Canadads 156 at montreal interview
We are going for our interview in montreal on wednsday. On the appointment letter it says we need to have duplicate copies of the ds 156. We already sent duplicate copies of our ds 156 with our packet three. We are just bringing the copies of the original 156 to the interview. Do we need to go and do them over again and submitt 2 new ones at the interview? Any one with a recent interview or any info would be appreciated. Thanks in advance!

Oh no!! ranting33va.gif I would be freaking out if I was you. I hope they find it!! At least you're already approved...so even if you have to replace your passports, they can just put the approval in them and have you on your way...but after all the time it takes to get the approval, another delay is so frustrating! I'll keep my fingers crossed that it's a fluke and it will turn up.

Its not that easy my fiancee is a Russian citizen and only a permanent resident of Canada it could take her up to six months to get a new passport!!!

Removing Conditions on Residency General DiscussionContacting CSC from overseas
QUOTE (Stefanie @ Feb 24 2008, 04:10 PM) <{POST_SNAPBACK}>
Hi everyone,

Is there any way I can contact California Service Center from overseas? My husband and I are stationed in Germany and I have been awaiting my I-751 approval since July 2007. I just checked the processing times and CSC is already working on cases from August 19, 2007. 1-800 (or any toll-free numbers in general) won't work from Germany. Is there any other number I can call or maybe there is an email address I can write to?

Thanks!

Stefanie

not sure if this will help but here is a link to a military specific immigration information.

I guess the answer was in front of my eyes the whole time right here at this site whistling.gif right in the fact portion of the site was worried for nothing blush.gif

4.4.3)...Are K2 children required to have their own passports?
A...In general, a separate passport is not required if the child is under 16. If the Consulate requires the child to have a passport, it will be listed on the OF-169 (or UK85). Many countries will permit young children to be listed on a parents passport, but at least consider getting a passport for your young child. You can avoid any problems dealing with INS upon entry, the young person can travel independently (if required), and the passport provides an identification document if you are ever separated for some reason. Besides, it will make a cool addition to the scrapbook collection when the child is an adult.

She might travel back to russia to get him a passport. but now here is another million dollar question. Is it possible to have her case and interview transfered from Montreal to Moscow?? she is a citizen of russia and she is only a permanent resident of Canada. I have read in other post that her interview should take place in the country that she has citizenship. So maybe it has been a mistake by the NVC. helpsmilie.gif helpsmilie.gif helpsmilie.gif helpsmilie.gif

The interview takes place where she has residency, not citizenship. Someone else please correct me if I'm wrong, but I don't believe a transfer like what you're asking about can happen. Has your fiancee called ??? yet?

Just got an email response from Montreal!! They said it was ok if he is on her passport as long as her passport was valid for at least six months. kicking.gif So i think i better print out a copy of the email in case some one wants to protest it at the interview.

The Ministry of Foreign Affairs (I believe) handles international passports. They will be open in about 4-5 hours. It would be best to give them a call to find out logistics and timeframes. Their website is http://www.mid.ru . It's in Russian, so you'll want to have her go there for contact information (unless of course you're fluent in Russian.).

My Fiancee is a Russian citizen and she has a 3 year old little boy and they are both currently permanent residents in Canada.

My question is her son is already listed on her passport and, he has a landed immigrant card issued by Canada. we have just received our packet 3 from montreal it states that he should have his own passport? If he is listed on her passport, and has his landed immigrant card will it be sufficient for Montreal?
or do we have to try to go through Russia to get him a passport
unsure.gif

You should be able to get him a passport through the Russian consulate in Canada. Best to give them a call and see if you need an appointment and what documents to bring. It can't hurt to email the U.S. Consulate in Montreal too, to see if he definitely needs his own passport. But if I recall correctly from other topics, he will need his own passport.

He absolutely must have his own passport. Yes, a Russian Consulate in Canada can arrange it. Time is short. Contact them tomorrow.

They will each need visas. The visas are affixed directly to passports.

My fiancee and I forgot to turn in her I-94 card the last time she visited me in the US, and we did not realize it until six months after it expired. So we found out through customs where to send the card and sent CBP a letter explaining that we forgot to return the card and sent pay stubs from her job in canada and a letter from her work and even a copy her lease to prove that she was in Canada for the time after the card expired.

We are about 2 months away from our interview an we are worried that we will be refused because of this. We have saved all the documents that we sent CBP and we will present them at the interview. will this be ok?????

Did CBP send you anything acknowledging your fiancee's departure after you sent in I-94?

At departure, I checked out of the US at San Francisco airport using a machine (had my passport, my two thumbs, and I-94 scanned and everything) but didn't return my I-94. Nearly 2 years later, I realized my I-94 was still attached to my passport. I sent a letter to CBP telling them about the information of my exit and also asking them about my status. They sent me back a letter within 2 weeks saying that my departure was properly recorded and that my departure was on Aug 31, 2005 (the date I exited the US). I took that letter with me to my interview.

I would send them a letter requesting to know if your fiancee's departure has been properly recorded. Better be having it just in case than sorry.

Good Luck.

where did you send this letter to find out if your departure was recorded?

In any way it is going to take at least two weeks to a month to get your marriage certificate which is what you need for your AOS and you need to get social security cards and other documents. So if you plan to get married and immediately file for AOS you will still need to wait a month or two after your fiancee enters the country

I don't know if this is true of New York state but in other states it apparently dependent on county. Your certified copy is delivered from the clerks office and apparently smaller population counties have quicker response times on delivering the certified copy. Maybe someone else from New York state here on the forums could help you out or you could call the clerk's office in a few counties and find out how long it takes.

yes you are right if you are married in a small county it may be possible to get it quicker but most likely you wont get your marriage certificate the same day When I was married in NY state we got our marriage license in one day and it took about a month to get our certified marriage certificate. Even in Las Vegas the marriage capital of the US you can get your marriage license the same day but it takes a couple of weeks to get your actual marriage certificate. Your marriage certificate is an official document and it takes a sometime to generate it and mail it.

Doing some research about marriage license and I saw that the NY State law for applying for a license is that both parties must be in attendance to sign the paperwork and that couples should give it a month's advance.

I know that there are many people here that got married almost immediately upon the spouses entry. Does the clerk's office really take a month to give you a license? What is the story here. We have decided to get a civil ceremony immediately to file AOS and plan a real wedding later.

With this in mind we dont want to wait a month for the license to come through. Does it really take a month and is there a way around this month waiting if I present the K-1 visa information to the county clerk?

Also if it does take that long which states around NY have different marriage laws to expedite this?

Any NY marriages out there... please help me

I got married to my x-wife in Niagara falls NY and got our marriage license in buffalo and we got our license the same day. but you are right we both had to be there. hope this helps?

K-1 Fiance(e) Visa Process & ProceduresProper preparation for sons and ex-husbands
QUOTE (donmerlin @ Mar 9 2008, 07:34 PM) <{POST_SNAPBACK}>
When I filled out my I-129F to petition my fiancee for a K1 visa, it had specifically stated that if she had a son, her son would automatically be included, and that I did not have to fill out any further forms. I read this several times to ensure that I understood the instructions correctly.

However, it did not cover the consulate process, and so I'm not sure if there is something extra that must be done to include my fiancee's son. When she applies for her K1 visa, will her son automatically be included, or does he have to file separately? I think I may have seen a post that mentioned a different kind of visa for the child. Also, will the consulate officer question the child during the interview as well? My fiancee's son is only 7, and is just now learning English, so I don't know if he could pass an English interview.

The second half of this question is with regards to the son's father. My fiancee's ex-husband has been out of the picture since the child was born. When her son was still a newborn, my fiancee apprehended her husband having an affair, and it was over. Since then, the father has not shown any desire to take part in raising the son. He has only actually met his son maybe a total of 4 times in the son's lifetime. My fiancee does not have contact with the ex-husband. What kind of rules are in effect with regards to ex-husbands? Does my fiancee need her ex-husband to agree to his son leaving to the US? What happens if he does not? She would never leave her son with her ex-husband, so I know she would not leave China if her son couldn't leave also. What are the requirements, and what could she do if her ex-husband is not co-operative?

if you included her son on the petition and provided copies of birth certificates and such then you should be fine his visa will be a K2. You will fill out more forms for her child when it comes to the consulate stage. When it comes to getting permission from the father thats when its tricky. She will need to prove sole custody of her son or get written notarized consent from the father that he has no objection to the child's immigration. some consulates may want both or may be happy with one or the other. One woman on here went to her interview and had sole custody papers but they would not issue the visa to her child because she did not have written permission from the father. So better track the father down and get him to sign a statement. hope this helps.

Good luck
