Your filing might have been sent to the Arizonia or Texas intake centers. There was a change in the method of Package intake to help make it more "uniform" according to the press release. Numerous packets sent to the Service Centers first have simply been resent to the appropriate intake center.

It will be sometime before the process becomes smoother as new instructions are required to send I-129F petions to the proper address.

Be a little more patient than others right now. Do not be alarmed if you see notices of transfer to Arizonia or Texas.

Hello,everyone.A question that really bothers me.One of the things you need to declare is whether you lived in another country for over a year since the age of 16.Is that 12 consecutive months?What if you were somewhere for 5months,then left for a few weeks,then went back for another few months.This way you really was somewhere for a year,but not at once...So what do you do?Do you still need to declare you lived somewhere over a year and get a police certificate (even though you never really had a resident address or anything)?Or do you just not declare it because it wasnt 12months at once?Any help will be appreciated!Thank you

This is still residing in one place for a year or more. Taking a week or two of vacation does not mean you have given up your residence. You will need to declare your place of residence and obtain a police certificate if AVAILABLE. You can check the DoS web site reciprocity pages to determine if the police records are available.

By sending two packages, he meant send ONE package now with the forms that are ready and needed for scheduling the interview appointment. The SECOND package could be the I-134 sent at a later time but before the interview as he believes it is due at the interview.

Petitioner/sponsor may submit the Affidavit of Support. It is optional for K1/K3 applications.

It seems the I-134 is OPTIONAL for Afghanistan. Is that your understanding from previous posters from Afghanistan? Very strange that they would not require an affidavit of support.

It might mean that some form of Affidavit of Support is necessary but not the I-134. You could use something else.

Our petition has been approved since May 5th but is being held "captive" at the USCIS because it is under going an extended Quality Assurance Review. Does anyone know what this means and how long it will take? I spent alot of time putting the petition together and it was very well organized exactly as described in the visa journey guide....Thanks!

I have never heard of that or read any postings about it. It sounds like a supervisor might be pulling a ver few randomly selected petitions and checking the work and review performed by the USCIS petition adjudicators. That delay sounds excessively long.

While the B-1 visa is appropriate for the interview, it does not sound like it is appropriate for actual work in which he is earning a salary (which is my assumption about the position in the US).

I believe from your description of his education and potential US employment he would most likely need an H-1B or possibly a J-1. The J-1 is less likely depending on Nationality of your fiance and the Florida position's responsibilities.

With an H-1B it should be a fairly simple matter to marry and then have him Adjust Status but you must be very careful to document his road into the US while it is not clear he immigrated to marry you rather than work, there could be some confusion.

While most people at VJ advise against seeing or using lawyers for simple form filing and interview procedures you are entering muddied waters and might want to search for a competent lawyer to discuss the matter.

More information after the job interview might also be helpful.

The Affidavit of Support form to file for the K-1 Visa is the I-134. But Bernie was giving the link to the Poverty Guidelines for 2009 which is the I-864P. Bernie was not saying to file the I-864. There is no poverty guidelines form for the I-134.

@OP - You should plan on providing recent pay stubs if you are qualifying based on income and at least one year of tax forms or transcripts depending on what the Consulate/Embassy asks for.

the K1 is not denied but has been under review for the past few days after the CO requested more pictures. She didn't like the ones we previously handed to her because they weren't intimate enough. My fiance answered all her questions but she requested more pictures. He brought more pictures now he's home waiting for a phone call. not sure when they're going to call and give a decision.

Absolutely. You haven't been denied yet. Be positive and hang in there. If they haven't denied you, you can't go and file again. They just wanted more photos.

Caveat: If the K1 was denied at the consulate, but USCIS has not made a decision yet, then the petition is not yet dead. Filing an I-130 may not necessarily kill it, either. Apparently, there are people who've received NOID's on a returned K1 petition, and ignored them because they'd already filed a CR1 petition. Failure to respond to the NOID caused a P6C finding against the beneficiary (material misrepresentation). When they showed up for their CR1 interview they were told they were inadmissible due to the finding of fraud, their visa was denied, and they had to try to get a hardship waiver to overcome it.

The new CSC tactic described in the pinned topic by Marc Ellis could also conceivably be applied to a CR1 petition filed after a K1 petition was returned to USCIS. In those cases, CSC even SAID the K1 petition was dead, and still used it as a basis for a NOID on a subsequently filed petition.

There's certainly no danger in filing a CR1 petition after a K1 visa has been denied at the consulate. There may, however, be danger in presuming a K1 petition is dead. If you get a NOID then you must respond to it, even if it's for the original K1 petition. If you don't then you're inviting USCIS to conclude that the CO's accusation was true.

Agreed. However if the Ki is denied, he/she can file the new petition.

The problem is "if the USCIS issues a NOID, then you must respond to that NOID." Does a response such as No Contest or Do not wish to pursue keep you from receiving a finding of misrepresentation?

It sounds like you are saying you must vigorously defend against the NOID to the satisfaction of USCIS that you do not receive the finding of misrepresentation or fraud.

Will ALL "no responses" to an NOID result in a finding of misrepresentation or fraud? Is there a clean way to quickly squash the first petition after visa denial so you can go on to the second petition?

I'm currently filling the I-129F form, and me and my boyfriend are confussed as to what to put for his address.

He is currently living in australia, but only started living there 2 months ago, but we are planning to file in sydney because he is working and living there for 6 months.

My question is if he should put his current address in austalia, in part 1, or his england address, then in the other section stated location abroad place the australia address? Thank-you

I think this is a little confusing. He started living in Australia 2 months ago. So does he still have 6 more months or does he have 4 more months (6-2=4).

You need to think about where he will be for the Visa application and interview. If he will be in Austalia long enough, more than 4 to 6 months, he should list both Part B - Q2 as Australia and Part B - Q15 as Australia. But it depends as the process for the petition, Packet 3 and arranging for the interview might take him back to England.

There really isn't a difference in the Address as neither question says permanent address versus local or temporary address.

What does matter is Part B Q-20, where will he interview, Sydney or London.

It is up to the Consular Officer to look at the finances in their totality. There is no definite about how liquid or solid assets can be, there are no instructions for applicants, only for adjudicators.

Depending on the nature of the assets, it is possible they could represent 60,000 to 100,000 in annual income. See section 29 on page 9 of the I-864 form and instructions.

hey everyone, I have a few questions and would appreciate the help. Now for the affidavit of support I will need a co-sponsor, at the same time my brother is also in this same process as me trying to bring his fiancee, now the question I am asking is would me and him both be allowed to use the same co-sponsor? We know a family friend and he has agreed to help us out but we dont know if he can be the co-sponsor for both of our fiancees.

Another question I have is when we file the affidavit of support, is the support needed for me and my fiancee or just her?

And the last question is having a co-sponsor who lives in another state possible? Like does the co-sponsor need to live in the same state as me for the person to be eligible?

1) The joint sponsor can act as a joint sponsor for more than one family or person as long as the income is sufficient for the total of all peopole needing sponsorship. The joint sponsor will need to fill out an I-134 (or equivalent for Afghanistan) for the first Alien Beneficiary he jointly sponsors. Then on the next I-134 (say for your brother/relative), the joint sponsor needs to list that he has filled out an I-134 Affidavit of Support previously and list the person sponsored.

2) The joint sponsor only supports the Alien Beneficiary and any dependents of that Alien Beneficiary. You would not be included.

3) This is very important. The evidence the joint sponsor submits in addition to the usual documents like pay stubs, tax transcriipts, MUST include proof they are a US Citizen, US National or Legal Permanent Resident. Other requirements of the joint sponsor are that they must domicile in the USA or its territories, a different US State from US is fine. A different country is not fine, it is then up to the judgment of the CO.

Right, I'm the petitioner. I'm afraid that the embassy will deny the visa if I'm not working and showing I can support my Thai fiancée...

All things considered, an interruption to your current income is not the best thing for an Affidavit of Support. The Bangkok Embassy has been getting stricter over the past six months based on reports from ladies on usvisa4thai. Many more interviews are resulting in 221(g)s for more docs or AP.

Additionally it is difficult to stay legally in Thailand for 2 months. If you enter by air you are allowed an automatic 30 day visa and can extend that with great trouble I believe another 15 days. Or what we usually do is fly out to Malaysia or Singapore and re-enter to get another 30 day visa for Thailand. DO NOT overstay a visa in Thailand. If you are stopped for any reason without a valid visa, it can either be extremely costly or you can go to jail.

Yes, you should update the USCIS. You can do it online at the USCIS web site, www.uscis.gov or you can send in Form AR-11 available from the Forms page of the same web site.

I do not see passport style photo for each of you in the list but as Gary and Alla said, you need everything for an I-129F packet plus the Waiver for Part A, Question 11. You need to state why you withdrew the support of the previous K-1 petition and any document or evidence that you will be willing and able to continue this petition without withdrawing again.

If it happens to be the waiver for multiple I-129F K-1 petitions, they might not even issue an RFE as there isn't always a formal waiver required. As Jim said, the best thing to do is to wait and see if you get an RFE from USCIS. Then respond to that RFE.

I'm working on my G-325A and they only allow a small space in the employment history section to put your employer's name and address. I was thinking of attaching a page with the full information since I can't fit it. I am going to write my employer's name then say "see attachment" in the spaces. Do you think this will be ok?

To be complete, you should probably sign and date the additional sheets for the G-325A. The G-325A form states that it inherits the instructions of the form that requires the G-325A. The I-129F which requires the G-325A states that you are to sign and date each Additional Sheet.

I believe this questions has been asked b/4 b/c it was another question that prompted me to ask this question, but i can't find a thread anywhere. I am purchasing an existing business and will be recently self employed at the time of my fiancee's interview. I am using my brother for the I-134 in the mean time. My question is that my brother files his taxes jointly with his wife. Do I need his wife to fill out the I-134 form as well as my brother? Can i just have my brother supply the I-134 with his tax form? If i had a choice i would prefer to not have her fill out the I-134. Thank you very much for your help and experience.

Your brother will fill out the I-134. Hopefully, his income alone will qualify to cover his dependents and your fiancee (and any of her dependents that will also come from China.)

His wife does not fill out a I-134. But he needs to separate out his income from his wife's income if she also earns money claimed on the 1040. The best way to do that is to provide copies of his W-2's only to show his portion of income earned.

Do not forget to provide copies of his qualifications which are that he is a US Citizen, US National or LPR of at least 18 years of age. (so a birth certificate, naturalization certificate, copy of green card, etc...)

There is no theoretical limit to the number of people one person can sponsor. Of course they will eventually reach a limit in terms of dollars and prtacticality.

The I-864P Tables show the dollar amounts for up to 8 people and then give you a dollar amount of additional required income for each additional person to be sponsored.

Example, non-military, 48 states, 125%

8 people $46,262
Add $4,675 for each additional person.

yesss this is exactly the same, how did your petition work out then?

I do not see the Country of your Alien fiance(e) listed as that would help.

Generally current income is more important than past history such as tax returns. You will want to document your new current income with many pay stubs and a letter from the new employer.

I do not see any timeline information or what you have applied for and when. So if you can get three to six months at the new employment before the Embassy/Consulate interview, I think you will be fine. The six months of pay stubs from your pay checks would probably be sufficient.

However if you are reaching the interview shortly, like in two weeks, then if the Consulate of the Country your fiance(e) will interview at accepts a joint sponsor, you should definitely consider trying to locate a joint sponsor.

Wow, there is some serious confusion here.
You send I-129F, G-325As, $455, proof of having met, etc...
You receive NOA1.
2-5 months later You will have your I-129F approved - That is NOA2, you will be sent NOA2 as approval.

Then your fiance(e) ia allowed to apply for the K-1 visa at his/her Embassy/Consulate which is where they need to interview. You fiance(e) needs his/her passport long before you plan to file for the Visa at the Embassy/Consulate which is after you have received NOA2 in the mail.

There is no interview in the NOA2. Please go over the guides and flowchart to studdy the steps in the process.

He must have the Visa to fill out the Forms DS-156 and make application at the Embassy.

We got our NOA2 on May 13, 2010. So, I'm in a rush to get information gathered to send to her ASAP. However, I have some reservations about as to when I should start. For example, will my banking info be considered "stale" by the time the interview is conducted? Also, I plan on sending her the following... Please tell me if I'm on the right track.

1. Copy of original I-129F packaged that was sent out.
2. Copy of NOA2 letter.
3. I-134 with 3 years of tax/income data (IRS Transcripts).
4. Bank account history.
5. Letter from employer.
6. Letter of intent to marry (updated)
7. Eveolution of relationship letter.
8. Proof of on-going relationship. Includes photos, passport visa stamps (scanned and printed), calling card CDR list, e-mail, and skype chat logs.
8. Certified Copy of Birth Certificate (Long/Full size).

Do I need to also provide proof of residency letter (I live in a single bedroom apartment)?

Most importantly, which of the aboved mentioned should I get notarized?

BTW, Packet 3 and 4 is intended to be filled out by the beneficiary (my fiancee in China). Any action items needed by me state-side that requires mailing out to her?

I would like to suggest Pay Stubs if you have them from your employer. They are a far better proof of current employment than a letter from the employer.

Also, if you can handle the cost, you can FedEx your latest three or four paystubs to your fiancee about 10 days before the interview, but it is about US $57. That will make your income information "current."

Yes, it is a good idea to provide the birth certificate as most Consulates do want them for the USC as part of Packet 3.

DO NOT send your ORIGINAL Passport. The Embassy is entitled to ask for originals of any documents that were provided for the I-129F.

If you do not have anything in an original form such as boarding passes, copies from your passport, pay stubs, you need to make it clear to your fiancee. You need to giver her a list of what you only had submitted in copied form and she needs to understand just in case they ask for it at GUZ.

Separately, the Consulate typically wants to see the Birth Certificate, Divorce Decrees etc of the USC. You need to check what GUZ wants in Packet 3 or GUZ's equivalent of Packet 3.

Also: There is a member here by the name of Darnell, maybe try to PM him and ask your question about the Birth Certificate if you do not see the Packet 3 for GUZ online.

That is a Consulate/Embassy specific question but there are a few things you can do.

Contact the NVC to get your file number for your Embassy. Contact the Embassy to make sure they get your file.

You could also go to the web site for your Embassy and try to locate Packet 3 on line as most (not all) Embassies have Packet 3 online.

Non-residents should send their requests to the Royal Thai Police Department at the above address with the required documents and a fingerprint taken by a police authority at their place of residence.

Normal processing time is two to three weeks. There is no processing fee.

So my questions) are....

1. All of her documents...passport, previous expired visas, current visa she is listed by her maiden name and we plan to file all the paperwork using her maiden name. The only paperwork that we have that list her married name is her actual divorce decree. Does she need to go thru the German system and have her name legally changed back to her maiden name before we can file? I'm pretty sure I know the answer to the question but just wanted to bounce it off of the forum.

2. Her father/mother are deceased and she doesn't know any of his details (date of birth/death/birth location). How important will this be...will it be ok if we can just add an explanation to the form?

3. As she is a Thai Citizen someone told her that she would have to go Thailand and register her previous marriage/divorce. I call BS on this as she was married in Germany and Divorced in Germany so anything in Thailand shouldn't matter. Am I correct in my thinking?

1) No, she does not need to do anything. The divorce decree is sufficient for a name change (back to her maiden name) in itself.

3) No, Thailand has nothing to do with this. Even if her marriage in Germany had been registered in Thailand, the divorce does not need to be registered because Thailand has nothing to do with this.

If she wanted to register with Thailand that is a different matter and would require some changes, but it seems like she does not want to do so and has no need to do so.

My fiance is from Thailand, and she's filling out her G-325A. For her last 5 residences question, she listed the two addresses in Thailand she lived at (present address + one previous address). Does she still need to fill out the next section titled "Applicant's last address outside the United States of more than 1 year"? I advised her to put 'None'. She was an AuPair, and has been in Thailand for <1 year, and her Thai addresses are listed in the section above. Does anyone think this'll be a problem?

I think the answer is incorrect. I cannot be sure if it is a "problem." I think she needs to put an answer in the question you refer to. It sounds like she was an au pair in the US and then moved back to Thailand. She has been in Thailand for less than one year. So the correct answer to the question is the address in Thailand before leaving Thailand and was at the address for more than one year.

The Visa denied at the consulate, the file returned to USCIS and finally closed due to validity expiered in Feb '10.

So, what should I write to make a good case for 'em to grant me a waiver?

What you write should be addressing the Reason for Denial at the Embassy for the first petition and how you plan to overcome that issue the second time around. I think USCIS is saying, OK, you had your chance with the previous approved I-129F and were denied the Visa at the US Embassy/Consulate interview. Why should we just go and issue or approve another I-129F ???

I think they will want to know how you will fix this situation and overcome the previous problems at the Consulate. If you can demonstrate a reasonable and valid plan then USCIS might grant the Waiver to the IMBRA requirements.

Oh, if she is from Shanghai, China, then pushbrk is correct. There is almost no chance she can get a tourist visa to come to the USA.

You will need to travel to China and meet here.

As others have said, document your trip thoroughly to prove with the I-129F petition that you indeed went to China and met her. Keep all used boarding passes, submit copies of your visa entry stamps, hotel receipts and finally photographs of the two of you together. If her family lives in the same area and approves, then try to have pictures of you, intended fiance(e) and her mother or father.

ok lets see where to start, well my sweetie that i have known online for over 1 year now just online we would want to get involved with each other even more, and step it to the next level of being with each other and seems the way we are going at it most likly we will marry each other and we are fine with this ^.^

now my question is since we have had only online love and no real life contact yet, would Fileing for a K1 be a bad idea? or would her fileing for a Tourism Visa first then a K1 afterwards be the best idea here?


i'm trying to figure out whats the best thing for her and me, we really want to be with each other like most lovers. but i was reading that you need to meet them in the past 2 years? meaning have known them for the past 2 years and have met in real life in some way yes?

If the US Citizen wants to file the petition allowing the Alien beneficiary to apply for a K-1 visa, then you must have met in person in the two years prior to filing the petition. If one of you can get a tourist visa to meet the other first, it is required for the I-129F.

It makes sense no matter what.

Another question. On the instructions about form I-129F,it says provide evidence of us meeting, so I send all of that with the form? If we send things like boarding passes and stuff can we just make copies or does it have to be the original thing?

You send the evidence with the form.

Definitely arrange the evidence neatly and send copies. Such as putting the used airline boarding passes or bus tickets or whatever on a sheet of paper and make a copy. Keep the originals of everything.

My regular government pension brings in a gross total of $2,138 per month. I also receive an $800 monthly annuity form my Thrift Savings Plan (govt. version of 401k). The $800 monthly annuity can be varied (or canceled) if I so apply to change it to another value. The regular government pension of $2,138 is permanent until I die. Is this enough for the I-134? You did not say what your household size is to properly determine if the amounts given are correct.

Let's say you earn $2938 a month total including dividends in the form of the annuity, then your yearly income is about $35,256 assuming no significant losses from investments or businesses.

Then you can look on the I-864P Poverty Threshold guidelines at USCIS and see you are able to cover yourself and fiancee which only require $18,212 with substantial margin. Even if you have more dependents you will still be very safe.

You should not mess with the house. It is unneccessary.

K-1 Fiance(e) Visa Process & ProceduresVisit on tourist visa while waiting for K1?

My GF/Fiancee is in Costa Rica. She has a tourist visa that I think she said is good for ten years for her to come here to visit when she wants. She was just here in December, for example. Will she still be able to come and visit on the tourist visa while we wait for the K1 visa to go through? Or will that cause more problems than it is worth? We would like the visit to be as long as possible, but know we have to go to Costa Rica to do the interview when the time comes. I do plan on visiting her while we wait, too.

Nothing is guaranteed. But she certainly can present herself at the POE for permission to enter. She should bring extensive documentation showing her ties to Costa Rica proving she will return at the end of her intended stay.

Return air ticket, Apartment Lease agreement, letter from employer stating her return to work date, or a class schedule showing her enrollment for classes etc...

It should be a certified birth certificate, a version with a raised stamp or seal. It needs to be a "long" version which lists both parents if mother was wed.

You can send a copy of this type of birth certificate, both front and back to USCIS. Do not send the original.

You did not post or list the country of your fiance(e). Not all Embassies/Consulates accept Joint Sponsors. Please be careful to check that the Embsassy your fiance(e) will be interviewing at is known to routinely accept joint sponsors such as England and not routinely deny them such as Bangkok.
