I received an RFE text yesterday, but haven't got the hardcopy yet. I called USCIS to see if they would tell me what information or evidence they needed. They are not allowed to say. She told me that since they have 5 months listed on the timeframe, that the 13 of this month I could inquire about it being over the timeframe, at 6 months. They received my NOA1 October 12, 2012.
My question is, since my case is now on hold for the RFE, would it be worth anything to do that? I am worried that it might piss them off, and then they just deny for spite??
I checked my list twice when I sent it, and am pretty sure that I put everthing in, and signed everything. One thing that comes to mind is that i could not list my fiancee's father, she is adopted and does not know...I have also been divorced 3 times, so might have been a red flag...I am wearing myself out guessing, and anxious to get the hardcopy.
From what I gather, depending on how quickly I can reply to the RFE, it can take 2 weeks or 2 months. Any information about RFE's is appreciated.
I asked the USCIS person if she thought I would need a immigration lawyer since I am getting a RFE, and she said that she didn't think so, that it would be a waste of money...usually I can't get any personal input from them, but did then...
Any help is appreciated. I am stressed and sad over more wait...

Hello VJ'ers,
I got my RFE in the mail today, and it is a request for the complete divorce decree's. I only sent the first page, because the other pages were just property division etc. No problem I will send the complete versions. The problem I have is that they are only requesting for 2 of my divorces, I had 3, and only had sent the cover (first page) of the third one too. Should I go ahead and include it too, even though they only asked for the other two complete decree's?
The other question is this: I put the wrong date of one of my divorce's on both the I-129F, and the G-325A. I have made a corrected copy of each. Would it be ok to include them in my RFE that I am returning? I am thinking I can write a letter explaining that there was a mistake, and am sending a corrected. Should I say in the letter what the mistake was? I want to do this right, and USCIS, won't offer much help if any when calling...

I did my taxes 2 weeks ago. I tried ordering the tax return transcript at the on-line website for IRS, but it says that my 2012 is unavailable. I have read that some people can order. Maybe they didn't do their taxes as late as I did? Any suggestions? Thanks

Hello, we received out NOA2, and am now waiting for an interview date...My fiancée has been reading too many blogs though, on here.  She found one blog that was written last July, about an interview in Rio de Janeiro, the same embassy she will attend. The blog said that the one being interviewed had plenty of paperwork, but since the interviewer was new, asked her for the fiancé to attend a later interview. She pleaded that he was working in the USA, but the consolidate demanded he be there. The USA fiancé later attended an interview and they were approved.

Now, my fiancée thinks that I have to be there. I visited her in September of last year, and again in February of this year. I do know that it would help if I was there, although is hard for me to get away from my job etc.  My question is, if she brings all of the required paperwork, with proof of our ongoing relationship, should she worry about it being denied? Is it now the normal thing to have both fiancé's there at the interview?

I don't want to chance anything, we want to be together as soon as possible, without waiting for a second interview et.

I appreciate any answers.

The day I was there I was the only Spouse/Fiance. There were at least 5 women that appeared to be there for K1 out of about 20 people. No one seemed to be there with someone they knew except me.

I imagine the one that had problems may have had circumstances that made the consul want to see them together. It is on the website that the spouse/fiance does not need to be present. I am sure the Consul was aware of what she/he was doing. They seemed fairly competant.

I have read through the reviews. Many of them say that is was short and sweet. That is our problem.  She read too many reviews. 99% were saying no problem, then she finds that one review that was a nightmare.  Now, she knows that will be the way her interview will be, like the one nightmare.  I just wish I could find out some reassuring information, such as that they aren't going to deny the visa, if she presents everything required, and is able to prove a true relationship...

I carefully printed out a duplicate of the I129 package to send to my fiancee, but now am reading the Brazil embassy information.  It states that the consolate told that  there's no need to bring copies of I-129F, G-325As; also no need to bring NOA1, NOA2 or any RFE received.

 

So I can not worry about the old information, since it is forwarded in the package to the embassy anyway?  Makes sense to me...

Ahh, ok.  Sorry about that. The thing they frown on the most in this situation would probably be drug charges and smuggling illegal immigrants. You would think felony drug possession would be red flag out of fear of drug trafficking.

i got an email on may 4, that an rfe was coming to me and then today i just got another notice that an additional rfe is coming to me also. i can t think of what they could be requesting but honestly, i am glad to get some notification from them so hopefully the wait wont be much longer.

Don't worry, is most likely the same RFE.  I also received two RFE notices. They told me it was mailed to me on thursday, then the following monday they told me I was having a RFE sent to me...The basically lie to you saying it was sent, on the first notification, when proper wording would just be to say that you are being notified that you will get an RFE. Too much typing for them, I guess. :)

What kinds of Crimes are we talking about?

A previous criminal record may affect the ability of a fiance or spouse to immigrate to the US. The law has
specific guidelines in it that may exclude some foreign fiances or spouses from entry into the US, if their crimes
are of a certain type. The most common type of excludable crime is one of "moral turpitude." However, there
are several other factors to be considered, and every case is slightly different.

A criminal record's impact on immigration, in general, depends on several things:









ball.gif the type of the crime: crimes of "moral turpitude" are more serious in nature and may cause exclusion
from immigration to the US. ball.gif the age the person was when the crime was committed: in general, crimes committed before age 18
are not considered as serious, and under the age of 15 even less serious, however two moral turpitude
crimes under the age of 18 may still cause exclusion. ball.gif the length of the sentence that was imposed: a sentence of 6 months or more makes the situation

I got an RFE for not having all pages of the divorce decree's. The top copies showed that it had been filed, and the date etc., but they wanted the judges signature's. I got approved a week after they received my reply of the RFE.  As long as you are legal to marry, and have not been in trouble with the law, don't worry.  I worried too, but turned out to not be a big thing. I prayed too, that helps. :)

I have a printed page of my Life Insurance, and a page showing my thrift savings plan that has stocks and bonds...but I am nervous that if I include them, they may want more proof.  I don't want to chance a RFE at her interview...as long as my income is sufficient. Since I have had the same job for 28 years, should show that I am somewhat responsible. wink wink

I am filling out the I-134.  My income is sufficient.  However, I have read on here that if they ask you to list 5 things, list 6.  I think the form ask for at least 2 things.  I have life insurance, with a sheet printed from on-line, stocks and bonds, also printed from an on-line site, with my name and the amout printed on it.  I own my home and land, and want to include the approximate value of it, even though it is not needed, but to possibly make the amount look even better.  I have a copy of the deed for proof.  However, I know that an appraisal would be the only real way of proving value.

 

My question: as long as my income is good, should I just not list real estate? If I listed the real estate, could they RFE on grounds of needing proof of the value?  Would they even care, one way or another, as long as I had good income?

My fiancee is/was the same way.  She is getting a little better now...she had read a post that someone had trouble at the interview, and made her think that it will be her having trouble next.

Here is something I found on Visa Journey, that might reassure her a little:

How often are the K1 visa applications denied?
A..In reading posts from the newsgroup, not often. The K1/K2 visa application process is handled by the US State Department through the US Consulates. USCIS (INS) is not involved at this stage. It is assumed the fiance(e) meets the requirements for medical test, police records, etc. The newsgroup has experienced denials based on failure to disclose a prior minor criminal offense, and failure to disclose a visa overstay during a previous visit to the US. It wasn't the necessarily the minor crime or the overstay that caused the denial, but in both cases, the applicants did not admit to them.
If you have some sort of past problem, you will have a better chance at getting the K1 visa if you are honest and forthright. In early 1999, a UK man received a K1 despite past minor criminal problems, and he attributed his success to his total honesty. Depending on the particular reason for denial, a waiver may be available.

I am reading the list of required documents at the interview.  I have been married before, but my fiancee hasn't. It ask for this:

  1. Termination of previous marriages (if applicable) with a simple copy;

Are they asking for mine (the petitioner), or the beneficiary's?  It seems that most all of the documents they are asking for are for her, except the affadavit of support.

It is my understanding that you need to prove that you guys met within the last 2 years PRIOR to applying for the petition.  After the petition is sent in, new stuff don't count.  It can be used for "ongoing relationship" at the interview though. Do you not have any pictures with something in the back ground, such as "Bank of Canada", "Your city park" with the sign showing the name.  Credit card statement showing money spent in the other one's hometown.  Traffic tickets in the other country...LOL

On the I-34 form since May 2011, above where you sign it says "under penalty of perjury".  What that means to us is that it doesn't have to be notarized. I'm suprised your lawyer didn't know that. :)  Of course a lawyer is just human...The folks on here (VJ) may not be lawyers, but all have one thing in common, we are all getting first hand experience in each step of the way, and each embassy has individuals from this site that are tackling and learning their "pet peeves".  I really don't think one lawyer can have the wealth of knowledge of so many "heads" on here.  If a person has plenty of money, it certainly doesn't hurt to hire one or two lawyers to help. :)  I would still check their work, and compare with what you find out on this site.  I have read of many RFE's because the lawyer didn't know what he was talking about.  Good luck, and it sounds like you are on the right track!!.

Hi, I'm not sure if you got your answer from all of the links, but you need to find out if the first petition was withdrawn. Technically, it is dropped after a timeframe, but I have read about someone's second petition being denied at the interview stage, because it was still in the system. A letter can be sent to the NVC to request that it be withdrawn.  If you could call or email NVC concerning the first petition, you might find out the status. Then they send it back to the service center, where a decision is made as to what happens to the case. The service center is not too thorough, but at the embassy, they usually seem to check things out, and look for certain things to deny a visa.  What is the status of that petition when you put that number in at the USCIS website?

From what I have been reading on the embassy reviews, it comes down to the luck of the draw, of who the interviewer is.  If she gets the right one, maybe they won't make an issue. I guess I have one more thing to worry about, as if this isn't stressful enough already...

1st ... tell her to kick your butt!   Not sure why you put part of her family name in the middle name space... had a DUH moment?

 

The name should be as listed on her passport.  Not sure what the embassy will do with that petition once they receive it.  Your fiancée for sure should use her ACTUAL name as listed on her passport for all documents... then hope the screwed up I-129F doesn't come back to bite you in the butt.

1st...I would take a butt kicking, a slap or anything just to get her up here, or see her. 

 

Here is the reasoning I used: Here in the USA when a woman marries, they sometimes use their maiden name for the middle name.  It was my understanding that her middle name could be her mother's parents name, to be similar to here in USA. Does that make sense?

 

I let her look at the completed I-129F, and also let the approving service center of Vermont look at it, and the BOTH said was ok. 

 

So what you are saying is that you think it will be denied?

 

With birth certificate, passports, photo ID's etc., you would think there would be no question who she actually is? I want to do the forms correctly, but if they deny over such nonsense, that is ridiculous.

Our I-129 petition has already been approved.  I filled the papers out, and put part of her "family" name in for her "middle" name.   Now she tells me that she only has a first name, and two parts of her family name.  Names are different there in Brazil! :)   What should I tell her to put now, for the middle name, the same as I did on her I-129, or leave it blank?   Does it really matter??   Thanks

Just a thought, but can he get the county clerk/court house to certify that it is in fact him? Maybe a just a note saying that there was a typo, or that it is in fact the same person, and possibly they could use their stamp on that letter? I think the main thing is to prove that it isn't someone else's paper.

Every one has their own opinion, but I think writing up a story or "timeline" is worthless proof at this embassy. Anyone can either write, or hire someone to write a very good fiction story, the consulate knows that. My opinion is the burden of proof that you have met within the 2 year period. My fiancée's pictures were important to her interviewer, she looked at all 40+ pictures. I think she wanted to see if it looked like a real relationship. The 100 pages of computer chat messages and emails were not looked at. The passport visa stamps are the big hurdle. If you don't have red flags, one visit is sufficient. With red flags, I think 2 or more visits are better, and if he can be at the interview, Rio prefers his presence. It's like bonus points. There's my opinion. Good luck! smile.png

What you are describing sounds like a K1 fiancé case where the file passes in days through NVC and then the Embassy contacts you in a few weeks to say they are ready for you to submit your visa application forms. However your profile says you are applying for a CR1. Your case should remain at the NVC where you have a set procedure for submitting forms, documents, and making payment. Then the NVC will schedule your inerview.

So something isn't right here. Confirm you are seeking a spouse visa, not fiancé.

hello again

i posted a thread about a week ago about not hearing anything after my noa2 ,my wife used the phone number very kindly given to me by a ndu26 (thanks for that by the way).she was told that my case was passed on to Londona few weeks back and that they couldn't help any further. she was also told that i (the beneficiary) had to start calling the embassy in London myself as it was no longer in their hands. i'm no expert in these matters but what my wife was told just doesn't seem right i thought only the petitioner ie. the US citizen could make those type of enquiries, so i guess my question is ,has my wife been given bad advice on their so called helpline or do i need to start calling the embassy in London? to find out why we havn,t heard anything since my noa2 approval on 15 feb

Have you lived together for the last 8 years? If so, no problem as you'l have lots of other evidence (joint letters, bills, tax filings etc).

To ease youir mind, maybe ask family and friends? I am sure some of them will have photos of the two of you together at their weddings, parties etc.

we havn't lived together this past year as she moved back to look after her dad after an operation back in jan 12, after a couple of months we talked about it and decided that we should move there

i'm still waiting for my interveiw at london, i am in the process of getting all our ducks in a row i have realised that apart from our wedding and a few from when we were dating there are no pics of me and my wife together after we got married, she has deleted them all as she hates her picture being taken, we were married 8 years ago is this going to be a problem? i must admit i'm a little angry with her for doing this as we have lost some of the pics from when our daughter was born

i guess what i'm asking is will our wedding pics be enough?

London has nothing to do with your case right now so no need to call them. NVC does all your paperwork and assigns your interview. Your forms and documents are mailed to NVC, not the embassy. Ignore what they said. They misunderstood where you were processing

Did you read the letter you posted? It gives you a web address to go find your instructions. The letter gives an address where to mail things. It's going to be real hard to do-it-yourself immigrate with only an iPhone.

The petitioner has to submit the I-864 Affidavit of Support packet:

 

1. I-864 Bar coded Cover Sheet (print it off from payment portal)

2. Fill out I-864 Form

3. Recent Tax transcript or the last 3 years of tax transcripts

4. Letter of Employment

5. Pay stubs (recent 6 months)

 

You will know the address where to send this packet from the Bar coded cover sheet.

i take it that is not the same as the letter she has recived? also what about the ds230 do i need to send that off or do i have to wait for my wife to do the above?also she was living over here in the UK up until last year so she hasn't 3 years of tax transcripts although i have noticed you said the recent one should be ok

hi there

 

if i'm asking a stupid question i'm really sorry, but on the 13 of this month she recived this letter as we have no idea what to do next she has called the NVC and been told i have to send the ds230 part 1 off but to who and where she has no idea however when i called the US embassey in London i was told there is one more form my wife has to fill out till i can send them the Ds 230 we are both totaly confused at the moment any help you could give us would be gratefully accepted
