The Consulates and COnsular Officers within a Consulate all seem to vary on how this question should be answered. I have seen many posts on what has happened based on how the USC and joint sponsor (if applicable) answer the question.

You will not be denied a visa if the Consular Officer wants to see "I intend" checked. You will receive a 221(g) and asked to have the USC send a new I-134 with a different answer.

Don't panic, worst case it will be a slight delay, but NOT a denial.

Do the instructions for your Consulate say to Fax DS-230 Part 1. DS-230 Part 1 needs to be signed with an original signature for the Consular officer. It should not be faxed unless the consulate instructions are telling you to do so.

Hey guys,
Just so you all know first off I am NOT the USC I AM the beneficiary.
So I am thinking you are going to be hearing a lot from me here since i just received packet three and am trying to do this all correctly.
Ok so my question is I am currently filling out the DS-230 Part 1 form so I can fax it off tomorrow. Now every line that asks questions about my fiance is calling him my spouse? He is not my spouse yet should I just disregard that and fill in his information there?

If you are talking about question 14, 15, 16, 17, No, you are a fiancee. The only way you can be a fiancee is if you are UNMARRIED in terms of an I-129F. You have no spouse, leave it blank or NONE.

This is from the PDF file which makes up Packet 3 from the US Embassy in Bangkok:

"FOREIGN POLICE RECORDS: Each applicant is required to submit a certificate from the
appropriate judicial or police authorities from all countries (except for the United States) where
the applicant has resided for twelve months or more since attaining the age of sixteen."

NOTE: Bangkok Embassy says where people have resided for 12 months or more, most Embassies say 6 months. But note here, they say (except for the United States). I believe this is all Embassies as they can easily check and will check for a record in the US.

USCIS does FBI name checks, not the embassy. You need a police certificate for all the places you lived in for longer than 6 months.

Please go to thw web site for the US Embassy where the beneficiary will have the interview.

I have read that police certificates are required for everyplace you have lived since age 16 EXCEPT the United States. For periods in which you lived in the United States, the DOS does have the ability to get the name check done which is usually at the NVC. The NVC is a division of the DOS.

As you can see, it is an explanation of the requirements to show your beneficiary will not become a public charge, go on Welfare on Medicaid, etc...
You can USE Form I-134 to meet the terms of OF-167.

That is a little strange. I know the OF-167 is recommended by CDJ (Ciudad Juarez), the Mexican Consulate that adjudicates ALL Mexican K visa interviews. They request the OF-167 or the I-134 can be substituted is basically wjhat they say, I am paraphrasing from memory.

I would think only one ot he other is necessary. You might want to double check the wording of the Canadiann Consulate you are dealing with or send an email for clarification.

The other thing you can do is go to the web site for Ciudad Juarez US Consulate in Mexico and look through their Packet 3. They should have the OF-167 if anyone is going to have it.

Yea that's what I originally thought to do but we contacted the officer assigned to our case and he said that the interview can still be conducted without the police certificate. They will give a Yes/no answer to whether or not they will approve us for the visa but it will remain pending until the police certificate is submitted. So no big deal there i think. We are expecting it within a few weeks now.

The original support papers is what i'm most concerned about. I duplicated the package and resent it to her via email today and she will print it out tomorrow. I'm wondering if this will be ok?

They will require an ORIGINAL signature on the I-134 as it is an Affidavit signed under penalty of perjury.

I have never heard of a scanned, faxed or emailed signature being acceptable on an I-134. Maybe yours will be the first.

Ok so my fiance's interview is this coming Thursday, so I filled out the support papers and got the necessary documents (tax returns, bank statements, etc..) and fedex'd it to her on Monday April 12th. Well what do ya know, the documents went to the London hub before being sent to South Africa and then I think everybody knows what happend next.. Yup, that's right.. Iceland's volcano erupted and all flights in Northern Europe have been cancelled for the last 5 days and nobody knows when they will resume! So in a mad scramble I scanned all the paperwork and emailed it to her so she could print them out and have atleast something for her interview. Does anybody know if this will work? Also, her police clearance still has not arrived. She sent the 1st request over a month ago but was lost in the mail as she did not get a courier service.. (YEA, I KNOW) She sent off the 2nd request March 31st and then contacted the Police Clearance people but they will not expedite the request because they feel an immigration interview is not important enough! I'm starting to pull my hair out. What should I do?


Asking the Embassy to reschedule is the most responsible thing to do. You have two issues to overcome. You might go into the interview and come away with just a 221g to get those two documents or you could get a denial.

The Embassy might understand about the I-134 because of the volcano but then again, you are supposed to have all papers in hand before returning the chcklist and requesting an interview date.

As far as the Police Certificate, you do not have as good an excuse as a volcano.

I would ask for a postponement.

Based on Igor's list, my fiance's embassy has an average of 41 days from receipt to interview date for K-1ers. This is a good problem to have but how 'fresh' do the letters from my employer, bank, etc need to be? Is 30-60 days acceptable? Any insight would be helpful.

Actually that is very good. They will gladly accept that. They understand it takes time to get documents around the world and that you need to be prepared in advance so you need to ask in advance. 60 days is fine.

I was afraid you were going to ask if one year is OK ?

No, and you won't. Hopefully you have provided all the documents your fiancee will need at the interview.
1) I-134 affidavit of support and Supporting Evidence
2) NEW Letter of Intent to Marry addressed to Department of State, US Embassy in Tokyo
3) Originals of important documents you may have sent as copies like your birth certificate, divorce decree if it applies to you anything else special to your case.

If the sponsor doesn't have enough income, they can usually make up any shortfall with assets, like cash in the bank. The value of the assets has to be at least 3X the shortage in income if the sponsor is married to the beneficiary. Otherwise, the value of the assets has to be at least 5X the shortage in income. Consulates usually apply the 3X rule for a US citizen petitioner sponsoring their fiance, since this is the rule that will be applied when they ultimately get married and apply for a green card.


Are you saying it is okay for him to add cash into my account or not? I do not have the cash or assets for my account. I only make around $900.00 a month, so he will have to help me somehow.There are no co-sponsors. I already tried that. I guess he will try to self-sponsor. I don't know why they make this so hard. He also has a deed in his name in the U.S for a house he owns..which is for 118,000 dollars. I hope he can self sponsor if he cant deposit cash into my account.

Jim is trying to tell you it is not clear if it is Fraud. It depends on why your fiance is putting the money in your Bank Account. Additionally, a determination of fraud can only be made by the CO based on his/her opinion. But if your fiance puts the money into your Bank Account to make it look like you have a strong financial position or have more assets than you do, it might look like fraud to the CO.

Co-sponsors or more properly joine sponsors are not a sure thing for a K-1 visa anyway. There is currently a thread about a USC and his fiancee that received a 221g at the interview because the joint sponsor was not accepted and the USC did not have enough income shown to support his fiancee.

If the house is $118,000 without a mortgage or any other sums owed against it, he might successfully self-sponsor as the house is equal to about 23,000 in income at 5x or 39,000 in income at 3x.

I know someone posted under the name "suicide blonde" with roughly this description because the house was also 118,000. I am sorry that thread turned in to a discussion of the fine points of the AFM and FAM rather than providing you the help and answers you need.

I do not think you should put the money in your account.

I had a question about the affidavit of support. We're applying for a K-1 visa and I (the petitioner) have filled out the I-134. We recently received our letter for our interview appointment (yay!) but in the instructions it includes that the original I-864 should be brought to the interview. Is there a difference between the I-134 and I-864? Am I supposed to fill out an I-864 and then send that along as well?

No, the I-134 is used for a K-1 Visa whereas the I-864 is used for AOS. Here at the Argentinian Embassy website:

I have read through the instructions for the K-1/K-3 document submission. It says;

"(___)14. EVIDENCE OF SUPPORT: You must submit any evidence which will show that you and members of your family who will accompany you are not likely to become public charges while in the United States. Visa petitioner (US Citizen) will have to complete form I-134. If the petitioner does not qualify as a sponsor, a Joint-Sponsor should ALSO be presented (any US Citizen living in the US or Legal Permanent Resident), who will also have to complete form I-134...."

It clearly states to submit the I-134 and lists the required supporting documentation. The nice thing about this web site is it also clearly states that they accept a joint sponsor.

Ideally, the best thing to do is get PROPER tax transcripts, then there is no question as all Embassies accept this without any question.

Do not get the briefer Account Transcript. Dial 1-800-829-1040 and keep following the prompts on the telephone. Do not get the Account transcripts. Get the regular many page transcripts which I believe is ultimately option 2. Keep following the prompts for things like tax history or tax records. Very shortly, one or two levels in, it prompts you using the words "like transcripts..."

The tax form without the W-2 is NOT OK. I am serious. They will not accept it. That is really bad of H&R Block because every W-2 form has three versions, one to submit with Federal, one for State, and a third for the filer to keep for their own records. He needs to demeand his own copy of the W-2's from now on.

Get a PROPER Tax transcript from the IRS. Do not get the "Account Transcript." It is a shortened one page, no good. You want the regular "Transcript," many pages. Call 1-800-829-1040, follow the voice prompts always listening for "if you want records of your taxes, or eventually you will hear if you need a transcript. Pay attention because they have choices. I think it is number 2 that is the full transcript. Do not need to order the actual form copy which is $57 for each year.

Transcripts are free.

About Question 11, you know it is up to the Consulate's policy and even in some cases that have been posted, up to the mood of the interviewing officer. A few people have posted success using the N/A K-1 etc... answer. I think k it is safer to check "I intend..." and then write on the lines something general like I intend to provide housing, food, clothing and any and everything required for beneficiary <enter your name>

But as someone else suggested, email the Consulate and inform them of the expiration date and keep your petition active. Request an extension of the expiration date which is not a problem. I think No would probably be OK. Also I think Yes, and for school put "Online German school" and give the name. In general, you are always safe by listing all known relevant information. This isn't that important in the context of a K-1 visa application.

1) You as the Sponsor/Petitioner enter your Alien Fiance(e)'s name on this line. A joint sponsor would leave this empty (or better Enter NONE) since they have not filed a "visa petition" on behalf of your fiance(e). NOTE: If the joint sponsor has filed a VISA PETITION on behalf of someone, then they need to fill in the space. But that someone would be unrelated to your fiance(e).
2) DS-230 Part II does not need to be used at all for a K-1. Forget this part of the form.

I do have another question to ask regarding Q11: should my future sister in-law tick the I Intend or the I Do Not Intend? i really do need good advice on this one.. As there's so many conflicting things being said about it.

She really needs to check (check in American, tick in English) the I intend box. Especially if your fiance is not able to contribute financially at this time. They should still both check intend. The two I-134s need to be checked (ticked) the same.

I would not recommend writing on the lines specific cash ammounts. Perhaps a few general clauses such as I intend to provide for food, housing assistance, some clothing or other essentials as necessary...

Just a suggestion, IMHO.

You are going to ask him for a copy of the vaccination sheet, form DS-3025. This is where he writes your vaccination history and at the bottom of the form it says "give copy to applicant". Also ask if it is possible for you to get a copy of the ENTIRE medical for yourself (this doesn't always happen because he doesn't HAVE to) because there have been some issues with USCIS losing the medical (well not really, just too lazy to look for it) and this will save you time later.

This is great information to have. I think this applies to all Countries and all Consulates or Embassies because ultimately the information is to be used in the US for AOS.

Every Embassy/Consulate in the world will require at least ONE year's tax return, and for self-employed or complex cases, will ask for three years. It is not written on I-134 form, it is written in the Embassy requirements.

Often, when people do not know the commonly accepted answer for something on the I-134, they will use the instructions for the I-864 which is the Affidavit of Support used when your fiancee is in the USA and Adjusts Status.

Regarding counting family size, it says;

"Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return..."

How many of those children are listed as dependents on your tax return depends on the court orders regarding the division of the children between you and ex-spouse or any simple agreement or other understanding you may have. Then as far as the statement any dependent children under the age of 21, it does not break it up into partially dependent or wholly dependent.

A couple of things.

1) What Darnell said is right on for delaying the process if things start to move too fast. This just happened to one poster where the K-1 visa was granted and the six months will expire before her fiance is ready to move to the US.

I also will be delaying our Visa interview at the Embassy because my Fiancee has responsibilities to her job with the Thai Government which she needs to complete before moving here.

2) About how to count the children. Everyone here will give you a different answer. Tomorrow some poster will come back and contradict my answer here. You are marking partial support which is correct. Usually in the case of a fair divorce (not mine) the parents alternate years the children are claimed as tax exemptions or divided the number evenly every year.

You are not carrying the full support. But you only list the children and partially dependent or responsible. But you do not make the actual calculation and show the number of 125% of the poverty line for your family size. There is no place for that number on the form I-134. The only time the number will be written down is if the Consular Officer chooses to make the calculation.

So you are not the one calculating the number, the CO is. You have an absolutely 100% valid argument that it is you, your fiancee and 2 (full) children.

Question 1: You can switch back from a joint sponsor to just yourself before you turn in the I-134 but if you suffer a serious drop in income below the 125% level you might be better off keeping the Joint Sponsor until you go to do AOS in the USA using I-864. HOWEVER, you need to make sure Guangzhou (GUZ) accepts joint sponsor for K-1 Visas not all but most consulates do.

Question 2: Projected or future income is not used.

Question 3: You need to add the equivalent of two full-time dependents to your family size. So you, fiancee and 2 fully dependent children. The I-134 is a very nebulous form and many details are not spelled out. You need to go with conservative numbers and back up all your data. Most people get information from the I-864 and try to showhorn it into the framework of the I-134. The3re is one guy here that picks what he likes from the I-864 and tosses out what he doesn't like when giving advice.

Question 4: Unemployment benefits is a good question. I don't know. SSDI (disability) can be counted, SSI (essentially welfare) cannot be counted. One senior and respected member JimVaPhoung might know.

The alien fiance (beneficiary) must have the Passport. That person will require a passport to have the visa placed into the passport and then used again to enter into the US.

The DS-156 form asks for that Passport number, Date Passport was issued and the date it will expire.

I WOULD SAY EVERY CONSULATE IS DIFFERENT, I THINK SOME DON'T EVEN ASK YOU TO RETURN FORMS BACK UNTIL THE DAY OF THE INTERVIEW YOU TAKE EVERYTHING WITH YOU. I THINK IT JUST DEPENDS ON THE CONSULATE..I WOULD CONTACT THEM.

This is a little confusing the way it is worded. If you already have an interview date, then you have at least contacted the Embassy and told them you have all the forms completed and available or at least returned the checklist.

It seems highly likely from the question that nothing has been returned yet because if the interview was scheduled, they wouldn't need to ask the question. They have forms, they need to be filled out even if it is only the DS-2001 and scheduling a medical and getting a police certificate. So all the information I posted about the deadlines holds. There isn't a deadline as long as you are reasonable, don't keep pushing it out and contact the Embassy if you will go over the Expiration date on the NOA2.

There is no specified time. Basically you can return them when you are ready.

There is an expiration date on the NOA2 that notified you your petition was approved. The expiration date is four months from the date of approval. This date is routinely and automatically extended by a Consular Officer if the date passes and you need more time. It is describe on the DOS web site under K-1 visas that a CO can extend this time period.

It is a good practice to email or contact your specific Embassy or Consulate and give them your case number and inform them you need an extension of time. This way they will know your petition is still active.

The HIV ruling was announced in December and took effect in January 2010, I think January 4.

TB or any other communicable disease that is a significant problem to the population can be reasons to delay your visa issuance until the condition is remedied.

Arthritis and most of the medications for Arthritis should be OK. You will want to see a Rheumatologist when you get to the USA to make sure you are taking medications that are legal in the USA. Some NSAIDs in Thailand like DenZen are not legal in the USA. Additionally the Rheumatologist might want to make sure you are taking a DMARD if appropriate to your condition. This can improve the quality of your life significantly.

I do not know of a waiver to vaccinations.

Hello,

I have a quick question regarding the language barriers at US consulates in foreign countries.

I just received my approved NOA2, so I sent out the copy of the I-129F to my Japanese fiance.
I know we have to submit newer relationship evidence, but since he will be interviewed at the Tokyo US consulate,
I didn't know if I have to send translation certificates of all our Japanese e-mails.

Since the consulate staff would have to know (at least some) Japanese and English, I'm not sure.

...And does anyone know what language they will be interviewed in? I'm hoping Japanese..

These are Embassy specific questions. It will be best if someone that has gone through Tokyo can also provide answers.

Normally, the Consulates will accept documentation in English AND the native language of the country they are in. Maybe not because the Consular Officer can speak some of the language but because they have many native workers from that country that can act as interpreters. I know this applies to Tokyo based on another posting.

Normally they try to interview in the language used by the USC and Fiance(e) for communicating to each other. I understand the question. I understand you do not want to bring it up and re-hash it with anybody. Keep in mind everybody must always be honest and tell the truth.

So I am thinking you can improve your Fiance's answer. The way you wrote it makes it sound unrealistic, a little flippant or he just doesn't care or something he is trying to hide.

All parties always tell the truth... Can your fiance honestly say something like, "I have asked her about this and she will not tell me, or she will not discuss it. So I have to respect her privacy." "It is just too painful and too personal and she has asked me not to question her about it."

Will that work. I think it is more honest than someone having no desire whatsoever not to know. Every woman I ever dated since my divorce has asked that practically first thing, when was I divorced and why was I divorced.
