In April I petitioned for a spouse visa. My spouse decided she didn't want to come. I sent a letter to the California USCIS to discontinue it, and drop my sponsorship. Five days later I received notification that the application for my spouse was approved. I called them a couple of times, and re-sent another letter saying I wanted to drop the petition. The last time on the phone with California, they told me to send my divorce decree and a letter to NVC. I did. They sent me a letter that I needed certain information to give them, before they could discuss it. I then emailed them with every bit of information that they requested. I received a letter today that the NVC has returned the petition to USCIS. It has preference category as Conditional Spouse of US Citizen. It says that I need to direct further inquiries to USCIS.
Do I need to write them again? Do they keep a file of my letters. The visa petition was approved in July of this year.

The reason why I am concerned is because I have since met someone else that I want to apply for a fiancee visa, and do not want the other petition to interfere. My divorce decree is going to be sent, as required, with the fiancee visa application.

Any help would be greatly appreciated.

USCIS Service CentersIs CSC going slow?

At the beginning of this year VSC was approving in just over 3 months and CSC took about 5. They've both changed. Both will change again, every few months. Adjudicators will be moved from one type of visa to another. Things will slow down and speed up, seemingly at random. I'm CSC so I'm hoping for under 90 days. However I'm planning for 5 months, and anticipating that it could be longer to get my NOA2. Just because you are in CSC and they are currently going faster, don't count your chickens. They could pull all or most adjudicators off of K-1s for awhile to focus on other visas and it could get difficult if you are too much focused on getting your NOA2 in 70-80 days. 6 months ago K-1 NOA2s from CSC were taking about 150 days...

As I said, I'm hoping for a short process, but I am planning on 5 months. It could certainly be more. And if an RFE comes I'll have to take it in stride.

Worrying won't speed up the process. You can either have it takes the time it takes and stress, or have it take the time it takes and focus on other things. My fiancee is still working and I'm focusing on other hobbies and goals so we keep our mind distracted from the process. It doesn't make it easier, but at least we are doing something beneficial while we wait.

Thanks for the explanation. My Fiancee Petition was just routed to Vermont today. Reading most of these post made it sound like I will be waiting forever, since it is not the California Service Center. I'm glad to hear that Vermont isn't always the one behind, with the longest wait. :)

The 60 days is just their limit. I received mine 4/23, and got my NOA2 approval 4/30, so 1 week from the time I got the letter. Hang in there, good luck!!

 If you do not speak Spanish then that also will be a problem. I do not speak Portuguese and she does not speak English. This was the main problem between us. We have resolves this using translator and this allow us to become closer.

 

My Fiancee knows most English, but I have found that using my I-phone with a free translator application is very valuable.  I don't even use the cellular function while in Brazil, I use the free wi-fi at restaraunts, and at her condo...put it in airplane mode, so you don't get charged for anything cellular.  Now, if she doesn't understand something, I have the help in my pocket...

My neighbor married a peruvian that didn't know English.  She organized his house, then his shop, went back to college, took english courses, and nursing courses.  Now she drives a new car, works in the emergency room at the hospital, knows good english and seems to be a very good mother to their new baby. She definately isn't lazy.

  I do know of another peruvian that married an american, after they communicated for awhile. She planned on coming to the USA, told him that she was a strong person, and could leave her family.  He told her they would visit Peru periodically.  After their petition was approved, she changed her mind, and said her family members needed her, and did not want to come live in USA. She said she would visit USA, but wanted to have a baby in Peru.  She said was common in Peru, to have american husband to send money...they divorced...that goes to show you that women are different, no matter what country they are from.  They are not the same...:)

Since no one had the answer here on visa journey, I asked the consulate and got a reply.

 

They said that the Brazilian CPF number belongs in #14 blank for the national ID number.

Hey Bamellis, Sorry to not have replied sooner. I don't get on VJ much anymore. I wrote that post back in May, and am now married to my fiancee, which happened in July... You just want to be sure that your fiance has all of the pages of the divorce decree. To be sure, I went to the court house that the divorce was documented, and got them to make a copy, then they stamped it with their certification/seal, from the county clerks office.  It only cost $5 and gave me a piece of mind.

Hello VJ'ers,

The "original document" that I have is a copy.  WIll it be sufficient, or should I get them to certify it?  There is a stamp on it...but is a copy of the decree and stamp. The stamp is just showing that it was filed by the circuit clerk.

This will be for my fiancee's interview in Rio de Janeiro.

I think the Apostille is only needed when another country wants to confirm that documents are valid in our country, or ours wants to confirm for their country. Both countries have to be in the "treaty" for it to be trusted, or able to use.  Since it is a USA embassy, it should be trusted from one USA embassy to another branch....without an Apostille.

My question is: was the previous visa petition mentioned on the forms? There is a question asking if a previous visa petition  been applied for.  If it was not mentioned, then that could be grounds for denial.  They seem to put a lot of weight on not disclosing information such as that.

They sent us an email with the instructions, which is a little bit different of the informations at the website. Today I went to the consulate and I decided to keep my passport, I sent a certified copy (as they asked). They have 10 business day to check the documents and if is everything ok they will set up the interview.

I emailed them with our case number, and they emailed me a link to their embassy website, and also sent a letter to my Brazilian Fiancee, telling her to go to the website, and her interview date. 

They asked you to send something before they would schedule your interview?  Our interview will be July 2nd.

I don't understand why yours would be different than mine...the process.

I think there is a hiring freeze for the federal government. There was talk of government furlough, in some branches. If the government can't budget the money, then I doubt they will realize that expedited visa's could generate more money, not to mention that there is a pretty good chunk of money for what I am thinking is only 30 minutes of work for each petition...

Nothing to worry about, that happened to me as well with my RFE. i received 2 texts with different dates as to when they mailed it out. i only received one letter with everything they were requesting in the mail. you just have to wait for it in the mail in order to know what exactly is what they are asking for. when you do receive it you will see it is a blue paper with the requested information. make sure when you do reply to it (send it back) make sure the blue paper is on TOP of the documents you are sending back to them.

Ahh, thanks!! I was thinking they found two problems that they didn't like. Do you remember how many days it took for them to get the hard copy to you, from the time they texted? Did it seem to have been sent from the first text day, or the second text that they claimed to have sent? Thanks again.

I received and email stating that a Requesting Additional Evidence had been mailed out April 11, 2013. I have been anxiously awaiting its arrival in the mail. Now, today, I recieved another text and email stating that it was sent out today, April 15, 2013.
Did they forget to put it in the mail April 11? Is there two questions now? Did they simply click the notify button again today, by accident?
I called the service center, but all she did was read what was on the email, and say that she only sees what I see, that it was mailed April 15.

How hard would it be for them to include the information that they are requesting in the email, and also send it as well via postal mail? After they verified who I was, they still could not give me any information. :wacko:

Just sharing my "journey". Any input or ideas are appreciated.

I hope the information they gave you is true, I am also a 10/24 filer, however that completely cotradicts all info that we on this site have been able to formulate. Most here have it figured closer to 90 days for October filers assuming CSC starts moving again.

They key is the filing location. If you will notice, they are Vermont filers, whereas you are a California filer. Vermont is ahead of California for the moment. When I first filed, it was the other way around... :thumbs:

I can vouch that Masha is correct. I got a message that my RFE had been sent April 11, then got a second notice that it had been sent April 15. I suppose it is too much trouble for them to change the wording on the first message to just say "issued". :)

I finally got that sweet text, that said our status had been changed...the sent 2 texts, 30 minutes apart, and an email. Our I-129F petition had been approved. :) I worried about things that they might not have liked on my documents...monsters that really didn't exist.

I go to church almost every Sunday, but I never go up to the alter and pray.  Well, I did Sunday, and prayed that our visa would be approved.  I told my fiancée that it would be approved this week, since I had asked God for it.

I want to thank God, and everyone on this site that helped me with my questions I was unsure about.

Now, I am ready for round 2, and get the package ready for my fiancée's interview.

Hey, I was just curious about the letter I received from Vermont, approving our I129F.  It states that my information is being sent to the consulate that I indicated on the form.  I saw an approval letter made approximately a year ago, from California, and it states that the information was being sent to the National Visa Center, then will be determined which embassy to go to from there.

 

Has there been a change in the procedures?  Are they saving money by sending the documents directly, and possibly sending the information that NVC need electronically?

 

Just curious, and would like to hear other's opinions.

My Fiancee will be attending an interview in Rio de Janeiro, Brazil.  She has read somewhere in a blog about a letter describing how we met,..basically our story.  I cannot find anything about it. :(

All I can find is that a letter of intent is good both with the I-129, and to have a fresher dated copy at the interview. Is anyone else including a "personal" letter, for the interview?

Since he got a RFE just now, THEN decides to stop the petition, I think there is something he is hiding. Already married, in trouble with the law...
Whatever the reason, I would not give him a second chance. I would want someone that would put a fight up to be with me.
I was in a shaky relationship before...I learned not to keep patching it up.
As someone said, everything happens for a reason. I am very happy with my new relationship. Just pray, it works!

After the petition is approved at the service center, it is sent to the NVC.  There it is given a case number.  Mine was given three letters and some numbers.  The letters RDJ, since the interview will be at Rio de Janeiro for me. After it is processed, it is sent to the appropriate embassy, where the interview will be scheduled.  Each embassy is different, and has their own ways of handling it.  In my case, the RDJ embassy assigns a interview dates without input from the petioner or beneficiary, other than a chance to reschedule at a later date. I have read that some embassies send you a package, let you get your medical done, then notify them that you are ready to schedule an interview...

If you bank account is not charging you any fees to hold the account, I'd just leave it there empty doing nothing (turn off paper bank statements or set your address on it to somewhere in the UK you can forward from).  You never know when you might want a UK bank account again, and opening one from outside the UK can be a pain. smile.png

thats true, even opening an account as a British citizen in the UK with all documents and paperwork can be a real pain, i would not like to do it from overseas.

Is it possible to have someone else withdraw it all and close out your account for you? Then they could send it via western union.

 

this is just my opinion, but i have found that western union is ok for small amounts.However if your talking a sizable chunk of money i would not use them as they charge a huge amount your better of just using your banks own transfer system.one other thing, some not all banks in the UK won't close an account without the account holder being present.

I knew that in tort law there is a doctrine called Res Ipsa Loquitur, never heard of Res Ipsa Loquita, let alone in determining whether a crime is federal or state.

Res Ipsa Loquita is a well defined legal term under UK law, not sure about the rest of the world though, maybe something got lost in translation lol

Massachusetts does not have the death penalty, and as a naturlized US citizen unless there is an "accident" it is highly unlikely he will be killed whilst in custody.

I was under the impression that it was impossible to vote in an election if you were not a US citizen, i have learned something today. i'm unable to add much, however you have some very clued up members who have advised he doesn't go to that appoinment without a lawyer i would follow their advice.
