When you arrive in the US...make sure you tell imigration why you are here and what your plans are. They will help you thru the next step.

In the spirit of VJ welcome to the message boards. Please make yourself comfortable by setting up your timeline, your signature and grab a coffee and read the links previously posted directing you to the extremely informative guides, websites and perhaps check out some example forms so you can get a better picture of what this process is like from a couples view and the stages/legal view. :) It may look very overwelming as most people find when they research into a way to "make it happen" but if you're serious we know we will be seeing you around and VJ is always here to help you with any questions or concerns you may have about the visa process. Though we aren't lawyers, we're just like you and your boyfriend just a little older.

The first thing I'd like to say as you've just read from the others, which I totally back is you need to be 100% sure you and this guy are serious enough to want to dive into this and you need to ask yourself if you are prepared to do what it takes to be together and stick with it till you finally make it. Patience is one of the hardest things couples are forced to learn during this process. The waiting game can not only be frustrating but absolutely heartrenching at times.

Now the K-1 Fiance(e) visa is a visa aimed at engaged couples where one is a USC (that is VJ lingo for United States Citizen ie your boyfriend) and the other is a foreign citizen commonly refered to as the foreign fiance(e) or "alien." The purpose is so you may go to America with the intention of marrying and reside there with your then husband perminantly. But that's not it the K-1 is ONLY the START of this journey, you then need to Adjust Your Status to obtain a Green Card and then if you wish become a Naturalized Citizen of the US. In total it can be anything upto 5 years until you're totally free of filling in paperwork, going to interviews etc. As for the length of time you wait for K-1, it can be anything from 4-11 months, as you can see everybodys case is different and there are delays, obsticals and frustrations. You are not allowed to stay with your fiance(e) in the USA for more than 3 months at a time whilst you wait for your approval.

To touch on the age issue in your case. I don't think you should jump into this process UNTIL you and your family have met this person, in person. It is a VERY dangerous thing to do to meet somebody even if you think you know him for the first time. I'm sure even many older people here would agree with me that it is much safer to bring a friend or relative to meet him with you. In general, not just because you're young though it is a factor. Whilst you visit him in November take photographs of you both together, perhaps with friends and family in them too and maybe you'd like to take the I-129f forms (the packet that starts the process for a K-1) with you when you go meet him incase you do get engaged so you can fill them out together and he can send it off, because HE has to petition for YOU. You fill find the appropiate forms as you search around VJ and the London Embassy website. Or if you have not known this guy for particuarly long I'd recommend making a second visit before starting this process. You want to make sure you're sure, backing out then trying to re-apply will raise some red flags. I'd say wait till January for your boyfriend (then fiance) to post the application so you are in the ok zone.

We are in a slightly different situation, I am 18 this coming September and my fiance (a USC) is 21 this coming November. We had contacted the London Embassy about the age requirement and they instructed us at the time when we applied which was Sept 30th 05 that as long as my USC fiance was over 18 and I had parental concent and letters from my parents saying they approve and support our intentions we should be fine. We are waiting for the K-1 interview at the moment and I do not plan to enter the United States until October if approved so I am going with the marriage laws of 18 of the US.

Like the others have said, read, re-read and read some more. Mental preparation is another key, are you ready for marriage? Andy and I had known each other for 4 years via letter and internet before giving in to the fact we had something much more deeper than a friendship, a further year before we saw each other in the flesh and he proposed and 2 months after touching back to the UK we started to research our options and began the K-1 journey. My parents know him, I know his...everybody is fine with this and we have brillient support from other older couples on VJ despite our first impressions.

Keep your chin up and get down to some thorough reading, get that boyfriend involved too if he's really keen. And I hope to see you post in the future that you've began the journey to your future. Best of Luck

Theres been alot of "red flag" threads recently which have ruffled a few feathers here at VJ, possibly yours just looks the same to some. I am a firm believer in the past is in the past and if you're SURE about this intention to marry. Congratulations and I wish you all the best. It isn't easy for anybody to consider marriage to somebody who has had quite a troubled history, I totally respect that you can put this thing with her rushed past marriage behind you and move on fresh and consider starting a new life together.

There are guides at the top of the page which gives you a description and details of both K-1 and K-3 processes. I personally say in your situation to go for the K-1, reason being you won't be rushing into marriage for at least 6 months when the visa is approved which gives you more time to get to know each other and make the right decision. A K-3 you apply for after marriage which then if you two decide it doesn't work you'd end up with another divorse on your hands. It's upto you, but remember either way isn't going to be easy and the waiting process will test your relationship to the max.

Like the others have said age shouldn't be an issue for you guys at all. The only times I personally have ever read an age issue is when the couple have a rather large age gap between each other or the couple is below 18.

See I'm 18 in September and we're getting around the "legal to marry" issue by waiting till after my Birthday to legally do it if the visa is approved :)

This is a very interesting thread. It reminds me of a fillable form way back last year thats only option for citizenship, place of birth and current residence the only drop down option was the long "United Kingdom/N. Ireland." I later disguarded using that particular fill in document as I was adviced here somebody went to their interview with it and got a telling off. I'm sure it wasn't for that reason but it made me think of it. Then I decided to just fill the form in by hand from one of the packets when I actually got them ...with Scotland as my birthplace and England UK as my current country of residence and of course a british citizen.

I wish the "UK" would just be a dang state of the US it'd be so much more simplier. But here's somebody here who thought Seatle was a state *runs.*

Hello,
I realise there is a medical later on in the k-1 process. I am incredibly worried about the fact I have two medical conditions. A muscle wasting disorder which makes me wheelchair dependant (genetic not infectious what so ever) and I am chronically asthmatic. The muscle wasting disorder is progressive (worsens with time). I have already contacted california social services and I have a number to call if my visa is approved to recieve emergency disability benefits for 2 years till I have to change status and then I can apply for the full amount.
Has anybody gone to this medical with a medical condition and been turned away because of it? I have done ALOT of reading online and can find no mention of any k-1 visa stories with people with medical conditions. I realise you have to have a chest x-ray. Will asthma show on this? I realise they are looking for signs of TB but I was just wondering. Also I realise their is a blood test involved, I take steriod inhalers so this would be found in my blood yes?
We keep trying to be positive, surely they cannot turn us away because I have a medical condition. Thats disability discrimination. But on the other hand they can argue back I'll be a burden to the system.
Anybody at all got any information?

I noticed somebody asked a week or so ago if there was a list of all RFEs so people could look out for possible "boo-boos." So here we go!

My RFE reason was;
The forms we downloaded didn't tell us to add evidence of meeting in the past two years or frontal face photographs. Which is weird because we got them directly off the London Embassy site. So we got an RFE for basically the other half of what you're suppost to send origionally. We started the K-1 appliciation before we found this forum so we were kinda just going with the instructions as best as we could. We say if you're just starting the I-129F download it from VJ...they seem to have the right instructions....

Hey,
So I'm renewing my British passport from here in the States and after the whole palava of gettin' somebody to sign an official British Document I now have another problem. The doctor has wrote 'I certify this is a true likeness of *enter name here*' on both of the photos I intended to send with the application to Washington. I have read that one passport photo must be totally blank on the reverse side. I am already cutting in fine in submitting my application as is and now am I going to have to get my photos retaken because of this mess up or can I send both photos with that statement, signed and dated in and just put in a note explaining? I tried calling the place I got the photos taken at to see if I can order another print but they did not save them. ARG! What are my options here? If I have to get the photos retaken I'll have to wait for the doctor to write the statement, sign and date all over again!

I'm not sure which forum this question belongs in so I'm taking a lucky guess and hope I can get some answers.
I'm in touch with a couple male in NY USA with a fiancee in India. I cannot for the life of me find a B2 Visa application form for an applicant in India. Went to the USCIS website of India etc wasn't much help. Anybody know where on the internet it's at so I can pass it along? I was origionally going to suggest to them the Visa Waiver Programme but on researching that, India isn't a country thats under that scheme.

Help me help them lol :)

We just got a letter from NVC saying its approved by them and its going to be sent to the US Embassy in London within a week and our NOA2 was offically March 8th so I say perhaps a few days you should get your responce from NVC.

But with the RFE being sent in this week there are pictures of us both which may alert them. But yes good idea, I shall "make sure." Just wondering when we get to the interview stage (way off yet) how the US embassy in London is for wheelchair access? I assume they HAVE to have access just wondering if anybody noticed anybody in a wheelchair whilst perhaps you were waiting in the waiting room for your interview or whatnot. I'm hoping it won't be a problem when it comes down to it. Bit worried about the chest x-ray at the medical I cannot lean forward to put my chin on the bar everybody talks about. Wonder what would happen then....I mean I can lean forward but an operation to fuse my spine prevents me from sitting forward more in say 5 degrees from bolt upright...

Andy came through the surgery and is now back home. Haven't had a minute to update our website blog if any of you guys like to check our site :) He's very dopped up, they got him on one of the strongest painkillers out there which is causing him to fall asleep every few minutes.....hes also have other affects....confusion etc...But thankfully he's getting weaned down on these till he's off them completely. His surgery was a success his pain level has decreased masses. He says to tell you guys hi and thanks for all the info. 'sigh this was very hard for us, I was in pieces while he was in hospital (huh great support...) but things can only get better now right? :unsure: God where are you letter from NVC ..... :(

My sweetheart and I got our NOA2 approval March 8th by e-mail and recieved it offically by post 11th March. So we've got going through the NVC, Embassy, Medical and interview to go yet.
I just wanted to know when you have the visa in hand how soon are you actually allowed to go "home" to your partner? I read somewhere on here that at the interview they ask you when you plan to go also get married and you've to say later than you actually have in mind. Do they get suspicious otherwise? If we are approved and we get the visa I'd like to stay a few nights in london after the interview and then just go. Is that ok to do? It's to save us money and god :crying: we've been like this for 6 years. We just wanna get together asap. But how soon is too soon? I don't want them throwing me back at the POE noticing we got the approval say a few days before....
Advice please....

Also I'm a little worried about the interview questions too. I've read the guide on this site of all possible questions. I'm just concern how far they read into your words. Say if they asked me "Why do you want to live in America?" and I say "Because I love and want to be with my partner, and we figured the US would be the best place for us to be because of our disabilities....we'd have a better quality of life there as pose to england." Which is true....that is why I chose to go there rather than him come here. I just don't want them thinking I'm trying to get in for medical purposes.....ack worries! Do they question their questions answers?

My fiance (USC) recieved a letter from NVC saying that they recieved our approval 20th March and that they will be sending it out to the london embassy within a week. Problem is they gave us a LND number but when I go to add the case to the online status USCIS page it says it doesn't exist. Am I doing something wrong?

I have a few other questions if any UKers can shed some light.

1. Do we keep these staples in....they tell US not to use them but they have? They hold all the forms together....
2. My co-sponser and sponser are filing in a downloaded verson of the I-134 each...there is one included stapled into packet three....do we rip this out because it will remain blank and may cause some confusion
3. Theres some form with a barcode on it....I remember filling this in online once because it needed the barcode.... the instructions don't say in packet 3 to go online to get the barcode of this form they've included so I can only assume they'll give me that at the interview?
4. Do I send back the instructions too? If we keep the staples in they are stapled with them too....

So you guys know ( :D whoever follows our case) I emailed the London embassy today and asked about the medical/interview not being on the same day anymore and if there was anyway at all due to our circumstances they could aid us... Not expecting them to say yes but can do but ask. I also asked about having my caregiver at the medical and interview....if she'd need a special pass and about disabled access at the embassy. All posted in other threads. So :thumbs: waiting for a responce. Pray its positive. Ty all for your continues help...

:dance: What a great surprise this morning.

So far today I've filled out the Bio data form and leaving the rest for a bit (I tire easily).... But all looks "ok." We were looking at the medical instructions though and it says THEY choose where I go and that it takes 2 days now to get the results...so looks like we're gonna have to make 3 trips to london....1 for the medical, 1 for the interview and 1 to heathrow if approved. According to our packet 3 it has I-134 gets sent back with all the rest they supplied....but I have to wait for my co-sponcer and fiance to send them back to send off packet 3 ...so hmm....

Wish us luck!

Btw the whole packet 3 came with 2 staples through them....we haven't unstapled them incase....is this right?

Just wondered if anybody knew wheather a relative can get special permission to be present in the medical and interview.... I know they're asked to wait in the waiting area but I'm going to need physical assistance.....especially doing a x-ray etc ..

I plan to call the embassy when I get a date but just wondered if any of you "experianced" folks out there know of anything of the such?
