You can check the NOA1 date online. If you have access to your cashed check image (available to me from my bank), you can get your receipt number which should be stamped on the back of the check. The number will probably start with the letters EAC followed by 10 digits. Go to the following link:

and enter this number. It should list the NOA1 date. I don't know if they'll email the NOA1 but you'll definitely receive one in the mail. Hope this helps.

I think you'll be fine with the edition you are using. Previous editions are accepted currently for form I-864 so I wouldn't worry about it. If you want to worry about it, you can wait to see when they issue the new form and fill out that one. But I don't think you would have to. Just my opinion.

From what I understand anywhere between 5 business days to 2 weeks. However, it seems completely normal if you do not receive it. Check the back of the cheque that was cashed and it should have your case # there. Or you could just call and heckle them smile.gif

Hopefully, you fired the lawyer the moment you heard this, and hope your paperwork ended up in a Shred-it box somewhere. As said in previous post cancel the payment on your cheque and try it yourself. As intimidating as the immigration process is, it is meant to be user friendly. You don't need a third party telling the government you love someone. Do it yourself!

Also keep in mind most recessions only last 10 months. I mean either way the first while is going to be tough financially, even if it's not ideal. And, what makes the both of you sure that he will get a teaching job? I know in Canada it can be tough to get a job in that profession, very competitive. I say complete the process, it's in your best interest because come 2009 the recession may be done.

K1 Visa interviews are processed out of Montreal (Ontario and east) and Vancouver (Manitoba and west). Those are the only two places that will complete interviews.


And no it won't get returned..it will just be corrected.

It's been like that for about a month now. USCIS claims that this strange message is in reference to the original NOA1 that was returned due to inability to deliver for whatever reason. So, I never saw the typical status message that tells me how they will proceed. I'm assuming it's a form letter, so no big loss. Still, I'm wondering why each NOA1 copy they sent me has a different receipt date. Maybe I'm worried about nothing, but does anyone know why?


I'm not all that knowledgable in the ways of USCIS but if I were you I'd use the date on the first NOA1 you received.

Agreed. USCIS/CRIS is Homeland Security. NVC is Department of State. USCIS will not update their online case status system to reflect your NVC status. If you are curious, you call NVC. Their phone number is on the travel.state.gov website. Have fun!

As much as that situation sucks, I don't see how it could warrant an expedite. You could always try the worse they will say is no but when they expedite due to USCIS error its usually because you have to refile for the visa (example: they lost your fiancees file and now you have to refile). I've been wrong before though lol.

The same thing happened to us. We sent our petition waited a month, cheque was never cashed. You can't really talk to anyone because you're not in the system and they can't see your information. We sent them a letter no response, e-mailed, called etc. Just resend it (that's what we did)

Would be a good idea. Our case was straight forward, the first time we sent it it got lost. Then after we were approved NVC sent the petition to Australia instead of Vancouver. I'm not saying that is a common occurence but even straight forward cases go awry.

Regardless of whether they check or not. What's done is done. Your fiance accepted under the table payment, you cannot change this. So you might as well just relax and file. If it bites you, it bites you. But, I don't think it will, and if it does he'll just have to take the repercussions of his actions. But that's just my opinion.

They are checking to see if you meet the requirement of having met within 2 years. I would personally include a photocopy of the passport (cover to cover), photocopies of travel documents, hotel receipts and what not. Photos of the two of you together. I did not submit photos with the date digitally printed on. I simply wrote the date on the back of the photo, where we were, and who was in the photo. If your fiancee has travel stamps in her passport for coming to visit you, include those too.

Okay...

1 : How often are fiance visa denied?
I haven't seen too many get denied, have all your paperwork in order and be honest.

2 : I do not have a Birth Certificate! I was born in Vietnam back in 1987, my birth certificate has been long lost since then. I have never returned to vietnam eversince I left when I was only 6 months old. I do however have a british passport. Would this affect our petition? Most people born in Vietnam will not have a Birth Certificate, my fiance Binh doesnt have one either but he has his naturalization certificate and his passport. This is driving me mad worrying!

I personally would try like hell to get a birth certificate. It's always a good thing to have. The Canadian Packet 3 for K1 visa's states the following about unobtainable birth certificates.

EVIDENCE IN LIEU OF AN UNOBTAINABLE BIRTH CERTIFICATE: In rare cases, it may be impossible to
obtain a birth certificate because records have been lost or destroyed through war. In such a case, secondary evidence may
be submitted for consideration, such as a baptismal certificate, hospital certificate, school records, and/or a notarized
affidavit from a close relative, preferably your parents. You must also submit a sworn affidavit (s) explaining why a birth
certificate is unavailable.


3 : There is a 2 year age difference between me and my fiance. I am turning 22 on the 21st of august, and he is 20. I am nearly exactly 2 years older then him...... Would there be a problem with our age? A lot of people would think that "we might be too young to make the right decision" to get married so soon etc. Do you think we should get our parents to write us a letter of support? I am nearly 22..... I really dont think thats young at all.

It doesn't matter there is 15 years between my SO and I and we got approved.

4 : When will he need to meet the poverty line requirement?

Pretty much now. You will need to prove financial support at your interview. If he cannot meet income requirements now would be a good time to get a cosponsor lined up.

5: He wants to send 20 photographs of me and him with our I-129F package, is that too many photos?

Some people submit entire photoalbums its up to you. I provided like 3 or 4.

6 : In 2007, I did not get to visit him and he couldnt visit me because we both had college and no jobs, we couldnt afford to go anywhere that year! Would they question that? But in 2008 I went to visit him twice, once for 18 days and another for 89 days! The border patrol wasnt so happy to see me staying nearly the maximum allowed days in the US and gave me quite a hard time!

You met the requirements of meeting within the past two years so you're good to go.
