I believe it doesn't apply to any of us, Andy. K1s are non-immigrant visas. Also, should it be an option, I guess it would be up on the consulate website, right?

I checked the Tokyoo embassy site and there is an entirely different procedure for K1 applicants.


Maybe it doesn't apply to us. I thought I was going to skip out on 3 weeks :dance: but not happening :( Warsaw's instruction packet includes a WRW1 which is returned a signed. Oh! Well!!

I read this and got a little excited!! it has to do with opening a provisional file at the consulate after NOA2

o OF-169 - if you already had your fiance(e) sign this during your meeting, include it here and this will save you about 3 weeks. Be sure to state your receipt number or ARN number on the form and check the applicable boxes. The OF-169 isn't required to open the provisional file, and if you choose to include it here, you can basically ignore Packet 3. Also, Warsaw will accept a mailed or faxed OF-169 from either you or your fiance(e).

I'm trying to get a copy of this form from the net. Anyone know where I can find it?

yeah! William I agree. I would like to point out that I don't know what you will need in your particular case. You need to figure that out by learning more and seeing what you have to show for income. If at this point you see that you won't qualify, look into a sponsor. I'm not saying that you surely need a sponsor.

Listen, you really need to think ahead in these cases. I'm not trying to scare anyone, not in anyway. I'm just trying to help you down the road in avoiding a mess. Getting approved for the K-1 only allows you to enter the country for the purpose of marriage. After marriage you will need to file AOS which has much stricter guidelines and requires much more evidence. You don't want to waste an approval, come too early, and then get denied AOS, and have to leave the country. You might want to learn more about what AOS requires for income. You also may want to look into a sponsor.

Just making you aware of the big picture.

I didn't file my taxes yet for 04 or 05. I plan on doing it shortly but haven't yet. I know you need this for the I-134. Do they check this kind of stuff at the service center level? do they deny benefits for not filing? I was just wondering. I guess I better file and get it over with. Need it for the rest of the journey.

Can you tell me if I've got everything covered and this is the order I should do things. I gathered information from a website and this is what I came up with. Please check and see if I missed anything.

Steps For Consulate

1. Once the consulate receives the approved petition, they will send an “Instruction package (Package #3)
2. Immediately return the following documents:
a) Completed DS 230 Part 1
B) Clear Photocopies of the biographic data page of your passport and the last page of your passport which contains your parents/spouse’s names, and any other pages which may indicate any change in name/date & place of birth/marital status
c) A complete copy of your passport (all pages) and the “applicant’s Statement” sign and date it, and return the checklist to consulate.
3. Mail all this and the checklist back to consulate immediately

4. Then they will mail Package #4 with the Medical Examination information
· She will need records for all vaccinations done
· Must have her passport
· 3 identical passport photographs
· Need the appointment letter

Interview

1. In packet #4 there will be the Appointment Letter
2. Make sure you have the following documents
· DS-156
· Medical Examination Report
· Birth Certificate (Long Form)
· Police Certificate
· Visa Fees $100.00
· Completed DS 230 (both parts)
· DS-1858
· DS-156K
. I-134
· Complete copy of fiancée visa petition
· Letter of intent to marry and continued intent
. Appointment Letter
· Proof of Relationship
Ø Correspondence between us, Letters, e-mails, IM's, phone bills, post cards, and cards.
Ø Photographs taken together

1. What letter is this - something specific to the IV post in Poland?

2. Many employers have a letter that their legal counsel has approved for confirmation of employment. If not, they can simply take the list of what information is should contain and expand each item into a sentence. *(The DoS will not grade you on grammar and composition of the letter.)

The letter is just something that I've been coming accross in others lists. the Guidelines of VJ mention this letter for the I-134

Who is "you" - the petitioner or the benficiary? Remember, for the visa application it's the visa applicant who they're primarily interested in.

What may be requested of you, the petitioner, is a statement confirming that you continue to be free and wanting to marry the visa applicant, particularly if it's been a long time since the petition was submitted.

Well, that's a good question. Should the letter be written by me the petitioner or by the Beneficiary. I'm going to the interview so we will be together. Maybe we can both write a pre draft and then write our own based off of that.

Well, I'd like to save money on the pictres if I can. I keep all my pictures on my computer and I don't want to go crazy on the pictures if I don't have to because I need to print them at Rite Aid. Maybe I can print some on paper as well.

I'm going to Poland for 1 month on October 13th to see my baby. I have all my income documentation prepared now for her potential interview. If things go smoothly for her petition she could have her interview in 8-9 weeks. I'm thinking about just extending my trip out to her interview date.

The only problem I see with that is the fact that I'll have all my letters and last paychecks dated from two months prior to her interview date. Do you think this is going to be a problem?

I'll have:

2005 tax return
2 years paychecks
letter from employer
401K statements (minimal amount under $10k)
Verification of Employment (as a lender would ask for)
last 2 years W2's

Maybe I should get a letter of continued employement upon my return from Poland?

What do you think? problem?

You don't have to do anything.

Signing the affidavit just affirms those 3 questions that are in that section.

I have no idea though what it means though. It's probably legal mumbo-jumbo for something they can nail your hide to the wall with......

This document isn't the one that binds you to USCIS anyway. It's the I-864 you file later on that does.

Somebody else is going to have to explain why, cause I don't know. I just know that it isn't.

need to be notarized as the purpose is a witness of siginiture.

I don't know. I've contacted the consulate in Rio to know how long I-134 and the supporting documents were good for and they said "a year" - but I've heard that some other embassies/consulates will say 3-5 months. But then again, I had them dated a month or so before the interview. Why don't you contact Poland and ask them? And... are there any other VJers going through Poland? Have you tried the regional forum? At this stage, getting input from them would be important.


It's been suggested that I go to the regional forum before, maybe I'll take the advice this time. I just don't think that there are many going through the same Embassy. I know of 2 people who have been helping me through PM's. I'll try. Thanks Mew.

Aaaah. I don't think he'll say that you will always have a position there because there is no way you know that. Do you agree? I'd rewrite it like this:

I did ask about certified, but you said they were interchangable, so I just started saying notarized.

So, what I have are: my own, uncertified, non-IRS transcript, unnotarized, original and copied tax returns with the CPA's signature. I hope this works. If not, I'm bringing a bunch of other #######.

So the Embassy in Warsaw say's the following:

Documentation regarding financial support can be in any form so long as it contains enough detail and information for the consular officer to conclude that the beneficiary will not become a public charge. Petitioners may submit the "old" Affidavit of Support (form I-134) if they wish.

I guess what I have will be fine.

What the I-134 instructions say is not relevant. I-134 does not dictate what evidence needs to be provided to meet the public charge provisions of the law, and is itself optional for that purpose - not required unless the consular officer wants it. (Granted, they usually do want it.)

I-134 is the tail, not the dog.

The anecdotal evidence is that the tax returns do not have to be notarized, despite what DS-2000 says. Maybe they did have to be notarized at one time - comparing a present day DS-2000 to a decade old OF-167 (some consulates still give out OF-167) shows no changes. I did not have my tax returns notarized.

But I thought you asked about certified copies?
