well..I have a question..I know USCIS gives approvals of the both petition at the same day more or less. What is the benefit then? Does it help to schedule an interview earlier? Otherwise, what can be done if the I-130 and I129f get approved the same day?

I think you will be notified by email, your case status will be changed in USCIS.GOV website. However, VJ history says that you get transfered only when you have stand alone I-130. So, you gonna have to be here unless they (USCIS) change their policy in new year. If you have followed our members postings, you will find transfers of even October filers by now (only with the stand alone I-130).

Interestingly, by filing in VSC we have done our first mess (which apperantly had no choice other than doing this), second mess was when we filed I-129f to expedite kicking.gif . So buddy, accept the fact that we are on "expedite" boat which barely moves...........

That was my question too. Hope denied of issuance for not having strong tie with homeland will not be a problem anymore...who is going to get back proving strong bond with home country after issuance of K3?

I believe, for the opposite reason of why they did not give us visa before goes for us positive way now. Since we don't have strong tie with our home country, that is why want to live with my husband in his country...make sense ...huh!!! kicking.gif

In November, I have seen approvals both April and May along with the transfers....I don't think much of April and May filers are left other than few of our friends...Being extremely optimistic here as I think June filers would start getting approval from early january and should be done by the mid february.

Dear All,

As we can gather knowledge and information about the immigration process while we are stucked with our immigration, I would like to have some ideas about Assets of Benificiary.

I was going through GUIDE where I found something like a beneficiary may also support for ownself if needed. Like, if it worths 5 times from what is considered in the poverty guideline to meet up. Is it correct?

Like if I have some assets something around $25K (1 Apt. and Stock Market investment), how can I present this if I would like to mention in the asset side of I-864?

Life is all about hope...I became extremely greedy when I saw one of the june filers getting their approvals for both petitions...its hard to believe for the april filers, but it obviously gives june filers with some hope.....however, I have seen approvals within 6 months time period and like lisa and others from april who have been waiting for more than 9 months...but, I don't want to be a of left outs....wish all us get approval really quickly......

I think there are quite a few May filers still waiting. The transfers were stand alone 130's(CR-1/IR-1).
VSC has been throwing those CSC's way lately.

check Birch-Beer's spreadsheet.. he has way more members than our "dust collector's" heh

If you have questions, it's always best to read the guides at the top of the page. They're very logical and straightforward.

You have to file you I-130 and when you receive your NOA1, then you file the I129F. So no, don't file them at the same time because as the guide says, you have to include the NOA1 in the I129F.

It would make more sense for you to do 8 copies of the G325A, 2 photos and 2 sets of affadavits (if you are supplying any of the proof of a bona fide marriage) since you'll need them for both anyway, and send them to him in one go. Obviously FedEx type courier service is usually faster but more expensive. I don't think having the dates on the different sets of documents accompanying the 2 petitions matters.

Just little advise from my side, I am not saying you should do this but consider twice before filing for k-3. The recent trend has shown us alot that filing I-130 alone gets priority over k-3 so think about it before you send I-129f to go with k-3 route.

I got few queries...Where does you husband live? I am not sure though, but I think you are supposed to file I-130 either VSC (for the east coast) or CSC (For those who are in west coast). Please have look at the USCIS website for the correct center to send your file.

Well, I got even confused reading whole thread...Confused about which one should I go for once I am approved? Is it K3 or CR1?

K3 takes appx. 2months after approval upto POE...
CR1 takes appx. 3+ (additional for AP depending on case) months

K3 additional 3-6 months to get greencard
CR1 usually 4-6 weeks....

Best case scenario with K3:
K3 visa stamped recieved within 2 months from the date of approval.
Fly to USA and live together with spouse.(Early Living with spouse)
AOS completed with 3 months and greencard recieved.
5 months from the date of USCISapproval.

Worst case scenario with K3:
K3 visa stamped recieved within 2-4 months(with additional paper works and AP) from the date of approval.
Fly to USA and live together with spouse.(Early Living with spouse)
AOS completed with 3-6 months and greencard recieved.
6-9 months from the date of USCIS approval.

Best case scenario with CR1:
CR1 visa stamped recieved within 3 months from the date of approval.
Fly to USA and live together with spouse.
4 months from the date of USCISapproval to get greencard.

Worst case scenario with CR1:
CR1 visa stamped recieved within 3-6 months(with additional paper works and AP) from the date of approval.

But I have feeling that, after all these I-130 transfers, and after christmas and new year vacation, VSC will speed up themselves a bit...if I not mistaken, they approved, 24/25 K3 filers, which is definitely a good for us who are in the waiting list. However, it was extemely slow in November 08.

I am not sure, if they only work faster every alternative month.... Do they? if they do, in that case January will be an another frustrating month which I hope not to be.........

Here is some instant information for you..however, you can also visit the VJ guidlines for more information.

As we can see you got both of ur application approved, u can go for either of the visas K3 or CR1/IR1.

If you want to go with I129f which is K3(non-immigrant spouse visa) then u dont need to deal with NVC, you will now correspond with local US embassy and forward K3 packages as per embassy's instruction. K3 is a faster way to get a visa and family reunion where u have to status the adjust for getting the green card after the benificiary enters in to the US.

If you want to go with I130which is CR1/IR1(immigrantion visa) then u need to deal with NVC which takes around 4-6 weeks if you don't get RFEs(request for evidence). Then NVC forwards ur case to the local US embassy and schedules an appoinment for visa interview, which is more likely to be 4-6month from the case completion at NVC. after successful interview, u are stamped with Immigrant Visa, and after coming to US there is no extra hassle of AOS and green card arrives within 4-6 weeks.

cuz this the fact...I have even seen April 9, April 11...gradually it came up this...well, they usually update this considering VJ members approvals and their innitiative to update their own timeline...so it is more or like working...

You are goin with K3, but in AOS & EAD forum I found something really frustrating thought....it takes 4months to even one year to get AOS approved...u still have gutts and patience left to deal with USCIS again and again? What do u say?Can even sacrifice couple of months rather waiting for something(worst case scenario) may be months after months?

How long does it usually takes for AOS and EAD? I am really bored and exhausted to live a life without my sweet hubby...at the same time I am scared to deal with USCIS once again...who deals with the AOS and EAD?is it VSC? Who will deal with mine if I live in Arakansas? Is it VSC again or TSC?

Oh, damn! My best friend is married to an Indian guy. If I'm not mistaken they had to file an I-601 waiver for her husband. It was a waiver for someone who was deported, and I think she said it was 601. She has been waiting almost 2 years on her husband's waiver answer. She just got an email 2 weeks ago saying a decision was made and to wait for instructions from the consulate in India.

I hope they get your approval quickly! Your situation is very serious! Let your lawyer bust their a$$ and get it done!!!!


I think India is a high fraud country... That could be the problem. I don't think Costa Rica is considered to be high Fraud. But being processed in Honduras is what scares me.


But I don't think here is the case of being fraud rather it is a case of deportation. Don't forget, even if we understand the fact of Costa Rica being less fraud country compare to any other but u r dealing with a deportation issue...here it has some issues to be resolved no matter where u live...Not everyone in US get deported....and it happens to be extreme cases with several factors related to it....

I don't know but in Bangladesh, everyone goes through AP...he he he... this is really funny, very few ppl here are so intelligent to create terrorist activities wisely like the other ppl in better countries can do...no offence to anyone trust me...may be I am wrong, specially girls like me are far away from terrorism, but it won't wonder me if they say me I am on AP cuz my best friend got to wait 2 and half months to get her visa....she is even less active than me, she can't even spell terrorism, and mostly She is a DOCTOR.....most wise profession so far....
