In addition to just answering Question 18 as you have done, you need to submit substantial evidence to document the meeting (or one of the meetings that occurred in the two years before the USCIS will recive the I-129F submission. Evidence from 2006 and 2007 will be of no use at this point of the process. Technically the same applies to the answer to Question 18. Anything before mid-2008 does not apply.

Only use evidence of meeting from about October 2008 to the present.

You both need to fill out your own version of the I-134.

Since you are a student and presumably not working, you only need to provide the I-134.

The joint sponsor should fill out the I-134, provide documentation of current pay such as pay stubs, letter of employment is nice but not necessary and should provide three years of tax transcripts or tax forms (with W-2s if tax forms and not transcripts).

IMPORTANT: Make sure the joint sponsor is eligible, he/she must be a US Citizen, US National or LPR. Make sure you submit the proper documentation which would be the joint sponsor's copy of birth certificate or copies front and back of green card.

Do not send any additional papers without first being requested from the USCIS.

The USCIS does not consider evidence of an ongoing relationship so you might not receive the RFE even though the documents are in Portuguese.

The USCIS is only concerned with evidence that you have met in person in the past two years. If there are some documents you cited that the USCIS thinks are relevant to showing you did indeed meet in the previous two years, perhaps, hotel receipts, restaurant receipts, used airline boarding passes which are in Portuguese, those should have been translated. You could receive an RFE to translate the documents under those circumstances.

The Department of State web site has what is called a reciprocity table for most countries in the world. It describes what types of police certifcates and prison records are obtainable. To be honest, I read it and I did not understand it completely.

Like some other countries it seems you cannot mail into China requesting the certificate. It seems you need to present yourself in person to get the documents. I am not clear about this because usually when a country does not allow a person outside the country to make the request by mail, the DOS considers the documents unobtainable (such as South Korea).

Staple or paper clip the money order to the front page of the I-129F petition. Possibly you could staple or paper clip it to the cover page of the cover letter. They don't really need the 2" binder. They will take it all out, use an ACCO 2 hole punch and make their own file. Just slip it into a manila folder or entire package into a manila mailing envelope.

I do not understand the question "Is one faster than the other." There is no other because you cannot drive it over nor walk it in. All you can do is a) Mail it in or b) Fed Ex, DHL, UPS it in.

I am not sure about the previous answers. Marriage certificates (actually licenses) are issued based on state and county specific regulations. Marriage licenses are not under Federal jurisdiction. You need to search the net (use Google or whatever) for the state and county requirements to apply for a marriage license. If there is a requirement for a SSN by the state or county, you will do your marriage plans according to that information. Otherwise you can follow the plan you have first outlined.

In July 8 they received our reply to RFE regarding IMBRA. We sent IMBRA waiver and the proof that my fiance canceled it before it was sent to the UAE embassy.

What does the BOLD text mean, "my fiance canceled it."

What did he cancel? What did that have to do with the UAE Embassy?

Your post is unclear. I can understand since the petition was rejected. Wait for the letter as mentioned but maybe you could try to explain more.

Since she will only have the one paystub, a letter on official company letterhead would be helpful. But if it is difficult or an inconvenience to the boss, then go with the one paystub and a short letter of your own explaining the raise.

You will be mailing it to the Dallas TX lockbox where all petitions go for uniform intake processing. Then it will be sent to either California or Vermont. You cannot tell anymore because the USCIS has not published a list saying where your petition will go.

If you want to put an address on some letters then use the Dallas TX delivery address in the I-129F instructions.

Yes, this is correct information. The guidelines are:

1) You need a police certificate from anyplace in your home country you lived six months or more unless the certificate is National level.

2) You need a police certificate from any outside country where you lived fro 12 months or more EXCEPT the USA. You never need to request a police certificate for the US, the Embassy has ways to find out your record in the US.

You need to know they received the case. That means you do not even need to know although with London, it might be easiest to wait for the letter. Otherwise you need to call and pay money to get a PIN so you can email them to ask if they have received your packet from NVC.

Yes, you can start filling them out. They do not need to be dated after Packet 3 is sent. Many Embassies do not send a Packet 3 but just a link to the web site.

You can either send copies of those forms required by the DS-156K but in general the originals will be produced at the Embassy. It is best not to send the originals in case they are lost in the mail or at the Embassy.

A new and original letter of intent can be produced at anytime. It should have been within six months.

It could be very different. There have been several postings about what USCIS does when it is the second application for the same beneficiary after the visa was denied the first time.

The USCIS might go and investigate or adjudicate based on the Embassy's findings. In other words they might issue an RFE for Evidence of a bona fide relationship. Or they might just follow the usual course.

Edited to add: Also change up and add extra things that aren't always included in the Evidence of a Relationship. Is she in English School. Have you been sending her money for the classes. Have you searched the web for flower delivery services in her city. Can you send flowers or a gift for a special occassion or no occassion at all.

Try to do more than email, chat log, pictures from first visit.

Not all can afford an Engagement Ring. In many cultures there isn't an ENgagement Ring at all, but there might be some type of ceremony or cash and payments of jewelry.

Sometimes the Embassy/Consulate will only grant the visa if there is evidence of the ceremony and many times there simply is no way to be sure. In the case of the Western world, they do seem to like to see a ring by the time of the visa interview. If you get a ring by the time of your interview, show it.

Well if he is your fiance(e) then he is NOT a married applicant. He darn well better be a divorced applicant or he will not quqalify for the K-1 visa.

They might be using the same list of instructions for more than one visa type.

Some Embassies/COnsulates request a Marriage Certificate if obtainable but in the case of a K-1 visa, they will only require the Divorce Decree, not the marriage certificate.

It depends on the particular Consulate and the current number of applicants and case load at the Consulate. I had to wait until my fiancee was informed of her interview appointment. It was scheduled roughly 24 days in advance. I asked my boss for time off the same day. I bought the airline tickets online the next day at a higher price than I would have liked. Nothing you can do about it.

In your case, you need to go if she is to have any chance this time. Also send cards by Fedex or UPS. Send flowers or gifts through a web service in China. Make the gifts and Evidence of ongoing relationship different than the usual.

Wake up the CO with the clever innovative and loving things you have done for her. She will need to do some things different as well. Like attending English class and showing it is a burden to her schedule or other committments to you and your life in the US.

It is silly the way they insist on black pen because when you get to the Embassy interview stage, you fill out all the forms and should sign in blue so they can see the original signature. 3) If the baby is born in Indonesia, then you will need to file the papers to have the child declared a US Citizen and not require a K-2 derivative visa. If the process is drawn out so long that the baby is born in Indonesia, it will not affect the case, but you will need to pay the additional visa application fee and file for the K-2 derivative visa.

On the separate sheet, I listed very briefly the details, date, places of having met in the two years prior to submitting the petition but then I made a list underneath of all the evidence that was attached or copies I had made and attached to prove that we had met, used airline boarding passes, receipts from two hotels showing both our names registered, photos of us together, passport visa stamp...Those kinds of things. It helps to highlight with a yellow pen or a post-it note right on the paper want you want them to focus on like both names on the hotel receipt for example.

The Philippines is one of a few countries the varies greatly on allowing and disallowing the use of a joint sponsor to get around the affidavit of support.

I have read many stories posted here from members whose fiance(e)s were denied visas when their joint sponsor was rejected and the USC could not prove a higher income.

Similarly I have been surprised when I have seen postings from people applying at the Embassy in Manila saying the CO issued a 221(g) telling them to have the USC peitioner find a joint sponsor to back up the petition.

It is absolutely impossible to predict with any certainty that a joint sponsor will be allowed. At least with the Embassy in Bangkok I can tell you absolutely without a doubt it is not allowed.

To be a little more specific about the I-134 affidavit of support, it is not both parents that fill it out. It is one or the other. You can only have one joint sponsor for an I-134.

They must figure out correctly how to separate their income and only one person declares their income on their I-134.

The joint sponsor must be a US Citizen, US National or LPR domiciled in the US, its possessions or territories. You will need to submit copies of the birth certificate or green card for the parent submitting the I-134 in addition to all of the financial documents submitted as proof.

While most of these answers are very good and apply to MOST Embassies/Consulates, you need to be careful about getting a joint sponsor (sometimes referred to as a co-sponsor).

You said the approved petition is on its way to Manila from the NVC. Unfortunately, Manila is one of the Embassies that "usually" does not accept a joint sponsor for the K-1 Visa. The Embassies are not required to accept a joint sponsor for a K-1 Visa. Most of the Embassies do accept them although in particular, Southeast Asian Embassies DO NOT.

I have read posts from USCs and their fiancees who received 221(g)s and were told they could not submit a joint sponsor and to bring back documents of more substantial financial support.

Find the Philippines specific forum in the Regional area and post questions only to people that have passed through Manila.

Have your fiance(e) concentrate on getting a job. There are ways to stretch out the time until the interview to allow your fiance(e) more time for the job search. Basically delay the return of Packet 3 or the calling for interview scheduling. But be careful to request an extension of NOA 2 expiration date.

For this years income, he needs to give you 3 or 4 pay slips, enough to show what his income will be for all of 2010.

For last year with the tax form, you really need a W-2 wage slip to go with the tax form. The alternative is to get a tax transctript from the IRS which does not require a W-2 slip. You can have the IRS send it to you by fax machine the next business day.

If in the Embassy/Consulate's Packet 3 instructions states to send in copies of the documents, you should do so. Do not send originals of the documents required to be shown for a DS-156K as they can be lost in the mail or Embassy mailroom. Carry them in by hand at the time of the interview.

If you have read the letter accompanying your Consulate's Packet 3 or onl;ine instructions for Packet 3, and you are certain you are being given no instructions, then you do not need to send in any of the accompanying documents at this time, prepare to hand in copies of all required documents and be prepared to hand in originals of some documents like the police certificate. Be prepared to show originals of other important documents such as a divorce decree or birth certificate.

We noticed there is a fee of $350 dollars the day of the interview. Is this one fee of $350 or will I have to pay one for my fiance and her daughter equaling $700 dollars?

The fee is per visa applicant meaning one for fiancee and one for daughter, $700.

Double check the instructions. Usually most Embassies/Consulates don't deal in money and require you to pay at a bank or a post office and bring a receipt to the interview.
