Igor's list has only 171 June filers and 94 July filers!!

I know only a fraction of people who file for K-1's use VJ, but hopefully this is a representative sample and we'll see some quick approvals for our class!

As of January of this year, the Texas Service Center has been processing a few I-129F's. About 1% of the total load. These are either some of the lucky few or (more likely) they are VJer's who simply put "Texas" as their service center and never changed it to Vermont or California.

I agree that form G-325A for work history is way too short. I couldn't type in full addresses in. I had to abbreviate and also leave out spaces because I used adobe to input.


My fiancee only worked at one place in the last 5 years and only had 2 apartments in that time, so on hers I used 2 lines on the form for each address and made sure the dates lined up correctly.
Mine, though, forget it. Not even close to enough room. Had to use a separate sheet. But either way, they accepted it and sent it on for processing.

I don't think they make that big of a deal about this form. Technically they don't even need to be signed. The petitioner's signature on the I-129F is deemed sufficient and the beneficiary can sign at the interview.

I was vacationing in Spain and staying with the family of a very good friend. While there, my friend told me about a friend and co-worker of hers that she wanted me to meet. She said that as we were both coming out of bad relationships, we'd have a lot in common. I was extremely skeptical, especially because I didn't know much Spanish and her friend didn't speak English. But I am extremely happy that she talked me into it. For whatever reason I found that I could understand HER Spanish when she spoke to me, and she could understand MY English. We've had our problems, here and there, communicating, but overall it's been very minor. My Spanish has improved immensely since we've been together...

Ugh. I'm so sorry to hear that. It seems like our lives are put on hold while we wait out the bureaucracy, but of course they move on without regard. I can't express how sorry I am for your loss that certainly puts the process in a different perspective.

I went to visit Ira on the 20th of September and spent my birthday with her (21st). I just got back on the 3rd...15 minutes actually before the 4th. Tonight I got an email stating:

And the final numbers are in for July... as expected there are fewer July petitioners (about 75% fewer than previous months). Hopefully they will burn through them quickly now that they've begun!

Just got home from a short visit to Spain. I was hoping the final July statistics would be up on Dashboard by the time I got back but.... not yet. I think they come out on the 15th of each month anyway.
Next up is a trip to Mexico in November together.... then, hopefully not long after, another trip to Spain for an interview!

Just to update everyone... It looks like CSC is processing June petitions (Yay!!!) while VSC is still stuck in April (Booooo!!!!)
At least it looks like a few May's have gone through Vermont recently...
The numbers are in for June filers: 2160 petitions received in Vermont, 4163 in California... both are about the same number of petitions as were received in May and April.

I have not really registered to the USCIS website to check my status... What do I need to do that?


On the USCIS website, there's a link on the left, under services, "sign up for case updates". Register as an applicant customer and use your receipt number for your case.
You can turn email notifications and text messages on and off, and see whenever they "touch" your file.... pretty neat, but really just another thing to obsess over...

Sent our packet on the 15th of July US Postal Service Priority. Texas signed for it on the 18th. Check cashed on the 20th. Recieved NOA1 on the 25th. Now just waiting B-)



We filed on 7/27 and received the email of our NOA1 on 8/02.
Now to wait and relax. hahaha.


Hopefully we can all keep each other sane while we wait!

They come from Igor's list under the Immigration Timelines link. You can sort the list by Service Center and Approved Petitions to see how your Service Center is progressing. VSC is currently processing late March and early April petitions.
Good news for us is that the June class is about 1/2 the size of the average class and we are about 1/3. So there are less applications in front of us than there usually are for a particular month.
Of course this list only shows petitioners that use VJ, and it's accuracy depends on people updating their timelines, but hopefully it's a representative sample!

I'm helping a friend with his I-864. His income isn't that much higher than the minimum. Around $31K to sponsor his wife.
He is submitting all 3 years of IRS transcript and 1040 of 2010. No W2s because he is self-employed. What else should he also include?


If there are no other dependents involved, 31K is well above the 125% Federal Poverty Guideline ($18,387)
Also he must include the entire 1040 including schedules and any 1099s

Depending on the timeline involved, they MAY grant you emergency advanced parole. Your fiancee should make an infopass appointment with a copy of your father's death certificate. I've heard of cases where people have received advanced parole after leaving the country. There are no guarantees, but it doesn't hurt to ask.



CLARIFICATION:
Advance Parole MAY be granted to certain non-immigrant visa holders while they are outside the US if they left in emergency situations. However, those who entered the US with a K-1 visa are not eligible. This is explained in a meeting between USCIS and the American Immigration Lawyers Association in April, 2008.

"Advance parole granted to those outside the U.S. is an extraordinary measure used sparingly to bring an otherwise inadmissible alien to the U.S. for a temporary period due to a compelling emergency or significant public benefit. It is not to be used to circumvent the normal visa issuance process. Advance parole that is sought to preserve the pendency of an I-485 application must be applied for and granted before the alien’s departure from the U.S."

Sorry. It seems the only option is to start with a new visa/aos process.

I'm helping a co-worker with his I-129f paperwork. I have done this before for myself but I'm no expert on this. I have 2 questions for the I-129f, the first one being #3 for the petitioner. He was born in Guadalajara, Jalisco, Mexico. Should he put only Mexico or Jalisco, Mexico for state and country. Also on I-129f question 20. His fiance is from Guadalajara, will she go to the consulate there for the interview or another city? On the the G-325a, he was born in Mexico but has been living here for over 20 years. Does he have to put his last address in Mexico which over 20 years (I thought they were only interested in the last 5 years) so he would leave that blank? Thank you for any assistance you can give me/him.


1. Just Mexico should be sufficient. Or if not comfortable with that, print it by hand with black ink (any answers may be handwritten)

2. All K-1 visas for Mexican nationals are processed through the Ciudad Juarez embassy.

3. The form asks for his last address outside the U.S. for a period of more than 1 year. It doesn't specify when. Be safe and plug it in.

NOA = Notice of Action

NOA1
After submitting your I-129F application to the Dallas lockbox it is received at the Lewisberg, TX office. They open it and make sure the forms are filled out properly and send it on to either the California Service Center or the Vermont Service Center. They also send you a form I-797. This form officially recognizes that the USCIS has received and is processing your application. It also contains your receipt number and instructions for checking the status of your case online. This is NOA1.

NOA2
After the petition is approved by USCIS it is forwarded on to the National Visa Center (DOS). In addition, the USCIS will send you another form I-797 informing you that the petition has been approved. This is NOA2.

I've seen this questioned addressed on legal forums a couple of times. In both cases it was stated that a K-1 visa is impossible to get until the 2-year home residency requirement was met. However, after reading a bit of the INA Act, I don't think this is completely accurate.


Sec. 212(b)(regarding J-1 Visas) (e) No personadmitted under section 101(a)(15)(J) or acquiring such status after…shall be eligible to apply for an immigrant visa, or for permanent residence,or for a nonimmigrant visa under section 101(a)(15)(H) or section 101(a)(15)( L) until it is established thatsuch person has resided and been physically present in the country of hisnationality or his last residence for an aggregate of a least two yearsfollowing departure from the United States…


What that says to me is that your fiancee is ineligible for H or L visas but is completely eligible to receive a K-1 visa and re-enter the US. However....


Sec. 245. [8U.S.C. 1255] (regarding adjustment of status)

©1/ Other than an alien having an approvedpetition for classification as a VAWA self-petitioner, 1aa/ subsection (a) shall not be applicableto…

(8) any alien who wasemployed while the alien was an unauthorized alien, as defined in section <a href="http://www.uscis.gov...ml#0-0-0-4081">274A(h)(3) , or who has otherwise violatedthe terms of a nonimmigrant visa.


That implies that, once here, she still cannot apply for AOS as the terms of the J-1 visa would have been violated. The 2-year residency must be served in the country of citizenship or the last country of permanent residence prior to coming to the US on the J-1 visa. I would suggest looking into the possibility of a waiver.

Agreed. Having doubts about your relationship due to a recent arguement is not a reason to abandon the relationship. You can still attend the interview, pass it, and receive a k-1 visa. Once you have the visa, the choice is yours whether or not you use it. It expires in 6 months, so you have that time to work things out with your fiance or decide that things can't be patched. Leave yourself with as many options as possible.

i think 2 for each month is a good number. and i would leave out any photos with 1 person in them. only use photos showing the 2 of you, or showing him with your relatives, or you with his relatives. These are especially good if you have supporting letters from those relatives testfying to the validity of your relationship.

Too many photos, or photos that look like they were taken specifically for this process (ie photos with 1 person in them) may raise a red flag at the interview per a fraud checklist that I saw floating around the forum somewhere.

Yes, your co-sponsor needs to submit the most recent income tax return together with all W-2's and 1099's. And although only the last year is required, they may ask for the last 3 years to show consistency. So better to have them ahead of time.

I believe the USCIS approval is valid for 4 months but the consulate can extend it indefinitely if needed for their review. Once you are approved at the consulate and receive the visa, it is valid for 6 months or until used.
