This wouldn't be in his police record--which would be a record of prior convictions. What if he has no record at all? I think that would give a false impression of the situation to the OP.

I was just wondering if they continue to update our cases on the USCIS website after the NOA2 approval. Do they update it when it arrives at the NVC and when they send it to the embassy?


NO, one of the reasons being is that the USCIS is a part of the Department of Homeland Security and NVC and Consulates are a part of the Department of State.


How do people no when it arrives at NVC and then sent to/received by the embassy/consulate? Do we have to wait till we receive the Packet 3 to know where our file is?

I've been waiting for my NOA1 for a while now. I called my father back in the States this weekend and he goes something like, "Oh yeah, you got something in the mail from the government about a week and a half ago." Arghhh!!! I would think something like that he would have emailed me about since he knows we are going through the visa process.

I guess they don't send them overseas and sent it to my permanent address. Good thing my father is still there every other week or I might have ended up waiting for the NOA2 for a long time in the future.

CanadaProving domicile when not living in the U.S.

I have read the first six pages of this thread and this domicile business has me scared.    I have lived in Thailand for ten years and married for five.    My wife and I have no children of our own or assets to brag about.     I've voted in the past presidential elections and I have filed taxes every year that I have been in Thailand except for the current one.   My CPA has always told me that there was no need for me to file taxes since my income was below the poverty line. Naturally, I have a joint sponsor who has provided me with all of his financial details.    I plan on living with some relatives once I get back to the states and our feet on the ground.     What more can I do to prove my intent of re-establishing my domicile?

My dad listed his wife as a person who had income under section 6 item 6.a of the I-864 form but left blank section 11 and 12.    Section 11 asked if the person listed in 6.a completed the I-864A form and section 12 states that the person is not required to to fill one out because he/she is the intended immigrant.  Can he leave both of these blank?

great forum guys.     My I-130 was approved in bangkok and I am having a little trouble with the i-864.   I've lived in Thailand for ten years and have been married for five years.  I have filed taxes stateside back in the state each of the previous ten years except for the current one even though my income does not meet the poverty level set forth by the IRS. This meager income will not carry over when I move back to the States.    My dad has agreed to sponsor my wife and he sent his filled out i-864 form with him as the joint sponsor. Other then his tax returns what documentation does my dad need to submit?   Will a copy of his passport/birth certificate be enough proof to establish that he is a citizen?    I figure that I will have to fill out an i-864 as well but I am stumped as to what to put in for my income.   My earning are in Thai Baht.  Hopefully, I will secure a better paying job once I am back home but that is not the here or now.

I am quite familar with that page and it's a problem that has been gnawing at the back of my mind for some time now.   I've been in Thailand for ten years now and married for five.    By no means am I a well off individual with alot of assets.   As much as I would like to I will not be opening any account with Peter Schiff or buying real estate.    Nor will be able to enroll childen into school since we have none.   We have family members who will shelter us until we are able to get on our own two feet.   That's not a problem.   About the only other thing that I can think of is my voting.

you'll see there's a section about domicile and the fact that you have to show either:

1. proof of USA domicile or

That's the safe way.  You COULD use Dad's income alone and then document it but quite often the Consular Officer will request the I-864a from the spouse anyway.  The real reason is that, because they are married, Dad alone signing is committing the joint assets to repay the government for any potential benefits.  The purpose of the affidavits is not limited to showing the ability to support somebody.  It's also a contract to repay the governent for means tested benefits ever paid to the immigrant during an extensive period of exposure.  Married people are responsible for each other's debts, so asking them both to sign for a contract obligating marital assets is "prudent".
 

 

That depends on which state you live in.    In a handful of states "community property" rules, most debts incurred by one spouse during the marriage are owed by both spouces.  But in states that follow "common law" property rues, debts incurred by one spouse are usually that spouse's debts alone, unless the debt was for a family necessity, such as food orshelter for the family or tuition for the kids.   These are the general rules as some states have subtle variations in how they treat joint and seperate debts.   My dad and I are fully aware of the purpose of the affidavit and the consequences should my wife require financial assistance from the government

One last question that should not cause to much controversay.     Would I list the country of domicile as Thailand as I have worked here for ten years and explain in an attachment that I will be moving back with my wife once she is approved?   Should I include a photocopy of my current workpermit and copies of my prior visas in my passport for the duration of my stay in Thailand?

so, for I-864 stuff (hello to all, btw)

must show:

 

1.  prior years income (3 years) via

.....a.  Full Tax Return Documents (1040, W-2, Schedules, Forms) or

.....b.  Tax Return Transcripts

2.  current annual income for 2013 via

.....a.  Employment Letter from Employer or

.....b.  Paystubs or

.....c.  Audited Quarterly Income/Loss statements (plural) from CPA's office (If a business)

 

When an income tax return is filed jointly, the spouse must also prep an additional I-864A. 

 

That's it, in a nutshell.  I pray you have a good nutcracker, as I know the spoon is big.

Form I-864A may only be used when a sponsor's income and
assets do not meet the income requirements of Form I-864 and
the qualifying household member chooses to combine his or

If you present a tax return, instead of an IRS transcript, you must include a W-2 as it is an integral part of the tax return. This is because anyone can fill out a copy of tax return and not necessarily file it, so you must include W-2's. A W-2 is not the same as an employment letter (which is easy to "fake"). The rules are what they are and you are wasting time by trying to go around them because you don't have a needed document (W-2).

The phraseology of the statement quoted does not suggest that W-2's may be optional. They are not optional if the worker received one. If the income was from self employment rather than wages, then the taxpayer would have filed a Schedule C and he would not have a W-2. This is what your quote refers to when it says "supporting schedules and/or W-2's". So it is either/or/and depending on how the income was produced.

BTW, your sponsor should be able to easily get a W-2 from his employer. If he says that he can not, then something is wrong.



 

I will probably be doing an DCF filing with the Bangkok Embassy.  The instruction booklet that i downloaded from  the embassy  website states that all I need is an employment letter.    I have quoted directly from the booklet and attached it on a previous post for closer inspection.    No where does it mention a w2 form. I had my dad get an employment letter to satisfy the requirement listed in their booklet.     It was not an attempt to somehow skirt the rules.     I am merely trying to follow them exactly by crossing every "t" and dotting every "i".        IAnyway, t's 2:00 am sunday morning for me.   Perhaps a good night sleep will clear my head a little bit.

i've seen that checklist before though I am afraid that it does not answer the question that I posted above.    The relevant parts states the following:

 

IF you paid U.S. income taxes, you MUST submit a copy of the most recent federal income tax return with all supporting schedules and/or W-2s, or an Internal Revenue Service (IRS) transcript (even if the sponsor filed electronically). To request IRS-generated transcripts or copies of a tax return, visit the IRS website.

Schedules are additional forms you file with the IRS.  For example you fill out a schedule C for profit/loss. 

 

Thanks for the clairification.  My dad sent his tax forms and his schedules but not his w2s.  Would that be sufficent?  I am a little shy asking him for anything else and I would like to get the ball moving for my wife.

Yes, your stepmother should complete an I-864a.

 

Your current income for the I-864 is zero because it won't continue in the USA.  In the past income tax section of the affidavit list the income I indicated from past tax returns.  If your income was below the filing threshold, simply hand write in that section.  "N/A Income below filing threshold."

 

Does my dad have to list her income at all and forgo the I-864a altogether?  His income was in excess of 100k which is by far more than sufficent to sponsor someone.   

 

I believe that that every year that I have been in Thailand I have been below the threshold.   Would I write "NA: incole below filing theshold" for ever year and add a copy of the 1040ez as addtional proof?

The I-864a is for combining income.  The OP has no income to combine, so the qualified joint sponsor provides an I-864.  The petitioner can simply indicate they have zero income currently, since their income will not continue from the same source once they come to the USA.  In the past income section, indicate either the adjusted gross income from past 1040EZ forms or line 22 "total income" from past 1040 forms.

 

My father listed his wife income on the I-864 that he sent me though his income is more than sufficent to sponsor.    Should my step mother fill out the I-864A form if her name is listed on the I-864 form that my father sent?  

 

None of the ten years that I have been in Thailand have I been required to fill out an 1040 EZ due to my relative low income.  I have filled out for 9 years though this current year I did not file.  Would I give a rough approximation as to what I earned last year on the I-864 form and use line 22 on the 1040 for the prior years?

In the Execution of Affidavit of Support,(I-134) it says “If you are sponsoring more than 1 alien, you must submit a separate form I-134 for each alien”….

My fiance is petitioning me for K1 and I have a daughter who is coming with me. Would that mean, we have to submit two sets of form I-134?. Please anyone, enlighten us about this.

This is a call that must be made by the consular officer conducting the interview. They may be reluctant to consider a few pay stubs if the work is part time. If he can get a letter from his employer stating what his sustained income is expected to be, and if that income is comfortably above the level required for his household size, then it may be enough. Otherwise, you might be better off getting a co-sponsor.

The safest route would be to get a co-sponsor anyway.
