United KingdomUgh. Passport lost.
Apparently if the passport has been lost, they claim they can't replace them on the same day.

But this happened to me a couple years ago (the day before my flight to the US!!) I went to London and paid about 114 and had a new passport in 4 hours.

I would give it a shot

The receptionist at my doctor surgery didn't know about it either so she called me back after speaking with others. She said the vaccine is so new that it's not very known about but some places are doing it at an expensive price.

Perhaps call a helpline (NHS?) and ask who are giving it.

United KingdomQuestion about psych stuff
I don't think it's anything to worry about.

I attended 2 years of counselling after my mum's suicide and don't expect that to affect my visa application at all.

They aren't there to make moral judgements about the person as long as they haven't committed any serious crimes. For example, I really doubt they would deny someone based on marital affairs in the past (with the assumption that there will be issues in the future). All they can do is take your official intentions via letters and statements that you're in this for a genuine relationship.

If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US.

The OP has intent to immigrate, she even says that she is "living" in the US with her family and using the VWP to leave and re-enter. That is extremely frowned upon. To gain permanent residency, you need a green card which you can get from applying for a visa.

Hi Gemmie,

I have seen posts on here in the past where others have been able to file for AOS that have been married for 2 years plus that have come to the US on the VWP.

I guess the OP will need to do some homework and read up on all her options and take the correct route to gain her GC to live here and work.

The route that I would take is to file for a K3 / CR1 myself and return to the UK and wait, but sometimes this can not be a viable option to some if they have no place to stay in the UK or do not have the funds to keep going back and forth. There are points where you could submit a letter with the AOS application detailing extream hardship to the family if she was to move back to the UK etc.

Hi Ian/ Anne,

The AOS option is open and legal to those that have visited the US, and then suddenly (without intention upon entry) decided to get married and stay. I think you're getting confused with those that have successfully adjusted status while remaining in the US after marriage. The person can not leave the US while waiting for the greencard. As soon as you leave the US without adjusted status, you are to apply for a spousal visa. The OP has left the US in the past two years of being married to her husband (seeing as there is no other way to reside there) and therefore needs a visa.

Also, the OP is using the VWP to enter the US for 90 days, leave and then re-enter. This isn't allowed as you cannot use the VWP to essentially "live" in the US. You need to get permanent residency, of course. People have been denied entry for this.

90 days is pretty much 3 months, give or take. I'm sure the OP knew that.

As someone else stated, you cannot continue to leave the US every 90 days and then re-enter. Many others have had problems with this, some even resulting in a denied entry. I experienced some problems myself this year as my re-entry apparently occured inside the 90 days I was last in the US, and was lucky to get in.

You have to apply for a spousal visa, you can read the guides at the top of the forums to look at the advantages of both types.

I've just read your previous posts and it seems you might have some issues with the criminal record when applying for a visa. Have you thought of hiring a lawyer? Or your fiancee could move to the UK considering he doesn't have a criminal record... previous denials don't matter.

I believe Gemmie nearly got turned away after the officer saw how many entry stamps she had in her passport for the same POE. She just got asked a load of questions then they let her through.

Yeah, I'm not sure if I just got unlucky with the officer as I was standing on the line (in front of the booth) for quite a while as the person in front of me was asked for their return ticket... then when it was my turn, he asked me many questions once he saw my stamps, and asked for my return ticket. I also gave him my university letter and he asked me more questions about my rights and my plans. When he asked where I was getting married, I told him we hadn't gotten that far yet and that was the last question he asked. Looking back though, he obviously meant "which country are you getting married in" but I took that as "where in the US are you getting married" so I did technically answer honestly!

I'm trying again in 6 weeks and I'm really nervous, this will be my last visit before I have my visa. I'm planning on saying I'm here to visit my fiance for the holidays, and if he asks/seems suspicious, I'll offer my return ticket and/or university letter stating when the Christmas break ends.

United KingdomApplying for B-2 Visa prior to K-1 Filing
You can apply for a tourist visa but be prepared to be denied if he has little ties to England. I've seen many people that were denied because of that, especially if they know of a girlfriend or fiancee in the US.

It won't affect your K1 application; BUT on the VWP form, it does ask if you have ever been denied a visa before. He would have to say "yes" (otherwise he could be done for misrepresentation if caught out) and that will probably lead to extra questioning at the border. I have read people that have been denied and still gotten through POE though, so it can happen.

Good luck.

My hubby never had trouble coming to the US through Newark. they only questioned him the last time and said he should look into visas but every time I go to England through LHR they give me a really hard time. I feel like I have to fight my way in. I always tell the truth, leave on time. but it's like they see me coming. only went 3 times and he came here 3 times but for the whole 90 days every time.

Bill had problems at LHR last time too, and it was his second visit. The woman asked what he did for a living, he said IT consultant and graphic designer, and when she asked how he had managed to get time off work for a month, he responded with how his boss wants him to do a little work from England too (naively).. OH NOOOO! That was it, she went on at him for about 15 minutes apparently, asking him all about his rights and about me, and finally stamped him through.

As soon as he told me his answer about working, I cringed and now he's learned his lesson. Anything to do with working here = NO!

United KingdomGood Luck Today Gemmie
Sorry, I didn't check this forum.

Thank you guys, it means a lot to me that you thought of me!

There were only two officers that night, a young smiling man and an older quiet man. I hoped for the younger one but got the other.. he asked why I was visiting, how often I came, when I was last there and what me and Bill did for a living.. he then asked why Bill was in the US and I said he's American.. he just said oh, then took my fingerprints and said "that's it!" I made a comment about how tired I was and he chuckled and sympathized.

I then found my case sitting on the conveyor belt waiting for me, so grabbed it right away. Other officers in the baggage hall looked at me but said nothing.. and I wasn't asked to scan my suitcase either. It took about 3 minutes from the time I was inspected to when I was out of there!

Bill was pretty much having a heart attack out there though as apparently I was one of the last ones out.

Last VWP use for me!! I'm never putting myself through that again, and Bill is coming to England in March.

Thanks Damian and everyone else. smile.gif

Aww I'm sorry.. I'm not surprised you're so angry! I would be exactly the same!

Bill is always doing things like that and it seems like every time it happens, he agrees to try and stop putting things off, though the next time something happens again and I call him on it, he just gets annoyed at me because "well I didn't put *this* off until later..." Like that matters when you've accomplished one thing out of the five.

*sigh*

He even tells me that the reason he avoids telling me whenever he thinks/does things is because he knows he'll get a lecture about doing it now now now, and negative vibes. So what happens? It doesn't get done, it just stays in his head until I ask him about it... and THEN he gets a lecture.

Did Jeremy even acknowledge that he should take this as a reason to start doing things sooner?

I'm almost jealous wink.gif But the house is slowly coming together now - we have glasses made of glass now instead of plastic!!! And I finally found some wine glasses I liked!

Awful night last night - Jeremy was meant to get home early so we could go out and get things for the party ( he STILL hasn't invited anyone ranting33va.gif ) SO we dash around the store in like 45 minutes (a record for me!) and head to Home Depot to pick up a plant (as you do). I kindly point out (for the third time in as many days) that his tire is getting flat and needs air. He tells me it is fine (again).

We go to Home Depot.

By the time we come out of Home Depot, I inform him that his tire is now beyond flat, it looks a lot like the flats you see in cartoons, where the rubber is all saggy. He looks again and concedes. But we have no pump (we took it out of the van apparently when we were clearing it out to sell, before we realised he had lost the title mad.gif ) and he cleverly left his cellphone at home (as he informs me when I suggest calling AAA).

We go back into Home Depot.

Luckily the lady who served us on the checkout got someone to help us and they were able to pump the tire but you could hear the air hissing out of it. Jeremy then tells me that he drove over something on the freeway on the way home wacko.gif Exactly why he didn't sort it out earlier is beyond me - maybe something to do with the fact that he was an hour and a half late home from work whistling.gif

We get to Arco and he picks up some weird sealant spray that supposedly fixes flats and we rolled into the house at about 10pm... Great(!) 45 minutes later he is asleep as he wants to be in work at the crack of dawn...

Don't men realise that when us women nag, it is for a very good reason?! And that reason is because we know we are right?!?!?!?!?! laughing.gif Maybe one day he will listen... unsure.gif

This isn't the first time I've read one of your rants and thought 'Jeremy IS Bill!" laughing.gif

Seriously, we fight more about this than most things. If something needs to be done (like errands, booking things, contacting someone, applying to a job etc), I'm the one that tells him the "plan" and when he doesn't do it after I've given him plenty of time to get it done, I'll get irritated calmly ask if he's gotten it done yet. He proceeds to tell me that he hasn't gotten a chance yet and that not everything runs on MY schedule. I'll ask *why* he hasn't done it yet, he'll ask why I'm nagging him and there it kicks off. unsure.gif

Perhaps for my psych dissertation, I should be looking at the male brain in more detail in relation to procrastination.
