IR-1 / CR-1 Spouse Visa Process & ProceduresCopies and Photocopies??
QUOTE (lucyrich @ Jan 7 2009, 04:00 PM) <{POST_SNAPBACK}>

What is the difference between a copy and a photocopy?

A photocopy is a copy made by any sort of photographic or xerographic process. It would include a Xerox copy, as well as a copy made by a similar process using an office copier of another brand (IBM, Sharp, Epson, HP, etc.). It would also include a copy made by a computer with a scanner and inkjet printer.

A "copy" made by having a human re-type the text of a document on a typewriter is NOT a photocopy. Some might not even call it a copy, but I'm straining to come up with an example of a "copy" that's not also a "photocopy".

Is it photocopy if I scan papers, and take printouts when needed?

IR-1 / CR-1 Spouse Visa Process & Proceduresbank wires as evidence for spouse CR-1

Last week my Chinese fiancee and I got married in China, and now we're starting to prepare for CR-1 submission. We'd like to include as much evidence of the bona fides of the marriage as possible. We don't have any comingling financial resources or property yet, so we're trying to think of what might be good to include. Thus far, we have the following: marriage certificate, telephone records, emails, evidence of 10 trips to China to see her in the past couple of years, affidavits from my parents of the bona fides of the relationship, and I'll be putting her on my medical insurance. In the past couple of years, I've also wired her money three separate times for living expenses. Could receipts and bank statements from these wires be helpful? The pessimist in me doesn't want the consulate to construe these wires as "buying" a Chinese bride.....which it most certainly is not. It seems to me that it's totally normal and acceptable for a husband to support his wife any way he can.....including financially. So, can evidence of bank wires be helpful? Thanks for your input.

USCIS doesn't expect newlyweds who have never lived even in the same country much less together, to have comingled assets. I would not include evidence you sent money in either direction. It doesn't help and CAN hurt. Why not elect to send evidence from the "any other" category, such as pictures with family and maybe a few communication records.

Here I would like know something, apart from family photos, honeymoon photo, email, phone logs, why it be harmful if I show that my husband sent me money time to time, and for verious fastivals specially? These all are part and proof of relationship I believe...

IR-1 / CR-1 Spouse Visa Process & ProceduresIs there any hope out there?
QUOTE (Moosker @ Jan 3 2009, 09:00 PM) <{POST_SNAPBACK}>
I just feel so helpless...we filed our I-130 in April 2008, received an NOA1.....and still nothing!

We also sent in our I-129f about June/July, got it back (that was a heart stopper, thankfully only missing a signature...) sent it back, then received a "thank you we got your papers".

We haven't heard a thing! I wish we could at least know a general "time line" of when things are going to get rolling. Ok, I'm venting, any other sufferers out there?

So I know for the future....what happens after the I-130 (or the I-129f) is approved? It goes quickly after that right?

Thanks for listening good.gif

Hi, I am here and would like to have the privilage of providing some info to you.

1) USCIS barely updates its website, so don't rely on them much. Current trend says they are working on April Filers and looking on to you timeline you seemed to be approved anytime soon (May be within couple of weeks or so).

2) Once you are out from the USCIS, you usually get the steering. With the NVC process, you may be able complete it within 2 weeks by following the WIKI guides and normal process may take 6-8 weeks... Once your case is successfully completed u r given a date for interview, which is more or less a month later than the date of NVC case completion.

My information should be backed by the specialized though

Thank you

Sonia

K-3 Spouse Visa Process & ProceduresK-3 visa approved yesterday and passport delivered today!!!!
QUOTE (sardes @ Feb 27 2009, 09:22 AM) <{POST_SNAPBACK}>
Hello all,

My interview was yesterday.. Thanks God!!! K-3 visa approved!!!! and UPS just delivered my passport.. I'll be able to fly with my husband on March 5th... I can't tell you how much happy we are... Thank you so much to you all and especially to pushbrk...

I want to share my experience to help those who will go to interview..

We went to Ankara, Turkey on Wednesday by bus which took 7 hours to get there. We were lucky because my friend lives just a few block away from the US Embasy.. We had a very good time in the eve and walked to the embassy on Thursday morning..we were there at 8.30 a.m. My interview was at 9 a.m. We met an Iranian couple outside who were on the same visa K-3.. They let me and the iranian woman in, but not our husbands.. I was very upset when I heard they changed the rules that they don't let the US citizens in the embassy till 1 p.m. I tried to convince them, but it didn't work.. I left hubby outside with his Iranian friend.. I was happy at least hubby wasn't alone outside.

After the security check, I gave them my passport, 2 photos and medical exam report, and they gave me a number. I started to wait inside to be called..also tried to talk to that Iranian woman who seemed she has no preperation. Whereas I had a huge file that filled with documents, pictures, e-mails, phone bills etc. I couldn't communicate with her because she didn't speak English.. She had her interview by 10 a.m. It was fast! Unfortunately she couldn't get the visa. I didn't understand what they spoke, because it was arabic.. but all I could understand is that the consular officer asked pics, but she showed only a few..and the officer asked e-mails and phone bills she couldn't show.. I don't know what they spoke, but all i saw she was very sad when she left.. I also thought since she left hubby's friend would leave too.. He would stay outside alone and also the weather was cold.

Then my number was called at 10.15.. A guy asked me the visa fee receipt and said I should wait. I said ok..but my husband is waiting outside, please let him in. He said the consular officer will interview with you, not with him. I said I know, but it is cold outside and I don't know how long i will wait to have my interview.. The guy was great..he called the gate door and hubby was inside in 5 min smile.gif waiting turned to fun after he came smile.gif

We saw another woman on marriage visa whose papers were in order, but the officer said to her she was on AP. We got really nervous.. All we have seen 2 marriage visa applicants, but they didn't leave the embassy happily.. There were 3 consular officers who were interviewing with people.. There was an Asian officer.. i told hubby I wish I could interview with him.. he was very nice.. Then my number was called at 12.30.. Yesss!! the Asian guy called me.. I got all my stuff.. He first asked me "what was your husband's name".. i answered and said he is sitting there.. He greeted hubby and hubby smiled at him.. Then he asked how we met, which schools i went when i was in the states, what hubby does for a living, where he lives.. and if I have any pics.. What a question! smile.gif I said I had a lot.. and showed him our pics.. He said "very nice".. I was thinking to show him my power point presentation but he didn't want it.. He asked what I love about hubby.. I said "he is a very honest person".. this came to my mind first smile.gif then he wanted listen our love story a little more.. I started to explain how we fell in love smile.gif) then he got my finger print.. I put my fingers on a small screen.. he said I should press more.. I smiled and said i didn't have breakfast this morning.. he laughed..then I thought how silly I was..who cares if i had breakfast! lol

Before the interview hubby said to me that I should only answer what he asks, don't give more info if he doesn't ask.. but obviously i didn't listen to him much.. ha ha! When he asked me how many times hubby has been in Turkey, I said "It is his fourth time, do you want to see his passport?" He asked me again what I love about hubby.. I wasn't expecting this question again smile.gif) Yes I could say a lot..but when you are on a big exam you can't think properly.. I said "I trust him a lot".. here goes! smile.gif and I said "It will be 2 years in June 2009 we have been together but apart.. I said "Some of my friends said to me how you can trust him, you don't know what he does there (meant cheat).. I told them I trust my hubby!" He smiled at me and looked at hubby and said "now you can keep your eyes on him".. ha ha! visa approved!

great thing is that interview was yesterday and my passport was delivered today.. How fast!!!! We both are so happy and we wish everyone have a smooth journey...

Thanks again to all VJ family!!

congrats, and another congrats for it being such a sweet story and it will remain a sweet memory forever!!!!
me and my hubby are waiting to be together.....
pray for us...........
ill share your story with my hubby lol
happy ever after wishes....

Morning all .

ma wife got latter today from NVC thay say that our case is arrived and thay ask her to pay 70$ so i wana know wht's that mean bcoz we r k3 and k3 dosnt need to pay nothin to nvc so is that mean that ma case change to cr-1 or wht ??
and by da way ma Current Status: Case received and pending.

Well, if you haved filed a I-130 and I129f, then those both will be approved. you will get an approval notice from the USCIS of both of those seperately.
After that, the USCIS will forward both of those the the NVC. And then the NVC will forward the I129f to the Consulate of the country where you were married. which will turn out as your K3. From there the Embassy will send you a instruction packet-reffered to as packet 3 commonly. But during the meantime, the NVC will also progress with your I130 petition, which is the CR-1, if you do not want to progress with it, you can just ignore it, as far as i know and contact the consulate to see how far they have progressed, and just ignore the NVC.

Hope that helps you, also watch for others opinions.

We have a high surf advisory today. So we went to check it out last night and this morning. I told Chris to stand on a rock where the waves were breaking so I could get a picture. He didn't want to. So I called him a sissy-pants. So he did it, and of course right at that moment the biggest wave of the morning crashed up underneath his feet.

So, when do you predict we may get our NOA2? I am guessing mid-April. What do you all think?

My 2 cents - any time between Mid Feb to Mid March, taking into account that VSC is going by I 130 dates smile.gif

I think Serendipity is quite ok with the timeline ofcourse considering that VSC is going by I-130 dates....Still, unpredictable VSC...

In this way, June filers should get started to hear something from Mid Jan to Mid Feb.....I wish!!!!

Let's see how VSC does for approvals in the next 2 weeks, this will really set the tone for future approvals.....if they do as good as they did in Dec we should see our approvals in the next 60-75 days

If they are working on April cases in January, then they will get to late July/early August in April like you mentioned. But this is with the assumption that they continue processing K3 cases in early 09 and do so at the rate of one month's worth of cases in approximately one month's time. Of course with VSC it is impossible to make any kind of realistic projection about their future processing speed. They may very well pick up their speed and do 2-3 months worth of backlog in each month (the best case scenario I am hoping for - especially now that they have offloaded a lot of their I-130 cases to CSC). In which case your approval may come sooner than April. Or of course they may go the other way and put K3 on the backburner once again for a few months (like they did for most of the latter part of 08) and in that case who knows when we will get our approvals.

Deepak

I am glad that I moved prior to filing otherwise I would still be waiting. I filed in July and got NOA2 in October! I am so sorry guys!

I am sure of the fact the USCIS would declare the process timeline something aroung mid may, so that later filers will not complain...however, as of september 30 it is February 26, in that case, as of December 30 it should be June26. But, believe me, it will not happen.

the time line will be something like...

I contacted the Congressman's office and explained that people who filed after me already got approvals. I asked if she could look into what's going on with my case. She was acting kinda nasty. Her answer to me:

"Well have one of those people who filed after you fax me a copy of their reciept of approval. If I have that, then maybe I can help you. Otherwise I can't do anything."

I was like, "Who the hell would give their reciept number to a stranger over the internet?" Then she said, "They dont' have to give it to you. They can fax it directly to me."

I'm so pissed off. Why don't they just tell me to ** off? I would totally respect an answer like that, more than another pile of BS. I'm so tired of BS everywhere I turn.

Dear Narina,

relax..hard to do what I saying ... may sound like BS to u ....but this is fact...the whole immigration process runs on their own, not a single person can come up with a wealthy solution...

And sweetie, I believe u will be done by this week...May be u r one of those like Mamalou of March filer, who got their approval after everyone got...anyways....

I completely agree with you...Please dear VJ members do not get offended ...all I m criticising is about the Bull$hitting system that VSC following that leaving april K3 filers and some of MAY and JUNE, they are rather bz with September through November approvals...well come'n..atleast make sense of something....I love to see everyone here to get approval as deserved...I love when ppl conveys us their good news, but we are human being..not angels, it sometimes hurt to see approvals of the later filers...at the sametime, I smile and say myself that we all don't born with the same kinda fate & fortune....

Yet, I love being here and watch ppl smiling when they get approval, and get ppl who r really on my shoes, who can understand my feelings....

Good Luck everyone....Atleast wish that, Narina gets her approval, then I will start shout for myself, cuz if she does not get hers, then I will not be well deserved....

I know, but for how long? I heard NVC turns out to be slower....I don't know what to do ? How long to wait.....I am simply desperately impatient............

I would really love to dance with you baby...

For your information I just talked to a very nice representative at USCIS customer service. I wanted to share the overall impression of our conversation as I put in words here.......

USCIS representative: Wished me a good morning and uttered those regular queries
After finished
Me: Ok...Sir, I know my process is within the timeline as of the website and I also know u have the same information if I am not mistaken.
USCIS representative: YES!!!
Me: Is there anything else you can provide me with?
USCIS representative: No Mam.
Me: Do you have any idea when VSC gonna update their webpage.
USCIS representative:Actually...No MAM... (he rather answered in our voice, he is as annoyed as we are, atleast it sounded to be)

I got the floor now....

Me: Ok sir!! you sound very nice and decent to me, I really appriciate that, but do u think it is wise to make our spouses to live apart for long time like this?
USCIS representative:No Mam...
Me: (in a smiling requesting voice) Please convey our eagerness for the family reunion to the concerned authority, and that would be very nice of you.
USCIS representative: Of course Mam...that's why we are here...I understand ur situation and realize...
Me: Thank you so much for being so nice.
USCIS representative: Greeted me a good day with a smile.

BOTTOM LINE IS: NO UPDATE but had a feelings that there are some sweet ppl work in USCIS call center.....

HAHAHAHA call me Jen... Esposa de Tucho is Wife of Tucho ( my husbands nick name)

anyway, when I called yesterday, the USCIS doesn't even have a record of me sending a fax with the requested evidence. We sent it on Sunday morning. ELECTRONICALLY !!!
I was transferred to different reps yesterday . Very helpful BUT had no info for me. I will be calling again today and every day until I get the answer I am looking for. They told me when they receive the fax then I should hear something within 5 days . I am sure they will take 10 days or so to receive the info. It seems they always have a way around things. Like how they won't undate the processing times on the website. God forbid they get phone calls from people who are out of the processing times.

My husband is bummed out. He just wants to be here with me. Yesterday his motorcycle broke down and now he needs to take 2 buses to get to work everyday. I feel bad that I can't be there for him.

hey Jen! It just seems like it is one thing after another..... Keep the faith, this immigration nightmare will be over very soon and we will be reunited with our familes.
We need to hook up on FB... we all need to keep in touch such that we can laugh over all these trials and tribulations this time next year smile.gif

You will find me with my full name Sonia Sharmin Diana, in the facebook...However, it is currently deactivated, becuz everyone everytime asks me the same damn question " where r u going to US?" I am tired of this question...I will be back in track as soon as I get NOA2 .... please add me with a small note....
