K-1 Fiance(e) Visa Process & ProceduresNOA-1 Arrived May 28 - What if I get married in the Phillippines
QUOTE (raquel_1208 @ Aug 23 2008, 09:03 AM) <{POST_SNAPBACK}>
You have to cancel K1, get married, refile CR1 and start all over again. CR1 takes longer than K1.

It does? I thought it was quicker...

Don't worry yourself with all those "awww poor you doing it the long way" looks.

I get them too because people don't realise how difficult it really is.

QUOTE (reeses16 @ Aug 30 2008, 02:54 PM) <{POST_SNAPBACK}>
No don't list a co-sponsor on your G325A. Do you have any type or fellowship, scholarship, work study or student loans? Have you had any internships or part-time work, if so list them.

Look into whether or not your embassy will allow a co-sponsor. When you are filling your sponsorship forms be thorough. Include your financial aid award statements, and scholarship letters, and earned income. Be sure to make your case as best you can.

Good luck!

Just to clarify, he doesn't need these (other than the employment) on the G325A either. Nothing financial is needed.

You don't need to mention it at this point.

Some people have been unemployed and were approved, others (my fiancee included) works freelance.

They're only concerned with finances at the consulate stage.

You need to look at the AOS process for afterwards but you have a long time until then. You don't mean that she's coming over *now* to get married, do you? Because that would defeat the purpose of applying for a K1.

I agree with the others, you should try to arrange to meet each other before you file and get plenty of evidence of the visit.

It can be hard when you both have busy lives but it's a sacrifice we all make. I haven't been able to hold down a stable job due to flying out on holidays.

We simply put "Unemployed" for my fiancee (USC) with the time frames. For myself, I put "Unemployed" with a footnote with my dates of school.

It really doesn't matter though what the reasons are/were for unemployment, just so long as you account for the years on the form.

oops.

yeah we didn't write any of that. we just wrote the jobs we had and nothing else. oh dear.

well hopefully it isnt a major issue.

i hope this is the only thing we got wrong. i keep coming across little things we did different and i start panicking.

such as the passport photo size thing, i read they have to be american size? well i had them done here in the UK, so im guessing they may be the wrong size sad.gif

Did you give the past five years of employment with dates?

That should be all that's needed.

Figners crossed for the UK sized photos... I think it explains the requirements for US size in the guides though.

US sized passport pictures.

We just wrote "SUPPLEMENT: PART B, QUESTION 18: How you and your foreign fiance/e met" or however the question was phrased.. a couple sentences about how we initially met online and then broken down into sections of visits.

If you already know where your new address will be, make a supplement or re-do the sheet?

When you file, file as if you did everything the day you filed. If a date isn't current, redo the form.

Is there something specific you are concerned about?

There's not really anything that can be done to speed up the process as every file gets sent to the same two centres.

How about arranging for a trip in March where you can be there for the birth? Only issue is that you'll need to be around for the process in London (packet 3, medical, interview etc) so you'll need to make sure it doesn't clash with those dates. Being a September filer, you might find that your approval is around January and the Consulate process around March. sad.gif

About the driving license, there are many questions related to this in the "Moving to USA" forum. It's a long way off yet so don't worry about this yet. You may be able to use your UK license for a year or you might have to wait for your Social Security number before you can apply for a provisional (if you don't drive). It all depends on the state requirements but most find themselves driving in a reasonable time space.

K-1 Fiance(e) Visa Process & ProceduresI might have to give up hope :(
We were in a similar situation as my fiancee (USC) only made $11,000 even though he was working full-time. He just wasn't being paid enough and wasn't getting hours during the winter. Now he's left that job, he's only managed to find a part-time/freelance job that makes the same amount of money as even though he's being paid twice as much as before, it's just not enough hours. That means that there's just no way he can sponsor me to move there on a K1.

Fortunately for us, his mother is likely to agree to help as a co-sponsor as she knows what is required and hasn't outright refused yet. She makes enough money and knows that she won't be supporting me each month... my fiancee will manage to support me on his limited income (since he lives with his parents) until something comes along. In the meantime, he's applying to everything that he can and yesterday he went in person to a temp agency to speak with someone about signing up, rather than using countless online sources.

From what I understand, there's no way that your family will agree to co-sponsor, right? How about if you sat down and discussed it with them again and explained how happy he really makes you regardless of being non-American... make them understand that you're not asking them to feed him everyday... you just want the chance for a life together. If there is still absolutely no way they agree, I suggest looking for either more hours at your current job, or a full-time position elsewhere.

I know how difficult it is to get a job in the US right now, but I also sense that your confidence has been knocked by your ex-husband... tell yourself that you CAN get another job and start applying to as many places as you can, even signing up to temp agencies. And if all else fails, look into moving to the UK (which is much easier) with your children. I know it must be hard for them to start over but children are hardy and adaptable. You might be able to get them into a school with learning disabilities (your 13 year old) which would be much easier for making friends without judgement.

GOod luck!

I was wondering how everyone's getting married. Given the economy and the fees for visas, it's many forces against us. I've got a marriage license sitting in my car and can't decide whether to go to the courthouse and get it done or have a couple family members here and do it out back.

I'm holding off for now...til some job pops up if it will. Never been without a job in my life!

We spent:

- $25 for my dress

- $27 for his waistcoat

- $150 on decorations (that we've re-used by wrapping them around grapevines and putting outside)

- The flowers/bouquet that my MIL bought for me.

That's all. smile.gif We can't afford a big thing (like most people right now) and the materials aren't important to us anyway. The entire thing lasted only a few minutes and it was a special moment.

Afterwards my new grandmother paid for everyones meal at a nearby Italian restaurant, who gave us quality seating because we just got married. And of course the upgrade at the hotel because of the marriage also. We were very very lucky. biggrin.gif

Sorry for my message on Facebook - I looked at your pictures and assumed you were already married by one of them in particular.

We are now married!!

Everything went well.. it was a nightmare at first trying to find somewhere to do the ceremony as all parks were fully booked for labour day weekend and my visa expires next week. So we had one day, picked up lots of decorations, flowers, etc and made the deck in the back yard look really pretty. The ceremony itself lasted all of 3 minutes and I was a nervous wreck! My dad and best friend were listening on speaker-phone which was nice (my dad cried and my best friend was so excited). Then we went to a nice italian place to eat... and then went off on our mini-honeymoon. The hotel was absolutely gorgeous.. they upgraded us to an executive suite just because we got married! We had a jacuzzi in our room, along with 2 huge TVs, a king-size bed, a living room, etc.. we didn't want to come home.

Pics to come tomorrow.

We're finalising the AOS documents and sending them within the next 2 days.

Hey guys, today is the one year anniversary of sending the K1 petition! dancin5hr.gif I remember thinking "this time next year, it will be over"... and it is. It feels really good to not have that horrible dreading feeling of leaving my loved one.

We picked a place for our ceremony, it's a little park in Plymouth MA. There's a bridge in the middle where we hope to get married depending on how busy the park is. We're going real early to avoid people. And then hoping to all go to breakfast together before my fiance and I head off for a couple of days on Cape Cod. We're looking at Labour Day weekend which is close to the end of my 90 days so we're trying to get the AOS paperwork done before... then add a marriage certificate and BOOM - off to the mail. Then I can get my AP approved for a UK Christmas visit.

I'm so glad to hear of peoples progress here with visa and GC approvals. smile.gif

Hi everyone,

Gemmie: You are strong, I know your grandpa didn't say cause didn't want you to regret anything, so keep on going with your plans, my hubby's grandma also had cancer, we all knew, and in spite of that he came to USA, she died the week after we got married, they lived together so it was really shocking, but he knew it was a decision he had to take cause we were separated for so long that he thought it was the best thing to do. May they rest in peace.

Thanks for your kind words, Cuchita. I'm sorry for you and your hubby's loss too. I'm sure his grandma wanted him to be happy.

We decided that I'm going to celebrate his life from the US by making a memory book (photos, stories, drawings) and sending a letter in a bottle over the ocean (his ashes are going in the ocean). I miss him so much and have so many regrets, but I know he wouldn't want me to feel that way. He always asked me if I was happy out here, and even when I was going through some adjustments, I told him I was. I'm glad he took that with him. The last thing I said to him was "God bless, love you" which I never meant more true.

Congratulations Hyena, it's been a long time for you. Now we just need you and Mara to make it here to your August family.

You apply for the EAD and AP at the same time as the AOS because then it's free. Otherwise you'll have to pay separately for the two documents.

AP can be used in cases that isn't an emergency too. It takes roughly 8 weeks. If there is an emergency though, you can make an infopass appointment and expedite it and receive the emergency AP on the day.

I've posted this elsewhere, but my grandfather died yesterday suddenly; I'm looking into getting emergency AP but apparently am not eligible as we haven't yet applied for AOS. I'm trying to get my K1 re-validated by the consulate so that I can go back to the UK and then use it to re-enter, but it doesn't look good.

Well i have another question..u said it took u 5 weeks from u sending the checklist till u received a interview notice. how many weeks or days was it all together from checklist send till interview date??? Another month from the 5 weeks? thanks

Are you dealing with London?

If so, I'm pretty sure you need to wait longer than 2 weeks. If you go to the UK forum on here, you'll see that most people had to wait a month or so before they heard back about an interview. From when they sent me packet 4 with the interview date, it was only about 2 weeks or so until the actual interview. So all in all, from the time you send in packet 3, you should only be waiting 6 weeks or so before you get the decision. Look at my timeline for details.

Wow Freddy, that cost so much money for the CS! I'm a bit concerned now, hopefully there won't be any problems with the medical things. I need to get one vaccine and then have the form signed, but I hear many CS's want you to pay for an entire medical exam. huh.gif

Good news, Mara! Let us know what they say today.

I'm very sorry to hear that, Candy. I'm thinking of you.

HD, we're also planning on sending the AOS stuff in August or September. I really hope we get the AP quickly though as I want to see my friends and family before Christmas!

Stay calm, everything is fine.

You're not supposed to send documents with the checklist, so whoever told you that at the London Consulate told you wrong or misunderstood. You're only supposed to send the checklist which lets them know you're ready for an interview.

I should tell you now it takes a while for them to get back to you. It took about 5 weeks for me, I believe - as it takes a few weeks to put in the system and then a couple of weeks to send you the last notice/package with your interview date. So you're still within the waiting time, you should get your date shortly.

While you wait, re-gather documents! Did you send the originals? If so, you need to get yourself some more because they'll want to see originals and copies at the interview, work on getting all the documents needed. It tells you here in the Guides.

***

We applied for a marriage license yesterday and I froze when asked what my name will be after marriage. To be honest, I hadn't thought much about whether I would change my name. They said when I pick up the license on Thursday, I can let them know my decision.

I got my SSN yesterday (finally!) so I can start adding my name to accounts, getting a library card, apply for a drivers permit, etc. We're also making an appointment for my HPV vaccine in RI next week - then we're going to get a civil surgeon sign off on my stuff and get some of the paperwork ready for AOS. That way, we can focus on planning a ceremony.

I'm happy to see progress with people here. smile.gif

How did it happen? Apparently the written K looked a lot like a F... so perhaps they also saw my DOB (22 years old) and assumed it was indeed a F1 Student visa.

I don't know how they got B2 in the system, I've always used the VWP.

I assume I wouldn't be able to do it over the phone as they needed to see my actual visa. Luckily, the airport was only a half hour ride for me.

Woo, good luck Mara! I'm excited to hear that stuff might be moving on with your case.

I've written about it on the board elsewhere, but we had some problems when trying to get the SSN.

I waited 14 days to make sure that I was in the system, and when we went to get my #, the woman said that although I had a K1 visa, the POE entered me on a F1 visa. She told me to go and get this sorted first and come back. I tried calling so many numbers but got nowhere, so made an infopass appointment.

USCIS told me that in their system, I was listed as a B2 visa! They told me to go back to the airport I entered and get them to correct this.

I went to get my SSN today and she told me it will take another 7-10 days to get my #... nothing but trouble there. We can't do anything until I have this number but hopefully it won't take too much longer.
