K-1 Fiance(e) Visa Case Filing and Progress ReportsRFE again!!!
QUOTE (jury @ Oct 14 2008, 08:32 PM) <{POST_SNAPBACK}>
hi guys!
we received another RFE again! I'm so sick and tired of this! first they asked my fiance to send a passport photos and now i don't know what else they need, because we haven't receive the letter from immigration yet, guys do you think this can be be the reason I'm so worried coz my fiance told me that maybe it's because of our age gap, that's why it's so hard for them to make a decision about this petition.....
this is what they say in there e-mail.

Current Status: Request for Additional Evidence Sent

On October 14, 2008, we mailed a notice requesting additional evidence or information in this case I129F PETITION FOR FIANCE(E). Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, call 1-800-375-5283 to update your address.

what shall i do? i really wannna to give up now... i feel like I'm wasting my whole lifetime with this fuckin, bullshit, immigration thing!!!!!!!! sometimes i asked my self if the lord is really there to listen to all my prayers?

They may ask for more evidence for proof of meeting in the last two years or ongoing relationship. But do bear in mind, age can be a factor but very rarely is if you look at other VJ'ers age difference. It's essentially discrimination. Just do what they ask and deal. I mean hey it sucks. But what is an extra two-three weeks if you're going to get a lifetime together right?

Officially 141 days from when we submitted our K1 to the CSC - it looks like we finally got our NOA2 approval!!!
The USCIS email notification didn't seem to have done it's job. I didn't get any of the alerts for the first
touch - or for the NOA2. It's not really a complaint - just information for those of you who might actually
be expecting an email alert.

YAY!!!

QUOTE (maliciant @ Oct 16 2008, 12:23 AM) <{POST_SNAPBACK}>
I seriously doubt that they can match up someone from a post on VJ to a box most likely in storage somewhere that easily, I agree with the someone picked up the wrong box and went wild on it theory. They generally only have a username (not a real name, ssn state etc) and a filing date to go on to do so, I don't think too many USCIS employees read this site or many others relating to imigration, sure some might have looked but seriously, most people don't bring their work home or go looking for more (it just doesn't pay well enough). There are probably a few fraud people who who as part of their routine do look into websites like this to see if there is any trends being recommended to circumvent the system but even that is unlikely... but you know who I DO think follows these forums... consular officers, many of them are described on these forums, the place they work, the window number, physical description, and flattering and non-flattering things are often said about them, those people have a bit of a fame incentive to look, it's specific enough about them that they'd be curious, people like reading about themselves afterall.

From what I see looking at the list of VSC and CSC is that VSC has a few really old petitions, and CSC has quite a few more in the same date ranges... this might just be a result of the overall higher number of petitions sent to CSC, but I think CSC only get's about 50% more petitions but has about three times old petitions stuck in there.

Agreed, it's like working at a bar and looking for forums to see what people are saying about that bar. People aren't that dedicated to their job. They simply don't care. Work is work, and home is home. Keep the two seperated and no one gets hurt smile.gif

Agreed. As hard as it is, don't freak out until you have passed USCIS timelines. Until that day happens, they're not going to be too keen on helping you. Just join the waiting room with the rest of us. At least you know your in the system, they'll get to you when your time comes.

I don't want to be the one to burst any of your venting bubbles...However, most of you are still within USCIS estimated times. And contacting your congressman earlier in the game is mostly useless, as USCIS will give your congresman the same response they will give you. Sorry kids.

Ken knew that he was within waiting times when he wrote that letter. He actually wrote it at the beginning of his visa journey. The letter was not specifically about his case, but about the fact that it takes on average 6 months to get this type of visa processed and it only takes up to 3 months to get a business visa expedited for those corporations who wish to employ overseas workers (and I will grant a distinction between an immigrant and non-immigrant visa - but still HALF the time)

6 months, for USCIS to process our forms. The system does not work well, and the current levels of productivity in Vermont are not justifiable (weather permitting or not) on any level. The sudden surge in California shows, it can be done faster. But someone has to take responsibility.

It's about time the people in charge were asked some questions.

There are too many unknown variables for anyone short of a USCIS employee can justify. Unfortunately, K visa's are not the only visas processed, we do not know VSCs caseload or CSCs to actually make that assumption.

IMO, I think the best response to the frustration is sit and wait, enjoy the time you still have with your friends and family at your current home while you still can. If I spent all my time getting frustrated at VSC (and I have my reasons) or stressing myself out in general, I probably would be to the hospital and back. But for now, I focus on my job, the logisitics of moving, and the life I have here in Canada.

I just noticed last night that our number on the Berkeley website is #109 and the link from here to Igor's list shows us as #201. They can't both be correct. Anyone else notice this?

I have noticed these two lists as well. I also posted a question about it, but no one responded. I'll bump up your post, so perhaps we will both get our question answered.

From what I can see...this is why. The Berkley one does the lists in order of your sent date, and the other one does it by NOA1 date, which in some cases makes a huge difference. And second, the berkley website bumps people who have been waiting over 6 months down to another list, and the other one keeps them with the regular time frame people smile.gif i am also a lot different between the two lists. What i'd tell you is to just pick one to look at, and stick with that one. Or, look at parts of each...for example I usually look at the berkley one as far as my placing on the list goes, and the approved list. But I like to look at the other one to see the graph of percent approved smile.gif hope that helps, if not let me know!

The Berkley list is no longer maintained. Both lists just serve as an estimate and nothing to be taken to heart. However, the list on the "Immigrations Timelines" page is the most up-to-date. Use this list.

What do you mean its no longer maintained? Its still updated hourly....

From my understanding it is no longer being reviewed for duplicates etc. Use whichever list you like, but if I were to trust one and one only it would be VJ's.

Not being able to see your case status online is not really a reason to involve your senator, because the online system sometimes does not update correctly. When our I-129F was approved, it was about 4 months before the date changed to reflect the date of our approval....by that time my fiancee was already here w/ me...go figure. wacko.gif

wait, are you the USC, or the beneficiary? either way, a 'grilling' by CPB would make no difference on the adjudicaition of your petition.

Exactly right. Once the trust is gone, it's over. My ex did the same thing to me, got together with his ex behind my back, I found out. Gave him a 2nd chance (STUPIDLY) and I ended up dumping his pathetic azz, the trust never came back. She has every right to be pi$$ed as hell at you. Lies don't make for a good relationship. By the way. I don't think saying "she's fat" has anything to do with this story and is incredibly rude.

Probably a good thing to let it die but remember that lawyers want to represent for a reason (most immigration cases are a walk in the park). And lawyers know full well that they don't need to help you with these petitions. An overstay is an overstay regardless of your country of origin. Good luck.

CanadaAm I crazy?
Canadians typically do not get their passports stamped this is true. I'm unsure for land crossings but when you fly they do swipe your passport which I imagine has something to do with it. If this was me I'd do as suggested either attend the interview or withdraw the petition and adjust.

From what I was to understand also paying a lawyer a $1000 to go to your interview would be pointless as they aren't allowed in the actual interview itself. I may be wrong but none the less ask around if they can attend.

I'm scared about changing my name too. My name has always had a nice flow Janka *insert three word dutch name here* if I hyphened it it would be far too long. And if I went with his last name I feel like the flow of my name would be gone. Thats what my name does it flows. Take a 13 letter last name and change it to a 5 letter last name..it feels stunted..who knows.

CanadaMarriage during the US visit
My understanding that it wasn't illegal because you did leave and it was probably spur of the moment. However, when crossing the border bring proof of ties to Canada with you (lease or mortgage, letter from employer, utility bills etc.) and you should be fine. I could stand to be corrected however.

Congratulations on your marriage and good luck on your visa journey!
