. Embassy posted today July 2 the latest appointment list. I only see out to July 29, nothing in August listed. Maybe have to wait until first or second of August for the next update to the appointment list.

My fiancee says for right now, the ladies at usvisa4thai are saying they receive letters from the Embassy about two weeks before the scheduled appointment. That won't give me much advance warning to go and buy a reasonably priced ticket since I want to be there about 4-5 days before the interview.

Hey Everyone,

Sorry but another stupid question  Mimi finally sent Packet 3 off on Monday. Will we be notified when they receive Packet 3 or only after they set the interview date? I'm guessing it takes about 3-4 weeks before we find out about interview date? Will they email us or just send Packet 4 via postal mail? Sorry I should know this by now but do not. Thanks,

Mike

About getting notified as to the date of your appointment, it is somewhat hit and miss. Some of the ladies from usvisa4thai report it is best to keep checking the Embassy's web site where the appointment list is posted.

1) Here is the link to the web page which contains the link to the appointment list in case that appointment list link keeps changing

http://bangkok.usemb...pointments.html

2) Here is the current link to the list of scheduled appointments. Keep checking the current list (maybe form link1 above) for your BNK number.

http://bangkok.usemb...edule060210.pdf

This link will change since it has the posting date in it. So use the link in number 1 above.

Good luck.

Here is the interview results and experience from Ying's interview. My link

Hi Richard. I read your interview report. Thank you for writing such a good report. I am surprised at the level of detail they asked Ying.

I sent the list of questions to my fiancee. I also have made a list of additional information I want her to learn such as date of my first marriage, name of ex-wife, ex-wife is a US Citizen, how I support my daughters and when the divorce was but she knows that last one.

My divorce was seven years ago. I met my fiancee two years ago. The relationships are very separate in time. I hope the Embassy does not want to go after that.

@richard and ying. Congratulations to you both. Good luck with the next steps in your lives.

@Tom and Teaw. I cannot believe it. I keep thinking it is about to come to an end, and it gets dragged out longer still. I agree with Kari. It is a good sign that they kept Teaw's passport. Also agree to just have Teaw hang on to the papers you sent. If they grill her again, she should turn in the papers. If it is a visa in her passport, she does not want to turn in those papers.

Good luck TomandTeaw.
