I think Mommy is right....I found one of May filer of VJ getting approval on Nov. 26. His I-130 was of May 23, 2008 and filed in the WORLD CLASS VERMONT SERVICE CENTER. He also had his 129f at the same time which has no track yet...well well well.....none of my business though I am really curious about the matter that 129f happens to be a faster process, doesn't it? Anyways... No one know with INS thing...God, please help us all....

Dear VJers, I feel that, this happens to be my most frustrating period of life....This long distance relationship is turning in worst pain of life...I may not let my children to get married outside where they gonna live!!! But, for the time being I can't even think of a child..lol.......

Many people on VJ have different thoughts about this matter.

We didn't send any photocopy except passport biographic page and didn't get an RFE

We also wanted to send them photocopies but when we talk to NVC they replied they don't require (why they are charging $400)

all this confusion is because they require photocopy of passport biographic page. Call NVC and conform for yourself and post here.

let us see what's your experience says.

I actually received my paperwork (AOS Fee and a copy of the DS-3032) before my wife, received, hers, actually she still has not received her packet (DS-3032) yet. Once I received my packet, we emailed NVC the information in which they just accepted (DS-3032) and I paid the AOS Fee online, but only after I received my paperwork (petitioner). The package the petitioner receives tells you how to pay online but emailing the info in regards to the DS-3032 I got from the Le Ching (whatever it's called) method, which really works. You should start gathering your documents you'd need to send with your AOS package and DS-230 package while you wait on your petitioner package, this will only shorten the time you spend looking for the documents you'd need to get through NVC, once you get each package, all you have to do is fill out the forms and attach your documents and mail it off rather than waiting on everything. Start requesting your tax transcripts and letter of employment now. Good luck to you.

Well...It took a while for us..don't panic...Although it is easy for me to say don't panic but if it is lost what can u do? Nothing...Just wait and chill...keep looking at ur mail box....By the way...I am the beneficiary from Dhaka, Bangladesh. I never got any posts sent by NVC...Seems like Choice of Agent form and IV instruction packet are lost...It is been 6 weeks I have not got anything so far..Good thing is, u never have to wait as soon as u get ur AOS bill containing the IIN (Invoice Identification Number)...That is the most important...

Though my interview was at 9: 45 we reached the embassy around 7: 30. and were asked to enter around 9: 15..... Was issued a Token.....Waited in the Lounge with my Fater in Law....then both of us went in to to the counter assigned to us...gave my Medical Report nad Passport.....

She did not ask for the VFS recpipte or the 2007 1040 that I was supposed to take for the interview, did fingerprints and was told to wait

Went to the second window....An Indian with an Amerixan Accent talking in Hindi:)

He asked me if the Pic was mine....Asked my FIL to wait......Made sign the DS3032 part 2......and swear what all I had written was true and asked the following questions


1) Who Lives in USA
2) When was the first time you met
3) When did you get married
4) How many people came for the wedding
5) When Did he go to USA
6) What does he do
7) Where does he live
8) Where did you meet
9) Who all where there when you first meet

Thanks Mam, you will get your Visa in 7 days

Thats all....no pics....no records...nothing.......

But I suggest that you be polite and stick to facts and check your paper work anyways because there was a girl who was put under AP cause in the process of convincing the counsler she put her foot in her mouthhe doubted if there relationship was genuine or not

I really don't think religion has anything to do with it nor does country of origin. The USCIS recently released statistics on permanent residents who came to the USA in 2008. Majority come from Asia - approx. 33%, Africa 12% and Europe15% (Europe includes middle east), The America's about 40% and wait for it..................Only 0.3% from Australia! Yes you read correctly, ZERO POINT THREE PERCENT - THATS NOT EVEN 1%. And most of us Aussies are of a christian denomination.

So I wouldn't worry about AP....just be glad that they are letting your people in! Religion has nothing to do it - besides, they do not collect this information on any of forms that I have filled out!

Remember, the USA is a predominantly Christian nation after all and they have the right to do whatever they want. If the shoe was on the other foot and a Christian applied to immigrate to a non-Christian country, would there not be some scrutiny there? Particular in some parts of Asia, some catholic asians are persecuted for there beliefs.

Just my two cents.....


Well...I do clearly understand what u meant... So tell me something, do u have any idea how many ppl get immigrated to ur country(Australia) each year? It is nearly twice as much as the US immigrants. But, why don't u have anything like AP (Background check, Name check)for ur immigration purpose? Why is it like, fill out some immigration papers, wait, give the fees, have ur visa w/o any hasstle and fly, then live in AUSSIE happily? No Muslim, No Hindu, No Christian can point out any specific procedure on ur immigration process saying"YES! Here is I am discriminated(Of the record)". So, how many terrorist attacks do u face in ur country for having immigrants with no back ground checks/name checks each year? I can't even see one from here.....do u?

I completely agree with WhidbeyGirl that US govt. is more concern about the national security and undoubtly it is more likely to affect muslims and more specifically the males than any other...But lets just hope everything goes smooth and sound and we all are reunited with our spouses with a shortest amount of time.

Appriciate ur appreciation brother... Well... One more thing, I went through the embassy/consulate review and it more likely seems to be a review for K3 visa...

As u know, K3 and CR1 have two different ways of processing. K3 is not scrutinized by the NVC, while for CR1 u have to pass through NVC, and perhaps an AP if needed. I won't say u will not have any checks for the visa, but give ur best try.

Close ur eyes and listen to ur heart...Simply listen to what it says...

Well, no one here can give a garuantee to u for the issuance of ur spouse's visa. About going for the interview, it is always better if u somewhere near to ur spouse (even if the embassy/consulate don't allow u right at interview window). It is considered as the eagerness of the petitioner to have his/her spouse by her/his side as soon as possible-a way of proving bonafide marriage. And I am really not sure about what u r saying "USC spouse is a male and a Muslim, they could extend the background check"- as far as I understand, the back ground check after interview is mostly on the beneficiary. As USC, DOS and FBI knows everything about u, these checks are mostly done when the case is under USCIS and NVC..But I am unsure of this issue though...

My husband is coming too for my interview...Although we know I may not get visa right after my interview...But giving the best try for it, so that we don't regret later.

My comments won't change anybody's life anyways, it is what it is, it will be how it should be.....

Even the USCIS timeline justifies my comments whatsoever made earlier.....

Beside, none of us here fall under the category where we have to wait our priority date to become current....Thats a reliefe we din't had to wait at NVC....

Upgrading a Petition - If You Were an LPR and Now are an American Citizen

If you filed a petition for your family member when you were a lawful permanent resident (LPR), and now you are an U.S. citizen, you must upgrade the petition from family second preference (F2) to immediate relative (IR). You can do this by sending proof of your citizenship to the National Visa Center (NVC). To prove that you are a U.S. citizen, you can send:

A copy of the biodata page of your U.S. passport; or
A copy of your certificate of naturalization
Important Notice: If you are now a U.S. citizen, you must file separate immigrant visa petitions for each of your children. If you upgrade a family second preference (F2) petition for your family member and you did not file separate petitions for your children when you were a lawful permanent resident (LPR), you must do so now. A child does not have derivative status in an immediate relative (IR) petition. This is different from the family second preference (F2) petition. A child is included in his/her parent's F2 petition. A child is not included in his/her parent's IR petition.


My question: For the bold part, please tell me, why it should be sent to NVC not USCIS? Does not it imply that the file is more likely to be in the NVC's hand?

What Does the National Visa Center Do?

After a Department of Homeland Security, U.S. Citizenship and Immigration Services (USCIS) office in the United States approves the petition, it sends the petition to the National Visa Center (NVC). When an applicant's priority meets the most recent Qualifying Date, the NVC will contact the applicant and petitioner with instructions for submitting the appropriate processing fees. After the appropriate processing fees are paid, the NVC will again contact the applicant and petitioner to request that the necessary immigrant visa documentation be submitted to the NVC. Outlined below is a general explanation of the NVC visa case pre-processing and descriptions to help you better understand the steps involved.

My Statement: Ok...Here is the confusion might occur. I have known quite few members waiting for NVC to provide them with AOS and DS 3032. And if a petition gets approved earlier, then it is sent to the NVC by USCIS, and when the priority dates comes near to current and NVC starts processing the case. This mostly happens with the spouses of PR of US.

This thread was created becuz one of the members got email saying

"Unless an adjustment of status in the United States is requested, after approving an immigrant visa
petition filed in the United States, the U.S Citizenship and Immigration Service (USCIS), forwards it to
the National Visa Center (NVC) where the State Department's immigrant visa process begins. If the
petition is for a visa applicant whose priority date is not likely to be reached in the next year, the petition
will be stored at the NVC until that priority date is reached.
When there is an immediate visa available or likely to be available within the next nine months, NVC will send a letter enclosing the Choice of Agent and Address Form (DS-3032) to all of the applicants
with a few exceptions. The DS-3032 will not be sent to the applicant when an attorney represents the
applicant (and the CIS file contains the appropriate designation that an attorney has been retained) or
when the visa applicant will be the adopted child of the petitioner. "

So, it is not saying an interview date to some specific consulate or something....This itself is self explanatory. Please read it carefully. This is not my thoughts.

This part is done with USCIS not with NVC, USCIS don't send your papers to NVC until your status is Current. When you get NOA2 from USCIS your are current.

Well... I don't agree with that....USCIS approves ur petition and sends it to NVC. It is then NVC who checks for ur dates. If it is not current, they keep ur file with them until ur priority date gets current. And this mostly happens with the ppl of green card applying for their spouse, USC applying for their brothers and sisters and few more categories.

From my understanding, if u r applying for ur spouse and u r permanent resident not a US Citizen, u r given a priority date when ur visa is available to issue. It may be 6 months later or may be 2 years. U have to wait until ur priority date gets current.

So the thing is, if u r a US citizen, and applying for ur spouse, u don't have to bother about that clause at all, cuz ur priority date is ur date of NOA1 received, which is current and ur visa is available right after NVC recieves the approval..

So don't worry if u r USC and applying for ur spouse, just keep following the instructions given by the NVC to complete ur case.

It is enough to carry the photocopies of the documents and the forms that had been submitted to NVC previously.

Althought it is not needed, if u want to be in the safe side, u can prepare another DS 230 form signed by the beneficiary.

Fill out the forms and send it. You may get an earlier date for your interview. After u pay IV bill, u don't have to pay anything for the visa purpose. But for the medical, I am not sure.

Blue 123....Please don't think u have lied. Cuz, at the time of interview u will be able to present all the original documents, does not matter if its sent by NVC or carried by u...Regardless the fact u r goin for K3....So, I don't see any lies here as long as I have it and being able to present at the time of interview...

We scheduled you for a K3 visa interview on April 29, 2009 and we issued the appointment package (Interview letter, list of documents required for interview, form DS-230, medical instructions and photograph instructions. If you do not receive the interview letter by March 29, 2009 you or an authorized person can come to the Consular Section on any working day (Sunday-Thursday) between 8.30-9.00 a.m. with a copy of this e-mail and we will hand deliver the interview letter.

He he he...This K3 became absolute worthless...One reason is that we applied shortcut Methods at NVC which made our CR1 move faster than the embassy...Anyways....Atleast I don't have to deal with the flip issue(Although I really wanted an earlier date as I submitted the K3 packet way earlier than we were completed the NVC).

I called all day yesterday and got the same thing, that NVC is closed. I believe it is due to the bad snowstorm they are having right now...so hopefully they will be open today! I am waiting for them to receive some paperwork my attorney sent in and I want to make sure they get it!! Darn snow!




when you send the papers to the embassy did u have to send all the originals?
are they going to send them back to you?
arent they requiring originals for the interview also?

you need to submit originals 1 set and photo copies 1 set to NVC. also it is suggested that you take a photocopy set of everything to the interview (for CR-1) just in case something gets lost by NVC.
And yes club you need to obtain a CENMAR from NSO. We went to the one here in Iligan and got it the next day after we applied.

Also make sure you document the fact that you are a student right now. A student right now means you have a way to upgrade yourself in the future, right now you may be earning only 10k a year but once you complete your studies, depending upon whatever you are studying will show that you are on your way to earn 40k or whatever per year.

Do remember that you will also have to file i-134 or i-864 (depending which path you are taking, k-3 or cr-1 respectively). So you will have to document why are you getting yourself a joint sponsor.

somethin struck my mind tonight, i thought it would be better to have sum opinions about it. to tell frankly right now im not working a REAL job, i am in collee work study which is not that much, my husband works and sends me money o also get food stamps etc (i am the usc). my husbands job isnt a big big one its just a job kinda thing so he actually doesnt hav assets to show. i am going to get someone co sponsor HIM. now my question is, are they goin to raise the topic of who is supportin me??i get help from all over now and there is no particular MAIN source. how many peple should be counted as my co sponsor supportin? he isnt married has no dependents. i am just wondering if my tax papers(which show very little income) make them wonder who is supportin me and put us in RFE or AP????
