K-3 Spouse Visa Process & ProceduresWeeken pity party for waiting K-3'ers
I see mostly the April Filers here....Being a June filer, I may not be saying much, but I am just wondering, next week before chrismas holiday, I may have to see some approvals coming from CSC those were sent this week and not to mention they were june, july and august filers with stand alone I-130. Then why this K3? Having a feeling of being clown, VSC is playing with us. They are like "wanted to expadite, haaaaaa!!! and with a fee waiver!!! wait and see how pain I can give you"...khikz....

YES YES YES!!!! I am really pissed of.......I don't know what to say...........No offence to anyone who gets their approvals luckily and significantly earlier(mainly the CSC filers), why is this happening to us only? I am afraid of being left over as a june filer whenever they would start processing our cases.....like Lisa, CJ-Gator......I really feel for you guys....I believe u should be getting ur by the end of this month.....and before goin to NVC please wish me luck so that I can have some best wishes from the ppl who were hurt badly by VSC...

Take care....and Hope for the best...

Have at it kids!

Our update....nothing.

VSC, please realize that you wont want to do much the rest of the week. You wont want to work the week after either...go ahead and get those petitions out the door so you can relax over the holidays,ok?

K-3 Spouse Visa Process & ProceduresK3 Visa approvals for December 2008
ok!!! Lets face it...For the whole week, I could hardly found 3/4 VJers got approval and more likely from CSC (Transfered from VSC in Early and mid November). What difference gonna make to VSC for Chrismas holidays? They r actually passing the whole month of Chrismas (actually that's what seems to me in open and realistic eyes).

I am really depressed. However, my hubby and I are planning to have a trip in January (Will Visit the TAJ MAHAL in agra, Delhi, Jaipur, Ajmir). This will be our second honeymoon (First one was in Malaysia). I hope, I will have to go for couple of more honeymoons till I get my approval...he he he.... Does any of my fellow members wanna join us? It will be great fun with broken Hearted couples at Taj Mahal!!!!

I really do pray that VCS goes by the NOA1 date from your i-130!!! That means i should be approved much earlier than i was expecting! I got my noa1 for my i-130 in May! but my noa1 for my i129f only in august. do you think this could actually be good news for me??

Same question here as well, I have my I-130 in June 16 and I-129F is in September. Is that a good news for me?

Another thing is, the tracking number I have for my I-129f gives invalid in USCIS.GOV webpage...Does anybody facing thing kind of problem or does anybody ever faced this type of matter earlier in this forum...any info?

Seen 1 Approval of I-130, for a June filer who was actually transfered in CSC in Early November....So, can't count him as VSC approval though...

Soniasharmin,

If my post on this thread rubbed you the wrong way, let me apologize sincerely. It was not my intention to come across as a smart-###. I was merely pointing out the fact that having filed your I-130 in June 08, it was probably a little premature for you to expect an approval (given that April & May filers are still waiting). But of course I was going by the timeline you posted and had no clue that you had started this process in last June. In that case you do deserve to be approved before anyone else here. You do need to get your husband to contact his senators/congressmen right away because it is simply not right for you two to have to wait 18 months or more to be together in the US.

Deepak

Soniasharmin,

I don't mean to play spoilsport here but do remember that between now and the end of the year is the holiday season - I would expect most people at VSC to be taking time off and spending it with their families. And so I wouldn't expect much to happen in terms of approvals until people start coming back to work in the New Year. I really hope that they start tackling the backlog with renewed vigor when they come back and give us the news we have all been waiting to hear.

Also as bad as your situation may seem to be, please remember that there are a number of people who applied (especially for K3) even before you, that are still waiting. Just give it some time and I am sure you will hear something positive soon (luckily for you VSC seems to be moving on the CR-1/IR-1 cases faster than K3).

Deepak

Dear RooDoo,

I don't think we are here to compete with each other in terms of waiting period. And also I know this is a holiday season going on. This is a place where we can breathe, share... Not just poke one another by saying who is facing what, who is before me and who is after!!! You seem more frustrated than me.... God bless you buddy....

One more thing, if you, for any reason, don't like this thread, no one would force you to post something...TRUST ME!!!

Yesterday was almost a a tragic day for us, My husband is terribly depressed about the whole thing, We were expecting last week & this week of our NOA2 after we responded the RFE , but it was so frustrating, still no email from CRIS-Vermont until now, looking at the thread of some members here they got approval after 10 to 15 days, thats why my husband was expecting the same. We both feel the same way now we are sooooo pathetic waiting and waiting ,don't know now how much longer we gonna wait for more, we don't know what will happen to us now. Yesterday morning, my husband was crying out loud when i talked to him in the internet, At this point in time he's very deeply affected of the situation, he was sitting there, saw him hysterical, his mom, trying to comfort him, he shouted all his anger & frustrations. He keep on crying suddenly told me better to ''kill himself'' and speaking words he ''don't want to live anymore '' my life is useless without you sweetheart'' why it so hard to live with my wife'' why don't they approve us yet, why those people (Vermont) screwing us they don't care our feeling,,they want us to separate'', I was crying & screaming trying to stop him, i comforted him & I did my best to calm down, I talk to him with Love & affection ,just to cool his anger,.. Oh, i really pity him, i know what he feels now, I keep telling him that no one can help us except to have more patience & might as well ignore the petition in the meantime, & he answered, I been so patient for the last 300+ days & its over.
Things are so complicated, Our relation being husband & wife is so much important to him more than anything else in this world, he want us to be together, last Aug/Sept when were not yet approve he wanted to come & live with me here but i just stop his plan & told him to just wait until we get approve. Now he want to pursue it by early Jan. 2009 he will come, don't know yet if he will return to the States or not, but sure he will lost his job, & losing his job might be an issue in the Consulate interview, am afraid it may jeopardize granting me a visa. Don't know now what to do. We are in the verge or uncertainties.
My VJ friends Please we need your support...we are emotionally down this time.
Thank you, for bearing with us ever since i posted here.

We are like a family here (atleast I believe so). We all have the similar pain more or less...But we are here only for our love....the love which has yet to receive justice from the people who probabely never loved someone so dearly...Never got the pain of being apart from the person u love so dearly....while u need the person when ur house get robbed...when u have extreme fever, and want to have a kiss on ur forehead to make some comfort of being with the person that u love so dearly....

mamalou,
first off, you have a caring audience to talk to about these things and more importantly, we understand the emotional rollercoaster that you are on.

The fact that you cant even hold your husband when he is so upset makes it 800 times worse.
My husband and I have had those "f it!" just move here, talks and I would like to think its normal. There is nothing really to compare to this whole process. The closest thing I can think of is having a spouse in prison.
You are right in that you guys need patience and faith to get through it.
I dont know where Im going with this other than to say, you arent alone. rose.gif

Hi everyone,

Had some issues getting the docs back to embassy as my fiance was confused. He ended up sending the requested doc special delivery and then phoned curior for his passport. So the two items arrived separately.

So just the info for anyone wanting to loosely compare their expected times.

Intreview- July 7th
Sent requested translated doc- July 20
Sent passport- July 23
Items received (not sure when but DOS finally said the emabassy had everything they needed and the visa was in the final stages, whatever that means)- Aug 5
Curior has sch delivery- Aug 10.

We are rather skeptcal (and after reading horror stories of typos on visa) to make plans and celebrate too much yet but come Monday, we will be on top of world.

Marm- by the way, I am mostly a lurker here but not a day goes by where I don't think and pray for you and your beloved to be together soon. I can't wait for the day you post the good news update.

White Cow

Congrats on getting everything together, hopefully your visa will be perfect when it arrives, be sure to post when it arrives on Monday!
And thank you so much for your kind words, we appreciate it and are keen on expecting good news of the visa printing this upcoming week. Will post an update as soon as we know.

thank you marm sooo much, for the numbers...u are always in our prayers,

We have contacted Senators/Congressman but no response yet. Also, we still have not gotten any replies from the US Embassy in London. But a DOS rep has given us this new information:

A DOS representative told me while checking the status of my fiance's case that "The US Embassy in London has not transferred his file to the next database for printing. It is still in the first one." When I asked what that means, she told me that when they transfer to the second database, then it is in queue for printing. His case is still at the US Embassy in London, but it is yet to be internally transferred."

What does this mean?

I think the officer approves and sends on to the visa printer station who does the visa and gives to courier. So it probably means you haven't been approved. Either they are waiting on name checks (AP) or it's sitting there because they are waiting on the passport, which could be sitting somewhere else and they failed to match up. It is maddening and I know you've wished you could just go in and find your stuff, put it together and hand it to them. I hope the congress people will make a timely request to them and spur them on to at least give you a logical answer.

marm, how do u call the embassy and talk to dos? which number isit? is it the number that you have to pay 1.20 pound per minute that number????? i have been trying to call them but they say that is the only way i can get to know by the paying phone number to get any info......i am soo confused...which one is the embassy extortion line?

Due to circumstances beyond my control...no wait scratch that wacko.gif

I am beginning my clinical rotations for psychiatry by August 1st so I will not be able to update the interview list or keep track of approvals/changes/etc.... so unfortunately I will no longer be "in charge" of the Interview List as of Saturday August 1st, 2009.

It would be great if someone could come along and take over the responsibility...mind you its not written in stone that you HAVE to be punctual about it, but just someone who acts as a reference for the interview list would be nice...

OR

Anyone can make updates or add changes or interview dates by doing the following:

Just follow the format on the interview list that is already set: By clicking "reply" on the post with the most recently updated interview list, you can delete the words: [qoute] from the beginning of the post and [/qoute] from the end of the post to make it a new post. And then follow the template to either:

Add interview dates:
Just type in the interview date in the format shown and high-light the entire entry and click on the blue color in the color options menu tab.

Add the shiny red approval star: On the bottom of the interview list is the "Legend" which tells you that the red star=APPROVED. Just copy the entire link for the red star and paste it next to the name of the interviewee who has recently been approved.

Everything else is pretty much self explanatory in terms of typing in new information/deleting information/changing colors.

I hope this helps anyone who is interested in taking over the "Interview List" or just as a reference to anyone who would like to enter/delete/add changes or dates.

Feel free to decide what to do about this issue, of course!

ETA: I will be updating the list until July 31st. August 1st is when I won't be available.

AWWW marm you are soo sweet the way you keep us all informed and together in a list..... i wasnt in the list because i dont come on that often but i do cum online and read the updates all at a time and it has been so sweet of you the way you always put those stars and updates in there....i hope you get the visa very soooooooooon im praying for all of you out there waiting...........just keep holding on..smile.gif))))

i was reading a post--------

"The US Consulate in Ho Chi Minh has denied my wife case and advised that it's on its way back to USCIS. The case was denied due to the following reasons:

1. Pictures shows we've only been together for 2-3 days --- Not true, we gaves them a lot of pictures with different places for my 3 trips to vietnam.
2. Letters without postal envelopes. --- I admited this. We were not prepared and over confident but we do have all the envelopes ready to proof.
3. Her lack of knowledges of my personal information. She did not know my boss name and the project I'm working on. --- Well, my mom has been married to my dad for 40 years and have idea what project he is working on.
4. We provide different married proposal dates --- Not true, the CO misread my timeline letter. My timeline letter clearly provided the same date as when my wife was providing them on her interview.
5. Phone bills not tracable --- What else do they want? I wrote the web url and id/password of the phone company where i obtainted the bill on the first page.

I took 4 trips to Vietnam

Trip 1: 4/07 Met her
Trip 2: 9/07 Visited her
Trip 3: 4/08 Married her
Trip 4: 4/09 Visit her -- received denial letter at the Consulate when came for status

MY QUESTION IS:

What should I do?

1. Should I file another petition? Seem faster but doesn't make sense because it's the same petition.
2. Should I wait for the letter from USCIS and file an appeal? I heard it takes 2-3 years for them to decide? Too long!!
3. Should I quit my job and move back to Vietnam to live with her while waiting for the decision? I'm having a great 10 years career with 1 company making over 100K but I can't imagine seeing her only for 3-4 weeks a year for the next 3 years (assuming I'm choosing option 2)

Hii...

Well, 1% of the VJ members know about W7 and ITIN for the foreign spouse...and this can't be a issue for u to put on AP for any reason and being in the VJ journey, I read so many posts specially of those who was interviewed in Dhaka and never had a problem with this TAX issue....

Trust me, 99.999999% people get out of this visa issue without facing problem of joint tax return. So, u shouldn't be thinking much about this...Try to concentrate on other issues to proof ur relationship in front of CO...

Good Luck...

Sonia

thanks sonia...
i havent actually earned much some one will co sponsor with me, what are tax transcripts, i know the 1040 and w2. is anything more than those needed other than those two an employers letter of employment?

Tax transcripts are obtained from the IRS... Tax transcripts are good for showing ur past tax schedules...If u gonna have Co Sponsor, u must need to submit all the papers needed for the regular single sponsorer...Like the recent year's(2008) Federal Tax Return along with W2 and Employment Certificate. It is the best practise to submit the IRS transcript for the previous year's Tax records...

Please for the Linche shortcut for the IRS transcripts.

Good Luck

Sonia

thanks sonia, so now ill have to run and get those donee...runn runn runn...wish me luck on this guys...here i goooo whoooooooooooo

Administrative Process tends to be about name checking, not about IRS returns.

Many in your situation file as single since their spouse is not in the country yet, and file an amended return later.

Lastly your profile, and post says K-3, yet you posted this to the CR-1/IR-1 forum.

Moving this to NVC since your timeline indicates I-130 and I-129F were approved.

One last note, you may want to keep the I-130 moving through NVC, if you handle the NVC process properly, more than likely you can get the superior CR-1 IMMIGRANT visa, and save yourself from having to adjust status with it's added costs.

CR-1 is work authorized, K-3 is NOT.

ya we hav dercided to move on with the cr-1...
