What the I-134 instructions say is not relevant. I-134 does not dictate what evidence needs to be provided to meet the public charge provisions of the law, and is itself optional for that purpose - not required unless the consular officer wants it. (Granted, they usually do want it.)

I-134 is the tail, not the dog.

The anecdotal evidence is that the tax returns do not have to be notarized, despite what DS-2000 says. Maybe they did have to be notarized at one time - comparing a present day DS-2000 to a decade old OF-167 (some consulates still give out OF-167) shows no changes. I did not have my tax returns notarized.

But I thought you asked about certified copies?

I did ask about certified, but you said they were interchangable, so I just started saying notarized.

So, what I have are: my own, uncertified, non-IRS transcript, unnotarized, original and copied tax returns with the CPA's signature. I hope this works. If not, I'm bringing a bunch of other #######.

That's cool! I just read something and then have to dispell it. I've personally never heard of certified copies for tax returns.

I did however read on the 0-167 that it says Notarized copies of tax returns. Does everyone get this 0-167 or is it just something from Poland?

I know, I know... not another I-134 question. Sorry! so here it goes.

I'm going to present my 2005 tax returns as proof of income, with other things as well. I only have my copy signed by the CPA at the time the taxes were completed. I do not have IRS transcripts as I don't have time to get them. I'm leaving on Friday for Poland.

I've read that it's suggested to get IRS transcripts, but not required. I also read that the returns had to be certified, what's that all about?

Will my copy be sufficient?

I know this is Consulate sensative and I've alread PM'd some VJ friends from Poland for there advice. I just wanted to get a general idea if these are the basic steps in completing the medical stuff. Thanks.

Medical Examination Notes


General Notes
1.All you need is a passport, case number, and priority date to get started.
2.You do not have to wait for packet three.


Step Number One
1.Contact one of the accepted doctors and ask what is needed at exam.
2.Find out if we can schedule the exam in 2-3 weeks.
3.Contact Ania’s current doctor and gather all of her medical records.
4.Make sure she has had all of her vaccinations and get the vaccination report.
5.Get any vaccinations completed that is needed.

Step Number two
1.Go to Krakow and get the X-Ray completed.
2.Go to Krakow and get the Blood tests completed.

Step Number three
1. Attend the scheduled examination with all the needed materials.

From what you explained, she never changed her domicile to the U.S., keeping her domicile in Poland, but she has lived there for 6 months (residence). I wouldn't put "none", but the address she had in the U.S.


yes, she lived at her sisiters house for the six months she was visiting the states. I guess it doesn't hurt to put that there but she has never had a change in domicile and that's what I figured thw question was asking.

It depends on where you are in the process and what is needed at the medical exam for the country in question. Some countries you need the invitation letter while others you don't even need the case number just the passport number.

Also you can get everything done in one day in some places. I know that for us in Poland we did everything in one day and weren't even asked for the case number. They just need the passport number to put on the X-Ray.

Sometimes it's best to find the answers to your questions by calling the Embassy in which you are using. Also, go to the Embassy website and find out what doctors are able to perform the exam, call the doctor who will be doing the exam and find out what's the best way to do it. Ask them what you need.

The results of the exam are good for 6 months in Poland, I think.

So find out what the case is for you. I wouldn't wait last second though, as something could go wrong. You could be late, the electricity could turn off, you get the picture!!

We go through so much to finally get to the end.

First we study the process, study immigration laws, gather proof of meeting, fill out the forms, sweat whether or not we filled them out right, check the case status everyday, jump for joy with our NOA1, then really sweat whether we did everything right, call the USCIS, call congressman, worry what's wrong, then we get those 5 or so e-mails "NOA2 approved (some of us) and it's like the world has been lifted off our shoulders!! what a feeling!!

And guess what?? that last's about 5 minutes. Then we start to wonder when it's gonna get to the NVC, we call to see if they've got it, we wait and wait, then we hear the good news, forwarded to the Embassy "oh my god, oh my god" this is so great!!

But... that lasts for about 5 more minutes. Then we really figure out what this is about!! holy Sh!t, what now!! need to fill out the I-134, need the proof of relationship, need to fill out the paperwork correctly, when will she/he get packet 3?, what about the medical?, gotta get the police certificate, did I remember?, did we do this right?, when will she get packet 4?, I hope everything is ok!! and then... you get the interview date!! yes, yes, yes!!

and then.... you realize that it all comes down to the INTERVIEW!! dum, dum, dum.....dum~~~~~

All the love and all the tears come down to one day, your proof, a couple questions, and whether or not another person who's never met you and your fiancee before, believes you have a real relationship.

I don't know about anyone else but my fiancee is crawling up the walls with nerves. What a scary feeling to realize that it all comes down to this. How much pressure will you put on yourself, how much stress can one person endure??

Well, I can tell you this!!

Just be yourself, tell the truth, and have the confidence in knowing that you are one day!! one day!! away from ending the madness!! one day away from being with your loved one!! one day away from making all your dreams come true!! and anyone would be crazy not to believe your relationship is valid!!

Then you'll hear those wonderful words!! your visa is approved!! holy sh!t!! what a day that's going to be!! the best day of your life!! for sure!!

And remember that USCIS is giving the only solid unbiased information. When there is an update or when there is something to post, they post it.

Congress will be political about everything and start petitions and lead the way for immigrants everywhere. They will be for or against the act however they feel will get them the most votes!! they like to twist things into there perspective in order to get you on there side!!! I hate politicians!!!

Lets just stick to what USCIS is telling us, because they are the ones holding the cards!! no one else!!!

that's good you clarified that "they" was her congress woman. I was a little discouraged after reading the same post. I really doubt congress will know anything before USCIS does, there in the dark as much as we are!!

just goes to show that the only solid fact in this whole thread is nobody has any facts... and the good news about the I-129F draft that should give us temporary relief after the emergency review.

USCIS knows they have to do something and is taking emergency measures.... that's the only news folks!!!

I agree with the fact that we need to just deal with it!! IMBRA is here for us to deal with. We should becareful not to get confused again or to run in circles. If you read this thread you will see us running in circles. The fact is, there's is a draft, USCIS is working on things, and there's nothing we can do about it. I do however think that we have been making a positive effect on our situation by causing a stir at USCIS. I think all of our inquires, phone calls, e-mails, and congress help has pushed the USCIS to move faster. So, keep up the good work!!! One way or another, the process will move forward.

And in my own personal opinion, however small it is, we will have answers soon!!!!!!!!!

Well, that's great that everyone could help me to understand what I was reading better. I hope I didn't stir up to many emotions. I think that 30 days sounds a hell of a lot better thatn 90. I'm not sure if anyone has read this yet or posted it. I was searching "IMBRA on the www.USCIS.gov site and came up with an interesting supporting statement. Try this link and see if you are able to read the form.

Go to line 8 and tell me what you think of it

From what I read they posted a notice in the Federal Register on May 26, 2006 requesting emergency review by OMB for the revisions to the form I-129F. They gave a 60 public comment period followed by a 30 day review of comments period.

So, included with the 4 subjects is the new draft of the I-129F and information about the paperwork reduction act.

Well, I conclude that the I-129F draft was posted on 6/1/2006 for 60 public comment to be followed by the 30 day review period. This could potentialy mean a 90 day delay from yesterday.

Now, I now we heard about the June 6 deadline from the lawyer and some other opinions which point to something faster (we hope) and I don't mean to give bad vibes. I am just looking for answers like everyone else and came accross this. Can you look into the form and tell me what you think? and if this is old or wrong information than I give you permission to slap me for the scare!!

Well, from what I read it all seems pretty straight forward. If you have been convicted for any of the mentioned crimes you need to provide police records with the petition. This information will be provided to the beneficiary for awareness. I read a post earlier asking if the government would be denying approval based on past convictions. I feel this would be highly unconstitutional and would create a huge uproar for later law suites. Thus this information is to be provided to the beneficiary for a better clue as to the person she is getting involved with. "we as americans have the right to marry whom we want" regardless of any past crime or conviction. From what I read everything should be picking up again soon.

I have a question: I have had 3 DUI's, 2 convictions and 1 PBJ. I wonder if I should just send in a complete criminal background check with all charges and outcomes ever had, just to be on the safe side, or should I just not send anything and not check a box on the petition. I am one who likes to cover all his bases but I wonder if there is such a thing as too much information. I dunno!!!

Well, this all sounds pretty good "I think". I'm not sending in my petition in until after June 21st!! so I hope that everything will be resolved by then. I have never seen a better group of detectives as there are on this sight. From what I've been reading they should have new forms out soon and the processing back up to speed within a month, correct?....................just looking for something to make me smile!!! Hi everyone,
I know I've been beating this site up with criminal history questions that no one really has an answer to yet, but here is another one. On the I-129F instructions for filling the form it states to include all court and police records showing charges and disposition. On the acctual application it just asks you to attach a separate piece of paper with information relating to the crime involved, date of conviction, and sentence.

I went to all the court houses and got certified copies of the records. The records show the Case history, including all charges, dispositions, dates, and sentences. Plus I'm going to attach a separate piece of paper explaining it all. Plus I will send any copies of original charging papers and whatever else I can dig up.

My charges all stemmed from Part C: question #3: alcohol related

Do you think this should be enough for the USCIS?

I'm in the same boat as you are. I went to the court house and got the certified copies and attached a letter of explanation (crime involved, date of disposition, sentence, definitions of dispositions PBJ etc.., definition of the crime) that the application asks for. "Using a separate sheet(s) of paper, attach information relating to the conviction(s), such as crime involved, date of conviction and sentence."

I send my application in without the police record since the application is asking for proof of charges and disposition which the court records show. I sent the application in without the police records because it takes several weeks to obtain copies which have to be requested in writing for the state of Maryland. Also one of my charges was given by the State Police and there record takes a month to get.

I figured I would take a shot at this being enough information and get the copies of the police records in the meantime in expectation of an RFE. I could either wait a month to send in the application or a month for the RFE. If they send an RFE I'll be prepared for a quick response back and an expedited processing of the RFE.

The truth is no one really know's how there going to handle this new law, we are kind of the ginnie pigs. I'm sure people will be interested in the turn out of our applications. I asked the same question as you and the majority of the people here at VJ suggested I give them what they ask for.

In all honesty it only takes a couple of seconds to obtain a free criminal backround check on anyone. USCIS could simply punch in your name and have the information at there fingertips. I'm sorry but it doesn't or wouldn't take any amount of extra man power. Just give me your full name and the State you live in and I could get your complete criminal history in just a few seconds from the internet, it's a matter of public record.

So, it's best to be honest as far as the convicitons are concerned.

However it does state 3 or more, so you don't need to mention anything.

I have no opinion on how to answer the IMB question.
